Subject: Fee Proposal for Additional Design Services for Cudahy Park Renovation Project - Design Phase Engineering Services for the Preparation of Plans, Specifications and Estimate
Amendment No. 3
Part A - Additional Soils Analysis Testing
Part B - New Park Electrical Systems Power Supply Upgrades Dear Mr. Santiago,
This proposal supplements our professional services agreement dated December 6, 2022, for the preparation of PS&E for the Cudahy Park Renovation Project.

Please find below our project description and understanding, scope of work and fee for the above-mentioned subject titles.

PART A - ADDITIONAL SOILS ANALYSIS TESTING
Project Description and Understanding
During a geotechnical investigation completed as part of the renovation project, three (3) geotechnical borings (B-1, B-2, and P-1) were performed at locations across the park renovation areas. Borings B-1 and B-2 were performed to depths of 20-feet, while boring P-1 was performed to a depth of 5-feet.

Converse, our environmental consultant, has reviewed the analytical results of the composite soil samples collected from the soil cuttings generated during the geotechnical investigation.

The data indicates that the reported concentration of total lead in waste profile sample No. 2 (associated with boring B-2, located near the baseball fields) exceed screening levels for residential and commercial uses, and therefore should be removed from this park site where park users could be exposed to this material. The soluble levels of lead in this sample would result in the soil from that location to be classified as non-RCRA (Resource Conservation and Recovery Act) California Hazardous Waste for handling and disposal purposes.

The results for the other samples analyzed indicate that soils from those areas are less than screening level concentrations and therefore be acceptable for reuse onsite. As the analytical data is limited, the extents of lead-impacted soil in the vicinity of boring B-2, from which soil sample No.2 was collected, are unclear. Converse has concluded that continuation of work in the vicinity of boring B-2 was not recommended due to the potential for the spread of leadimpacted soils to other non-impacted portions of the project area, as well as potential health and safety issues for both onsite workers and adjoining offsite residential and park users. Converse is recommending additional assessment in the form of step-out sampling in the vicinity of boring

B-2 to assist in determining both lateral and vertical extents of lead-impacted soil. During the March 28, 2024 meeting between the City and project team, additional screening of the baseball fields was also requested in association with evaluating the extents of potential lead-impacted soils.

Scope of Work
The reports will be prepared for review and comment, followed by modifications and submittal to the City. Willdan anticipates one draft submittal of each document and one final version of each document.

Task 1: Consulting Services
a) Review soil analytical data and prepare summary letter of findings and recommendations. b) Discuss with City staff findings and recommendations.

Task 2: Additional Assessment - Soil Sampling
a) Prior to the field activities, Converse will prepare a technical memorandum work plan outlining the proposed sampling procedures and locations and prepare a revised site-specific health and safety plan. The work plan will be submitted to City staff for review and approval. b) Converse will obtain soil-boring permits from the County of Los Angeles Environmental Health Division.
c) Proposed field activities include the advancement of up to eight (8) borings. Seven (7) borings are proposed to be advanced to maximum depths of 8-feet beneath ground surface (bgs). One (1) boring, in the vicinity of geotechnical boring B-2, is proposed to be advanced to a depth of 20-feet bgs. Soil borings are to be advanced using direct-push drilling methods.

Soil samples are proposed to be collected from each bore at depths of 1, 2, 4, 6, and 8-feet bgs, with additional samples collected from the deeper 20-foot bore at depths of 12, 16, and 20-feet bgs.
d) Initially, soil samples from depths of 1 and 2-feet bgs (16 samples) from each of the eight (8) borings will be analyzed by Environmental Protection Agency (EPA) Test Method 6010 for Total Threshold Limit Concentration (TTLC) lead. Remaining samples will be archived pending the results of the initial samples analyses. However, for budgeting purposes it is assumed that up to twenty-four of the archived samples will be analyzed for a total of up to forty samples analyzed.
e) A summary report will be prepared following completion of field activities and receipt of analytical results. Included in the report will be a summary of the fieldwork and methodologies, as well as a discussion and summary of the analytical results. Converse will also present our conclusions and recommendations, if any. Copies of summary tables of sample analytical results, and laboratory analytical reports with chain of custody documentation will be provided in the report. A California Professional Geologist (PG) will sign the report.

Schedule and Deliverables
Our services will be initiated within one week after notice to proceed is received. The field investigation for the step-out soil sampling will be initiated within one week after notice to proceed. Note, one day is anticipated to be required to complete the step-out sampling field work.

One PDF electronic copy of the draft soil sampling report will be submitted to the City within 3 weeks after the field work is completed. After review comments are reviewed and addressed, one electronic copy of the final report will be submitted to the City within 2 weeks.

Additional Information
The boring locations and actual samples to be analyzed may differ than what is stated in the scope of work depending on field conditions. If conditions are encountered that are significantly different than those anticipated, services not specifically proposed herein may be required to achieve the objective of this assessment. Converse will not proceed with these unanticipated services without receipt of a written authorization and agreement to the additional services. If the scheduled scope of work cannot be performed due to circumstances beyond our reasonable control, Willdan will stop the work and consult with the City to assess the situation and discuss the next course of action in moving forward with the intended scope of work herein.

Furthermore, the soil bores will be backfilled with hydrated bentonite chips. As a result, the surface may settle or bulge over time. We recommend the City monitor the boring sites and address any mounding or settlement depressions that might occur to prevent trip and fall injuries from occurring near the backfilled boring locations.

PART B - NEW PARK ELECTRICAL SYSTEMS POWER SUPPLY UPGRADES Project Description and Understanding
During the site visit with our subconsultant, the electrical engineer observed certain elements of the current electrical system and has determined that a full power supply service, separate from the existing electrical system, would need to be put in place.

At the start of the electrical and lighting design there were expectations that the existing site electrical system could handle the new electrical improvements. However, after our site investigation that is not the case. We became aware that the power for the existing park was supplied from the existing City Hall’s main switchboard and were determined that we cannot use this power feed connection.

As a result of our investigation, the entire park renovations (pertaining to electrical demands) including the baseball field lighting, basketball, tennis, skateboard, pedestrian, and splash pad must be applied to a new electrical service feed with SCE. And as determined, to properly illuminate the two baseball fields, will require large electrical loads thus requires the new electrical service feed to be larger in size- therefore cannot be connected to the existing metered pedestal meter (which could not handle by only upgrading the existing meter pedestal). This design work requires additional effort in engineering work with the electrical purveyor Southern California Edison (SCE).

Scope of Work
a) Provide new electrical service power feed for the park which includes the baseball field, storage building, stage/amphitheater and power provision for the splash pad and water feature at Bedwell Hall. All the electrical distribution systems will be from the new main switchboard service.
b) Coordinate the new electrical service with SCE engineer and provide one site meeting with SCE.

c) Provide baseball fields new sport lighting circuits, and coordinate the lighting specification, lighting control and installation with MUSCO lighting company. d) Provide panel schedule, single line diagram and load calculations of new power service. e) Provide construction administration support for the related services noted above.

Schedule and Deliverables
Our services for the additional electrical work will continue as part of the overall preparation of the construction document package. The field investigation with a SCE representative is scheduled for the second week in June.

STAFF REPORT
Date: October 7, 2025
To: Honorable Mayor/City Council/Agency Members
From: Juan Arauz/Richard Iglesias Interim City Managers By: Raul Diaz, Public Works Director
Subject: First Reading and Introduction of Ordinance No. 761, Approving the City’s Membership in Clean Power Alliance of Southern California

RECOMMENDATION
The City Council is requested to adopt the attached ordinance (Attachment “A”) approving a Joint Powers Agreement (Attachment “B”) to enter and participate in the Clean Power Alliance of Southern California (“CPA”), implementing a Community Choice Aggregation (“CCA”) program.

BACKGROUND
The City of Cudahy has been actively investigating options to provide electric power services to constituents within its service area with the intent of achieving greater local involvement over the provision of electric services and promoting renewable energy at competitive rates.

On September 24, 2002, the Governor signed into law Assembly Bill 117 (Stat. 2002, Ch. 838; see California Public Utilities Code section 366.2; hereinafter referred to as the “Act"), which authorizes any California city or county, whose governing body so elects, to combine the electricity load of its residents and businesses in a community-wide electricity aggregation program known as a CCA. The Act expressly authorizes participation in a CCA program through a joint powers agency.

Through Docket No. R.03-10-003, the California Public Utilities Commission has issued various decisions and rulings addressing the implementation of CCA programs, including a procedure by which the California Public Utilities Commission will review “Implementation Plans," which are required for submittal under the Act as the means of describing the CCA program and assuring compliance with various elements contained in the Act.

ANALYSIS
CPA offers three tier rates defined by the amount of renewable energy in the portfolio tier:

Lean (40% renewable), Clean (50% renewable), and Green (100% renewable). The City Council will be responsible for establishing the default rate for the City for all customers to be automatically enrolled; all customers will have the option to select their desired renewable energy tier or to opt out of the program.

One of the foundational goals of the 2023 Draft Climate Action and Adaptation Plan (CAAP) is transitioning to 100% renewable energy by 2050; membership in the CPA is identified as a “Top 10 Biggest Bang for Your Buck” key strategy for reaching this foundational goal.

Should the City opt in as a CPA customer, the financial impact on the City’s electricity costs will ultimately be determined by the renewable tier rate selected. While there are no rate guarantees, CPA’s monthly rates, inclusive of Southern California Edison (“SCE”) delivery charges, averaged +/- 5% of SCE’s rates over the last three years, depending on the tier rate.

CONCLUSION
Motion to read the title of the attached ordinance, waive further reading, and introduce the ordinance on a roll call vote; (ii) Authorize implementation of a CCA program; and (ii) Approve the City’s membership in the CPA of Southern California, a Joint Powers Authority.

FINANCIAL IMPACT
There are no direct costs associated with joining the CPA.

STAFF REPORT
Date: October 7, 2025
To: Honorable Mayor/City Council/Agency Members
From: Juan Arauz/Richard Iglesias Interim City Managers Subject: Adoption of Ordinance No. 762 Amending Title 1, Chapter 28 of the Cudahy Municipal Code establishing requirements for the Spanish translation of public notices and outreach materials.

RECOMMENDATION
The City Council is requested to adopt Ordinance No. 762 (Attachment “A”), establishing requirements for the Spanish translation of public notices and outreach materials by and/or on behalf the City and its consultants/contractors to Cudahy residents and businesses.

BACKGROUND
At the August 19, 2025 regular meeting, the City Council asked staff to prepare an ordinance requiring that City notices and other written materials disseminated to Cudahy residents and businesses be translated into Spanish. The purpose of this request is to ensure that residents and business owners who prefer Spanish as their primary language can understand information sent to them by and/or on behalf the City.

ANALYSIS
While the City has produced Spanish translation of notices in the past, it has not been a consistent requirement. If adopted, the attached ordinance would require that City notices and outreach materials, such as mailed notices and flyers, be translated from English to Spanish before distribution.

If adopted, the ordinance would remove language as a barrier, make it easier for residents to follow City programs and services, and improve response to public notices and outreach materials. Having a municipal code requirement in place gives staff clear direction when preparing materials and reinforces the City’s commitment to reaching all residents in a consistent way.

Goal F. Communication and Outreach

4. Identify methods to connect with community members, including soliciting input on a regular basis.

FINANCIAL IMPACT
Currently, city staff is able to translate most notices and materials from English to Spanish inhouse. The attached ordinance would also require that contractors and consultants distributing materials on behalf of the City also translate materials from English to Spanish, which most already do. Therefore, the adoption of the attached ordinance is not anticipated to have an impact on the City’s general fund.

Date: October 7, 2025
To: Honorable Mayor/City Council/Agency Members
From: Juan Arauz/Richard Iglesias Interim City Managers Subject: Adoption of Ordinance No. 763 Amending Subsection 1 of Section 5.14.040 (For Cause Termination of Tenancy) and Adding Subsection 2 of Section 5.14.040 (For Cause Termination of Tenancy) of Chapter 5.14 (Just Cause Tenant Protections) of Title 5 (Business Licenses and Regulations) of the Cudahy Municipal Code

RECOMMENDATION
The City Council is requested to adopt Ordinance No. 763 (Attachment “A”), amending the For Cause Termination of Tenancy section of Section 5.14.040.

BACKGROUND/ANALYSIS
On June 6, 2023, the City of Cudahy (“City”) adopted Ordinance No. 737, establishing among other things, the “Just Cause Tenant Protections” for residents. Over the last two years the City has seen firsthand the positive impacts of Chapter 5.14 and the protections it provides for residents.

The City seeks to expand the protections provided under Chapter 5.14 (Just Cause Tenant Protections) by establishing a minimum threshold for eviction in cases where a tenant has missed rent. Under the proposed ordinance, a landlord may only initiate an eviction if the amount of rent missed exceeds one month of the fair market rent for the Los Angeles metro area, as determined annually by the U.S. Department of Housing and Urban Development. The ordinance also clarifies the definition of what constitutes a violation of a material term of the rental agreement between landlords and tenants.

CONCLUSION
If adopted, the attached ordinance would establish a minimum threshold for an eviction by landlord of a tenant for unpaid rent and clarifies the definition of a material violation of a rental agreement.

STAFF REPORT
Date: October 7, 2025
To: Honorable Mayor/Chair and City Council/Agency Members From: Juan Arauz/Richard Iglesias Interim City Managers By: Richard Iglesias, Interim City Manager/City Clerk
Subject: Approval of Second Amendment to Professional Services Agreement for Remote and On-site Translation Services

RECOMMENDATION
It is requested that the City Council approve a Second Amendment to the Professional Services Agreement (PSA) with Language Network, Inc. (Language Network) to provide remote and OnSite Spanish Translation Services for a one-year term, with the total services not to exceed $65,000 annually.

BACKGROUND

1. On October 6, 2022, the City of Cudahy (City) issued a Request for Proposals (RFP) for Translation Services.

2. On November 1, 2022, the City reviewed all proposals.

3. On November 7, 2022, the City notified Language Network that it was the top-ranked proposal in the RFP process and would be recommended to Council for contract approval.

4. On December 6, 2022, the City Council did not approve Language Network’s agreement and instead directed staff to reissue the RFP.

5. On March 6, 2023, the City reissued the RFP for Translation Services.

6. On April 5, 2023, the period to submit proposals closed, and the City received seven proposals in total.

7. On May 24, 2023, the City notified Language Network that it was the top-ranked in the RFP process and would be recommended to Council for contract approval.

8. On June 6, 2023, the City Council did not approve the agreement with Language Network.

9. On July 18, 2023, the City Council approved agreements with both Language Network and Municipal Translation Company for an amount not to exceed $18,000 per year. The City later began using Language Network exclusively after the second contractor failed to provide adequate proof of insurance, prior invoicing, and a W-9 as required by the City in May 2024.

10. On October 15, 2024, the City Council approved the first amendment to the Professional Services Agreement (PSA) with Language Network, Inc., for an amount not to exceed $42,000 annually.

ANALYSIS

Last year, the City Council approved the first amendment PSA with Language Network for an amount not to exceed $42,000 annually. Since the prior year, prices for translation services have increased, and the City is using these services for Council Meetings, workshops, and town halls as needed. Therefore, staff is now recommending that the City Council approve a second amendment to the agreement with Language Network in an amount not to exceed $65,000 annually.

Neighboring cities also have translation services agreements in place, providing their residents with English-to-Spanish translation. The City of Bell currently contracts with Municipal Translation Services with an amount not to exceed $55,000 annually. The City of Bell Gardens contracts with Samantha Lubrani for an amount not to exceed $28,000 annually. The City of Maywood contracts with Culture Bridges LLC and was unable to provide its contract amount at this time. The City of South Gate utilizes employees as translators for its Council Meetings, primarily the Executive Assistant, who is paid between $81,720 and $99,336 per year, according to its salary schedule.

CONCLUSION
Translation services are necessary to inform the City’s Spanish-speaking community and encourage participation from those who attend City Council Meetings and other scheduled meetings. City staff recommends that the City Council approve the second amendment PSA with Language Network for remote and on-site translation services to provide these services.
