NOW, T HEREFORE, the City Council of the City of Cu lver City, DO ES HEREBY RESOLVE, as follows:

SECTION 1. Purs uant to the fore going recitations and the provisions of the Culver City Munici pal Code (CCMC), as outlined in CC MC Title 1 7, Section 17. 620.030, the following findings for a General Plan Element Amendment are hereby made:

1. The proposed amendment ensures and maintains in ternal consistency with th e goals, policies , and strategies of all e lements of the General Plan and will n ot create any inconsi stencies with this Title, in the case of a Zoning C ode Amendment.

The General Pla n is un dergoing a comprehensive update and is s cheduled for adoption after the 2021-2029 Housing Element’s anticipated adoption. The 2021-2029 Housing El ement was updated i n coord ination with the other elements as they are being updated. This is meant to ensure that the goals, policies, and strategies of all the updated elements are consistent. Before the other elements in the GPU are adopted, their goals, policies, and stra tegies will be reviewed to e nsure consistency with the 2021-2029 Housing Element.

The Zoning Code will then undergo a comprehensive update after the General Plan is adopted. During that process, the Zoning Code will be updated to address constraints to housing production, as outlined in Measure 4.J of th e 2021-2029 Housing Element.

Under the Ho using Programs sect ion of the Housing Element , Measure 4.J is scheduled to begin in 2023.

2. The proposed a mendment wou ld not be detrimental to the pub lic interest, health, safety, convenience, or welfare of the city.

33 The prop osed General Plan Housing Element Amendment is not detrimental to the public interest, health, safety, convenience, or welfare of the city because adoption of the 2021-2029 Housing Element will n ot entitle any new develop ment pr ojects. The 2021–2029 Housing Element will be consistent with the objectives of the General Plan, the CCMC, and State housing law.

3. The propos ed amendment complies with the provisions of the California Environmental Quality Act (CEQA).

The proposed General Plan Housing Element Am endment complies with CEQA as outlined in the Addendum to the Negative Declara tion, Negative Declaration, and related documentation. The City Council’s adoption of the Addendum to t he Negative Declaration is made herein by approval of this Resolution. The Addendum to the Negative Declaration reflects the independent judgment of the City Council.

SECTION 2. Because the 2021 -2029 Housing Element relies on nonvacant sites to accommodate 50% or more of its RHNA for lo wer inc ome households, the following additional finding, as required by HCD, is hereby made substantiating that th e use wil l likely be discontinued during the planning period:

Based o n existing uses, ex isting floor area ratio , age of stru ctures (year s tructure built), improvement -to-land ratio, lot size, adjacency to par cels with redevelopment potential and lot consolidation potential, a nd ex pressed interest of developers or property o wners, the existing uses o n the sites identified in the site inventory to accommodate the lower income RHNA are likely to be discontinued d uring the planning period, and therefore do not constitute an impediment to additional residential development during the period covered by the housing element.

SECTION 3. Pursuant to the foregoing recitations and findings, the City Council of the City of Culver City, California, hereby (i) adopts the 2021-2029 Housing Element Addendum to the Negative Dec laration; (i i) adopts the updated 2021-2029 Housing Element (General Plan Element Amendment, P2022-0222-GPTA); (iii) authorizes staff to s ubmit the updated 2021-2029 Ho using Element to HCD for revi ew for substantial com pliance, in accordance with the p rocedures set forth by State law; and (iv) authorizes the City Manager to approve
