Every fifth year the local agency shall make all of the following findings with respect to that portion of the account or fund remaining unexpended, whether committed or uncommitted:
The purpose of this fee is to provide a method for the financing of public works capital improvements made necessary by permitting new development for nonresidential use. Fees from each new development shall be appropriated and disbursed only for street improvements, traffic controls and traffic management projects which are made necessary by the development and are: (a) located within the area from which the fees were collected; or (b) located within the impact zone of the new development as determined pursuant to 15.06.040; or (c) found pursuant to 15.06.045 to benefit the new development and mitigate its traffic impact.
The City and other governmental agencies have conducted numerous studies which indicate the nature and cost of the burden and impact placed on City facilities by new development. These studies and other information show a certainty that new commercial and industrial developments generate additional requirements for traffic control and management projects and street improvements requiring capital investment by the City which may be translated into cost burden per square foot of new development, and this burden and impact is found to be not less than $1.00 per square foot of any new development. A fee of $1.00 per square foot for new commercial and industrial developments in excess of 5,000 square feet bears a reasonable relationship to the capital needs generated by the traffic caused by new developments and these developments benefit directly for identifiable traffic control and management projects and street improvement. The new development impact fee shall not be construed as a substitution for any City-required dedication and or public improvement adjoining a new development or subdivision, but shall be construed as a a fee towards mitigating the impact of providing traffic controls, traffic management projects, and street improvements made necessary by permitting the development. (C) Identify all sources and amounts of funding anticipated to complete financing in incomplete improvements identified in paragraph (2) of subdivision (a); and (D) Identify the approximate date on which the funding referred to in item C is expected to be deposited in the appropriate account or fund.

The City and other governmental agencies have conducted numerous studies which indicate the nature and cost of the burden and impact placed on City facilities by new development. In addition, in Ehrlich v. City of Culver City (1996) 12 Cal. 4th 859, the California Supreme Court
evaluated the Art in Public Places Program and the in lieu contribution and determined that the fee and its amount are permissible land-use regulations. These studies and other information show a certainty that as new development and revitalization of real property within the City continues, the opportunity for creation of cultural and artistic resources are diminished. As these opportunities are diminished and urbanization occurs, the need to develop alternative sources for cultural and artistic outlets to improve the environment, image and character of the community is increased. The fee is 1% on all applicable building permits for all new residential development projects of five or more units, and all commercial, industrial, and public building development projects, with a building valuation of $500,000 or more, with some exceptions per CCMC Section #15.06.120. The fee is used so that development of cultural and artistic assets are financed by those whose development and revitalization diminishes the availability of the community's resources for those opportunities and contributes to community urbanization. Public art benefits the City by introducing cultural identity, improving vitality, community well-being and aesthetic beautification.
The increase in development generates additional residents and non resident workers who increase the need for public art to maintain the City's existing standards. Each new development pays its fair share of the fee based on the applicable building permit valuation, excluding land acquisition costs.

The City and other governmental agencies have conducted numerous studies which indicate the nature and cost of the burden and impact placed on City facilities by new residential development. These studies and other information show a certainty that new residential development generates additional impact upon the demand for the public parks infrastructure, and so long as new development continues to occur, the functional nexus between development and these impacts and demands upon the public park infrastructure will continue to accrue, expand, and/or increase. The public interest, convenience, health, welfare, and safety require neighborhood and community park and recreational facilities must be provided for the enhancement of the quality of life of the City's residents. The public interest requires three acres of community park or recreational facilities for each 1,000 persons within the City shall be provided and maintained for community parks and recreational purposes. There continues to be a deficiency in the City's community park and recreational facilities and land because the requisite three acres per 1,000 persons is not provided. This deficiency is caused by residential construction without adequate community park and recreational facilities and land for residents. Therefore, the development of new and rehabilitation of existing community parks and recreational facilities should be financed by applicants for developments which are served by public recreational facilities. The fee promotes the general welfare by requiring all developers of residential units to pay a share of the cost of developing a new, and rehabilitating existing, community park and recreational facilities which continue to serve the residents of the development. All new residential developments of more than one unit, and addition of one or more units to an existing residential development, shall be subject to the park dedication requirement, or payment of fees in lieu thereof, established by CCMC Subchapter 15.06.310. (C) Identify all sources and amounts of funding anticipated to complete financing in incomplete improvements identified in paragraph (2) of subdivision (a); and (D) Identify the approximate date on which the funding referred to in item C is expected to be deposited in the appropriate account or fund.
