CITY COUNCIL STAFF REPORT
Meeting: April 19, 2022
Subject
Consider adoption of a Resolution of Local Support authorizing the filing of an application for funding assigned to the Metropolitan Transportation Commission (MTC,) committing any necessary matching funds, and stating assurance to complete the project for the One Bay Area Grant (OBAG) Cycle 2 grant application for the Stevens Creek Boulevard Separated Bike Lanes Project.

Recommended Action
Adopt Resolution No. 22-xxxx (Attachment A,) a Resolution of Local Support authorizing the filing of an application for funding assigned to the MTC, committing any necessary matching funds, and stating assurance to complete the project for the OBAG Cycle 2 grant application for the Stevens Creek Boulevard Separated Bike Lanes Project.

Discussion
In 2016, the Cupertino Public Works Department, Transportation Division staff submitted an OBAG Cycle 2 application for grant funding in the amount of $807,000 for the Stevens Creek Boulevard Class IV Bike Lanes project. The Stevens Creek Boulevard Separated Bike Lanes project was identified in the 2016 Cupertino Bicycle Transportation Plan as the highest priority project. Due to the competitive nature of the grant and limited funding, the project did not score high enough by the MTC to receive funding. Recently, City of Cupertino staff were informed that, due to other agencies being unable to commit to obligating the funds for their projects, funding was now available for the City in support of the Stevens Creek Boulevard Class IV Bike Lanes project.

To receive these funds and complete the application process, the MTC, as the grant administrator, requires a Council-approved Resolution of Local Support. By receiving these funds, the City is responsible for invoicing the California Department of Transportation (Caltrans) every six months through the duration of the project phase, as well as reporting quarterly status updates to MTC.

This project was found to be categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section number 15301, existing facilities, as bicycle lanes previously exist within the same right-of-way of the project. A Notice of Exemption was filed with the County of Santa Clara on July 28, 2020. The Stevens Creek Boulevard Separated Bike Lanes project is currently finishing design. The grant funding will be applied to future construction phases of the project.

Sustainability Impact
No sustainability impact.

Fiscal Impact
The approval of this proposed Resolution will satisfy a grant requirement that will result in the City receiving grant funds in the amount of $807,000, which will be applied to the Stevens Creek Boulevard Separated Bike Lanes Project, Phase 2. The project is currently funded through the City’s Capital Improvements Program Bike Plan Implementation project, with an approved budget of $2,000,000 (420-99-036.) There is a local match requirement of $93,000 for the grant, which will be funded with the existing allocation. _____________________________________
