CITY COUNCIL STAFF REPORT
Meeting: May 17, 2022
Subject
Consider award of a construction contract for the Orange Avenue Sidewalk Improvements Project (Project 2016-10.1) for the construction of sidewalk, curb, gutter, storm drainage modifications, and associated improvements on Orange Avenue, between McClellan Road and Stevens Creek Boulevard.
Recommended Action
Award a construction contract for the Orange Avenue Sidewalk Improvements Project, authorize the City Manager to execute a contract in the amount of $1,738,875.00 with Redgwick Construction Company, and authorize the Director of Public Works to execute any necessary change orders, up to the construction contingency amount of $173,888.00 (10% of contract amount,) for a total authorized contract amount of $1,912,763.00.
Discussion
The Orange Avenue Sidewalk Improvements Project will install sidewalks where there are currently gaps on Orange Avenue between McClellan Road and Stevens Creek Boulevard, providing a continuous off-street walking route. Orange Avenue is a well-used route for school children who attend Lincoln Elementary School and Monta Vista High School, both of which are located on McClellan Road near the southern end of Orange Avenue. Orange Avenue is also a designated bike route.
Utility work to be done in conjunction with the sidewalk project will relocate existing utility poles, several of which are currently well beyond the edge of the roadway. The infill of sidewalk gaps, improved storm drainage, and relocated utility poles will result in a more comfortable and safer environment for pedestrians, bicyclists, and motorists.
Cupertino advertised the project for bids on April 18, and the bids were opened on May 10. Four bids were received, with the apparent low bid received from Terramark General Engineering Contractors, Inc. A math check revealed an error in Terramark’s bid calculation. Subsequently, Redgwick Construction was determined to have submitted the lowest bidwhich was approximately (3.4% below the engineer’s estimate.) Bidder

Municipal Code section 3.23.070 provides that a public works contract shall be awarded by the City Council to the lowest responsible bidder unless an exception set forth in Chapter 3.23 (e.g., a finding that the lowest bidder is not responsible) applies. The bid submission from Redgwick Construction was reviewed for completeness, and the contractor’s experience and qualifications were confirmed. It is determined that Redgwick Construction is the lowest responsive and responsible bidder.
The work for this project is scheduled to start within 30 days of contract award date.
Sustainability Impact

The Cupertino Climate Action Plan (2014) Measure C-T-1 directs the City to encourage multi-modal transportation, including walking and biking, through safety and comfort enhancements in the bicycle and pedestrian environment.
Fiscal Impact
The Fiscal Year (FY) 2021-22 Capital Improvement Project (CIP) budget includes the Orange (& Byrne) Avenue Sidewalks Improvements Project (budget unit 270-90-958). No additional funding is required. _____________________________________
