Q1: What is the status of the I Love Cupertino project? (Vice Mayor Mohan) Staff response: I Love Cupertino project is still active. However, the City has not contributed to the maintenance of the
program since June 2021.
Q2: Did the Chamber of Commerce pay for the use of the Quinlan space for its Lunar New Year events (held in February)? If so, what rate did the Chamber pay? The non‐profit rate or the business rate? (Member of the public, Rhoda Fry)
Staff response: The Chamber paid the non‐profit rate for the use of Quinlan Community Center for the Lunar New Year Luncheon this February.

Consider authorizing execution of a Maintenance Services Contract for City-owned orchards.
Recommended Action
1. Authorize the City Manager to execute the Maintenance Service Contract with Anderson Tree Care Specialists, Inc. to provide orchard maintenance services for three years, at an annual amount not-to-exceed $65,746, and if performance is satisfactory, allow up to two additional years of service.
2. Adopt Resolution No. 23-xxx approving budget modification 2223-267 increasing appropriations in the Blackberry Farm Grounds Maintenance (100-84-811) and Neighborhood Parks Maintenance (100-84-813) budgets by $8,362 and $3,875 respectively.

Q1: I am sorry to bother you all on the day of the meeting, however I ran across something which I feel obligated to ask about. Two issues, one is it a Public Works project (see link below) and I don’t recall Council continuing this item, it just fell off of the Agenda if I recall correctly?
I am wondering if tree trimming is a Public Works item. The contract does not specify, but has a caveat if it is (that’s what I could locate) then it would follow the Public Works requirements. I was just wondering with regards to what kind of contract this is and then sorting out what purchasing policy and Muni Code rules apply. The link below has a tree trimming stump removal case mentioned.

Consider authorizing an increase in the total contract amount with Guerra Construction Group for the Wilson Park Basketball Court Project (Project No. 2022‐ 11).
Recommended Action
1. Authorize the Director of Public Works to execute any necessary change orders for an additional construction contingency amount of $40,000 and increase the authorized contract amount to a not‐to‐exceed total of $369,421.40 to Guerra Construction Group; and
2. Adopt Resolution No. 23‐xxx approving budget modification #2223‐271 increasing appropriations by $40,000 in the Capital Improvement Program Capital Projects Fund (budget unit 420‐99‐252) for construction contingency and transferring the funds from the Capital Reserve (budget unit 429‐99‐001).

When was the Wilson Park basketball court approved?
Staff response: The project was part of the FY 2021‐2022 CIP and Budget programs approved at the June 15, 2021 Council meeting. As indicated in the staff report, Council awarded the
construction contract for the court on January 17, 2023. Staff is requesting approval of a contract amendment to complete the construction of the project because of unexpected conditions discovered during excavation activities.
Q2: Councilmember question (Moore):
I also noticed that the basketball courts mentioned by Rhoda Fry are adjacent to
residences, and appreciate this follow up. While I appreciate basketball as a sport, managed a State title one year, it can provide annoying pounding sounds and I am wondering what the process was to push the courts up against homes which were already impacted by Regnart Creek Trail, with many unhappy neighbors from that expected noise experience.
Generally, the city wants to ‘circle the wagons’ when there is some controversy brought up, but in this case, did the City perform due diligence and ask the neighbors who would be most impacted by the noise, if they minded it? And do we have that on record? Were they noticed and do we have that on record?
Please provide the documentation that the neighbors adjacent to the Wilson courts were noticed and asked about the new basketball courts and what responses did the City receive? It may be that they don’t mind, but I would like to know what people within a 300’ radius had to say.
Staff response:
The requested recommendation before Council is to amend the approved contract for the additional unanticipated increases in construction costs, as outlined in the staff report.
For background purposes, staff provides the following information. This design and location of
the basketball court are not agendized for discussion at the April 4 City Council meeting.
The project was part of the FY 2021‐2022 CIP and Budget programs approved at the June 15, 2021 Council meeting. Council awarded the construction contract for the court on January 17, 2023.
The lack of accessibility to a full‐size basketball court in City parks was identified as an area for park improvement in the Parks and Recreation System Master Plan. In a community‐wide survey for the Master Plan, basketball was the top recreation activity for teen respondents <18 years and was in the top 3 for respondents younger than 30 (excluding walking). Sites identified in the Master Plan include Creekside Park, Hoover Park, Jollyman Park, Monta Vista Recreation Center, and Wilson Park. Of these sites, Wilson Park was the only park identified in the Master Plan for short‐term implementation of a full‐size basketball court. It is also located on the eastern side of the City, an area deficient in access to outdoor recreation opportunities.
As part of the FY21‐22 CIP proposal review with the Parks and Recreation Commission at the April 8, 2021 meeting, the sites proposed for the full sized basketball court were reviewed with the Commission and the public. The Parks and Recreation Commission agreed with the recommendation. In addition to social media postings and calendar listings, Staff produced and mailed a postcard to 435 residents (500’ radius) announcing the project and a community meeting on November 30, 2021. Residents were in favor of the project and the City incorporated a small berm between the court and the creek and residences to the south to help
address concerns regarding sound. Additionally, the Regnart Creek Trail project recently installed new fences to help attenuate sound for those residents who had concerns over increased use of the trail and park. The court will not have lighting and will be ‘open’ during regular park hours only.

Community Questions
1. Bob Pickle: Are any trees displaced
Ryan Do: No, court was sited to avoid existing trees
2. Liana Crabtree: Is shared use ok, such as rollerblading and rollerskating use, or lessons?
Joanne Magrini: Yes, we can look at it, generally a variety of uses would be beneficial
3. Jeonghi Yi. What is City doing for noise and pricavy issues for southern neighbors? Can the court be put on the other side of the park?
Ryan: Trees provide a buffer from the court to the neighbors. This location maximizes uses of the total park as recommended by the Master Plan.
Susan: Tough to balance all priorities, City trying to be sensitive to neighbors and community.
4. Was an East-West orientation considered?
Ryan: Yes, however this has better separation from neighbors and avoids picnic areas
5. Are water fountains and benches being included?
Susan: A separate project is in planning to add water fountains, trash cans, and benches afterwards throughout the park in general and may include the court.
6. Lisa Molero, Ceramics Studio: When will start construction and how long? Ryan: Start in late spring and should take less than 3-4 months. - ATTACHMENT B -

7. Jeonghi Yi: What is City plan to minimize negative impacts to neighbors, from youngsters using the court at night?
Ryan: The park will be closed from dusk till dawn and the Sherriff can be called if inappropriate activity is occurring.
8. Barbara Ko: The loop path lacks shade, how will the City prevent heat island effect? Rodney: Colored coatings can be added to the surface to reduce the heat absorption, such as green or red.
9. What about parking?
Susan: No parking will be added for this project.
10. Carol: Will there be loud bouncing balls early in the morning? Ryan: Will be closed until dawn and then residents can contact the City and the Sherriff for specific complaints.
11. Suzanne Ranney: Does this community want a basketball court, what about baseballs, and gates to the Regnart trail?
Joanne: The City receives very few complaints regarding the other basketball courts around the City and is not anticipating significant negative impacts.
12. Lisa Molero: Upgrade or expand the bathrooms?
Susan: It is on the City’s radar for future improvements
13. Carol: Dawn comes at 5am, would you enjoy the sound of basketballs? Why not use the other side
Ryan: The other side currently is used for a successful soccer and mixed sports program.
Joanne: Signs could possibly be added regarding respecting neighbors quiet hours
14. Bob Pickle: Can you expand the half court at Creekside? Joanne: Not enough space for a full size court there.
15. Annonymous: We support the park and also think the trees will help shade the heat island effect of the court.
16. Andrew Yang: What will be done to stop flying basketballs? Ryan: The court is set back well from the path and there is plenty of room at the ends of the court.
17. Sanjay Krishnamurthy: What are the setbacks from the neighbors properties? Has played at Calabazes Park and concerned about closeness to neighbors and walkways.
Ryan: City is trying to add facilities for users from surrounding neighborhood so they don’t have to drive to distant parks.
18. Jeonghee Yi: can the City plant some smaller trees in between the larger trees for additional screening? Concerned that City is requesting feedback too late in the process and that immediate neighbors are not being asked first.
Susan: Shorter trees and shrubs can be considered. The City is stepping up its outreach and is finding larger public interest due to Covid and online meetings.
Residents are encouraged to reach out in writing for specific concerns.

Receive the informational memorandum on the Code Enforcement processes
Background:
On July 7, 2022, during a Special Meeting of the Cupertino City Council, Councilmembers Jon R. Willey and (Mayor) Hung Wei requested Code Enforcement Processes be added to a future agenda. Below please find Code Enforcement processes for Council’s information.
Q1: Regarding the Code Enforcement process if a setback has been violated, what does Community Development do when it receives this information? (Councilmember Chao)
Staff response:
After staff receives a complaint, an investigation is initiated which includes a site inspection to confirm if a violation exists. If the violation is confirmed, then a formal notice would be prepared and sent. The notice provides corrective actions so the property may be brought into compliance with the codes.
Q2: If it is a permanent structure built too close to the property line without a permit, how is this handled? (Councilmember Chao)
Staff response:
Similar to example in Question 1, once a complaint is received, staff would coordinate a site inspection to verify conditions and review code requirements. If a violation has been substantiated, then a formal notice would be prepared and sent. The notice provides corrective actions so the property may be brought into compliance with the codes. Structures that cannot be brought into compliance with applicable law may be subject to removal.
