Re: Update on Main Street Cupertino
Background
On September 4, 2012, City Council approved the Main Street mixed-use development, which entitled 130,500 square feet of commercial floor area. This approved scope includes a variety of uses such as retail, restaurant, and office use. At the time, the Council also approved a second addendum to the 2009 Environmental Impact Report that was done for the Main Street development. In October 2023, the operator requested the following:

Removing limitation on the maximum food services uses as stipulated in Condition #9; and A request for Conditional Use Permit Amendment (M-2022-003) and an Architectural and Site Approval Permit (ASA-2023-009) to allow a 5,585 square-foot second-floor addition within Shop 1, a free-standing building in the eastern portion of the Main Street center fronting Stevens Creek Boulevard currently leased to TD Ameritrade. The addition will enable TD Ameritrade to expand within the existing building rather than relocate to another location. The addition would increase the total square footage of the building from 5,930 square feet to 11,515 square feet.

On October 20, 2023, a Director’s Decision pursuant to CMC 19.12.040 was issued regarding the restaurant use and parking adequacy. Condition 9 of City Council Resolution 12-098 approving the Main Street mixed-use development established a maximum of 40% food service uses within the 130,500 square feet of development space. Condition 9 also states that “future refinements to the restaurant percentage may be approved by the Director of Community Development if a subsequent parking and traffic analysis indicates that there is adequate parking for the various mixtures of uses and there are no additional and/or new significant traffic impacts compared to the thresholds studied in the original 2009 Environmental Impact Report and 2012 Addendum.” A memorandum was prepared by third-party consultant Fehr & Peers, dated August 17, 2023. The memorandum found that the Main Street development would be able to accommodate an additional 16,500 square feet of restaurant use within the presently vacant 21,380-square-foot former Target building without any impacts to existing onsite parking. Therefore, up to 16,500 square feet of the building can be occupied and used as restaurant space. The Director’s Decision can be found in Attachment B.

On November 14, 2023, the Planning Commission unanimously 1) adopted the Third Addendum to the EIR and approve the Conditional Use Permit Amendment (M-2022-003) and (2) approved the Architectural and Site Approval Permit (ASA-2023-009), with an added condition to include a Class II Bicycle Parking facility to accommodate five (5) bicycles.
