A RESOLUTION OF THE CUPERTINO CITY COUNCIL
FOR LEASE AND OPERATION OF THE CUPERTINO MUNICIPAL WATER SYSTEM WHEREAS, the Municipal Water System (System) which is owned by the City was leased to San Jose Water Company to maintain and operate in October 1997 for a term of 25 year to September 30, 2022 and was extended for an additional two years until September 30, 2024; and WHEREAS, the City of Cupertino has determined to consider proposal for the lease and operation of the City owned System and advertised the Request for Proposal (RFP) on July 31, 2023; and WHEREAS, the City of Cupertino received one responsive proposal from San Jose Water Company on September 28, 2023; and WHEREAS, the City Council of the City of Cupertino held a duly noticed public hearing on July 16, 2024, notice of which was published in accordance with Section 6066 of the California Government Code; NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby determine that the City will lease the System for operation to San Jose Water Company under the terms and conditions substantially identical to those described in the lease agreement.
