City Clerk: Please include the attached email to Written Communications for the item for the Special City Council Meeting on December 11.

Dear Mayor Chao, Vice Mayor Moore and Councilmembers,
I would like to express my concern about how last week’s meeting concluded. The meeting ended abruptly when Councilmember Ray Wang disconnected, which halted the discussion and delayed action on Item

12. While he stated that the item was not properly agendized, the agenda clearly included the direction to “consider the Mary Avenue project and provide direction on next steps, including appointing the City Manager and Interim City Attorney as negotiators.” From my perspective, it appeared the discussion was on solid procedural footing. It seemed that the city attorney and Mayor Chao agreed as well and they clearly stated that to him.

The sudden disconnection had the effect of stalling the entire item, even though the Council was actively engaged in discussion. This raises broader concerns about the use of remote attendance in noticed locations and the ability of a single councilmember to end a meeting.

Until recently, this had not been an issue, and I hope the Council will consider steps to ensure that meetings can proceed without disruption.

For these reasons, I respectfully request that the Council not appoint Councilmember Wang as Vice Mayor at the December 11 meeting. I believe it is important for all councilmembers to demonstrate consistent ethical conduct and respect for the Council’s collective work.

I also ask that the Council reconsider allowing Councilmember Wang to attend meetings remotely, given the pattern of disruptions that have occurred. It is important that all members participate in a manner that supports the functioning of our city government.

Finally, I request that the Mary Avenue Project be placed on the December 11 agenda. The discussion that began on December 2 should have been completed, and the community deserves clarity and forward progress on this important issue.

Thank you for your consideration.

I would like to object to the election of Ray Wang as Vice-Mayor of Cupertino. In my opinion he has not acted in an ethical manor as a council member, as evidenced by his actions in the City Council meeting of December 2.

Please do not elect Ray Wang as Vice-Mayor at the December 11th City Council meeting.

Thank you,

Dear Mayor Chao, Vice-Mayor Moore, City Council Members, City Manager, and City Attorney:

First, thank you all for your service to our City; I appreciate you all.

It is my understanding you are planning to vote in a Mayor and Vice-Mayor for the upcoming year at the December 11, 2025 Special Meeting. I urge you not to vote-in Council Member Wang for either position. Doing so would be a mistake and a disservice to Cupertino’s residents. You will be rewarding the poor performance of Council Member Wang. One of the worst things an organization can do is to promote/reward poor performance. Why am I making this request?

Council Member Wang violated multiple provisions of the City Code of Ethics in the City Council meeting of December 2, 2025. He threatened the City Attorney and City Council Members with retaliation if they did not accept his viewpoint, then followed through on that threat by disconnecting from his remote Zoom meeting attendance at that meeting, knowing it would require the City Council meeting to end abruptly, which is a violation of the City Code of Ethics for Cupertino Council Members. We cannot unsee what we saw or unhear what we heard. If you do not recall what you all (and the public) witnessed, I ask that you go back and watch this video link below:
https://www.youtube.com/watch?v=lBWv1q3hbvk
Watch 2:53:26 through 3:04.22 of the meeting.

I have also become aware that Council Member Wang issued an “apology letter” to City Manager Kapoor and Mayor Chao dated December 8, which I have obtained a copy of. In that letter, he blames his computer battery as the reason he had to hang up from the Zoom meeting on December 2. Having watched the meeting video in the link multiple times, it is obvious his threat to end the meeting had nothing to do with his computer battery. Rather, it was an intentional act to disrupt the meeting. And instead of apologizing for his bad behavior, he is blaming his computer battery, meaning he is not being truthful, which is another ethical issue.

After seeing and hearing Council Member Wang's behavior at the December 2 meeting, how can you almost immediately thereafter justify rewarding this behavior with a vote to promote/appoint him to Vice-Mayor or Mayor of our City?

In addition, I also urge you to determine and implement whatever appropriate punitive actions the City Council should take to ensure Council Member Wang's unfortunate actions do not recur. Cupertino's residents deserve much better.

I hope you can see the logic in my request.

Thank you for your consideration,

City Clerk: Please include the attached email to Written Communications for the item for the Special City Council Meeting on December 11.

Dear Mayor Chao, Vice-Mayor Moore, City Councilmembers, City Manager, and City Attorney:

The December 2 behavior of Cupertino City Council member Ray Wang was outrageous and must be curtailed! He is abusing his privilege to attend the city council meetings from afar, and that needs to stop immediately. By violating his perceived rights, he is destroying Cupertino’s good governance, thereby threatening the quality of life of its citizens and the reputation of this fine city.

His behavior clearly violates the code of ethics he swore to uphold and undermines the goals of the Brown Act! This is the third time he has curtailed a Cupertino City Council meeting to satisfy his personal desires and the first time he has done so as a threat to his perceived future actions of the other council members. He has figured out how he, alone, can control the entire council. This is not acceptable because it destroys the quality of governance for this city.

Please find a legal way to reprimand and curtail this behavior immediately, and do not even consider rewarding it by electing him to vice-mayor in your upcoming election. Implement a policy that prevents him from participating, as a city council member, in any future City Council meetings when he is physically absent! Thank you!

Most sincerely,

Janet, Hal, and Cindy Van Zoeren

I ask that Council Ray WANG NOT BE APPOINTED TO VICE MAYOR as he has shown in the past council meeting that he violates the law to suit his agenda . He was aware about his other work/personal commitment when he stood for city council election last year. He needs to uphold his commitments to the city and if he cannot then he should resign from the council SUGGEST Council member SHEILA MOHAN for vice mayor position and

Hello Mayor Chao, Vice Mayor Moore and Council Members, My comments are regarding Councilmember Wang.

Do not allow Councilmember Wang to be Vice Mayor. His repeated unprofessional termination of a remote connection during council meetings has caused council meetings to end prematurely. This behavior is not appropriate for someone wishing to be Vice Mayor.

Do not allow Councilmember Wang to attend Council meetings remotely in the future.

He is abusing the privilege of using a remote connection.

Consider censuring Councilmember Wang for violating the City code of Ethics.

Please agendize the Mary Avenue Project for the December 11 Council meeting to continue discussion of the December 2 agenda item.

Dear Mayor Chao, Vice-Mayor Moore, City Councilmembers, City Manager, and City Attorney:

I think it is important to take into account that Councilmember Ray Wang has violated multiple provisions of Cupertino's City Code of Ethics in the Council meeting of December 2, 2025. He threatened the City Attorney and City Council members with retaliation if they did not accept his viewpoint, then carried out that threat by disconnecting from the meeting, knowing that it would require the Council meeting to end immediately.

The City Council needs to take swift and immediate action to make sure no single council member can EVER have the power to shut down a council meeting as this event has made clear can happen. The city needs to send a message to the city residents that the City Council takes the responsibility to behave in a professional, collaborative, and supportive manner seriously.

1. Do not elevate Councilmember Wang to Vice Mayor on December 11.

Through his extraordinary behavior on December 2, he has shown his lack of professionalism and lack of willingness and ability to build consensus on the dais – a key requirement for anyone seeking to be Vice Mayor.

2. Immediately revoke Councilmember Wang’s remote attendance privileges except in the case of an emergency as required by state law. Attending a City Council meeting remotely because of a personal commitment is a privilege, not a right, and Councilmember Wang has repeatedly misused this privilege.

3. Censure Councilmember Wang for his multiple violations of the City Code of Ethics which he swore to uphold when he joined the Council.

4. Agendize the Mary Avenue Project for the City Council meeting on December 11, 2025 to rectify the injury to the Mary Ave applicants as a result of the gross misuse of his office by Councilmember Wang which led to the meeting ending without a vote on December 2, 2025.

Dear Mayor, Vice-Mayor, and City Council Members,
I am writing to express my strong support for Councilmember Ray Wang. He has consistently demonstrated integrity, honesty, and a deep commitment to serving the residents of Cupertino.

His leadership reflects the values of fairness, transparency, and collaboration that our community expects from its elected officials.

It is unacceptable for any individuals or officials to gang together in an effort to remove him from office. Such actions undermine the trust and democratic principles that guide our city.

Councilmember Wang has earned the respect of the community through his dedication to listening, informing, and helping residents navigate complex city matters.

I’m also surprised at the amount of information that leaks out and is being posted in the public forum.

I urge you, as the current City Council members, Mayor, and Vice-Mayor, to recognize his contributions and elect Councilmember Wang as our new Vice-Mayor. His experience, integrity, and commitment to Cupertino make him the right choice to lead in this capacity.

Electing him will strengthen public trust and ensure that the Council is guided by a voice that truly represents the people.

Our city benefits from leaders who put residents first, and Councilmember Wang exemplifies this standard. Cupertino stands firmly behind him, and we ask that you affirm his contributions by supporting his election as Vice-Mayor.

Sincerely,

Dear Cupertino City Councilmembers , City Manager, and City Attorney , I found councilmember Ray Wang's conduct during the December 2nd 2025 city council meeting incredibly disheartening when he deliberately disconnected his zoom connection due to a disagreement with his fellow councilmembers and therefore no vote could be taken for the agenda item.

To be more specific I am referring to around the 3:00:00 timestamp to the end of the meeting video recording (https://www.youtube.com/watch?v=lBWv1q3hbvk )
Due to this, I suggest the following actions be taken to rectify Do not elevate councilmember Wang to Vice Mayor on December 11 and censure his multiple violations of the City Code of Ethics
Immediately revoke councilmember Wang’s remote attendance privileges except in the case of emergency
Agendize the Mary Avenue Project for December 11, 2025 since the Dec 2 meeting ended without a vote due to councilmember Wang's actions.

I have been a resident of Cupertino for over 20 years and it is a shame to see the level of unprofessionalism displayed by councilmember Ray Wang.

Councilmember Fruen,
I am a Planning Commissioner for the City of Cupertino, writing as myself today. City Manager and City Clerk, please include this email in the public record for the December 11, 2025 council meeting.

I was forwarded the email below that Councilmember Wang sent to his fellow Cupertino Council members. I am offended that Councilmember Ray Wang is telling us to "believe what I say now, not what I said during the Dec 2 council meeting or what you saw with your own eyes." The city residents are not fools. Councilmember Wang could have chosen to admit his wrongdoing and apologize sincerely. Instead, he decided to dig himself an even deeper hole by blatantly misrepresenting what occurred as if we didn't all witness his behavior in real time.

Here's the link to the discussion during the council meeting .

At timestamp 3:01:54, Councilmember Wang says "Well, at this point, then, I will have to leave the meeting. You do understand the ramifications?" He doesn't say "Oh sorry, my battery is dying". He does not appear frantic, he's actually quite calm. He makes a clear threat that everyone on the dais understands as a threat, as you can see from everyone's shocked faces. If Councilmember Wang's intention had been to "shut down my camera and leave in protest, NOT to end the meeting" as he now claims, there would have been no ramifications, the meeting would have continued unimpeded. So the very fact that he mentions ramifications means he was threatening to end the meeting.

At timestamp 3:02:05, Councilmember Wang repeats "At this point, I will have to leave the meeting... and the meeting will conclude." He is again clearly threatening to leave the meeting and force the council meeting to end as a result. He knows and clearly states the implications of his actions in that the meeting will be forced to conclude if he hangs up. Again, he is calm, he is not in a hurry, he is not frantically trying to fix battery issues, he is staring right at the City Attorney as he is making his threat and then he waits to see what her response will be.

At timestamp 3:02:11, Mayor Chao responds "Then we cannot vote on anything" indicating that she understands the threat made by Councilmember Wang will result in the meeting ending. Councilmember Wang responds by nodding his head in a manner indicating he understands the implication of Mayor Chao's statement and reiterates his assertion that the item cannot be voted upon because it is agendized as a study session.

At timestamp 3:02:42, after Councilmember Fruen reminds him that two attorneys (The City Attorney and Councilmember Fruen who is an attorney) have confirmed that a vote on the agenda item is appropriate, Councilmember Wang retorts "Then I will leave the meeting".

This is a clear case of retaliation because the City Attorney did not capitulate to his threat.

At timestamp 3:02:47, Councilmember Fruen specifically says to Councilmember Wang "If you leave the meeting, you can leave the room open for the public to participate" so that the meeting can continue and Councilmember Wang responds "I cannot according to the Brown Act." which is a false assertion because the Brown Act specifically requires the exact opposite.

It is clear from this exchange that Councilmember Wang is fully aware of what he's about to do and its consequences.

At timestamp 3:03:27, Councilmember Wang calmly says "Ok, well, have a wonderful evening everybody and thank you." He then disconnects from the meeting. He is clearly not rushed and fully aware that he's ending the entire council meeting with his actions.

Under California Penal Code Section 403 PC
, it is illegal to disrupt a public meeting, defined
as:

The defendant intentionally committed acts that violated implicit customs or explicit rules for governing a public meeting
The defendant knew or reasonably should have known that his or her acts violated those customs or rules
AND the defendant's acts substantially and unlawfully interfered with the conduct of the meeting
This is a misdemeanor offense “that may be punishable by up to six months in county jail, substantial court fines, fees and assessments, community service and/or labor requirements.” It seems quite clear that Councilmember Wang disrupted the December 2, 2025 council meeting, based on these criteria.

Councilmember Wang has a long standing history of threatening people and blaming his computer for his behavior. In 2003, he denied sending pornographic images to Rosanne Foust, a former Redwood City planning commissioner and city councilmember, and claimed that "his computer was hacked". Councilmember Wang also served community service in 2004 due to the related criminal case in which he pleaded no contest to a misdemeanor charge of “making annoying telephone calls to a place of work”.

According to a San Jose Spotlight article in July 2019
, Councilmember Wang implied on the
Nextdoor website in June 2019 that he would contact the employer of Richard Mehlinger, a pro-housing advocate and future Sunnyvale councilmember, who had been critical of him on Twitter. “Well that’s fun =) we’ll have to talk to Richard’s employer, DropBox. [sic] =)” The San Jose Spotlight article continues: "He also encouraged others in Cupertino who felt harassed by pro-growth activists known as YIMBYs...to “track down their employer and send their HR, Legal and CEO a letter outlining their YIMBY stance and all their tweets, their digital and social comms [sic] to show their lack of civility. It goes a long way to getting them reprimanded and in some cases a dose of reality.”"
He then published an apology for his behavior in a letter to the Mercury News . It’s likely that
Councilmember Wang may have apologized for his alleged sexual harassment of Rosanne Foust as part of his plea deal in 2004. And today he apologized for his many violations of the City Code of Ethics at the December 2, 2025 council meeting. So many apologies, yet it seems no real contrition.

I urge you to reject this insincere apology and do the following:

Do not appoint Councilmember Wang as Vice Mayor on December 11, 2025 Immediately revoke Councilmember Wang's remote participation privileges except in case of a documented emergency.

Issue a public censure of Councilmember Wang for his many violations of the City Code of Ethics.

Schedule a vote on the Mary Ave project at the Dec 11, 2025 council meeting to remediate the harm done to the applicants and the residents at the Dec 2, 2025 meeting.

Dear Fellow Colleagues,

I wanted to express my sincere apologies for abruptly ending the meeting on Tuesday December 2nd, 2025.

As our City Manager knows, while I was reminding everyone to add additional time, I was also suffering a battery issue and franticalliy trying to power my device. My intention that night was to shut down my camera and leave in protest, NOT to end the meeting. However, before I could do that, my battery died and I was not able to dial back in. By the time I was charged up to do so, the meeting had ended.

I recognize that this action has created a lot of consternation and I accept the blame for this, though this was not my intention. Now that you know the back story, I hope you will also work to clear this up in the public.

Please accept this apology and understand it was not my intention to abuse the Brown Act. In fact, it was my intention to discuss why we were violating the Brown Act with how we agendized and the irony of the situation is not lost upon me.

I intend to make a formal apology at our meeting on the 11th to clarify this matter as well.

Thank you in advance.

, Councilmember Wang implied on the
Nextdoor website in June 2019 that he would contact the employer of Richard Mehlinger, a pro-housing advocate and future Sunnyvale councilmember, who had been critical of him on Twitter. It goes a long way to getting them reprimanded and in some cases a dose of reality.”" He then published an apology for his behavior in a letter to the Mercury News .

I intend to make a formal apology at our meeting on the 11 th to clarify this matter as well.

Thank you in advance.

Vice Mayor Moore,
I am a Planning Commissioner for the City of Cupertino, writing as myself today.

Dear Mayor Chao, Vice-Mayor Moore, Councilmembers, City Manager, and City Attorney:

Councilmember R. Wang violated multiple provisions of the City Code of Ethics in the Council meeting of December 2, 2025. He threatened the City Attorney and City Council members with retaliation if they did not accept his viewpoint, then carried out that threat by intentionally disconnecting from the meeting, knowing that it would require the Council meeting to end immediately. This abuse of the Brown Act for Open Meetings to bully the City Council with a one-man VETO stopped the deliberation and vote on the Mary Avenue Project. This project would provide unique housing for Extremely Low Income/Intellectually Developmentally Disabled people in our community. Disgraceful behavior toward all parties, especially the parents of IDD people who were there..

Watch the last five minutes of the meeting at the link below to see for yourself. R. Wang's actions fall under California Penal code Section 403: Disturbing a Public Meeting.

At 3:00:12 Wang objects and says he will leave the meeting. Says he cannot leave the room open in accordance with the Brown Act.

I urge the City Council to take immediate action to make sure no councilmember can shut down a council meeting like this again. The Council must reassure the city residents that the City Council takes seriously its responsibility to behave in a professional and collaborative manner.

<!--[if !supportLists]-->2. <!--[endif]-->Do not elevate Councilmember Wang to Vice Mayor on December 11, 2025. Through his disgusting behavior on December 2, he has shown eagerness to abuse rules and regulations to bully the City Council into doing what he wants. He is not concerned about all residents, just those who agree with him.
<!--[if !supportLists]-->3. <!--[endif]-->Elect JR Fruen as Vice Mayor on December 11, 2025. He has served for several years as Councilmember, and one year as Vice Mayor. He has experience working effectively with all Mayors. His unique knowledge of the Housing Element process resulted in HCD’s (State) approval for Cupertino. HCD approval solidified local control. Recent projects have been approved for less affordable housing than required. We need JR Fruen to lead us through this next period of housing decisions.
<!--[if !supportLists]-->4. Revise Council rules to strengthen the Brown Act rules.

Censure Councilmember Wang for his multiple violations of the City Code of Ethics. Revoke Councilmember Wang’s remote attendance privileges.

Hello Mayor Chao, I urge you not to appoint council member Wang to Vice Mayor. Based on his comments & behavior, in my opinion as a 40 year Cupertino resident, he had shown no respect for the Cupertino residents. On December 2nd council meetings he got angry and left the zoom meeting resulting in the meeting to end. This shows a complete disrespect for those who were on the zoom meeting and those attending in person including the other 4 council members & City staff. He does not have the temperament & judgement to be Vice Mayor.

Also I request you put in policy that no one council member will be able to end the Council meeting, it should be done by a majority council vote.

Hello
My name is Tom Scannell and I have been a resident of Cupertino since 1980.

It was recently brought to my attention that Councilperson Wang abruptly left a meeting of the City Council meeting that he was attending remotely. His sudden and abrupt absence resulted in the meeting having to end and left a key topic undecided. Listening to the recording of the meeting it appears that Councilperson Wang left the meeting specifically because he did not like the way the discussion was going. I do not believe this is the proper behavior for an elected representative. It shows a lack of respect for his colleagues, the City staff, the residents of Cupertino and the overall process of democracy.

I understand that he offered a post meeting explanation that the real reason why he left so abruptly was that his computer was running out of power. He made no mention of this right before he left the meeting, so it seems to be a post facto explanation that does not hold up.

I understand that Councilperson Wang has frequently attended meetings remotely while traveling for business. It has also been reported that he left other City Council meetings that he was attending remotely before the meetings were over. While I respect his willingness to serve on the City Council while keeping up his obviously very busy personal business career, I’m not sure that remotely attending as many meetings as he has is in the best interests of the residents of Cupertino.

I am writing today as I understand the City Council is considering electing Councilperson Wang to the position of Deputy Mayor. I would strongly discourage the City Council from doing this. Councilperson Wang’s remote attendance record and his obvious disrespect for his colleagues, the City Staff and the residents of Cupertino, make him unqualified to serve as Vice Mayor this year.

If Councilperson Wang would consistently
attend City Council meetings in person and adopt a
more cooperative and democratic attitude, he could be reconsidered for the position next year.

Best regards
Tom Scannell

Dear Council Member Fruen,
The behavior of Council Member Ray Wang at the Dec 2 City Council meeting has been a hot topic on the socials this week. However, it is not the first time he has disrupted a meeting. The ability of one person to have veto power to stop a City Council meeting in this way is intolerable. Please do not reward his outbursts with a higher leadership role on the dais.

Furthermore, Mr. Wang has repeatedly shown that he is not a serious Council Member. He has proposed ideas that are not in the best interests of the City or the majority of residents. I am particularly concerned about his opposition to the Mary Ave Villas project. This project will provide homes for Extremely Low Income/Intellectually Developmentally Disabled people.

This has been a City Council priority for several years, including offering city property and over $3,000,000. Also, the City of Cupertino will face consequences if this Priority housing project from the Housing Element cannot be completed. No one wants the consequence of more Builders Remedy projects since they are not under local control! In the coming year the City Council will face important decisions about housing projects and will need to stay on top of them to stay compliant with the Housing Element. That is why the City Council needs your leadership right now. You know the law and were instrumental in getting the Housing Element approved. In addition, since joining the Council you have worked successfully with all former mayors. Please consider asking the Council to elect you to a higher leadership level.

I appreciate how you have demonstrated the kind of thoughtful leadership we need in Cupertino today. The City needs your guidance, your knowledge, and your vision of fairness to face the unique challenges of the coming year.

Thank you for contributing your expertise to our fair city.

In the coming year the City Council will face many decisions about housing projects and will need to stay on top of them to stay compliant with the Housing Element. That is why the City Council needs the leadership of JR Fruen right now. He knows the law and was instrumental in getting the Housing Element approved. Please consider electing JR Fruen to a higher leadership level.

Also very important, Council Member JR Fruen has consistently demonstrated the kind of thoughtful leadership we need in Cupertino today. Since joining the Council he has worked successfully with all former mayors. The City has important decisions to make and the City needs someone who leads with knowledge, patience, and a vision of fairness to everyone. As Vice Mayor JR Fruen would be a useful partner to tackle the unique challenges of this coming year.

Thank you for your kind consideration.

December 11, 2025 Agenda Item #1 Public Comment
Hi City Council,
I am saddened to see so much nastiness in the public comment today among people who do not know the whole story of all of what happened at the meeting on December 2. I agree with Councilmember Wang that a vote should not have been agendized within a Study Session item. I wish that Councilmember Wang had been able to stay on the meeting and abstain from voting rather than his leaving unexpectedly, evidently due to not being able to locate an operable outlet (he needs to get a bigger battery pack). Councilmember Wang should be applauded for recognizing that there was a problem with the way the item was agendized. He has a unique set of skills, is extremely intelligent, and deeply cares about residents.

As your first item of business as a new City Council, I would ask that you codify that no votes are to be taken in a study session. I have resided in Cupertino, and I never saw a vote taken during a study session (except in 2023, when I complained about it); I was only able to go back 9 years to show that this is how our City has operated in the past. Because there has been so much discussion on this issue, below and attached are the contents of an email that I sent yesterday that I’d like to be posted for item #1 today.

Separately, this has been a great year with Mayor Chao’s leading from the heart (in addition to her brilliant mind) and restituting canceled programs and instituting new ones.

Councilmember Wang has been the fresh new face on the council and in spite of a busy schedule, has been extremely accessible to his constituents and has brought novel perspectives to our council. Let’s give him some grace as our rookie on Team Cupertino. I am assuming that Kitty will be Mayor and she brings a wealth of experience from her days on the Planning Commission, City Council, independent study, and most of all, a curious mind. She is adept at running meetings and it has been a joy to watch her grow into this role.

Below and attached please find an email that I sent to you on December 10 and I would like it to be part of the public record for item #1 this evening.

Thanks,
Rhoda Fry, 40+ year Cupertino Resident

Dear City Manager,

On the December 2, 2025 Agenda (last attachment), an ACTION was listed under a STUDY SESSION ITEM #12. Agenda items with ACTIONS should be on the ACTION CALENDAR, not STUDY SESSIONS.

Please ensure that ACTIONS are not taken at STUDY SESSIONS in the future.

A similar error was made in January 2023 and you can see below an email that I wrote to the City about this along with a number of attachments illustrating that ACTIONS had NEVER been taken at prior STUDY SESSIONS.

Furthermore, I googled, “city government can actions be taken at study sessions” and got the following response (I’ll leave it to the experts to study the issue in greater depth):

No, generally, city governments cannot take formal action (like voting or passing ordinances) at study sessions
; these are for in-depth discussion, information gathering, and providing staff direction, with official votes reserved for regular meetings, though some "direction" can be given to staff to prepare items for a formal vote later. The key is that study sessions are for deliberation, not decision-making, and must still follow open meeting laws (like the Brown Act
in California) by being public, noticed, and having agendas, ensuring transparency even without votes.

I don’t know whether it is allowed to have an action on a study session (it doesn’t look like it), but it just isn’t good practice. Please also consider that an action tied to a Study Session could alter the nature of the discourse during the Study Session as it risks shifting discussion toward the specified action. Moving forward, please let’s keep STUDY SESSIONS action-free.

Thanks Much!

Dear City Manager and City Council,

Final Actions are not made at Study Sessions.

Items are studied at Study Sessions, discussed at subsequent Regular Sessions, and subsequently decided.

This has been the case as far as I can remember in my 40 years as a Cupertino resident.

Attached you will find the facts to back up this assertion going back 9 years of Study Sessions (this was the maximum I was able to extract from the database).

In 9 years, Final Actions have never taken place on the same day as Study Session Items.

To continue transparency and public participation, at the next City Council meeting and moving forward, please

1. Do not take Final Action (vote on resolution) on Study Session items

2. Discuss the outcome of a Study Session and open public comment at a subsequent City Council meeting and then take action

Respectfully,
Rhoda Fry

Subject: Annual election of the Vice Mayor
Date: Thursday, December 11, 2025 2:29:08 PM
CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

Dear Mayor and Council Members,
Thank you for your ongoing commitment and services to our city.

As you prepare to select the Vice Mayor at your annual December appointment, I respectfully encourage a clear, criteria-driven approach and a brief public explanation of your rationale. The City’s process of choosing the Mayor and Vice Mayor annually helps keep leadership accountable and responsive to evolving priorities, and I appreciate the intent behind this structure.

In considering the appointment, I hope you will weigh factors such as consistent meeting preparedness, respectful and fair facilitation, collaborative problem-solving, and a demonstrated ability to advance the City’s goals through constructive engagement with colleagues, staff, and residents. In addition, strengthening public trust often depends on leaders who communicate clearly, respect process, and follow through on commitments.

For context as you evaluate leadership experience and committee engagement across the dais, councilmember R “Ray” Wang, who is serving his first term until December 2028, emerges as a great choice. In March 2025 the Council established a two-member legislative review-style subcommittee for the 2025 session, comprised of Vice Mayor Kitty Moore and Councilmember Wang, to meet with the City’s lobbyist on state legislation. This is one example of the type of governance work that may be relevant to your overall assessment of leadership readiness and policy engagement.

More broadly, I hope the Council will prioritize a Vice Mayor who can help ensure orderly, effective meetings and support transparent, fiscally responsible, resident focused decision-making.

Here are highlights of some of his activities that I am impressed with and make him an ideal candidate for becoming the next Vice Mayor of the city.
===
Economic Development: In 2025, he worked through the Economic Development Committee to address vacant storefronts and improve the business climate, serving as the primary Council representative and on a two-member ad hoc subcommittee refining its focus and priorities. He supported the 2025–27 City Work Program, which places economic growth and a healthy local business environment among Cupertino’s core priorities.

Fiscal Responsibility: He has been consistently involved in fiscal housekeeping decisions, regularly moving or seconding consent items involving staffing changes, budget adjustments, and fee/lien actions. He supported bringing Treasurer’s and Investment Reports directly to the Council agenda, increasing transparency and strengthening oversight of City finances. He backed a work-program structure that ties long-term fiscal sustainability to service levels and quality of life for residents.

Regional Transit and Mobility: He represents Cupertino on the State Route 85 Corridor Policy Advisory Board and the Stevens Creek Corridor Transit Steering Committee, participating in regional mobility and transit discussions that directly affect local traffic and connectivity and has been representing the city's interests well. He also serves as an alternate to ABAG and the VTA Policy Advisory Committee, helping link Cupertino’s interests with broader Bay Area planning and transit policy.
===
Councilmember Ray Wang has demonstrated integrity, fairness, and a deep commitment to Cupertino residents in discharging his duties and has earned our trust through his dedication and honesty.

I urge the council to not pay heed to the attempts from certain sections to undermine his role and elect him as the next Vice Mayor of the city. I trust you will make the best decision for our community.

Thanks

Please do not designate Wang as Vice Mayor. Yes, the role is mostly ceremonial, but ceremonies exist for a reason! They signal legitimacy. This is not about ideology or policy disagreements. This is about ethics, and basic respect for the position. Let’s remember—Wang was already removed from the Planning Commission for poor conduct. The voters gave him a second chance. And how has he chosen to use that second chance?
Well, first, he doesn’t even attempt to attend meetings in person! He has been granted the unusual privilege of near-permanent virtual participation. But apparently even that degree of distance from his constituents isn’t enough! Now he needs even more distance, by quite literally disconnecting himself from public meetings, and conveniently shutting the entire meeting down with him.

If transparency and good governance truly matter, as many of you ran on, then the next logical action is obvious. You should censure him. Don’t promote him. Don’t elevate him.

Don’t hand him a title that suggests he is capable of leading the Council when he has demonstrated that he does not even want to participate.

PLEASE INCLUDE THIS EMAIL AS PART OF WRITTEN COMMUNICATIONS FOR THE ABOVE MEETING.

Dear Mayor Chao, Vice Mayor Moore, Councilmembers Mohan, Fruen and Wang, There has been a lot of attention to the Mary Avenue Villa project and city meetings related to it. Accusations, finger pointing, etc both regarding how the project was handled and how meetings evolved.

My preference for the mayor/vice mayor is Kitty Moore as mayor and Councilmember Ray Wang as vice mayor.

Councilmember Wang has delivered on his promise of representing the residents. He is a strong resident focused advocate who would be a strong support to the mayor.

IF this combination is not accepted, I would like to see Mayor Chao continue as mayor and Vice Mayor Moore continue as vice mayor. This would continue the status quo at a time when things are changing around us.

I am not comfortable with Councilmember Fruen being in either position due to his divided loyalities between Cupertino and the City of San Jose’s District 1. His “day job” working for the City of San Jose as Chief of Staff for District 1 puts him in potential conflict with what is best for Cupertino. I want someone focused on what is best for Cupertino. You cannot serve two masters.

In summary, please elect Kitty Moore as mayor and Ray Wang as vice mayor. IF that is not possible, please elect Mayor Chao as mayor and Kitty Moore as vice mayor.

Sincerely,
Peggy Griffin

Dear Mayor, Vice-Mayor, and Council Members,
We are writing to express our strong support for Council member Wang. he has shown integrity,
honesty and a strong concern for the residents and our our city.

There should not be any reason that other individuals or officials to gang together to remove him from office as he has accomplished so much in the last year .

Mr. Wang has earned respect from the community by being involved and listening to the
residents concerns. He answers emails and shows up at the Mayor's coffees. I have not seen
any other council member at the offices for many months.

We are urging you to appoint Ray Wang for Vice-Mayor because he is an advocate for residents of the city of Cupertino . How can others that are from outside of our city limits feel that they have a say in our governance? I actually do not understand this .

Please look at the respect of the majority that Cupertino residents have for Wang and consider him for vice-mayor.

Dear Mayor Chao, Vice Mayor Moore, Council Member Mohan, Council Member Fruen, and Council Member Wang,
It is that time of year again and I wanted to voice my support for the selection of Council Member Kitty Moore as Mayor, Council Member Ray Wang as Vice Mayor. I believe that these Council Members are focused on the residents and not on the residents of other communities that want to utilize city resources at cut rate prices when the city will be losing a significant amount of funding. I also believe that these two council members will be concerned with current residents, as they should be, and not future imaginary residents.

I hope you will be able to cut through the noise of individuals writing to the council whose supporters are merely a developer lobbying group and chose the candidates that are concerned with the good of the city and its residents. Please chose candidates that will work with council members who do not share their views instead of allowing the process to devolve into kangaroo courts and retribution campaigns as we have seen in the not-too-distant past.

Council Member Moore and Council Member Wang are best equipped to act in the residents' best interests.

Dear Mayor and Council Members,
I am writing as a long-time Cupertino resident to express my strong support for Councilmember Ray Wang and to respectfully urge you to select him as our next Vice Mayor.

In our community, we value leaders who act with integrity, listen with an open mind, and serve with a genuine commitment to the public good. Councilmember Wang has consistently demonstrated these qualities through steady, transparent service and a sincere willingness to engage with residents.

For many of us, especially those navigating city processes for the first time, his guidance and accessibility have been invaluable. It is therefore concerning to hear of any efforts by individuals or officials to marginalize or undermine him, as such actions run counter to the spirit of fairness and healthy democratic dialogue that Cupertino deserves.

Councilmember Wang’s integrity, his dedication to residents from all walks of life, and his record of thoughtful, principled leadership make him exceptionally well-qualified to serve as Vice Mayor. Cupertino needs leaders who place community above politics, and he has shown time and again that he does exactly that.

Thank you for your consideration, and I respectfully ask that you recognize his contributions by supporting Councilmember Ray Wang as our next Honorable Vice Mayor.

Dear Mayor, Vice Mayor, and Members of the Cupertino City Council, As a long-time resident and deeply concerned citizen of Cupertino, I am writing to express my strong and unwavering support for Councilmember Ray Wang.

Throughout his service on the Council, Mr. Wang has consistently demonstrated integrity, transparency, and a genuine commitment to the people of Cupertino. His thoughtful leadership reflects the values of fairness, accountability, and open dialogue that residents expect from their elected officials.

It is both troubling and unacceptable that any special interest groups, non- residents, or elected officials would attempt to undermine or remove a Councilmember who has served this city with distinction. Such actions not only disrespect the will of Cupertino’s voters, but also erode public trust in the democratic process that safeguards our community.

Councilmember Wang has earned the respect of residents across Cupertino through his accessibility, responsiveness, and principled decision-making. He listens to residents’ concerns, engages constructively on complex city matters, and upholds the public interest above all else.

With the conclusion of Mayor Chao’s term approaching, I respectfully urge the Council to recognize Councilmember Wang’s leadership and integrity by electing him as our next Vice Mayor. His experience, professionalism, and dedication to Cupertino’s long-term well-being make him an ideal choice to lead the city with balance, transparency, and vision.

Our city needs leaders who prioritize residents over political agendas. Councilmember Ray Wang exemplifies this standard. Electing him to a leadership role will reinforce public confidence and ensure Cupertino continues to be guided by voices that truly represent its residents—not by external influences or special interests.

Thank you for your attention and continued service to our community.

Dear City Clerk,
Could you please include the below for the 12/11/2025 city council meeting. Thank you for all that you do for the city. We appreciate your service to the city. [Writing as a Cupertino resident on behalf of myself only] Subject: Council Should Support Ray Wang for Vice-Mayor Dear Mayor Chao, Vice-Mayor Moore, Council Members,
I am writing because, as a resident, I believe it is important to acknowledge leaders who consistently stand up for the people they serve. Councilmember Ray Wang has shown a rare level of commitment to the residents of Cupertino. Time after time, in meeting after meeting, he listens to what residents say, weighs their concerns seriously, and votes in line with what the community is asking for. That kind of steady alignment with Cupertino residents is not something we see every day, sadly and it deserves to be recognized. We need to see more of it from more of you not less
I have watched him take positions that were not always the easiest politically, but were clearly the choices Cupertino residents wanted. Not special interest groups. Not organizations or clubs but ordinary residents of Cupertino. He does not pick convenience over responsibility. He chooses the Cupertino resident community time after time on every single vote he casts and position he takes. That is exactly the kind of leadership that builds trust in local government.

With this in mind, I am very concerned about any efforts by people preaching a moral higher ground to push him aside or reduce his role. When the council sidelines the member who listens most closely to the public, it sends the wrong message about priorities. These same people preaching today were nowhere to be found when prior council majority went after then council members Liang Chao and Kitty Moore including stripping them of committee assignments and did not even spare a past Mayor who served his 8 years I strongly encourage you to elect Councilmember Ray Wang as Vice-Mayor. He has earned that position through his consistency, his respect for Cupertino residents’ voices, and his willingness to act on what people actually want, not what is politically comfortable or aligned with special interest groups, organizations and clubs.

Residents would love to see the rest of the Council follow his example of always standing by residents, meeting with residents, voting for residents positions and respecting the rights of home owners, land owners and neighborhoods who pay enormous property taxes to live here and fund the operations of the city. Cupertino residents deserve council members and Mayors, Vice-Mayors who stand with them, not above them. Councilmember Ray Wang has set a standard, and it would benefit the whole city if every Councilmember approached decisions with that same commitment to the public’s will.

I hope you will take this opportunity to show the community that their voices matter by supporting him for Vice-Mayor. Stand with Cupertino residents not with special interest groups, clubs, organizations and those that preach morals when they showed none in attacking Ray Wang previously to take him off planning commission.

Dear Mayor Chao, Vice Mayor Moore, and City Council-members, I believe that Council-member Wang's behavior at the end of the meeting on December 2nd, where he intentionally prevented the Council from moving forward with important business, is disqualifying for any leadership position (e.g. Mayor or Vice Mayor) on the Council.

Council-member Wang's action was an intentionally hostile act toward the full Council and, by extension, all residents of Cupertino. You and Cupertino deserve better. You should not be in a position of having an entire meeting aborted due to the whims of one councilmember. Quorums were created for a reason.

Therefore, in addition to denying Council-member Wang any position of leadership on the Council, the Council should implement rules that ensure that the City's business moves forward. To that end, Council-member Wang's privilege to attend meetings remotely must be revoked. This is just common sense and good governance.

Council-member Wang's behavior reflects poorly on the Council and our great city. Please implement rules to ensure Council-member Wang can not be in a position to pull this kind of stunt again. Fool us once, shame on him.

Fool us twice, shame on us.

And please, do not elevate him to a position of leadership on the Council.

Sincerely,
Carol Stanek

City Clerk: Please include this email to the Written Communications for the item for the City Council Council Meeting on December 11.

Dear Honorable Mayor Chaio, Vice-Mayor Moore and City Councilmembers:

At the Dec 2, 2025 City Council Meeting, Ray Wang, city councilmember, behaved in an incredibly disgraceful and disrespectful manner to the entire city council when he argued with the city attorney, attorney and councilmember, JR Fruen and Mayor Liang Chiao, when he repeatedly vehemently refused to accept the legal council of the two lawyers present, ignored the Mayor’s control of the meeting, threatened to hang up from his Zoom call attendance even though it would prematurely end the council meeting before the council finished all the items on the agenda, and finally hung up on the meeting terminating the meeting unilaterally.

He now offers a late and flimsy excuse that he had “computer battery” issues. The video of the meeting especially the last 10 minutes of the YouTube of Cupertino City Council Meeting Dec 2, 2025 (Part 2)from 2:53:26 to 3:04:22 shows the truth and how his late flimsy apology is a lie. https://www.youtube.com/watch?v=lBWv1q3hbvk
The entire heated verbalization from Ray Wang was that the title of the meeting was a “study session” and he repeatedly adamantly stated that the second item of appointing a negotiator for Mary Ave Villas could not be done. He threatened to terminate the meeting by leaving. He would not accept the legal advice of the 2 attorneys present and ignored the Mayor. He then hung up thereby unilaterally forcing the council meeting to close. He NEVER said he was having computer battery issues during the entire council meeting including the last 10 minutes.

We cannot reward such behavior by electing him Vice-Mayor nor Mayor. As Vice-Mayor and eventually Mayor he would be in charge of running and managing our city council meetings. Through his behavior on Dec 2, 2025 and his long history outlined below, he lacks the willingness and the ability to build consensus on the dais and city. He is not professional, and frequently falls into extremely inappropriate behavior. We cannot have such a “loose cannon” running our city council meetings.

He must be censured and have his Zoom attendance privileges revoked. He has abused his attendance via Zoom by having the vast majority of his council attended by him via Zoom and now has caused 3 meetings to end early. Two other meetings he ended early claiming he needed to board his plane. He should have scheduled his plane flights to not force the city meetings to adjourn early. He has totally abused his attendance by Zoom and now is using his Zoom attendance to veto item(s) he disagrees with by terminating the meeting. He has demonstrated extremely poor behavior and extreme self entitlement including violating California Penal Code vSection 403 PC: Disturbing A Public Meeting violation and lack of collaboration and compliance in the business and procedures of the city and city council.

Do not make him Vice-Mayor or Mayor which would highlight and reward his bad behavior. He would terminate/interrupt fruitful council discussions and entangle the city and city council in his misdeeds followed by flimsy excuses. Let his shortcomings be his. Do not reward him for them nor entangle the city and the council in his shortcomings.

His history of misconduct includes blaming his computer for his behavior. In 2003, he denied sending pornographic images to Rosanne Foust, a former Redwood City planning commissioner and councilmember, and claimed his “computer was hacked”. He has a long history of misconduct documented by San Jose Spotlight in July 2019 and his NextDoor postings June 2019 implying he would contact the employer of Richard Mehlinger, a pro-housing advocate and future Sunnyvale councilmember. According to SJ Spotlight he encouraged others to “track down their employer and send their HR, Legal and CEO a letter outlining their YIMBY stance…to getting them reprimanded…” He also served community service in 2004 in which he pleaded no contest to charges of “making annoying telephone calls to a place of work”.

The council has other members who can be elected Mayor and Vice-Mayor. The city needs to have a Mayor and Vice-Mayor who have demonstrated the ability to follow the law, navigate the complicated issues Cupertino will face including having enough housing units to avoid the Builder”s Remedy to occur again and having the ability to be ethical without repeatedly blaming their computer for their misdeeds.

Cupertino deserves much better.

Cupertino stands firmly behind him, and we ask that you affirm his contributions by supporting his election as Vice- Mayor.

Sincerely,

Item 20 was Labeled “Study Session”
In the December 2 agenda, we consolidated two items into one: one is a study session and the other is an action item. But the consolidated item is labeled as "Study Session".

Another confusing thing is that there is no marking for "1)" before "Consider Study Session" so it is likely unclear to the reader that there are two separate items and the second one is an Action Calendar item.

My Objection to Jan. 2023 “Study Session” - with a
Resolution
I express my object to the adoption of the initial Council Procedures Manual back in January 2023, as the item was labeled "Study Session" and we adopted the "Resolution" for the Council Procedures Manual.

And that was the first time ever the Council Procedures Manual was placed on the council agenda. The first time ever the Council voted on a formal action in a study session.

Higher Standard Than the Brown Act
The Brown Act sets a minimum standard requiring "a brief general description of the business to be discussed". That said, the way we combined the study session and action item under one heading labeled “Study Session” did create some confusion, since we did so to combine the public comment period.

We’ve always aimed to go beyond the Brown Act’s minimum requirements when drafting agenda descriptions, for example, adding the budget modification amount, even though it is not legally required. I believe we should continue to uphold that higher standard moving forward.
