Meeting: February 24, 2026
Subject
Approval of first amendment to extend the term, through April 30, 2026, of the Interim City Attorney Agreement for City Attorney services by and between the City of Cupertino and Aleshire & Wynder, LLP, with Floy Andrews as Interim City Attorney
Recommended Action
Approve the first amendment, extending the term through April 30, 2026, of the Interim City Attorney Agreement for City Attorney services with Aleshire & Wynder, LLP
Background
The City Council of the City of Cupertino previously appointed Aleshire & Wynder LLP, and specifically Floy Andrews, as Interim City Attorney and approved an agreement with Aleshire & Wynder, LLP on February 19, 2025 (Attachment B). The agreement is set to expire on February 24, 2026, before the Council can consider the status and next steps for City Attorney services. The proposed First Amendment (Attachment A) to the Interim City Attorney Agreement would extend the term of the agreement through April 30, 2026.
Reasons for Recommendation
The proposed extension will ensure the continued provision of Interim City Attorney services while the City Council undertakes to perform an evaluation of the Interim City Attorney’s performance. This extension is intended to provide time for the City Council to complete a performance evaluation of the services provided by Aleshire & Wynder, LLP and Floy Andrews, as Interim City Attorney, to inform the Council’s consideration regarding future City Attorney services. Only the term of the Interim City Attorney Agreement is hereby amended; all other terms of the Agreement remain unchanged.
