This message originated outside your organization. Please use caution! The oversight responsibility for investigations and clean-up of releases from underground storage tanks was transferred from the Santa Clara Valley Water District to the Santa Clara County Department of Environmental Health as of July 1, 2004. DEH files on leaking underground storage tanks have been transferred to the State Water Resources Control Board's GeoTracker database.
Case files are available online at https://geotracker.waterboards.ca.gov/.
For more information, see Santa Clara County's file review page (https://www.sccgov.org/sites/hazmat/programs/smp/Pages/review.aspx) We also recommend that you visit the Department of Toxic Substances Control’s EnviroStor website for additional information related to non-DEH cleanup cases within the County at http://www.envirostor.dtsc.ca.gov/public/.
Solvent and toxic release sites in Santa Clara County are primarily regulated by the following Agencies:
San Francisco Bay Regional Water Quality Control Board (Case data available through GeoTracker)
California Department of Toxic Substances Control (Case data available through EnviroStor) United States Environmental Protection Agency (Case data for Superfund sites available through EPA)
Central Coast Regional Water Quality Control Board (Case data available through GeoTracker) Local Fire Departments may also maintain records.
We do provide some solvent case files at: https://www.valleywater.org/node/789; however, please note that these files may be incomplete and not up-to-date. These files are not maintained by the district. For complete case files, including the most recently submitted reports, contact the regulatory agency overseeing the case.
Valley Water’s information regarding wells is available at https://gis.valleywater.org/wellinfo/. This tool works best using Google Chrome. Using this portal and zooming in on an area, you can get data on whether we have data concerning wells at a site, and if so the well’s status, permit number, and construction specifics like depth, diameter, screen interval, if this data is in our database.
For well logs, please contact the State Department of Water Resources. Information on how to 1111

The location of Valley Water Fee Title and Easements can be viewed on our app at https://www.valleywater.org/contractors/doing-businesses-with-the-district/permits-working-valleywater-land-or-easement as well as information about how to obtain encroachment permits which are required for any work that takes place on or near Valley Water land, easement, or facility." 2965.0029S101/R Limited Phase II Investigation | ROUX | 1 Introduction
Roux Associates, Inc. (Roux), on behalf of SummerHill Homes LLC (SummerHill), performed a Limited Phase II Investigation (Limited Phase II) for the property located at 10268 Bandley Drive, Cupertino, California (Site). The location of the Site is shown on Figure 1. The Site occupies approximately 1.55 acres of land, associated with the Assessor’s Parcel Number (APN) 326-33-97 in Santa Clara County. The Site is currently developed with one commercial building and associated parking areas, and small strips of landscaped planters. The Site appears to have been used for agricultural purposes as orchards from at least 1939 through at least 1980, at which time a building was constructed on the Site in its current configuration.
The Site was occupied by commercial-use tenants, primarily offices and retail shops, from 2010 through 2020. The proposed redevelopment plan includes the construction of 32 townhomes.
Roux conducted a Phase I Environmental Site Assessment (Phase I ESA) to identify past, current, or material threats of the release of hazardous materials or petroleum hydrocarbons to the Site’s soil, groundwater, soil vapor, or surface water. The Phase I ESA was submitted to SummerHill on April 22, 2025 (Roux, 2025). The Phase I ESA did not identify any Recognized Environmental Conditions (RECs), controlled RECs (CRECs), historical RECs (HRECs) and/or de minimis conditions. Roux identified a business environmental risk (BER) of historical agricultural orchard use, which has the potential to impact soil with metals, herbicides and organochlorine pesticides (OCPs).
Per SummerHill’s request, this Limited Phase II was performed to assess potential metals and OCP impacts to soil from past agricultural orchard use of the Site. 1148

2965.0029S101/R Limited Phase II Investigation | ROUX | 2 Background
This Section provides the background for the Site, including Site location and description, Site history, and proposed redevelopment plan.
2.1. Site Location and Description
The Site is located in a mixed residential and commercial neighborhood in Cupertino, California. The Site is currently developed with one commercial building, associated parking areas, and small strips of landscaped planters. The Site is bordered by commercial buildings to the north and south, a parking lot to the east, and Bandley Drive to the west.
2.2. Site Geology and Hydrogeographic Setting
The Site is located within the Santa Clara Valley groundwater basin and the Santa Clara subbasin,1 which occupies a structural trough parallel to the northwest trending Coast Ranges. It extends from the northern border of Santa Clara County to the groundwater divide near the town of Morgan Hill. It is bounded by the Diablo Range to the east and the Santa Cruz Mountains to the west. Geologically, the water bearing formations of the subbasin include Pliocene to Holocene-age continental deposits of unconsolidated to semiconsolidated gravel, sand, silt, and clay. The combined thickness of the two major water bearing formations, the Santa Clara formation (a Plio-Pleistocene age formation) and a Pleistocene-Holocene alluvium formation, likely exceeds 1,500 feet.
According to the U.S. Geological Survey (USGS), the geology in the vicinity of the Site primarily consists of Holocene alluvial fan deposits and late Pleistocene alluvial terrace deposits.2 Based on the Limited Phase II as described herein, the Site is underlain by approximately 0.5 to 1.0 feet of sand with loose gravel and minor amounts of silt that is suspected to be fill. Underlaying the sand with gravel and silt fill, is approximately 1.5 feet of a similar material but with more sand content and a noticeable color change to reddish brown that is suspected to be native soil. No other environmental investigations have been conducted onsite.
The Site is at an elevation of approximately 245 feet above mean sea level (amsl). The general topography in the vicinity of the Site slopes gently to the east-northeast. The Site falls within the West Valley Watershed,3 which flows north into the San Francisco Bay. According to the U.S. Fish and Wildlife Service National Wetlands Inventory (NWI)4, the nearest surface water bodies include a freshwater pond located approximately 0.7 miles southwest (however, should be noted that this pond does not appear in recent aerial photographs), Regnart Creek located approximately 0.8 miles south, Calabazas Creek located approximately
1.2 miles southeast, and Stevens Creek located approximately 1.4 miles east.
Based on groundwater data from a nearby site in 2006, located at 20755 Stevens Creek Blvd (southwest of the Site), and groundwater data from a nearby site in 2009, located at 10165 North De Anza Blvd (southwest 1 California Department of Water Resources, 2003. Groundwater generally flows to the north-northeast; however, some southeast orientations have also been documented. In some areas of the valley floor, the groundwater gradient is essentially flat, resulting in great variability and significant seasonal changes in site specific groundwater flow directions.5,6
2.3. Site History
According to information provided in the Phase I ESA (Roux, 2025), the Site was used for agricultural purposes as orchards from at least 1939 through at least 1980. According to the City Directory, the Site was occupied by commercial use tenants, primarily as offices and retail shops, from 2010 through 2020.
The Site was not identified in any environmental reporting databases. According to records received by the City of Cupertino, the building was constructed in around 1977 and had minor renovations from 2005 to 2022 including reroofing, the installation of electrical kilns, and wall and window improvements. No known environmental releases have been recorded at the Site.

3. Limited Phase II Investigation
Roux conducted a Limited Phase II environmental subsurface investigation on March 10, 2025, to assess previous agricultural usage at the Site. The details of this investigation are described below.
3.1. Pre-Field Activities
Prior to intrusive work at the Property, Roux prepared a Site-specific Health and Safety Plan. Roux marked the proposed boring locations with white paint and notified Underground Service Alert of intended subsurface work at least two business days prior to drilling. Roux also contracted with Ground Penetrating Radar Systems, LLC (GPRS) of Manteca, California to perform a private geophysical investigation at each soil boring location to locate potentially buried utility lines or other subsurface features. On March 10, 2025, GPRS cleared the proposed boring locations prior to intrusive work.
3.2. Boring Advancement
On March 10, 2025, under the direction of Roux, Penecore Drilling (Penecore) of Woodland, California (C57 License # 906899) advanced four soil borings (RB-01 through RB-04) to up to 2.5 feet bgs) using a hand auger to collect soil samples. Boring locations are presented in Figure 2.
At each boring location during boring advancement, an experienced scientist, engineer, or geologist, under the supervision of a Professional Geologist or Engineer logged, and sampled the soil. Boring logs are included in Appendix A.
3.3. Soil Sampling
To assess if shallow soil has been impacted by historical agricultural use, soil samples were collected from borings RB-01 through RB-04. Samples were collected at varying depths ranging from 0.5 to 2.5 feet bgs from each boring location to collect samples at the first encountered depth of native soil, and 1-foot below this depth. Samples were placed into laboratory-provided soil jars, for a total of 8 soil samples collected.
The four shallower samples were initially analyzed for the following:
• CAM 17 metals by U.S. Environmental Protection Agency (EPA) Method 6000/7000 series; and
• OCPs with low-level cleanup for residential Environmental Screening Levels (ESLs) by EPA Method 8081A.
The four deeper samples were held upon review of initial results. Based on review of initial results in comparison to Residential San Francisco Bay Regional Water Quality Control Board (RWQCB) ESLs as described in Section 3.6, the deeper samples were not analyzed for the analytes listed above.
All soil samples were appropriately sealed, labelled, stored on ice, and transported by courier under chain of custody to McCampbell Analytical, Inc. (McCampbell) of Pittsburg, California, a California-certified laboratory.
3.4. Boring Abandonment
Following sampling activities, all soil borings were backfilled with grout to just below the ground surface.
Borings located in the asphalt parking lot were patched at the surface to match the surrounding ground surface with concrete with black dye.

3.5. Investigation Derived Waste
Soil cuttings were stored as investigated derived waste (IDW) in a Department of Transportation (DOT)-rated 55-gallon drum on Site. One four-point composite soil sample was collected and analyzed for the following constituents for waste characterization purposes:
• Total petroleum hydrocarbons (TPH) as gasoline (TPH-g) and volatile organic compounds (VOCs) by EPA Method 8260;
• TPH as diesel (TPH-d) and TPH as motor oil (TPH-mo) by EPA Method 8015; and • CAM 17 Metals by EPA Method 6000/7000 series.
OCP data from borings were used for waste characterization purposes. It should be noted that soil is characterized as California-hazardous and will be disposed of offsite at a regulated landfill due to the dichlorodiphenyldichloroethylene (DDE) concentration detected in RB-02-1.0. Manifest documentation will be provided to SummerHill following acceptance and signature by the receiving waste facility.
3.6. Soil Sampling Results
Concentrations detected in soil were compared to RWQCB September 2025 Residential ESLs (RWQCB, 2025) as well as the San Francisco Bay Area natural background concentration in soil for arsenic (Duverge, 2011). No metals or OCPs were detected exceeding Residential ESLs.
Soil analytical results are summarized in Tables 1 and 2. Laboratory analytical reports are included in Appendix B.
3.7. Limited Phase II Summary
All detected concentrations in shallow soil were below applicable Residential ESLs. Therefore, metals and OCPs from past agricultural orchard use do not present an unacceptable human health risk to future residents.
Based on the Limited Phase II results, no further investigation is recommended for the Site. 1152

¹ MDL is the minimum measured concentration of a substance that can be reported with 99% confidence that the measured concentration is distinguishable from method blank results. Definition and Procedure for the Determination of the Method Detection Limit, Revision 2, 40CFR, Part 136, Appendix B, EPA 821-R-16-006, December 2016. Values are based upon our default extraction volume/amount and are subject to change.
² RL is the lowest level that can be reliably determined within specified limits of precision and accuracy during routine laboratory operating conditions. (The RL cannot be lower than the lowest calibration standard used in the initial calibration of the instrument and must be greater than the MDL.) Values are based upon our default extraction volume/amount and are subject to change.

CITY COUNCIL STAFF REPORT
Date: June 2, 2026
Subject
Adoption of a Council Policy regarding Disruptions of Telephonic or Internet Service During Public Meetings under Senate Bill (SB) 707.
Recommended Action
Adopt Resolution No. 26-XXX adopting the Council Policy, “Disruption of Telephonic or Internet Service During Public Meetings,” as required by Senate Bill (SB) 707.
Background
The Ralph M. Brown Act requires that, with limited exceptions, all meetings of a legislative body of a local agency be open and public, and that all persons be permitted to attend and participate.
In 2025, the Legislature adopted Senate Bill 707 (Durazo), which amends the Brown Act with the intent to diversify and increase public engagement during local government meetings of legislative bodies. Among the various new requirements under SB 707, all eligible legislative bodies must now offer hybrid meetings (through a two-way phone or video platform). City Council, Commission and Committee meetings, except for the Library Commission, are already and will continue to be conducted in a hybrid format via Zoom.
In addition, SB 707 requires the City to formally adopt a policy, on or before July 1, 2026, that outlines the procedures for recessing and reconvening a City Council meeting in the event of disruption and the efforts that the City Council and staff must make to restore the service. This policy pertains to all open and public meetings of the City Council. (Government Code § 54953.4).
Reasons for Recommendation and Available Options
Staff prepared the attached draft Council Policy (Attachment B) to satisfy this new State requirement. The Policy mirrors the meeting disruption guidelines that are already outlined in SB 707, which require the legislative body (i.e., the City Council) to take a recess and attempt to restore service for at least one hour. If service cannot be restored within one hour, the City Council must conduct a roll-call vote confirming that good faith efforts were made and that the 1187

public interest in continuing the meeting outweighs the need for remote access. (Cal. Gov. Code § 54953.4(b)(1)
The draft Council Policy outlines the accommodations that would take place if disruptions were to occur. If adopted, the requirements would take effect July 1, 2026.
The full text of SB 707 can be found here:
https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=202520260SB707 Based on the findings outlined above, staff recommend adopting the draft resolution approving the Council Policy on Disruption of Telephonic or Internet Service During Public Meetings (Attachment A).

1. PURPOSE
Senate Bill 707 (SB 707) (2025) amended the Brown Act to require eligible legislative bodies to adopt, on or before July 1, 2026, a written policy that addresses how the agency will respond when there are disruptions in telephonic or internet service that prevent members of the public from attending or observing a meeting remotely. This policy is adopted to comply with that requirement and to ensure continuity of public participation during technical disruptions.
1.1 This policy sets forth clear procedures and expectations for addressing technological disruptions in telephonic or internet services that provide two-way remote public access to City Council meetings, as required by the Brown Act (Gov. Code § 54953.4). This policy affirms the City’s commitment to maintaining transparency, accessibility, and continuity of government during technology disruptions, consistent with SB 707’s mandate to recess meetings and make good faith efforts to restore service when remote access fails.
2. DEFINITIONS
2.1 Disruption: an interruption of telephonic or internet service that prevents:
• the legislative body from broadcasting the meeting; or • the public from attending, providing comment, or otherwise participating remotely.
2.2 “Remote access services” is defined as the two-way telephonic service and/or two-way audiovisual online platform used to provide real-time remote public attendance, participation, and/or observation of meetings.

4.1.1 The Presiding Officer or City Clerk shall announce the disruption to the legislative body, the in-person audience, and any remote participants.
4.1.2 The Presiding Officer or Clerk shall call a recess of the open session.
4.1.3 The legislative body may convene in closed session during the recess if otherwise authorized by law.
4.1.4 Staff shall make efforts to identify and restore the disrupted service.

A Message from the City Manager
Hello Neighbors,
I hope everyone had a meaningful Memorial Day weekend honoring and remembering the brave men and women who gave their lives in service to our country.
Public safety services and fiscal responsibility remain among the City’s highest priorities. As one of three cities that contract with the County for Sheriff’s services, Cupertino continues working collaboratively toward a fair, long-term agreement.
Yesterday, as part of ongoing discussions and one of many meetings the City has had with the County on this topic, the three cities met with the County to continue negotiations of our law enforcement contracts. The County has agreed to an extension of the current agreements as negotiations continue over the terms of a new contract and to allow a third-party consultant to perform an assessment of the County's proposed cost methodology. The short extension will ensure that both parties can continue working toward a legally compliant agreement that maintains public safety services for the community. I will continue to provide timely updates to the community on this important topic through this newsletter.
In the weeks ahead, there are also many opportunities for you to take part in local events, support local businesses, prepare for emergencies, and recognize fellow neighbors for the contributions they make to Cupertino. 1196

Warm Regards,
Tina Kapoor, City Manager
Nominations for the CREST Awards are now open, and we invite you to consider nominating your neighbor, or others in the community, who are making a impact in Cupertino. We also invite local artists to take part in the Cupertino 250 Art Showcase by submitting their artwork for a chance to be featured during our July Fourth celebration and help highlight the creativity that makes our community special.
We are also looking forward to National Night Out, an annual event that brings neighbors and law enforcement together to strengthen relationships and help build safer, more connected neighborhoods. It’s a meaningful reminder of how important community partnerships and civic engagement are in keeping our city strong. In addition, we invite everyone to join us for the City’s annual Pride Flag Raising on June 10 as we celebrate inclusion and unity in Cupertino.
Thank you for your engagement.

City Council Councilmember Report
2 Councilmember.
● Due to my work schedule, I have cut down on the event attendance for ceremonial purposes, especially those I have attended almost every year in the past. Instead, I focus more of my time on constituent services. (In reverse chronological order)
2026-05-25 attended the meeting of the US-China Chamber of Commerce with the delegation from Yiyang, Hunan Province, China
● There were presentations by two regions from the Yiyang city. One region is a technology and manufacturing center and the other region Taojiang is one of cities with massive bamboo forests in China. The bamboo products are not only used in furniture, utensils, but also in building materials (stronger than steel according to them) and even highperformance green and environment-friendly batteries. ● Some business members of the US-China Chamber of Commerce signed collaboration agreements with businesses from Yiyang.
2026-05-24 attended the InATalent 10th Anniversary and Award Ceremony for students at Quinlan Center
● Certificates were presented to students with volunteer hours from 20 to over 100 hours. The graduating students were honored. The videos of past participants who are already in college were inspiring on how the participation in the volunteer programs has helped them grow.
2026-05-24 attended the Summer Splash Market at the Rancho Rinconada Pool ● The pool is open and free for everyone. It was packed with families and kids. There were food vendors and craft booths too. What a fun idea for a pool day.
2026-05-20 had a virtual meeting with Urban SDK
● Their email described what they offer. "With the tool we built with the assistance of over 400+ other city and county agencies, it allows for you to address speeding complaints within minutes. We can provide: speed data for every road within your boundary every single day down to the hours. With that, we would like to provide you with a month of sample data for your jurisdiction because we believe you may be a good candidate for the program" ● It seems their aggregated data, collected from chips installed in cars by manufacturers, can show the speed of every street in every hour. It likely can provide traffic congestion data during rush hour also. 2026-05-16 attended the Women’s Summit in the AI Era at Alexander’s Steakhouse in Cupertino, hosted by the Global Federation of Chinese Business Women, Northern California Chapter ● The panel consists of women business leaders from various industries, from solar panel, event planning, healthcare to restaurants. They share their career paths and their community engagement. 2026-05-16 attended the AAPI Multicultural Festival at the Cupertino Civic Plaza, hosted by the Asian American Parents Association (AAPA) and other partners
● This is the fifth year of the AAPI Multicultural Festival and the fourth year held in Cupertino Civic Plaza.
There were amazing performances and many booths featuring different cultures and student groups, including students from De Anza College foreign language department. 2026-05-16 attended the Potluck of the Cupertino pickleball group at the Memorial Park ● Spoke to some participants to hear their concerns about the proposed pilot program to start in July. 1200
