2965.0029S101/R Limited Phase II Investigation | ROUX | 1 Introduction
Roux Associates, Inc. (Roux) , on behalf of SummerHill Homes LLC (SummerHill), performed a Limited Phase II Investigation (Limited Phase II) for the property located at 10268 Bandley Drive, Cupertino, California (Site). The location of the S ite is shown on Figure 1. The Site occupies approximately 1.55 acres of land, associated with the Assessor’s Parcel Number (APN) 326-33-97 in Santa Clara County. The Site is currently developed with one commercial building and associated parking areas, and small strips of landscaped planters. The Site appears to have been used for agricultural purposes as orchards from at least 1939 through at least 1980, at which time a building was constructed on the Site in its current configuration.
The Site was occupied by commercial -use tenants , primarily offices and retail shops, from 2010 through 2020. The proposed redevelopment plan includes the construction of 32 townhomes.
Roux conducted a Phase I Environmental Site Assessment (Phase I ESA) to identify past, current, or material threats of the release of hazardous materials or petroleum hydrocarbons to the Site’s soil, groundwater, soil vapor, or surface water. The Phase I ESA was submitted to SummerHill on April 22, 2025 (Roux, 2025). The Phase I ESA did not identify any Recognized Environmental Conditions (RECs), controlled RECs (CRECs), historical RECs (HRECs) and/or de minimis conditions. Roux identified a business environmental risk (BER) of historical agricultural orchard use, which ha s the potential to impact soil with metals, herbicides and organochlorine pesticides (OCPs).
Per SummerHill’s request, this Limited Phase II was performed to assess potential metals and OCP impacts to soil from past agricultural orchard use of the Site.
2965.0029S101/R Limited Phase II Investigation | ROUX | 2 Background
This Section provides the background for the Site, including Site location and description, Site history, and proposed redevelopment plan.
2.1. Site Location and Description
The Site is located in a mixed residential and commercial neighborhood in Cupertino, California. The Site is currently developed with one commercial building, associated parking areas, and small strips of landscaped planters. The Site is bordered by commercial buildings to the north and south, a parking lot to the east, and Bandley Drive to the west.
2.2. Site Geology and Hydrogeographic Setting
The Site is located within the Santa Clara Valley groundwater basin and the Santa Clara subbasin, 1 which occupies a structural trough parallel to the northwest trending Coast Ranges. It extends from the northern border of Santa Clara County to the groundwater divide near the town of Morgan Hill. It is bounded by the Diablo Range to the east and the Santa Cruz Mountains to the west. Geologically, the water bearing formations of the subbasin include Pliocene to Holocene-age continental deposits of unconsolidated to semi- consolidated gravel, sand, silt, and clay. The combined thickness of the two major water bearing formations, the Santa Clara formation (a Plio-Pleistocene age formation) and a Pleistocene-Holocene alluvium formation, likely exceeds 1,500 feet.
According to the U.S. Geological Survey (USGS), the geology in the vicinity of the Site primarily consists of Holocene alluvial fan deposits and late Pleistocene alluvial terrace deposits.2 Based on the Limited Phase II as described herein, the Site is underlain by approximately 0.5 to 1.0 feet of sand with loose gravel and minor amounts of silt that is suspected to be fill. Underlaying the sand with gravel and silt fill, is approximately 1.5 feet of a similar material but with more sand content and a noticeable color change to reddish brown that is suspected to be native soil. No other environmental investigations have been conducted onsite.
The Site is at an elevation of approximately 245 feet above mean sea level (amsl). The general topography in the vicinity of the Site slopes gently to the east-northeast. The Site falls within the West Valley Watershed,3 which flows north into the San Francisco Bay. According to the U.S. Fish and Wildlife Service National Wetlands Inventory (NWI) 4, the nearest surface water bodies include a freshwater pond located approximately 0.7 miles southwest (however, should be noted that this pond does not appear in recent aerial photographs), Regnart Creek located approximately 0.8 miles south, Calabazas Creek located approximately
1.2 miles southeast, and Stevens Creek located approximately 1.4 miles east.
Based on groundwater data from a nearby site in 2006, located at 20755 Stevens Creek Blvd ( southwest of the Site), and groundwater data from a nearby site in 2009, located at 10165 North De Anza Blvd (southwest

Groundwater generally flows to the north-northeast; however, some southeast orientations have also been documented . In some areas of the valley floor, the groundwater gradient is essentially flat, resulting in great variability and significant seasonal changes in site specific groundwater flow directions.5,6
2.3. Site History
According to information provided in the Phase I ESA (Roux, 2025), the Site was used for agricultural purposes as orchards from at least 1939 through at least 1980. According to the City Directory, the Site was occupied by commercial use tenants, primarily as offices and retail shops, from 2010 through 2020.
The Site was not identified in any environmental reporting databases. According to records received by the City of Cupertino, the building was constructed in around 1977 and had minor renovations from 2005 to 2022 including reroofing, the installation of electrical kilns, and wall and window improvements. No known environmental releases have been recorded at the Site.

3. Limited Phase II Investigation
Roux conducted a Limited Phase II environmental subsurface investigation on March 10, 2025, to assess previous agricultural usage at the Site. The details of this investigation are described below.
3.1. Pre-Field Activities
Prior to intrusive work at the Property, Roux prepared a Site-specific Health and Safety Plan. Roux marked the proposed boring locations with white paint and notified Underground Service Alert of intended subsurface work at least two business days prior to drilling. Roux also contracted with Ground Penetrating Radar Systems, LLC (GPRS) of Manteca, California to perform a private geophysical investigation at each soil boring location to locate potentially buried utility lines or other subsurface features. On March 10, 2025, GPRS cleared the proposed boring locations prior to intrusive work.
3.2. Boring Advancement
On March 10, 2025, under the direction of Roux, Penecore Drilling (Penecore) of Woodland, California (C- 57 License # 906899) advanced four soil borings (RB-01 through RB-04) to up to 2.5 feet bgs) using a hand auger to collect soil samples. Boring locations are presented in Figure 2.
At each boring location during boring advancement, an experienced scientist, engineer, or geologist , under the supervision of a Professional Geologist or Engineer log ged, and sample d the soil . Boring logs are included in Appendix A.
3.3. Soil Sampling
To assess if shallow soil has been impacted by historical agricultural use, soil samples were collected from borings RB-01 through RB -04. Samples were collected at varying depths ranging from 0.5 to 2.5 feet bgs from each boring location to collect samples at the first encountered depth of native soil, and 1 -foot below this depth. Samples were placed into laboratory-provided soil jars, for a total of 8 soil samples collected.
The four shallower samples were initially analyzed for the following:
• CAM 17 metals by U.S. Environmental Protection Agency (EPA) Method 6000/7000 series; and
• OCPs with low-level cleanup for residential Environmental Screening Levels (ESLs) by EPA Method 8081A.
The four deeper samples were held upon review of initial results. Based on review of initial results in comparison to Residential San Francisco Bay Regional Water Quality Control Board ( RWQCB) ESLs as described in Section 3.6, the deeper samples were not analyzed for the analytes listed above.
All soil samples were appropriately sealed, labelled, stored on ice, and transported by courier under chain of custody to McCampbell Analytical, Inc. (McCampbell) of Pittsburg, California, a California-certified laboratory.
3.4. Boring Abandonment
Following sampling activities, all soil borings were backfilled with grout to just below the ground surface.
Borings located in the asphalt parking lot were patched at the surface to match the surrounding ground surface with concrete with black dye.
2965.0029S101/R Limited Phase II Investigation | ROUX | 5
3.5. Investigation Derived Waste
Soil cuttings were stored as investigated derived waste (IDW) in a Department of Transportation (DOT)-rated 55-gallon drum on Site. One four -point composite soil sample was collected and analyzed for the following constituents for waste characterization purposes:
• Total petroleum hydrocarbons (TPH) as gasoline (TPH -g) and volatile organic compounds ( VOCs) by EPA Method 8260;
• TPH as diesel (TPH-d) and TPH as motor oil (TPH-mo) by EPA Method 8015; and • CAM 17 Metals by EPA Method 6000/7000 series.
OCP data from borings were used for waste characterization purposes. It should be noted that soil is characterized as California-hazardous and will be disposed of offsite at a regulated landfill due to the dichlorodiphenyldichloroethylene (DDE) concentration detected in RB -02-1.0. Manifest documentation will be provided to SummerHill following acceptance and signature by the receiving waste facility.
3.6. Soil Sampling Results
Concentrations detected in soil were compared to RWQCB September 2025 Residential ESLs (RWQCB, 2025) as well as the San Francisco Bay Area natural background concentration in soil for arsenic (Duverge, 2011). No metals or OCPs were detected exceeding Residential ESLs.
Soil analytical results are summarized in Table s 1 and 2 . Laboratory analytical reports are included in Appendix B.
3.7. Limited Phase II Summary
All detected concentrations in shallow soil were below applicable Residential ESLs . Therefore, metals and OCPs from past agricultural orchard use do not present an unacceptable human health risk to future residents.
Based on the Limited Phase II results, no further investigation is recommended for the Site.
