RESOLUTION NO. 26-

A RESOLUTION OF THE CUPERTINO CITY COUNCIL AUTHORIZING

SUBMITTAL OF AN INDIVIDUAL GRANT APPLICATION FOR THE

RUBBERIZED PAVEMENT GRANT PROGRAM
This resolution authorizes City of Cupertino staff to complete and submit an application for the Rubberized Pavement Grant Program operated by the Department of Resources Recycling and Recovery (CalRecycle), for the 2027 Pavement Maintenance Phase 2 Project.

WHEREAS, the California Public Resources Code authorizes the Department of Resources Recycling and Recovery (CalRecycle) to administer various Grant Programs; and
WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of the Grant Programs; and WHEREAS, CalRecycle grant application procedures require, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of CalRecycle Grants; and WHEREAS, the City of Cupertino is requesting $80,000 from the CalRecycle Rubberized Pavement Grant Program; and
WHEREAS, the CalRecycle Rubberized Pavement Grant Program does not require a local match; and
WHEREAS, the City of Cupertino (Applicant) intends to enter into a Grant Agreement with the CalRecycle should grant funds be awarded; and NOW, THEREFORE, BE IT RESOLVED that the City Council does hereby:

1. Authorize submittal of an individual grant application for the City of Cupertino to the Rubberized Pavement Grant Program operated by CalRecycle

2. Authorize Veena Raghavan, Grants Analyst; Saurabh Nijhawan, Senior Civil Engineer; and/or Chad Mosley, Director of Public Works to submit Resolution No. __________________

an application for the Rubberized Pavement Grant Program operated by CalRecycle

3. Authorize the City Manager or their designee, in this case, Chad Mosley, Director of Public Works, as Signature Authority to execute in the name of City of Cupertino all grant documents, including but not limited to, applications, agreements, amendments, and requests for payment, necessary to secure grant funds and implement the approved grant project.

4. Approve the acceptance of grant funds from the Rubberized Pavement Grant Program, if the appropriate authorities award grant funding for the Project;

5. Approve these authorizations as effective for five years from the date of adoption.

BE IT FURTHER RESOLVED that this Resolution is not a project under the requirements of the California Environmental Quality Act, together with related State CEQA Guidelines (collectively, “CEQA”) because it has no potential for resulting in physical change in the environment. In the event that this Resolution is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility that the action approved may have a significant effect on the environment. CEQA applies only to actions which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. In this circumstance, the proposed action of submitting a grant application would have no or only a de minimis effect on the environment because it is an administrative funding request that does not authorize or commit the City to any physical project or environmental disturbance. The foregoing determination is made by the City Council in its independent judgment.
