CITY COUNCIL STAFF REPORT
Meeting: October 6, 2026
Subject
Approval of a Resolution Authorizing Submittal of An Individual Grant Application for $80,000 for the Rubberized Pavement Grant Program
Recommended Action
Adopt Resolution No. 26-XXX Authorizing Submittal of An Individual Grant Application for $80,000 from the Rubberized Pavement Grant Program
Background
The proposed grant application would request $80,000 from the Rubberized Pavement (Pavement) Grant Program to partially offset the cost of rubberized chip seal in the 2027 Pavement Maintenance Phase 2 Project. The Pavement Maintenance Phase 2 Project is a recurring annual roadway maintenance project that will apply rubberized chip seal across various roadway locations throughout the City. It is scheduled for construction between July 2027 and December 2027. The granting agency, CalRecycle, does not require a match.

CalRecycle's Pavement Grant Program aims to decrease adverse environmental impacts of waste tire disposal and to extend road usability, with rubberized pavement roads showing longer life cycles than roads made only with conventional materials.

The City of Cupertino adopted a Zero Waste Policy in 2017. The Policy's goal aligns with CalRecycle's goal of reducing by 90 percent the amount of waste sent to landfills. The Zero Waste Policy and the City's Climate Action Plan 2.0 recognize that disposal facilities such as landfills negatively impact human health, waste natural resources, and pass environmental liabilities on to future generations. One strategy identified is to pilot and support innovative, cost-effective programs that reduce waste generation and divert materials from landfills to their highest and best use. The Pavement Grant Program creates an opportunity for the City to address this strategy, through use of waste tires that would otherwise be in landfills.

Reasons for Recommendation and Available Options
CalRecycle requires all grant applicants to provide written evidence of authorization to apply for grant funding and recommends the use of standard language. Staff is presenting the proposed resolution to Council to comply with the granting agency requirement. If approved, the resolution will be submitted to CalRecycle by the October 20, 2026 deadline. The Pavement Maintenance Phase 2 Project was approved by the Council. The proposed grant opportunity aligns with the adopted Zero Waste Policy. By applying for grant funds to offset the project costs, the City avails an opportunity to leverage external funding to advance a priority project.

Based on alignment with the approved Pavement Maintenance Phase 2 Project and adopted City plans, staff recommends that Council adopt Resolution No. 26-___ (Attachment A) Authorizing Submittal of An Individual Grant Application for the Rubberized Pavement Grant Program.

Sustainability Impact
Approval of the draft resolution to apply for grant funds will facilitate a Climate Action Plan 2.0 goal to reduce 90% of all waste sent to landfills.

Fiscal Impact
There is no immediate fiscal impact associated with authorizing the grant application, and no additional appropriations are required. If awarded, the grant will increase budgeted revenue by $80,000 in revenue account 270-85-821-440-430 and will partially offset costs already budgeted for the 2027 Pavement Maintenance Phase 2 Project.
