Conduct the second reading of Ordinance No. 26-2286: “An Ordinance of the City Council of the City of Cupertino to amend Municipal Code Chapter 19.08 (Definitions).” Background
On October 6, 2026, the City Council considered proposed amendments to Chapter 19.08 of the Cupertino Municipal Code and conducted the first reading of the Ordinance.
The Ordinance addresses the need to align the City's Municipal Code with state housing laws by establishing a standalone definition of “square footage” and revising the definitions of “attic” and “garage, residential.” These amendments are intended to provide greater clarity and consistency in the application of state housing laws, including the streamlined ministerial approval provisions of Government Code section 65913.4, while preserving the City's existing local zoning and floor area regulations.
The City Council unanimously approved the proposed ordinance as amended on the first reading. The October 6, 2026 staff report is included as Attachment A for additional background. If the City Council approves the proposed ordinance (Attachment B) at the second reading, the ordinance will become effective thirty days after adoption, Sustainability Impact
