CITY COUNCIL REPORT
City Council Special 1.

FROM: Alisha Farnell, City Clerk
DATE: 03/08/2022
SUBJECT: Approve Findings Required by AB 361 to Use Teleconferencing for City Council Strategic Planning Meeting

RECOMMENDATION

1. Approve conducting the March 8, 2022 Special City Council strategic planning meeting via teleconference; and

2. Approve a Resolution to make the required findings under State law for remote teleconference City Council meetings.

DISCUSSION
The City's strategic planning facilitation team has requested that the City Council conduct its March 8 strategic planning session virtually. In order to conduct the strategic planning session virtually, the City Council must take action in accordance with state law.

Teleconference Meeting Requirements Under State Law
In September, the Governor signed Assembly Bill 361, which amended California Government Code section 54953 regarding teleconference meetings. Those amendments authorize cities to conduct remote meetings by teleconference during a Governor-proclaimed state of emergency provided that the City Council makes findings and meets public access procedural requirements. AB 361 requires the City Council to make the following findings by majority vote (and reaffirm the findings at least every 30 days) to hold remote teleconference meetings:
(A) The legislative body has reconsidered the circumstances of the state of emergency; and (B) Either of the following circumstances exist:
(i) The state of emergency continues to directly impact the ability of the members to meet safely in person; or
(ii) State or local officials continue to impose or recommend measures to promote social distancing.

In addition, AB 361 adds new procedures and clarifies the requirements for remote teleconference meetings:

Public Comment Opportunities in Real Time - a legislative body that meets remotely must allow the Public Comment Opportunities in Real Time - a legislative body that meets remotely must allow the public to access the meeting via a call-in option or an Internet-based service option, and the agenda for the remote meeting must provide an opportunity for the public to directly address the body in real time. A legislative body cannot require public comments to be submitted in advance of the meeting (written public comment is permitted along with real time input).

No Action During Disruptions - in the event a remote meeting is interrupted by technological disruption (or a disruption that prevents the public from offering public comments using the call-in option or internet-based services option) the legislative body is prohibited from taking any further action on items appearing on the meeting agenda until public access is restored. The City's webinar system and meeting protocols previously in place during virtual meetings are in full compliance with AB 361.

BUDGET IMPACT
None.
