Re: City of Cypress Elections
Dear Mr. Grant:
We represent Cypress land Company which, as you know, is one of the owners in the Cypress Business Park. I know that the City has been conducting community forums regarding whether the City should change City Council elections from at-large voting to elections by District and that the City Council may be further considering this issue at its meeting this evening. We believe that the Business Park has been an important entity for the entire City not just the area where the Business Park is located and, therefore, on behalf of Cypress Land Company believe it would be in the best interest of the City to maintain at-large elections. I would be happy to answer any questions about this.
Sincerely,
Mark Armbruster

Council Member Peat:
Spoke about a conflict of interest complaint submitted to the Fair Political Practices Commission (FPPC) by Cypress resident George Pardon. Council Member Peat stated the FPPC dismissed the conflict of interest complaint and requested the FPPC’s response letter to Mr. Pardon, dated February 2, 2022, be included in the minutes of this meeting:
“Dear Mr. Pardon, This letter is in response to the sworn complaint you submitted to the Enforcement Division of the Fair Political Practices Commission regarding the above-named individuals. Your complaint alleged that Cypress City Councilmembers Ann Hertz-Mallari and Jon Peat had a conflict of interest when they made decisions regarding the City’s contract (and contract amendments) with Valley Vista Services (VVS).
Under the Political Reform Act, a public official has a disqualifying conflict of interest in a governmental decision if it is reasonably foreseeable that the decision will have a financial impact on their personal finances or other financial interests. The facts and information in your complaint failed to establish that either Hertz-Mallari or Peat had financial interests that would have been effected when they made or participated in making decisions regarding VVS.
Therefore, after review of the complaint, evidence provided, applicable law, and communication with the Respondent’s legal counsel, the Enforcement Division will not pursue an enforcement action in this matter. If you have any questions, please contact Ginny Lambing. Sincerely, Angela J. Brereton, Chief, Enforcement Division” Council Member Peat thanked the FPPC for their quick response in this matter and made additional comments directed at Mr. Pardon.
Mayor Pro Tem Hertz-Mallari:
Attended the Orange County Fire Authority board meeting and provided an update. Will attend a Library Advisory Board meeting on February 24 and will provide any updates on changes to Library operations at future meetings. Attended a grand opening for Senior Helpers, a home health care service. Addressed the conflict of interest complaint submitted to the Fair Political Practices Commission and requested residents reach out to her directly with questions instead of obtaining information from questionable sources.
Wished everyone a Happy Valentine’s Day.
Mayor Morales:
No Report.
The City Manager requested clarification from Council Member Marquez regarding her comments regarding consideration of the California Voting Rights Act (CVRA) challenge at the next City Council meeting.
Council Member Marquez requested an item be brought forward to make a decision on the CVRA challenge at the February 28 City Council meeting.

CITY COUNCIL REPORT

SUBJECT: Approve an Appropriation for the Renovation of the Cypress Branch Library
RECOMMENDATION
1. Increase appropriations in the City Capital Projects Fund by $226,920 for the Orange County Cypress Branch Library Renovation Project; and
2. Increase budgeted transfers from the City Infrastructure Fund to the City Capital Projects Fund by $226,920.
DISCUSSION
The Orange County Cypress Branch Library is located at the Civic Center on Orange Avenue. Since 1974, Orange County Public Libraries (OCPL) has leased the city-owned building to provide library services and programs to the area.
OCPL recently completed renovations by updating the interior, lighting and furnishings and enhancing its layout. The project cost approximately $2,267,000. The project replaced portions of the exterior walkways from the parking lot to comply with American Disabilities Act (ADA) requirements and replaced the heating, ventilating, and air conditioning (HVAC) system. The lease agreement establishes the ADA and HVAC improvements as a city/building owner responsibility and the lease obligates the city to reimburse the County.
Specifically, Section H of the attached lease provides that City "shall provide at its own cost and expense all repair, maintenance, and janitorial supplies and services to Demised Premises, including but not limited to the repair and maintenance of the air conditioning system."
The ADA exterior site work cost $127,243.41 and the HVAC replacement cost $99,675.70. Public Works has reviewed the attached invoices for reasonableness and recommends the City Council approve reimbursing the county $226,919.11.
BUDGET IMPACT
This project is not included in the budget, but sufficient amounts are available in the This project is not included in the budget, but sufficient amounts are available in the Infrastructure Fund to pay the recommended $226,920 of lease improvements at the library.

CITY COUNCIL REPORT
City Council Regular 5.
FROM: Mark Lauderback, Chief of Police
DATE: 03/14/2022
SUBJECT: Approve the Annual Drug Enforcement Administration Task Force Agreement
RECOMMENDATION
1. Authorize the City Manager, or designee, to enter into an agreement with Drug Enforcement Administration (D.E.A.) Task Force and execute all related documents associated with the agreement; and
2. Increase appropriations in the Department of Justice Asset Seizure Fund by $3,100 for a rental vehicle for the remainder of FY 2021-22.
DISCUSSION
The Drug Enforcement Administration (DEA), as part of its mission to enforce controlled substance laws and disrupt large drug-trafficking organizations, forms task forces with local law enforcement agencies to prosecute drug trafficking enterprises in Federal and State Court(s). The Cypress Police Department has dedicated one task force officer to work with the DEA since 2008. Other participants include police officers from seven local police departments, investigators from the Orange County District Attorney’s Office, and DEA agents. The task force officers assist federal agents in handling large-scale narcotics cases that affect communities in and around the Orange County area, including Cypress.
In addition to prosecuting drug traffickers and disrupting the transnational drug trade, participating local police departments receive a portion of seized assets for official use via the U.S. Department of Justice Equitable Sharing Program. Since 2015, the City has received over $2 million in funds seized from large-scale drug operations investigated by our task force officers. These seized funds not only diminish the ability of transnational drug organizations to engage in criminal behavior, including crimes of violence, they also provide funding for a variety of public safety projects in the City, including the recently completed police facility modernization.
The Agreement is required for the participating Cypress police officer to legally participate in the task force. Normally, the DEA requires a new agreement to be signed by participating task force agencies annually by October 1, which coincides with the beginning of the federal fiscal year. However, Cypress' task force officer position was unfilled last October due to staffing shortages in the police department and the position will be filled again beginning in April. Consequently, the finalized Agreement will be effective retroactively to October 1, 2021.
BUDGET IMPACT
The vacant DEA task force position is included in the police budget and will be filled in April.
The DEA will annually reimburse the City for the task force officer's overtime up to a maximum of $19,372. The DEA will also provide the necessary items and equipment to support the activities of the assigned task force officer. This support includes office space, office supplies, travel funds, funds for purchasing evidence and information, investigative equipment, and training.
The task force officer position requires the City provide an unmarked vehicle suitable for the nature of the assignment. An appropriation of $3,100 is requested in the DOJ Asset Seizure Fund for a rental vehicle for the remainder of the fiscal year. A full year of vehicle rental costs will be included in the FY 2022-23 proposed budget.

10. The CPD shall comply with Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, as amended, and all requirements imposed by or pursuant to the regulations of the United States Department of Justice implementing those laws, 28 C.F.R. FROM: Matt Burton, Director of Finance and Administrative Services DATE: 03/14/2022
SUBJECT: Approve Register of Warrants, Transfers, and Wires Issued for the Period of February 12, 2022 through February 25, 2022
RECOMMENDATION
Approve the attached payment register summarized below for the period of February 12, 2022 through February 25, 2022:
Electronic Funds Transfers 10565 through 10581 and 10614 through 10693 Warrants 58829 through 58933

DISCUSSION
Payments to vendors for goods and services received and/or rendered are initiated and approved by the requesting department in accordance with proper purchasing guidelines.
Processing of these payments occurs centrally in the City's Finance Department with payments issued bi-weekly. A register listing of these payments is then presented to the City Council for approval. This register also includes any Electronic Funds Transfers (EFT), outgoing payroll transfers or wires issued since the previous register was presented to the City Council. Voided Payments (if any) are also included at the end of the register.
All payments are processed on the City's financial management software system. This system generates a payment batch register, sorted by warrant number (or EFT/Wire number), and presents the invoice amount and a description of the payment issued.
BUDGET IMPACT
Total warrants, transfers, and wires issued (net of any voided payments) during the period of February 12, 2022 through February 25, 2022 are $1,357,644.32.
LEGAL REVIEW
None required.
