CITY COUNCIL REPORT
City Council Regular 2.

FROM: Mark Lauderback, Chief of Police
DATE: 09/23/2024
SUBJECT: Accept the Donation of Fixed Automated License Plate Readers from the Cypress Police Foundation

RECOMMENDATION

1. Accept a donation of $49,700 from the Cypress Police Foundation for the purchase and installation of a fixed Automated License Plate Reader system; and

2. Award a contract to Insight Public Sector IT solutions for $49,700 for the purchase and installation of a fixed Automated License Plate Reader system; and

3. Appropriate $49,700 in the General fund for the purchase; and

4. Increase estimated revenues by $49,700 in the General Fund for the donation from the Foundation.

DISCUSSION
The Cypress Police Foundation is a 501(c)(3) non-profit organization of local business and community leaders who provide equipment and other resources to the Cypress Police Department that are not already funded by the City. The Foundation works with the Police Department to identify equipment and services that will enhance policing in Cypress. Once a specific item is identified by the Foundation to donate to the Police Department, the Foundation will either purchase the item and give it directly to the City or donate the value of the equipment or service for the City to purchase on its behalf.

The Cypress Police Foundation recently approved the donation for the City to purchase eight fixed automated license plate readers (ALPR) and a two-year subscription required to access the database provided by Flock Safety (Flock) to operate the devices. These ALPR devices are wireless cameras that will be affixed to street poles in strategic locations throughout the City to record vehicle license plate numbers and descriptions, but not persons or faces.

ALPR cameras have proven an effective force multiplier for many law enforcement agencies nationwide and in Orange County. ALPR technology leads to quicker apprehension of criminals, recovery of stolen property, and closure of criminal cases that might be delayed or remain unsolved. ALPR cameras located in jurisdictions neighboring Cypress have already assisted our Police Department in solving misdemeanor and felony crimes. Until recently, Law Enforcement Agencies in Orange County had free access to the Flock ALPR data which could be shared between police departments. However, Flock changed their model to only allow access to cities with their own ALPR camera subscription, which has created the need for Cypress to purchase its own subscription.

Flock Safety provides ALPR cameras to over 1,000 cities and 1,500 law enforcement agencies nationwide. The donated cameras will be provided using a subscription-based model costing $3,000 per camera per year. This cost includes all hardware, software, and connectivity. By opting for a two-year agreement and prepaying the full amount, the subscription cost will remain fixed during the contract term.

Insight Public Sector IT Solutions offers Flock ALPR camera subscription services through an OMNIA cooperative purchasing agreement. The OMNIA program allows local governments to purchase competitively bid information technology systems through a nationwide cooperative agreement and Municipal Code Section 21A-10(e) permits bidding to be dispensed with under cooperative purchasing agreements. These agreements, which the City uses regularly when available, expedite purchases and ensure market pricing.

The Foundation is donating $49,700 to the City to pay for the full cost of the ALPR cameras for a two-year period.

BUDGET IMPACT
The Foundation will donate the full cost to operate the ALPR system for the next two years, which results in no impact on fund balance in the City's General Fund. It is anticipated the Police Department and Foundation will review the effectiveness of this program at the end of the two years and consider an additional donation at that time.

4. Appropriate $9,000 in the Equipment Replacement Fund for the purchase of three Lidar devices; and

5. Approve a $9,000 transfer from the General Fund Grants Fund to the Equipment Replacement Fund.

DISCUSSION
The State recently awarded the City an Office of Traffic Safety Selective Traffic Enforcement Program (STEP) grant for the fifth consecutive year. The grant will reimburse up to $105,000 for overtime, equipment and training costs related to STEP between October 1, 2024 and September 30, 2025.

STEP's goal is to reduce collisions involving alcohol, speed, and red light violations. In Cypress, the grant funds will increase DUI enforcement through checkpoints and saturation patrols, as well as distracted driving, pedestrian and bicycle safety and traffic safety education.

BUDGET IMPACT
Eligible grant-related costs up to $105,000 will be fully reimbursed by the State's Office of Traffic Safety. There are no matching requirements associated with this grant; therefore, there will be no impact on fund balance in the City's General Fund.

GRANT AGREEMENT

GRANT NUMBER
PT25022

1. PROBLEM STATEMENT
The City of Cypress population is over 50,000 and the population has recently increased due to new residential developments built during the past several years. In early 2024, Cypress will see the completion of the new Cypress Town Center. The Cypress Town Center is a gathering place for the community and includes a mix of entertainment, retail, restaurants, commercial, and residential uses, which draw hundreds of people from inside and outside the Cypress community.

Cypress Community College and a large commercial corridor which includes an Amazon Last Mile facility are also located in Cypress, attracting thousands of individuals who travel through the city, increasing the average daily vehicle flow. The City of Cypress also borders Los Angeles County.

The Cypress Police Department is committed to making the City of Cypress the safest city in Orange County. The foundation for accomplishing this goal is by being committed to the Cypress Police Department’s mission:

To provide professional public safety services in partnership with our community.

Public safety and well-being are valued, fundamental components of quality of life within the community as defined in the City of Cypress Public Safety General Plan. The Cypress Police Department is an integral component of the public safety sector that provides for the reduction of criminal activity, crime prevention and educational programs designed to prevent crime. In addition to general public safety for its community members, the provision for safe pedestrian and bicycle environments is a component of public safety.

In order to accomplish these goals, the Cypress Police Department is committed to reducing traffic-related injuries and fatalities through an aggressive educational and enforcement campaign, targeting impaired/unlicensed drivers, repeat DUI offenders, and other traffic related violators.

In 2022, Cypress Police Department reported 130 injury traffic crashes, a 6% increase from the 123 reported in 2021 and a 13% increase from the 113 injury traffic crashes reported in 2020. In 2023, Cypress Police Department reported 135 injury traffic crashes, a 4% increase from the 130 injury traffic crashes reported in 2022.

There were zero traffic related fatalities reported in 2021 and three traffic related fatalities reported in 2022, an increase of 300% between 2021 and 2022. Four traffic related fatalities were reported in 2023, a 25% increase from the fatalities reported between 2022 and 2023. In addition, three of the four fatalities that occurred in 2023 were alcohol related.

Hit & Run injury crashes decreased by 40% between 2021 and 2022. Hit & Run injury crashes increased by 100% between 2022 and 2023. Hit & Run crashes resulting in property damage decreased by 37% between 2022 and 2023. In analyzing post incident crash data, many of these crashes can be linked to unlicensed, suspended, or impaired drivers, unwilling to take responsibility for their actions. Working to identify and apprehend unlicensed and repeat DUI offenders, the Cypress Police Department can continue to have a positive impact on reducing Hit & Run crashes on our roadways.

Our goal is to reduce the number of victims impacted by impaired drivers and other traffic related offenses. Our priority is to make Cypress a safer environment for its community members and the motoring public. A primary concern is impaired drivers and their impact on the community. DUI arrests decreased by 46% in 2023. To combat potential increases in DUI related events, public awareness and aggressive enforcement strategies continue to be the primary component in addressing this on-going concern and danger to the community.

Injury crashes also impact our community at several different levels. The impact of staffing level reductions within the agency, influence proactive traffic enforcement efforts, which continue to be a challenge. Additional resources are needed in order to maintain enforcement of primary crash-related 7/18/2024 1:40:43 PM Page 4 of 16
violations in locations of high frequency. This can be accomplished by utilizing personnel from other agencies in a collaborative effort. Unsafe speed, unsafe turning movements, and red-light violations continue to be our top primary crash factors.

Public awareness is the key to voluntary compliance with the law. High visibility and public awareness efforts are essential in filling the void created by a reduction in personnel. One officer seen driving down the road does not compare to two or three officers seen on enforcement stops at a high-crash intersection or on a known corridor of frequent DUI arrests. This could not be accomplished without additional enforcement activities and public awareness programs.

A. Phase 1 – Program Preparation (1st Quarter of Grant Year)  The department will develop operational plans to implement the “best practice” strategies outlined in the objectives section.
 All training needed to implement the program should be conducted in the first quarter.  All grant related purchases needed to implement the program should be made in the first quarter.  In order to develop/maintain the “DUI BOLOs,” research will be conducted to identify the “worst of the worst” repeat DUI offenders with a suspended or revoked license as a result of DUI convictions. The DUI BOLO may include the driver’s name, last known address, DOB, description, current license status, and the number of times suspended or revoked for DUI. DUI BOLOs should be updated and distributed to traffic and patrol officers at least monthly.  Implementation of the STEP grant activities will be accomplished by deploying personnel at high crash locations.

Media Requirements:

Issue a press release approved by the OTS PIO announcing the kick-off of the grant by November 15, but no sooner than October 1. The kick-off release must be approved by the OTS PIO and only distributed after the grant is fully signed and executed. If you are unable to meet the November 15 deadline to issue a kick-off press release, communicate reasons to your OTS grant coordinator and OTS PIO.

B. Phase 2 – Program Operations (Throughout Grant Year)  The department will work to create media opportunities throughout the grant period to call attention to the innovative program strategies and outcomes.

Media Requirements
The following requirements are for all grant-related activities:
 Send all media advisories, alerts, videos, graphics, artwork, posters, radio/PSA/video scripts, storyboards, digital and/or print educational materials for grant-related activities to the OTS PIO at [email protected] for approval and copy your OTS grant coordinator. Optimum lead time would be 7 days before the scheduled release but at least 3 business days prior to the scheduled release date for review and approval is appreciated.
7/18/2024 1:40:43 PM Page 6 of 16
 Send all Powerpoint presentations, online presentations and trainings for grant-related activities to the OTS PIO at [email protected] for approval and copy your OTS grant coordinator. Certified training courses are EXEMPT from the approval process.
 The OTS PIO is responsible for the approval of the design and content of materials. The agency understands OTS PIO approval is not authorizing approval of budget expenditure or cost. Any cost approvals must come from the OTS grant coordinator.  Pre-approval is not required when using any OTS-supplied template for media advisories, press releases, social media graphics, videos or posts, or any other OTS-supplied educational material.

However, copy the OTS PIO at [email protected] and your OTS grant coordinator when any material is distributed to the media and public, such as a press release, educational material, or link to social media post. The OTS-supplied kick-off press release templates and any kickoff press releases are an exception to this policy and require prior approval before distribution to the media and public.
 If an OTS-supplied template, educational material, social media graphic, post or video is substantially changed, the changes shall be sent to the OTS PIO at [email protected] for approval and copy to your OTS grant coordinator. Optimum lead time would be 7 days prior to the scheduled release date, but at least 3 business days prior to the scheduled release date for review and approval is appreciated.
 Press releases, social media posts and alerts on platforms such as NextDoor and Nixle reporting immediate and time-sensitive grant activities (e.g. enforcement operations, day of event highlights or announcements, event invites) are exempt from the OTS PIO approval process. The OTS PIO and your OTS grant coordinator should still be notified when the grant-related activity is happening (e.g. car seat checks, bicycle rodeos, community presentations, DUI checkpoints, etc.).
 Enforcement activities such as warrant and probation sweeps, court stings, etc. that are embargoed or could impact operations by publicizing in advance are exempt from the PIO approval process. However, announcements and results of activities should still be copied to the OTS PIO at [email protected] and your OTS grant coordinator with embargoed date and time or with “INTERNAL ONLY: DO NOT RELEASE” message in subject line of email.  Any earned or paid media campaigns for TV, radio, digital or social media that are part of a specific grant objective, using OTS grant funds, or designed and developed using contractual services by a subgrantee, requires prior approval. Please send to the OTS PIO at [email protected] for approval and copy your grant coordinator at least 3 business days prior to the scheduled release date.
 Social media posts highlighting state or national traffic safety campaigns (Distracted Driving Month, Motorcycle Safety Awareness Month, etc.), enforcement operations (DUI checkpoints, etc.), or any other grant-related activity such as Bicycle rodeos, presentations, or events, are highly encouraged but do not require prior approval.
 Submit a draft or rough-cut of all digital, printed, recorded or video material (brochures, posters, scripts, artwork, trailer graphics, digital graphics, social posts connected to an earned or paid media campaign grant objective) to the OTS PIO at [email protected] and copy your OTS grant coordinator for approval prior to the production or duplication.  Use the following standard language in all press, media, and printed materials, space permitting:

Funding for this program was provided by a grant from the California Office of Traffic Safety, through the National Highway Traffic Safety Administration.  Space permitting, include the OTS logo on all grant-funded print materials, graphics and paid or earned social media campaign grant objective; consult your OTS grant coordinator for specifics, format-appropriate logos, or if space does not permit the use of the OTS logo.  Email the OTS PIO at [email protected] and copy your OTS grant coordinator at least 21 days in advance, or when first confirmed, a short description of any significant grant-related traffic safety event or program, particularly events that are highly publicized beforehand with anticipated media coverage so OTS has sufficient notice to arrange for attendance and/or participation in the event.

If unable to attend, email the OTS PIO and coordinator brief highlights and/or results, including any media coverage (broadcast, digital, print) of event within 7 days following significant grantrelated event or program. Media and program highlights are to be reflected in QPRs. 7/18/2024 1:40:43 PM Page 7 of 16
 Any press releases, work plans, scripts, storyboards, artwork, graphics, videos or any educational or informational materials that received OTS PIO approval in a prior grant year needs to be resubmitted for approval in the current grant year.  For additional guidance, refer to the OTS Grants Materials Approval Process Guidelines and OTS Grants Media Approval Process FAQs on the OTS website.  Contact the OTS PIO or your OTS grant coordinator for consultation when changes from any of the above requirements might be warranted.

6. That where the Recipient receives Federal financial assistance in the form of, or for the acquisition of, real property or an interest in real property, the Assurance will extend to rights to space on, over, or under such property.

7. That the Recipient will include the clauses set forth in appendix C and appendix D of this DOT Order 1050.2A, as a covenant running with the land, in any future deeds, leases, licenses, permits, or similar instruments entered into by the Recipient with other parties:

8. That this Assurance obligates the Recipient for the period during which Federal financial assistance is extended to the program, except where the Federal financial assistance is to provide, or is in the form of, personal property, or real property, or interest therein, or structures or improvements thereon, in which case the Assurance obligates the Recipient, or any transferee for the longer of the following periods:
a. the period during which the property is used for a purpose for which the Federal financial assistance is extended, or for another purpose involving the provision of similar services or benefits; or b. the period during which the Recipient retains ownership or possession of the property.

9. The Subgrantee will provide a drug-free workplace by:

Establishing a drug-free awareness program to inform employees about:

1. The dangers of drug abuse in the workplace;

f. Making a good faith effort to continue to maintain a drug-free workplace through implementation of all of the paragraphs above.

POLITICAL ACTIVITY (HATCH ACT)
(applies to all subrecipients as well as States)

CERTIFICATION REGARDING FEDERAL LOBBYING
(applies to all subrecipients as well as States)

CERTIFICATION FOR CONTRACTS, GRANTS, LOANS, AND COOPERATIVE AGREEMENTS The undersigned certifies, to the best of his or her knowledge and belief, that:

1. No Federal appropriated funds have been paid or will be paid, by or on behalf of the undersigned, to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with the awarding of any Federal contract, the making of any Federal grant, the making of any Federal loan, the entering into of any cooperative agreement, and the extension, continuation, renewal, amendment, or modification of any Federal contract, grant, loan, or cooperative agreement; 7/18/2024 1:40:43 PM Page 13 of 16

2. If any funds other than Federal appropriated funds have been paid or will be paid to any person for influencing or attempting to influence an officer or employee of any agency, a Member of Congress, an officer or employee of Congress, or an employee of a Member of Congress in connection with this Federal contract, grant, loan, or cooperative agreement, the undersigned shall complete and submit Standard Form-LLL, “Disclosure Form to Report Lobbying,” in accordance with its instructions;

3. The undersigned shall require that the language of this certification be included in the award documents for all sub-awards at all tiers (including subcontracts, subgrants, and contracts under grant, loans, and cooperative agreements) and that all subrecipients shall certify and disclose accordingly.

This certification is a material representation of fact upon which reliance was placed when this transaction was made or entered into. Submission of this certification is a prerequisite for making or entering into this transaction imposed by section 1352, title 31, U.S. Code. Any person who fails to file the required certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure.

RESTRICTION ON STATE LOBBYING
(applies to subrecipients as well as States)
None of the funds under this program will be used for any activity specifically designed to urge or influence a State or local legislator to favor or oppose the adoption of any specific legislative proposal pending before any State or local legislative body. Such activities include both direct and indirect (e.g., “grassroots”) lobbying activities, with one exception. This does not preclude a State official whose salary is supported with NHTSA funds from engaging in direct communications with State or local legislative officials, in accordance with customary State practice, even if such communications urge legislative officials to favor or oppose the adoption of a specific pending legislative proposal.

INSTRUCTIONS FOR PRIMARY TIER PARTICIPANT CERTIFICATION (STATES)

1. By signing and submitting this proposal, the prospective primary tier participant is providing the certification set out below and agrees to comply with the requirements of 2 CFR parts 180 and 1200.

2. The inability of a person to provide the certification required below will not necessarily result in denial of participation in this covered transaction. The prospective primary tier participant shall submit an explanation of why it cannot provide the certification set out below. The certification or explanation will be considered in connection with the department or agency's determination whether to enter into this transaction. However, failure of the prospective primary tier participant to furnish a certification or an explanation shall disqualify such person from participation in this transaction.

3. The certification in this clause is a material representation of fact upon which reliance was placed when the department or agency determined to enter into this transaction. If it is later determined that the prospective primary tier participant knowingly rendered an erroneous certification, in addition to other remedies available to the Federal Government, the department or agency may terminate this transaction for cause or default or may pursue suspension or debarment.

4. The prospective primary tier participant shall provide immediate written notice to the department or agency to which this proposal is submitted if at any time the prospective primary tier participant learns its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

10. Except for transactions authorized under paragraph 6 of these instructions, if a participant in a covered transaction knowingly enters into a lower tier covered transaction with a person who is proposed for debarment under 48 CFR part 9, subpart 9.4, suspended, debarred, ineligible, or voluntarily excluded from participation in this transaction, in addition to other remedies available to the Federal Government, the department or agency may terminate the transaction for cause or default.

BUY AMERICA
(applies to subrecipients as well as States)
The State and each subrecipient will comply with the Buy America requirement (23 U.S.C. 313) when purchasing items using Federal funds. Buy America requires a State, or subrecipient, to purchase with Federal funds only steel, iron and manufactured products produced in the United States, unless the Secretary of Transportation determines that such domestically produced items would be inconsistent with the public interest, that such materials are not reasonably available and of a satisfactory quality, or that inclusion of domestic materials will increase the cost of the overall project contract by more than 25 percent. In order to use Federal funds to purchase foreign produced items, the State must submit a waiver request that provides an adequate basis and justification for approval by the Secretary of Transportation.

CERTIFICATION ON CONFLICT OF INTEREST
(applies to subrecipients as well as States)

GENERAL REQUIREMENTS
No employee, officer, or agent of a State or its subrecipient who is authorized in an official capacity to negotiate, make, accept, or approve, or to take part in negotiating, making, accepting, or approving any subaward, including contracts or subcontracts, in connection with this grant shall have, directly or indirectly, any financial or personal interest in any such subaward. Such a financial or personal interest would arise when the employee, officer, or agent, any member of his or her immediate family, his or her partner, or an organization which employs or is about to employ any of the parties indicated herein, has a financial or personal interest in or a tangible personal benefit from an entity considered for a subaward. Based on this policy:

1. The recipient shall maintain a written code or standards of conduct that provide for disciplinary actions to be applied for violations of such standards by officers, employees, or agents. a. The code or standards shall provide that the recipient's officers, employees, or agents may neither solicit nor accept gratuities, favors, or anything of monetary value from present or potential subawardees, including contractors or parties to subcontracts. b. The code or standards shall establish penalties, sanctions, or other disciplinary actions for violations, as permitted by State or local law or regulations.

2. The recipient shall maintain responsibility to enforce the requirements of the written code or standards of conduct.

DISCLOSURE REQUIREMENTS
No State or its subrecipient, including its officers, employees, or agents, shall perform or continue to perform under a grant or cooperative agreement, whose objectivity may be impaired because of any related past, present, or currently planned interest, financial or otherwise, in organizations regulated by NHTSA or in organizations whose interests may be substantially affected by NHTSA activities. Based on this policy:

1. The recipient shall disclose any conflict of interest identified as soon as reasonably possible, making an immediate and full disclosure in writing to NHTSA. The disclosure shall include a description of the action which the recipient has taken or proposes to take to avoid or mitigate such conflict.

2. NHTSA will review the disclosure and may require additional relevant information from the recipient. If a conflict of interest is found to exist, NHTSA may (a) terminate the award, or (b) determine that it is otherwise in the best interest of NHTSA to continue the award and include appropriate provisions to mitigate or avoid such conflict.

3. Conflicts of interest that require disclosure include all past, present, or currently planned organizational, financial, contractual, or other interest(s) with an organization regulated by NHTSA or with an organization whose interests may be substantially affected by NHTSA activities, and which are related to this award. The interest(s) that require disclosure include those of any recipient, affiliate, proposed consultant, proposed subcontractor, and key personnel of any of the above. Past interest shall be limited to within one year of the date of award. Key personnel shall include any person owning more than a 20 percent interest in a recipient, and the officers, employees or agents of a recipient who are responsible for making a decision or taking an action under an award where the decision or action can have an economic or other impact on the interests of a regulated or affected organization.

PROHIBITION ON USING GRANT FUNDS TO CHECK FOR HELMET USAGE (applies to all subrecipients as well as States)
The State and each subrecipient will not use 23 U.S.C. Chapter 4 grant funds for programs to check helmet usage or to create checkpoints that specifically target motorcyclists.

POLICY ON SEAT BELT USE
In accordance with Executive Order 13043, Increasing Seat Belt Use in the United States, dated April 16, 1997, the Grantee is encouraged to adopt and enforce on-the-job seat belt use policies and programs for its employees when operating company-owned, rented, or personally-owned vehicles. The National Highway Traffic Safety Administration (NHTSA) is responsible for providing leadership and guidance in support of this Presidential initiative. For information and resources on traffic safety programs and policies for employers, please contact the Network of Employers for Traffic Safety (NETS), a public-private partnership dedicated to improving the traffic safety practices of employers and employees. You can download information on seat belt programs, costs of motor vehicle crashes to employers, and other traffic safety initiatives at www.trafficsafety.org. The NHTSA website (www.nhtsa.gov) also provides information on statistics, campaigns, and program evaluations and references.

States are also encouraged to conduct workplace safety initiatives in a manner commensurate with the size of the business, such as establishment of new rules and programs or re-evaluation of existing programs to prohibit text messaging while driving, and education, awareness, and other outreach to employees about the safety risks associated with texting while driving.

CITY COUNCIL REPORT
City Council Regular 6.

FROM: Jeff Draper, Director of Recreation and Community Services DATE: 09/23/2024
SUBJECT: Receive and File the Cypress Recreation and Community Services Foundation Annual Report

RECOMMENDATION
Receive and file the Recreation and Community Services Foundation Annual Report for the Fiscal Year ended June 30, 2024.

DISCUSSION
The Recreation and Community Services Foundation is a 501(c)(3) that supports and enhances safe, attractive, and high quality recreation facilities, programs, and services in Cypress. The City Council serves as the Board of Directors and the City Manager as the Executive Director.

Foundation bylaws require an annual report to be submitted to the Board if the Foundation receives more than $25,000 in gross receipts during the year. If the Foundation receives less than $25,000 in gross receipts, the annual report is only required if the Board requests it. The annual report includes a listing of Foundation assets and liabilities; revenues/receipts and expenses/disbursements during the year; and changes in assets/liabilities/fund balance during the year.

Although an annual report for FY 2023-24 is not required (gross receipts were below $25,000), consistent with the City and District's rigorous financial management practices, an annual report is compiled and submitted to the Board each year regardless of gross receipts.

Doing so provides the highest level of transparency and ensures the Foundation's financial condition and activities are fully disclosed annually.

The Foundation received donations in support of various recreational programming from ENO Brand's American Gift Fund, the Cypress Line Dancers, the Woman's Club of Cypress, Country Garden Caterers, and sponsors of the Salute to America event. These funds were expended in FY 2023-24 to support programs in accordance with the donor's desire, and the Foundation's fund balance increased slightly to $33,974 on June 30, 2024.

FROM: Matt Burton, Director of Finance and Administrative Services DATE: 09/23/2024
SUBJECT: Approve Cypress Recreation and Park District Continuing Appropriations from FY 2023-24 to FY 2024-25

RECOMMENDATION

1. Appropriate $23,507,202 in FY 2024-25 for items encumbered at June 30, 2024 as detailed in Attachment A; and

2. Appropriate $174,579 in FY 2024-25 for the carryover of continuing appropriations as detailed in Attachment A

DISCUSSION
There are typically District activities and purchases in progress at the end of a fiscal year, the majority of which relate to capital projects. An analysis of the prior year is performed to determine which activities need to be carried over to the new fiscal year. Open purchase orders and programs/projects expected to be completed in the new fiscal year are recommended for re-appropriation from prior year resources. Additionally, any revenues and operating transfers related to the continuing appropriations may also be recommended for re-appropriation to properly allocate program/project resources.

The appropriations associated with each budget lapse at fiscal year end unless the City Council re-establishes the appropriation. The carryover of encumbrances and continuing appropriations represents previously approved purchases, plans, or projects as summarized in Attachment A. If the proposed encumbrances and continuing appropriations were not carried over into FY 2024-25, sufficient appropriations would not exist to fund the continued projects and the new projects approved in the FY 2024-25 Budget.

There is one carryover of note to reimburse the Cypress Community Festival for revenue from political booths which will not be present at the Festival. The Festival Association made this decision in consultation with the District to ensure the Festival remains a family-friendly, welcoming environment focused on strengthening our community. A $5,000 carryover of unexpended FY 2023-24 non-profit support awarded to the Festival is included in the recommendation.

BUDGET IMPACT
The recommended carryover of encumbrances and continuing appropriations represents previously approved purchases and projects included in the FY 2023-24 Budget. Projected fund balance amounts included in the FY 2024-25 Budget are not impacted since the carried over activities have been budgeted previously and were expected to be fully expended prior to June 30, 2024.

SUBJECT: Approve Continuing Appropriations, Revenues and Transfers from FY 2023-24 to FY 2024-25

RECOMMENDATION

1. Authorize the appropriation of $2,849,960 in FY 2024-25 for the carryover of continuing appropriations from FY 2023-24, as detailed in Attachment A; and

2. Authorize the appropriation of $5,711,043 in FY 2024-25 for the carryover of encumbrances on June 30, 2024, as detailed in Attachment B; and

3. Authorize the continuation of operating transfers totaling $2,656,920 and estimated grant revenue totaling $137,363 from FY 2023-24 to FY 2024-25, as detailed in Attachment C to support carryover appropriations.

DISCUSSION
Each fiscal year, the City Council adopts an annual Budget. At the end of each fiscal year, there are typically activities and purchases in progress which have not been completed. The appropriation for those activities lapse at fiscal year end unless the City Council re-establishes the appropriation in the subsequent year. At the end of each year, an analysis is performed to determine which activities need to be carried over to the new fiscal year.

Open purchase orders and programs/projects for which a purchase order has not yet been issued, but are expected to be completed in the new fiscal year, are recommended for re-appropriation from prior year resources. Operating transfers and other revenues specific to the continuing appropriations are also recommended to be re-budgeted to properly allocate program/project resources.

The carryover, or re-budgeting, of encumbrances and continuing appropriations represents previously approved purchases, plans, or projects. In many cases, preliminary work has been done on the plans or projects. If the recommended encumbrances and continuing appropriations were not carried over into FY 2024-25, sufficient appropriations would not exist in the Budget to fund the continued projects and the new projects approved in the FY 2024-25 Budget.

BUDGET IMPACT
The recommended carryover of encumbrances and continuing appropriations represents previously approved purchases and projects contained in the FY 2023-24 Budget. Projected fund balance amounts included in the FY 2024-25 Budget are not impacted since the carried over activities have been previously appropriated and were expected to be expended prior to June 30, 2024.

DISCUSSION
California Government Code Section 53607 and Cypress Municipal Code Section 2-18(f) requires the submission of a monthly investment report to the City Council. As of August 31, 2024, the City had $188.2 million (current market value) in cash and investments and the interest return (yield) on the public funds investments was 4.51%. As required by the Government Code, all investments are in conformity with the City's investment policy and sufficient cash flows are available to meet the next six months of estimated expenditures.

The attached Summary of Cash and Investments presents the investments held by the City of Cypress as of August 31, 2024. The Investment Report consists of the following five summaries:

1. Summary of Cash and Investments - Provides the total portfolio of the City.

Changes in Cash and Investments - Provides a two-month cash flow analysis by fund type. These separate fund types allow for restricted monies to be segregated and tracked separately. The total ending amount agrees to the current market value shown in the Summary of Cash and Investments.

2. Investments at Market Value by Maturity Date - Provides a list of investments by maturity date, and an indication of the liquidity (ability to turn into cash) of the investments. The California Government Code restricts the type of investments eligible for public funds. The City’s Investment Policy further defines permitted investments.

These restrictions on investment types and the terms of allowable investments tend to result in limited yields on City investments.

3. Interfund Investments - Shows all authorized and outstanding loans between City funds.

The loans from the Infrastructure Reserve Fund to the Cypress Recreation and Park District General Fund relate to the construction of Lexington Park and the rehabilitation of Arnold Cypress Park.

4. of Arnold Cypress Park.

Summary of Cash and Investments Held In Trust - Shows the investments held in trust by the Public Agency Retirement Services (PARS) for offsetting unfunded pension liabilities. The pension trust amounts can only be used for future pension obligations.

The legal restrictions on the allowable investment types are less restrictive than those in the City's portfolio, which provides the ability for the trust to invest in more diverse assets which have the potential to yield a higher long-term rate of return.

5. As mentioned previously, the City had $188.2 million (current market value) in cash and investments on August 31, 2024. The investments include Federal Agencies and US Treasuries Debt ($134.0 million) and Investment Pools ($51.8 million). The City's bank accounts held $2.4 million on August 31, 2024.

A portion of the City's portfolio is invested in the State Investment Pool (Local Agency Investment Fund or LAIF), which provides a diversified investment pool for local agencies. By using the combined size of the participating cities and agencies, the State Pool provides a competitive yield, liquidity and investment diversification and management that would otherwise be unavailable to a single entity.

The amount of cash in the City’s checking accounts fluctuates based on the maturity of investments, daily cash receipts, and when vendors and employees are paid. The daily balances maintained in the checking accounts provide credits which offset monthly bank charges. In addition to the Federal Depository Insurance Corporation (FDIC) which insures the first $250,000, excess checking deposits are secured by banks, government, or mortgage securities valued between 110% and 150% of the deposits.

CITY OF CYPRESS
CITY COUNCIL REPORT
City Council Regular 10.

FROM: Matt Burton, Director of Finance and Administrative Services DATE: 09/23/2024
SUBJECT: Receive and File Register of Warrants, Transfers, and Wires Issued for the Period of August 10, 2024 through September 6, 2024

RECOMMENDATION
Receive and file the attached payment register summarized below for the period of August 10, 2024 through September 6, 2024:

Electronic Funds Transfers 15547 through 15737
Warrants 65866 through 66120

DISCUSSION
Payments to vendors for goods and services received and/or rendered are initiated and approved by the requesting department in accordance with proper purchasing guidelines.

Processing of these payments occurs centrally in the City's Finance Department with payments issued bi-weekly. A register listing of these payments is presented monthly to the City Council for approval. This register also includes any Electronic Funds Transfers (EFT), outgoing payroll transfers or wires issued since the previous register was presented to the City Council. Voided payments (if any) are also identified.

All payments are processed on the City's financial management software system. This system generates a payment batch register, sorted by warrant number (or EFT/Wire number), and presents the invoice amount and a description of the payment issued.

BUDGET IMPACT
Total warrants, transfers, and wires issued (net of any voided payments) during the period of August 10, 2024 through September 6, 2024 are $7,332,202.59.

CITY OF CYPRESS
CITY COUNCIL REPORT
City Council Regular 11.

FROM: Anne Mallari, Council Member
DATE: 09/23/2024
SUBJECT: Appoint Mayor Pro Tem Peat as a Director to the Orange County Fire Authority Board of Directors

RECOMMENDATION
Adopt a Resolution appointing Mayor Pro Tem Peat as a Director to the Orange County Fire Authority Board of Directors.

DISCUSSION
As the City Council briefly discussed during the Council Member Reports and Remarks portion of our last meeting, recently it has been difficult for me to attend in-person Orange County Fire Authority (OCFA) meetings. Combined with my service on the City Council (which includes representing the city on seven boards and committees), a new full-time job as the executive director of a local non-profit family support center, and the blessing of a new grandchild have made it difficult for me to be as engaged with OCFA as I have been over the last several years.

While I made every effort to strike a professional-personal-civic life balance that would enable me to honor my appointment to OCFA and its efforts to foster effective governance by maintaining board continuity, I believe Cypress is best served by appointing Mayor Pro Tem Peat to the OCFA Board. As many in our community know, the Mayor Pro Tem and her family have been passionately engaged with OCFA since long before she was elected to the City Council. Additionally, her professional experience, which includes serving on large boards of directors for firms engaged in complex and important aerospace and national defense work, is excellent preparation for service on OCFA's 25-person board of directors.

The City Clerk informed me that the City Council must approve the attached resolution to appoint a representative to the OCFA board of directors.
