CITY COUNCIL REPORT

FROM: Sheila Tran, Accountant
DATE: 12/08/2025
SUBJECT: Receive and File the Investment Report for the Month Ended October 31, 2025

RECOMMENDATION
Receive and file the attached investment report.

DISCUSSION
California Government Code Section 53607 and Cypress Municipal Code Section 2-18(f) requires the submission of a monthly investment report to the City Council. As of October 31, 2025, the City had $179.1 million (current market value) in cash and investments and the interest return (yield) on the public funds investments was 4.21%. As required by the Government Code, all investments are in conformity with the City's investment policy and sufficient cash flows are available to meet the next six months of estimated expenditures.

The attached Summary of Cash and Investments presents the investments held by the City of Cypress as of October 31, 2025. The Investment Report consists of the following five summaries:

1. Summary of Cash and Investments - Provides the total portfolio of the City.

Changes in Cash and Investments - Provides a two-month cash flow analysis by fund type. These separate fund types allow for restricted monies to be segregated and tracked separately. The total ending amount agrees with the current market value shown in the Summary of Cash and Investments.

2. Investments at Market Value by Maturity Date - Provides a list of investments by maturity date, and an indication of the scheduled liquidity (ability to turn into cash) of the investments. The California Government Code restricts the type of investments eligible for public funds. The City’s Investment Policy further defines permitted investments.

These restrictions on investment types and the terms of allowable investments tend to result in limited yields on City investments.

3. Interfund Investments - Summarizes all authorized and outstanding loans between City funds. The two loans from the City to the Cypress Recreation and Park District relate to

4. funds. The two loans from the City to the Cypress Recreation and Park District relate to the construction of Lexington Park and the rehabilitation of Arnold Cypress Park.

Summary of Cash and Investments Held In Trust - Indicates the investments held in trust by the Public Agency Retirement Services (PARS) to offset unfunded pension liabilities. Pension trust assets can only be used to pay for future pension obligations.

The legal restrictions on the allowable investment types are less restrictive than those in the City's portfolio, which provides the ability for the trust to invest in more diverse assets which have the potential to yield a higher long-term rate of return.

5. As mentioned previously, the City had $179.1 million (current market value) in cash and investments on October 31, 2025. The investments include Federal Agencies and US Treasuries Debt ($114.9 million) and Investment Pools ($62.1 million). The City's bank accounts held $2.1 million on October 31, 2025.

A portion of the City's portfolio is invested in the State Investment Pool (Local Agency Investment Fund or LAIF), which provides a diversified investment pool for local agencies. By using the combined size of the participating cities and agencies, the State Pool provides a competitive yield, liquidity and investment diversification and management that would otherwise be unavailable to a single entity.

The amount of cash in the City’s checking accounts fluctuates based on the maturity of investments, daily cash receipts, and when vendors and employees are paid. The daily balances maintained in the checking accounts provide credits which offset monthly bank charges. In addition to the Federal Depository Insurance Corporation (FDIC) which insures the first $250,000, excess checking deposits are secured by banks, government, or mortgage securities valued between 110% and 150% of the deposits.

CITY OF CYPRESS
CITY COUNCIL REPORT
City Council Regular 5.

FROM: Matt Burton, Director of Finance and Administrative Services DATE: 12/08/2025
SUBJECT: Appointment of City Treasurer

RECOMMENDATION
Approve the appointment of Donna Mullally, Assistant Director of Finance and Administrative Services/Finance Manager, as Treasurer of the City of Cypress effective December 30, 2025.

DISCUSSION
The City Treasurer is responsible for investing and safeguarding the assets of the City of Cypress and the Cypress Recreation and Park District. The City Council is responsible for appointing the City Treasurer. Matt Burton, who has served as City Treasurer since 2014, will be retiring on December 29 after nearly 25 years of employment with Cypress.

The specific duties of the City Treasurer include the annual submission of the Statement of Investment Policy to the City Council, submittal of a monthly report to the City Council summarizing the investments of the City and safeguarding the assets of the City and District.

Additionally, the City Treasurer is responsible for the investing of all City moneys while considering the legality, safety, liquidity and yield of such investments. Since the ultimate responsibility for these duties lies within the Finance Department, historically, the appointed City Treasurer has held the role of either Director or Assistant Director/Finance Manager.

Donna Mullally has served Cypress in the role of Assistant Director/Finance Manager since 2015 and has over 30 years of local government experience in accounting and treasury management, and it is recommended the City Council appoint her City Treasurer effective December 30, 2025.

It is anticipated the City Manager will appoint a permanent Director of Finance and Administrative Services in early 2026 and that individual may be recommended for appointment as City Treasurer. However, any such recommendation would be considered by the City Council at a future date.

FROM: Alicia Velasco, Planning Director
DATE: 12/08/2025
SUBJECT: Approve Amendment No. 5 to the Legal Services Agreement with Rutan & Tucker

RECOMMENDATION
Approve Amendment No. 5 to the Agreement with Rutan & Tucker for legal services related to the future redevelopment of Los Alamitos Race Course.

DISCUSSION
Rutan & Tucker (Rutan) has served as the City’s legal counsel for matters related to the former Redevelopment Agency and Successor Agency, as well as housing and land-use issues, including specialized legal services for the Los Alamitos Race Course (LARC) redevelopment effort.

The partner now assigned to Cypress has negotiated numerous major development agreements on behalf of the city of Irvine and is eminently qualified to manage the complexity of our case. Rutan has requested an update to its billing rates to reflect current market conditions and the complexity of the LARC entitlement and negotiation process. The proposed Amendment No. 5 updates the fee schedule for LARC-related services, including land use, CEQA, infrastructure, agreements, and litigation support.

The last approved hourly rate increase for Rutan occurred in September 2020 when Amendment No. 4 (attached) was approved by the City Council. Amendment No. 5 proposes to establish revised hourly rates of $650 per hour for LARC reimbursable matters and $400 per hour for City-paid items, along with updated rates for litigation services, legal counsel, and paralegal support. All other terms of the Agreement remain in effect. The table below summarizes the previous rate compared to the proposed rate.

Hourly Rate per
Amendment No. 4
Effective
2020-Present
Proposed Hourly Rate
per Amendment No. 5
Effective December 2025
Reimbursable
Rate $350 $650
City Rate $250 $400
Consistent with past practice, LARC-related legal expenses are reimbursable by the Los Alamitos Race Course or its successor. Only non-reimbursable City-initiated work unrelated to LARC would be billed at the standard City rate.

BUDGET IMPACT
LARC entitlement-related expenses are fully reimbursable by the applicant. Any City-initiated work outside of LARC matters would be billed at the updated standard rate and sufficient amounts are available in the General Fund budget.

LEGAL REVIEW
The City Attorney has reviewed the amendment as to form.
