General Plan Amendment GPA -04-21-014998, Planned Development PD -04-21-014997, Design Review DR- 04-21-015000, Major Subdivision SUB -04-21-014999 – Preliminary Plan review of a proposed Precise Plan for the redevelopment of the Serramonte Del Rey Campus at 699 Serramonte Boulevard
Associate Planner Carmelisa Morales Lopez presented an overview of the precise plan, discussing its development plan, timeline, conditions, phasing plan and required entitlements. Ms. Morales Lopez summarized the topics discussed during committee meetings such as impacts of preserving the community garden, the proposal’s addition of approximately 2 acres of park and open space, and timeline for the Affordable Housing Plan (AHP) approval.
Jefferson Union High School District (JUHSD) Board Trustees Kalimah Salahuddin and Andrew Lie discussed the District’s purpose and goals with the plan. Ms. Salahuddin indicated the approval of the preliminary plan would allow the school district to solicit an affordable housing developer partner.
According to the Trustees, the project would help fund the district by generating a steady revenue, raising teacher salaries to be competitive with other districts, retaining staff, funding student programs, supporting the City with its 1200+ units of housing, expanding green space on the property and providing a childcare program. Ms. Salahuddin stated JUHSD is fiscally prudent, provided a list of their supporters, and was in favor of continuing talks with the community to reach an amicable place regarding the development.
Mayor Daus-Magbual opened the public hearing.
The following speakers opposed the JUHSD plan as drafted , urging the Council to vote “No.” While some acknowledged the need for more housing and supported a livable wage for teachers, various issues were raised as flaws in the plan. These i ssues included: elimination of the community garden and Westmoor Park; construction of 14- story high-rise buildings; unaffordability of the market rate units and the low number of affordable units being proposed ( 10%); non-compliance from the City’s inclusionary housing ordinance; lack of transparency in the plan on generated revenue and teacher’s salaries; negative impacts to climate change; issues of gentrification and displacement; and a lack of a housing shortage.

3 The following speakers were in favor of JUHSD’s proposal and urged Council to support the district by voting to approve the plan. According to supporters, developing the site gives the opportunity to address several issues including: providing the district with a steady revenue source; providing much- needed affordable and market rate housing in the area; expansion of the green space and making it accessible for all abilities; retaining high-quality educators and addressing the high turnover rate through salary raises; providing students consistent and high-quality education; and addressing the state’s Regional Housing Needs Allocation (RHNA) requirements. Speakers noted the lack of viable options to address the district’s lack of funds and some rejected the idea of turning to taxpayers for those funds.

It was moved by Vice Mayor Buenaventura, seconded by Councilmember Manalo and carried to close the public hearing.
Discussion continued with Ms. Salahuddin and Mr. Lie addressing Council’s questions. Concerns included the potential to increase the affordable housing units to more than the proposed 10% (possibly to 20%); what type of outreach was done regarding the community garden; what steps were taken, if any, to try and preserve the garden; why it is not feasible to preserve the garden; clarifications for the placeholders on the green space; willingness to work with community members regarding the green space; clarification on the timeline for AHP approval; whether conditions can be added to the plan, and tower heights.
Mayor Daus-Magbual moved up the Council Committee Reports to hear the Affordable Housing Committee’s report. Councilmember Sylvester reported on the committee’s joint meeting with JUHSD, providing information on garden concerns and expressing concerns over building height and affordability among the six parcels. To support the plan, Councilmember Sylvester requested the following concerns be addressed and to be included as conditions: a maximum heigh t limit for the area ; a more equitable arrangement for the garden; increasing the affordability for units ; more information on community outreach; and prohibiting clustering of affordable units in Parcel C . Councilmember Manalo reported on the district’s willingness to work with the community on the design of the proposed community garden and how the plan deviates from the City’s housing ordinance. Councilmember Manalo and Vice Mayor Buenaventura voiced interest in a good faith effort of reaching 20% affordability, to which Ms. Salahuddin and Mr. Lie were amenable. Ms. Salahuddin also addressed some of the concerns raised.
It was moved by Vice Mayor Buenaventura and seconded by Councilmember Manalo to approve the preliminary plan and include the condition for a good faith effort to reach 20% affordability. Vice Mayor Buenaventura accepted Councilmember Manalo’s friendly amendment to include a good faith effort to achieve a mix of lower AMI levels.
It was moved by Vice Mayor Buenaventura, seconded by Councilmember Manalo and carried by the following roll call vote to adopt the resolution, as amended.

Recommended Action
Staff recommends that the City Council adopt a resolution to accept the completion of subdivision improvements for Minor Subdivision SUB-7-18-13562 (127 Werner Avenue Subdivision) and authorize the release of security deposit in accordance with the Subdivision Improvement Agreement.
Background
On October 22, 2018, the City Council approved the tentative map for Minor Subdivision SUB-7- 18-13562 located at 127 Werner Avenue. The tentative map allowed for the creation of two lots.
On October 28, 2019, the City Council approved the Subdivision Improvement Agreement and Parcel Map SUB-7-18-13562 for the 127 Werner Avenue Subdivision. The 127 Werner Avenue Subdivision is a development of two single-family homes developed by the Absolute Best Courtesy, LLC (Developer). City Council Meeting Agenda ReportItem # _____
Meeting Date: January 24, 2022
Subject: Authorize the City Manager or Designee to Execute a Three-year Agreement with Looking Point for Pure Storage Services
Recommended Action
Staff recommends that the City Council authorize the City Manager or Designee to execute a three- year agreement with Looking Point, Inc. for Pure Storage to be the City’s enterprise storage solution.
Background
The Information Services Division (ISD) maintains an enterprise data storage environment for the City. The overall goal of ISD’s network server hardware update cycle is to ensure that server storage and network resources are secure, up-to-date, cost effective, and available to all users while still considering available budget resources. To achieve this goal, the City needs to replace an eight- year-old server storage area network (“SAN”). The current SAN hosts all the City’s mission critical server data and information. Failure of the SAN will cause interruption and delay to daily operations. To further minimize computer problems and risk, it is essential that the City replace obsolete SAN hardware for performance, functionality, and security. Accordingly, staff recommends adopting a comprehensive approach to enterprise data storage using a modern storage solution with a Gartner globally-recognized industry leader, Pure Storage.
Discussion
The City’s current SAN reached its End of Life on October 31, 2017 and will no longer be supported after October 31, 2022. Even under current support, the SAN has failed to update software versions properly multiple times.
For the replacement enterprise data storage solution, the primary goals include performance, reliability, support, and a leader in the Gartner Magic Quadrant market research analysis. ISD performed research across the industry seeking solutions to meet these goals. The team utilized analysis from Gartner along with reviewing technical documentation, participating in product demonstrations, and interviewing technical staff from other municipalities to formulate a plan for meeting these goals. Based on this analysis, Pure Storage has been selected as a best fit and value for the City’s enterprise data storage solution. The price of the Pure Storage solution is competitive compared to the other quoted solutions and takes advantage of new technology related to cybersecurity, deduplication, and redundancy while still being affordable. For example, in terms of cybersecurity, the Pure Storage solution offers point-in-time snapshots, which are copies of data as it appeared at any given point in time and are used as a method of data protection. In the event of a cyberattack or failure, staff could restore data from the most recent snapshot before the failure with minimal downtime. Additionally, the Pure Storage solution utilizes data deduplication, which is a space-saving technique to ensure that only unique data is stored on the server thereby saving space.
Moreover, data redundancy offers an extra layer of protection by replicating data to an additional system to serve as an alternative backup method.
City Council Agenda Report
Subject: Authorize the City Manager or Designee to Execute a Three-year Agreement with Looking Point for Pure Storage Services
After an initial solutions demo, a competing enterprise data storage solutions vendor was invited to submit a proposal. After numerous failed attempts for response, the vendor was eliminated from consideration.
Fiscal Impact
The fiscal impact of replacing and enhancing our current enterprise data storage solution is $132,939.05 and includes three years of vendor support. Funds for this purchase are available in ISD’s current operating budget. The advantages gained by this expense are manifold, as it will provide us with a modern enterprise data storage solution that will guarantee performance and reliability for the foreseeable future.
Summary/Conclusion
Staff recommends authorizing the City Manager to execute a three-year agreement with Looking Point, Inc. for Pure Storage to be the City’s enterprise data storage solution in the full amount of $132,939.05.
Staff is available to provide any additional information desired by the Mayor or Councilmembers.

City Council Agenda ReportItem # _____
s
Meeting Date: January 24, 2022
Subject: Setting Time and Place for a Public Hearing for General Vacation of Public Access, Ingress and Egress Easement, and to Initiate Advertisement in Newspaper and Posting of Notices along parking lot at 2171 Junipero Serra Boulevard (APN 002-342-240)
Recommended Action
Staff recommends that the City Council, in accordance with Streets and Highways Code General Vacation Procedure [8320 - 8325]:
1. Set February 14, 2022, as the date and time for a public hearing for general vacation of a public access, ingress and egress easement; and
2. Direct staff to initiate advertisement in the newspaper and posting of notices along parking lot at 2171 Junipero Serra Boulevard.
Background
On June 11, 2021, the Planning Division approved the Administrative Design Review Permit, DC-11-20-014774, to install vehicle control gates with a condition of approval that required the vacation of the Public Access, Ingress and Egress Easement (Resolution No.00-271) prior to issuing building permits for the project.
On December 13, 2021, the Planning Commission determined the vacation is consistent with the City’s General Plan. The City Attorney reviewed the request and found that the vacation is necessary to allow for the installation of vehicle control gates at both sides of the parking lot on the property to prevent unauthorized parking. The easement was intended for public access, ingress and egress between Westlake Avenue and Citrus Avenue. There is no longer a need for the easement since the existing parking lot does not provide access to Westlake Avenue from Citrus Avenue and only functions as a private parking lot for the existing office building.
The Streets and Highways Code General Vacation Procedure [8320 - 8325] requires a public hearing, newspaper advertisement, and posting of notices for a general vacation of an easement.
Summary/Conclusion
Staff recommends that the City Council, in accordance with Streets and Highways Code General Vacation Procedure [8320 - 8325]:
1. Set February 14, 2022, as the date and time for a public hearing for general vacation of a public access, ingress and egress easement; and
2. Direct staff to initiate advertisement in the newspaper and posting of notices along parking lot at 2171 Junipero Serra Boulevard.

City Council Agenda ReportItem # _____
Meeting Date: January 24, 2022
Subject: Award a Purchase Contract for one (1) Caterpillar Model 906M Compact Wheel Loader
Recommended Action
Staff recommends the City Council approve and authorize the City Manager, or her designee, to execute, a purchase order with Peterson CAT in the amount of $117,877.45 for the purchase of one Caterpillar Model 906M Compact Wheel Loader.
Background
Loaders are a critical piece of construction equipment used by staff in the Water and Wastewater Resource Department. Staff use loaders as a primary tool to move and relocate loose material used for the construction and repair of underground water and wastewater pipes. The Department operates two combination backhoe loaders and one loader. The equipment being replaced is a loader which is 25 years old. The estimated useful life of this type of equipment is 15 years or when the engine reaches 5,000 hours.
Discussion
The Fleet Maintenance Section of Public Works has seen measurable increase in the amount of “down time” due to wear and tear of the existing loader. Approval for the purchase of this new loader will provide the user department with improved availability (less “down time”) and improved operational ability compared to what they have been experiencing with the older unit. Replacing the older unit will also address requirements from the California Environmental Protection Agency (Cal- EPA) and Air Resources Board (CARB) to replace older, more polluting diesel equipment/vehicles with newer cleaner-burning models.
The California Government Code authorizes public agencies to participate in cooperative purchasing agreements, like those established by Sourcewell, while still adhering to the City's Municipal Code and adopted rules and procedures for the procurement of vehicles and equipment. By utilizing a cooperative purchasing program, the City can streamline the process of procuring vehicles and equipment. Staff have reviewed the Sourcewell contract documents to ensure the pricing is aligned with the quote provided by Peterson CAT.
As part of the purchase, Peterson CAT has agreed to provide a trade in allowance totaling $6,000.00 for the existing loader.
Fiscal Impact
Sufficient funding for the purchase of the Caterpillar Model 906M Compact Wheel Loader is available in the Fiscal Year 2021-22 Motor Vehicle Replacement Fund Account 51-315-453-4558.
Approve the Purchase of a Caterpillar Compact Loader
Meeting Date: January 24, 2022
Summary/Conclusion
Staff recommends the City Council approve and authorize the City Manager, or her designee, to execute, a purchase order with Peterson CAT in the amount of $117,877.45 for the purchase of one Caterpillar Model 906M Compact Wheel Loader.
Staff is available to provide any additional information desired by the Mayor or Councilmembers.
