City Council Agenda ReportItem # _____
Meeting Date: April 10, 2023
Subject: Amendment to the Professional Services Agreement with Swinerton for Project Management and Construction Support Services for Various Projects Recommended Action
Staff recommends that the City Council authorize the City Manager to execute Amendment No. 1 to the professional services agreement with Swinerton Builders DBA Swinerton Management & Consulting, Inc. of San Francisco, California, to include project management and construction support services for the Civic Center North Rooftop HVAC System Replacement & Tenant (HR) Improvements Project, Serramonte Library Improvements Project, and Fire Station 94 Improvements Project.

Background
On July 25, 2022, an agreement was executed with AGS, Inc. (AGS) to provide project management (procurement of design services) and construction support services (inspection and materials testing) for Civic Center North Rooftop HVAC System Replacement & Tenant (HR) Improvements, Serramonte Library Improvements, and Fire Station 94 Improvements projects in an amount not-to-exceed $309,292.90. Due to lack of performance from AGS under the terms of its contract, the City terminated the agreement with AGS in January 2023.

On November 14, 2022, an agreement was executed with Swinerton Builders DBA Swinerton Management & Consulting, Inc. (Swinerton) to provide project management and construction support services for the City Hall HVAC & Civic Center Generator Replacement, Doelger Art Center HVAC & Roof Replacement, and War Memorial HVAC Replacement projects in an amount not to exceed $264,565.00. Due to the termination of the agreement with AGS, staff approached Swinerton and requested a proposal to perform the services under the proposed Amendment No. 1.

Discussion
Swinerton has sufficient staff and the qualifications needed for the additional scope of work proposed under Amendment No. 1 for Civic Center North Rooftop HVAC System Replacement & Tenant (HR) Improvements, Serramonte Library Improvements, and Fire Station 94 Improvements projects. Construction of the three projects is anticipated to commence in 2024 and be completed in 2024 and 2025.

The scope of professional services includes, but is not limited to the following elements:
•Coordinate with city departments regarding plans for each facility •Project scoping

•Compliance with funding requirements and deadlines
•Oversee and manage the development of design plans, specifications, and construction cost estimates (PS&E), with said PS&E being developed by a consultant firm to be selected at a later date

The proposed professional services agreement does not include full design and development of plans, specifications, and estimates (PS&E) at this time. Swinerton would assist the City to procure and manage the design services for full PS&E development for each project, and would oversee additional consultants and contractors on the City’s behalf.

Fiscal Impact
The proposed Amendment 1 would increase the contract amount by $299,754.00 for a total not-to- exceed contract amount of $564,319.00.

CITY OF DALY CITY

CITY HALL
333 – 90th Street
Daly City, CA 94015

RE: Proposal for Project and Construction Management Services Serramonte Library, Civic Center North, and Fire Station 94 Improvement Project Dear Mr. Fehr:

Swinerton Management and Consulting (Swinerton) is honored that you have selected us to take over the subject projects. We hope that we have demonstrated to you that we understand the project delivery process as shown during our engagement with the City Hall HVAC/Generator replacement project. We understand that these are Federal Grant funded projects and time is of the essence to not lose the grant. We are pleased to submit this proposal to the City of Daly City to assist you with the project management and construction management services for the Serramonte Lib rary (HVAC, roof, ADA upgrades, elevator addition), Civic Center North (HVAC, HR tenant improvements), and Fire Station 94 (breakroom installation, sleeping quarter and training room upgrade projects). This proposal is being made in response to your email message on January 24, 2023.

We understand that the Serramonte Library project has suffered delay and is on the critical path. The budget for that project is $2.6 Million. Our goal is to move quickly to get a designer on board for the Serramonte Library project to make up time that has been lost. We will then follow up with separate RFP’s to procure designers for the Civic Center North ($1.7 Million) and the Fire Station 94 projects (1.4 Million) on board to carry out those designs concurrently. One challenge for these projects is that we will have to minimize impacts to the operation of the facilities. Another challenge is the long lead time for generators (54 weeks!), switchboards and transformers (35 weeks) and air handling units (40-50 weeks). We will work to develop strategies to mitigate these challenges. We understand that grant administration should not be a big task and will do what we can to assist.

Our task will include:
▪ Define scope of work
▪ Understand stakeholders’ need
▪ Develop RFP package to retain one or more design consultant(s) ▪ Design management including budget control
▪ Assist in the preparation of Bid Documents
▪ Constructability review
▪ Review and respond to RFI’s
▪ Review and respond to PCO’s
▪ Negotiate PCO’s and prepare recommendations
▪ Draft and Process CCO’s
▪ Review and Process Payment
▪ Draft and issue weekly statement of working days (WSWD’s) ▪ Prepare, review and file daily inspection reports
▪ Prepare daily construction progress photos
▪ Other construction tasks as needed
▪ Procure and/or provide building and special inspections such as mechanical and waterproofing

PROPOSAL LETTER

Page 17 of 79 ends

Peter Vorametsanti and Wanda Wong will oversee this project and be available to assist at any time during the project. Mr. Luis Guiulfo, will serve as the Project Inspector/Engineer, and will be responsible for day-to-day tasks.

Mr. Hany Gad will also provide his expertise in system controls and integration on an as needed basis. We will also be able to supplement this team with a qualified inspector as we move into the construction phase.

The fee proposal for the project is attached to this letter along with Ms. Wong, Mr. Guiulfo, and Mr. Gad’s resumes and a tentative project schedule. The additional project management and construction support services is estimated to cost $299,754, bringing the total not-to-exceed agreement cost to $564,319.

Thank you for the opportunity to serve the City of Daly City for the past several years. If you have any questions, please do not hesitate to contact me at 415-984-1239, or my cell phone at 650-483-7412, or by email at [email protected].

This standard of prudence shall be applied in the context of managing an overall portfolio. B. Collateralization
Collateralization is required on two types of investments: time certificates of deposit whose combined principal and interest exceed FDIC Insurance Limit and repurchase (and reverse repurchase) agreements. In order to anticipate market changes and provide a level of security for all funds, the collateralization level is 110% of market value of principal and accrued interest for government securities pledged as collateral, or 150% for first trust deeds pledged as collateral. Collateral will be held by the independent third-party custodian selected by the City.

VII. DIVERSIFICATION, MAXIMUM MATURITIES, AND CREDIT QUALITY The City will diversify its investments by security type, maturity, and institution in order to reduce market and credit risks associated with concentrating investments in specific security types, maturity segments, or in individual financial institutions. Diversification strategies shall be established by the Treasurer and will be determined based on our investment objectives of Safety, Liquidity, and Return. There is no minimum Portfolio percentage and/or dollar limit for diversification. The maximum Portfolio percentage and/or dollar limits for diversification are indicated in Section VI, Authorized and Suitable Investments.

Investments into the State of California Local Investment Fund and the San Mateo County Investment Pool meet our diversification requirements.

To the extent possible, the City will attempt to match its investments with anticipated cash flow requirements. Generally, no investment shall be made in any security which, at the time of the investment, has a term remaining to maturity in excess of five years. However, the City Council specifically grants the authority to the City Treasurer to invest a maximum of $14,000,000 of the City’s portfolio in Government National Mortgage Association securities which, at the time of investment, have terms remaining to maturity in excess of five years. Additionally, the City Council may grant express authority to exceed this term for this or other individual investments.

Credit quality will be A or above including modifiers for fixed income securities and Al/Pl for commercial paper. In the event of credit downgrades after purchase, sale of the security will be evaluated on a case by case basis.

No more than 5% of the portfolio may be invested in any one issuer, excluding Treasuries and Federal Agency issuers, Local Agency Investment Fund (LAIF), San Mateo County Treasurer’s Pool, and FDIC Insured/ Collateralized investments.

VIII. PERFORMANCE
The investment portfolio will be managed in accordance with the parameters specified within this policy. The portfolio should obtain a market average rate of return during a market/economic environment of stable interest rates.

The portfolio’s performance will be monitored and evaluated relative to comparable

Page 38 of 79 ends
Page 8 ends

2023
duration/comparable average maturity benchmarks (such as U.S. Treasury bills/notes) or alternative investment options. The use of benchmarks is to provide a comparison rather than to establish a predetermined target rate of return. The Treasurer shall not add additional risk to the portfolio in order to attain or exceed the benchmark.

IX. INVESTMENT REPORTING
The City Treasurer will make quarterly reports to the City Council. The reports will include the following informational items:
•A listing of all securities, investments, and moneys held by the City, showing the type of investment, issuer, date of maturity, rate of interest earned over the quarter, par, and dollar amount invested.
•A description of any of the City’s funds, investments, or programs that are under the management of contracted parties, including lending programs. •With respect to all securities held by the City, and under management of any outside party that is not also a local agency of the State of California Local Agency Investment Fund, the report shall also include a current market value as of the date of the report, and shall include the source of this same valuation.
•The transaction details of any transactions in the City’s portfolio, including reinvestments, purchases, and sales of securities.
•A statement that the portfolio conforms to this Statement of Investment Policy or the manner in which the portfolio is not in compliance.
•A statement of the City’s ability to meet its cash pool expenditure requirements for the next six months or provide an explanation as to why sufficient money shall, or may, not be available.

X. AUTHORITY TO INVEST MONIES
Pursuant to Government Code § 53600 et. Seq., with the annual adoption of this Statement of Investment Policy, the City Council hereby delegates the authority to invest or reinvest funds of the City, and sell or exchange securities so purchased, to the City Treasurer for a one-year period, who will thereafter assume full responsibility for those transactions until the delegation of authority is revoked or expires, in accordance with this Statement of Investment Policy.

XI. ADOPTION

XII. APPENDIX A-INVESTMENT TYPES

DEPOSITORY SERVICES
Active deposits are demand or checking accounts which receive revenues and pay disbursements.

Interest-bearing active deposits are money market accounts at a financial institution (i.e., bank, savings and loan, credit union). These accounts are demand accounts (i.e., checking accounts) with restricted transaction activity.

Inactive deposits are certificates of deposit issued in any amount for periods of time as short as fourteen days and as long as several years. Interest must be calculated on a 360-day basis, actual number of days.

Passbook savings accounts are similar to inactive deposits except they are not for a fixed term.

The interest rate is typically lower than for CDs.

INVESTMENT SECURITIES
U.S. TREASURY ISSUES are direct obligations of the United States Government. These issues are as follows:
•Treasury Bills are issued weekly with maturity dates from 13 weeks up to one year. They are issued and traded on a discount basis and are also known as discount securities.

Interest is computed on a 360-day basis, actual number of days. They are issued in amounts of $10,000 and up in multiples of $5,000 and are a highly liquid security. •Treasury Notes are initially issued with two to 10-year maturities. They are actively traded in the secondary market and are very liquid. The Treasury may issue notes with a minimum of $1,000, however, $5,000 is more common.
•Treasury Bonds are long-term securities having initial maturities of more than 10 years.

FEDERAL AGENCY obligations ("Agencies") are securities issued by U.S. Government agencies or quasi-government agencies in order to supply credit to various classes of institutions or individuals. These issues are guaranteed directly or indirectly by the United States Government. All agency obligation qualifies as legal investments and are acceptable as security for public deposits. They usually provide higher yields than regular Treasury issues and have many of the same advantages. Examples are:

•Federal Farm Credit Bank (FFCB) are notes and bonds used to finance the short and intermediate needs of farmers. They are issued monthly with three- and six-month maturities. The FFCB issues larger issues (one to ten years) on a periodic basis. Interest is calculated on a 360-day, 30-day month basis.
•Federal Home Loan Bank (FHLB) notes and bonds are issued by the FHLB to help finance the housing industry. These securities provide liquidity and mortgage credit to savings and loan associations, mutual savings banks, cooperative banks, insurance companies and mortgage-lending institutions. They are issued irregularly for various maturities. The minimum denomination is $5,000. The notes are issued with maturities of less than one year and interest is paid at maturity. The bonds are issued with various maturities and carry semi-annual coupons. Interest is calculated on a 360-day, 30-day month basis.
•Federal National Mortgage Association (FNMA) Fannie Maes are used to assist the home mortgage market by purchasing mortgages insured by the Federal Housing Administration and the Farmers Home Administration, as well as those guaranteed by the Veterans Administration. They are issued about four times a year for maturities ranging from a few months to eight years. They are issued in minimum denominations of $10,000. They carry semi-annual coupons. Interest is computed on a 360-day, 30-day month basis.
•Federal Home Loan Mortgage Corporation (FHLMC) Freddie Mac is a publicly chartered agency that buys qualifying residential mortgages from lenders, packages them into new securities backed by those pooled mortgages, provides certain guarantees, and then resells the securities on the open market.
•Government National Mortgage Association (GNMA) Ginnie Mae is a government owned corporation and an agency of the U.S. Department of Housing and Urban Development. GNMA guarantees, with the full faith and credit of the U.S. Government, full and timely payment of all monthly principal and interest payments on the mortgage- backed pass-through securities of registered holders. The securities, which are issued by private firms such as mortgage bankers and savings institutions, and which are typically marketed through security broker/dealers, represent pools of residential mortgages.

TIME CERTIFICATES OF DEPOSIT are investments for inactive funds issued by banks, savings and loans and credit unions. Investments of $250,000 are insured by Federal Deposit Insurance Corporation (FDIC). Certificates of Deposit can be issued from 14 days to several years in maturity. For deposits exceeding $250,000 we require that financial institution collateralize at 110%.

NEGOTIABLE CERTIFICATES OF DEPOSIT are unsecured obligations of the financial institution. These securities are generally issued in bearer form and pay interest at maturity.

Although negotiable, a strong secondary market exists only in the NCD's issued by the largest United States banks. These securities generally trade with minimum amounts of $l million per trade with the average trade in the secondary market of $5 million.

MEDIUM TERM CORPORATE NOTES are unsecured promissory notes issued by a corporation organized and operating in the United States. These are negotiable instruments and are traded in the secondary market. Medium Term Corporate Notes can be defined as extended maturity commercial paper. Corporations use these notes to raise capital. Examples of issuers are General Electric Credit Corporation, ExxonMobil, Chevron, Consolidated Edison, etc.

LOCAL AGENCY INVESTMENT FUND (LAIF) The Local Agency Investment Fund was established by Chapter 730, Statutes of 1976. This fund enables local governmental agencies or trustees to remit money not required for immediate needs to the Treasurer for the purpose of investment. In order to derive the maximum rate of return possible, the Treasurer has elected to invest these monies as a part of the PMIA.

Each participating agency determines the length of time its money will be on deposit with the Treasurer with the exception of bond proceeds, which must remain for a minimum of 30 days. At the end of each calendar quarter, all earnings derived from investments are distributed by the Controller to the participating government agencies in proportion to each agency’s respective amounts deposited in the LAIF and the length of time such amounts remained. Prior to the distribution, the State’s reasonable costs of administering the program are deducted from the earnings.

MONEY-MARKET MUTUAL FUNDS Shares of beneficial interest issued by diversified management companies that are money market funds registered with the Securities and Exchange Commission under the Investment Company Act of 1940 (15 U.S.C. Participants in derivatives markets include dealers and end users (including financial institutions, commercial firms, mutual funds, pension funds, state and local governments) and entities that use derivatives to hedge financial risks or to speculate.

FINANCIAL FUTURES AND FINANCIAL OPTIONS are forward contracts for securities and is a type of derivative. The government code states that a local agency may incur future contracts/options in any of the investment securities enumerated in § 53601, a-m. DISCOUNT RATE The discount rate is the interest rate charged to depository institutions when they borrow from their district Federal Reserve banks. Changes in the federal funds rate may be done without changing the discount rate.

FEDERAL OPEN MARKET COMMITTEE (FOMC) Consists of seven members of the Federal Reserve Board and five of the twelve Federal Reserve Bank Presidents. Meeting Date: April 10, 2023
Subject: Amend Traffic Regulations to install a 98 ft-bus stop zone in front of 2630 Bayshore Boulevard (TSR 23/42).

Recommended Action
Recommend the City Council amend the City’s traffic regulations to install a 98 ft-bus stop zone in front of 2630 Bayshore Boulevard, enforceable Monday through Friday, from 7:00 am – 9:00 am.

Background
On January 12 and February 9, 2023, the City’s Traffic Safety Committee met and reviewed various requests for traffic improvements, signage and pavement markings, and recommended that the City Manager proceed with amending the aforementioned traffic regulations.

Discussion
The amendment to the traffic regulations is recommended for the following reason:

San Francisco Municipal Transportation Agency (SFMTA) staff requested the 98 ft-bus stop zone to address a restroom access issue for SFMTA bus drivers. The bus stop zone would allow the bus operators to park the bus while they access their restroom at the intersection of Bayshore Boulevard and Sunnydale Avenue. Other nearby areas were evaluated but were not deemed suitable or were not available.

Fiscal Impact
Funding is available for the proposed signs and/or markings in the Street Maintenance operating budget 17-314-330 for the current Fiscal Year 2022-2023. Staff will also request reimbursement from SFMTA for the new signs.

Summary/Conclusion
Recommend the City Council amend the aforementioned traffic regulations.

Staff is available to provide any additional information desired by the Mayor or Councilmembers.

Respectfully submitted,
Shirley Chan Richard Chiu, Jr.,
Traffic Engineer Director of Public Works

Notice of Public Hearing for Proposed Water Rates will be mailed to customers by the week of April 28, 2023.

Discussion
The proposed water rates are based on a Water Rate Study that was developed by City staff, financial consultants from Hilton, Farnkopf, and Hobson, and were reviewed by the City Council Water Committee on March 20, 2023. If the City Council authorizes the Public Hearing on the June 12th Council Meeting, staff and consultants will present the assumptions and details of the Water Rate Study to the Council and the public. The Council will then make the determination to adopt the new Water Rates as presented.

Conclusion/Recommendation
Staff recommends the City Council set the time and place of a Public Hearing for proposed Water Rates for 7:00 p.m. on Monday, June 12, 2023, initiating the Proposition 218 process and beginning the 45-day comment period.

Meeting Date: April 10, 2023
Subject: Setting Time and Place for Public Hearing to Consider Five-Year Consolidated Plan for FY 2023/24-27/28 and One-Year HUD Action Plan for Fiscal Year 2023-24
Recommended Action
Set a Public Hearing for Monday, April 24, 2023 for the purpose of citizen review and comment on Daly City’s Five-Year HUD Consolidated Plan for Fiscal Years 2023-24 through 2027-28 and the One-Year Action Plan under the Community Development Block Grant (CDBG) and HOME programs for FY 2023-24.

Background
The Five-Year HUD Consolidated Plan provides a blueprint for the City’s Housing and Community Development activities. The Plan includes an extensive evaluation of needs, sets priorities and identifies types of activities that will be carried out utilizing Community Development Block Grant (CDBG) and HOME programs for fiscal years 2023-24 through 2027-

28. The One-Year Action Plan describes the specific allocation of CDBG and HOME funds to various activities for FY 2023-24. Prior to Council adoption of the Five-Year and One-Year plans, the Department of Housing and Urban Development (HUD) requires the City to hold a public hearing to allow for citizen comment on proposed priorities, activities and funding levels.

Discussion
CDBG funds can be used for various activities including Administration, Economic Development, Capital Projects, Housing and Public Services. HOME funds may be used for activities that expand the supply of decent, affordable housing for lower income families.

Pursuant to the City’s Citizen Participation Plan, the draft Five-Year Consolidated Plan and the One-Year Action Plan will be available at City Hall and all City libraries for a 30-day review and comment period beginning March 23, 2023 through April 24, 2023. Notice of the availability of this document and a summary of the draft Action Plan will be published in The Examiner Peninsula and made available on the City’s web site.

Staff is available to provide additional information desired by the Mayor or Council Members.
