Meeting Date: May 8, 2023
Subject: Approve FY 2023-24 Project List for Road Maintenance and Rehabilitation Account Funds Authorized Under SB 1
Recommended Action
Recommend the City Council adopt a Resolution approving the FY 2023-24 Project List for SB 1 Road Maintenance and Rehabilitation Account Funds
Background/Discussion
SB 1 (Beall) was filed with the Secretary of State on April 28, 2017. The bill established a Road Maintenance and Rehabilitation Account (RMRA) in the State Transportation Fund that is intended to address deferred maintenance on the state highway system and the local street and road network.

As written, SB 1 requires the California Transportation Commission (CTC) adopt criteria to ensure efficient use of these funds. The RMRA funds will be provided to cities on a monthly basis along with traditional gas tax monthly disbursements, with the first distribution in January 2018.

A city or county must submit a project list and supporting documentation to the CTC each year, which means the FY23-24 project list will need to be submitted by July 1, 2023. Public Works staff recommends using the RMRA funds for the design and construction of street resurfacing projects identified in the City’s five-year Street Resurfacing Master Plan as well as the City’s ten-year Capital Improvement Plan (CIP). The City’s 2023-24 Street Resurfacing project is planned to be combined with the 2024-25 Street Resurfacing project to design and perform pavement rehabilitation on Geneva Avenue between Schwerin Street and Bayshore Boulevard and on Bayshore Boulevard between the City of Daly City/City of Brisbane city limits and the City of Daly City/City and County of San Francisco city/county limits. The 2023-24 and 2024-25 Street Resurfacing projects will be designed in FY2023-24 and constructed in FY2024-2025.

Fiscal Impact
The approval of this recommendation will satisfy the CTC Project List requirement to receive SB1 funds in the amount of approximately $2.5 million.

Summary/Conclusion
Recommend the City Council adopt a Resolution approving the FY 2023-24 Project List for SB 1 Road Maintenance and Rehabilitation Account Funds.

Staff is available to provide any additional information desired by the Mayor or Councilmembers.

City Council Agenda ReportItem # _____
Meeting Date: May 8, 2023
Subject: Public Hearing - Proposed Increases and Updates to the Daly City Master Fee Schedule
Recommended Action
Staff recommends that the City Council adopt a resolution approving the proposed increases and updates to the Daly City Master Fee Schedule.

Background
At its meeting on July 11, 2022, the City Council adopted the Daly City Master Fee Schedule for FY 2023. The revised fee schedule included updated user fees for Building, Code Enforcement, Finance, Fire, Planning, Police, and Public Works as outlined in the May 2022 Daly City User Fee Study. At that meeting, the City Council agreed to review the Master Fee Schedule and any proposed increases and updates to the Schedule on an annual basis. The City Council also agreed with staff’s recommendation to update the user fees incorporated into the Master Fee Schedule on an annual basis consistent with the negotiated Cost of Living Adjustment (COLA) in that year.

Discussion
As part of the preparation for the FY 2024 proposed budget, Finance staff asked Departments to review and update the Master Fee Schedule. All the proposed updates and increases are included in Attachment A, Proposed FY 2024 Daly City Master Fee Schedule – Edited, and Attachment B, Proposed FY 2024 Daly City Master Fee Schedule – Clean.

The COLA for FY 2024 is four percent (4%), and Finance staff asked Departments with user fees to review whether to apply the 4% increase to their development fees and other permits, charges, and enforcement services. Most of the user fees, including fees in Building, Code Enforcement, Fire, Planning, and Public Works are recommended to increase by 4%. However, only some of the user fees in the Finance Department and the Police Department are proposed to increase by 4% given the nature of the fees. Staff is not recommending changes to the AB 1600 fees or the fees in the Department of Water and Wastewater Resources at this time, as these are being considered under a separate study.

Finance staff also asked the Library and Recreation Services Department if they had any program fee updates since they were not part of the fee study in May 2022 and did not update fees at the July 2022 meeting. The Library Division has a minor update to their fees and the Recreation Division is recommending several changes and increases to their program fees. The Recreation Division has not updated fees since 2018, and they have used this year’s Master Fee Schedule update to consolidate their fees, consider changes from the pandemic, and apply increases to help cover increased costs in staffing, contractor and material expenses, and facility maintenance. All the proposed changes to the Recreation Division fees are included in the proposed Master Fee Schedule and the rationale behind each update or increase is listed in Attachment C, Recreation Proposed Fee Updates – Details.

Finally, as part of the Master Fee Schedule update, each Department reviewed their fees and made changes to correct errors and ensure that the Master Fee Schedule appropriately summarized their

Page 2 of 2 ends

existing fees. Thus, some existing fees are added that were not included in the FY 2023 Master Fee Schedule.

Fiscal Impact
Although most of the fees in Building, Code Enforcement, Fire, Planning, and Public Works will increase with the proposed Master Fee Schedule updates, staff does not anticipate a significant increase in revenues for FY 2024. Staff in Economic and Community Development has started to see some slowing in development, which has started to affect overall permit fee revenue. Finance staff estimates that the proposed fee increases will help maintain revenues at their current levels in these areas. However, staff will continue to monitor development revenues and will bring any updates to the revenue estimates at the FY 2024 mid-year adjustments.

At the same time, the proposed increases to program fees in Recreation are expected to bring in about $250,000 in additional revenue in FY 2024.

Summary/Conclusion
Staff recommends that the City Council adopt a resolution approving the proposed updates and increases to the Master Fee Schedule as listed in Attachment A.

Staff is available to provide any additional information desired by the Mayor or City Councilmembers.

City Council Meeting Agenda ReportItem # _____
Meeting Date: May 8, 2023
Subject:Introduction of Ordinance Adding Chapter 9.60 Re: Firearm Safe Storage Recommended Action
Staff recommends the City Council conduct a public hearing and introduce the attached ordinance adding Chapter 9.60 to the Daly City Municipal Code adopting a Firearm Safe Storage requirement.

Background
On March 27, 2023, Council set April 24, 2023, during the regularly scheduled council meeting, as the time and place for the first reading and public presentation of the attached ordinance for Firearm Safe Storage. During the April 24 meeting, additional recommendations were made and have been addressed in this amended ordinance for this first reading.

Discussion
Research shows access to unsecured firearms can have significant impacts on intentional and accidental injury and death rates, especially involving youth, and often with substantial inequities by race, ethnicity, and socioeconomic status. While the best prevention is to remove firearms, the next best solution is to ensure safe and secure storage to prevent unintended access. This firearm safe storage ordinance requires any firearm as defined in the California Penal Code, capable of firing a projectile, which is kept or stored in any residence, be properly secured, or safely stored in an approved locked container. The container or trigger lock/cable should be listed on the California Department of Justice Bureau of Firearms roster of approved firearm safety devices. Additionally, any padlock type device used to secure a locking container shall be constructed of steel or other comparable strong heavy metals, and keyed locks shall require a key specific to the lock being used.

This ordinance would not apply to a legally possessed firearm on one’s person inside of a residence, or to the timely reporting of a lost or stolen firearm in violation of the ordinance, so as not to prevent crucial tracking of these firearms in databases. Any violation of this ordinance shall be subject to civil penalties through the city.

This ordinance, in conjunction with other applicable codes, will further support and encourage the safe storage of firearms in residences. The police department will make this ordinance and other applicable codes available via a link on our website. Through this link, we will also provide the process to obtain a cable lock for Daly City residents, as well as inform the public about the process to voluntarily surrender firearms for destruction. Additionally, we will share this information with our school districts for consideration for distribution to parents to support safety of children.

ORDINANCE NO.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DALY CITY ADDING CHAPTER 9.60 TO THE DALY CITY MUNICIPAL CODE REGARDING

BE IT ORDAINED by the City Council of the City of Daly City, as follows:

SECTION 1.The City Council hereby adopts this Ordinance to add Chapter 9.60 to Title 9 of the Daly City Municipal to read as follows:

9.60.010 Findings and Purpose.

The city council finds and determines that:

A. Firearm injuries have a significant public health impact; and B. Keeping a firearm locked while in a residence when it is not being carried ensures that it cannot be accessed and used by others without the owner's knowledge or permission, and this simple measure significantly decreases the risk that the firearm will be used to commit suicide, homicide, or inflict injury, whether intentionally or unintentionally.

The purpose of this chapter is to require the safe storage of firearms in a residence.

The City Council finds that the foregoing recitals are true and correct and are hereby incorporated into the Ordinance by this reference

A violation of this section shall be subject to enforcement through civil penalties, as provided herein.

A. Civil Penalties. The city may pursue any civil remedies available under the law.

B. Separate Offense. Each violation shall be deemed a distinct and separate offense. Payment of a penalty shall not excuse or discharge any continuation or repeated occurrence of a violation.

9.60.050 Amount of Civil Penalties
The amount of a penalty imposed for any violation of this Chapter shall be $100.00 for a first violation, $200.00 for a second violation within twelve (12) months, and $500.00 for third and additional violations within twelve (12) months.

The City Council hereby declares that it would have passed this Chapter and each and every section, subsection, sentence, clause, phrase, and word not declared invalid or unconstitutional without regard to whether any other portion of this Chapter or application thereof would be subsequently declared invalid or unconstitutional.
