Hexagon has the following recommendations resulting from the evaluation of site access and parking demand.
• The street parking south of the St. Francis Boulevard driveway and west of the two Southgate Avenue driveways should be prohibited by painting 25 feet of red curb. • The site plan shows a new trash enclosure would be located within this dead-end aisle near the St. Francis Boulevard driveway. The project should prepare a trash pick-up plan that shows how garbage collection vehicles would service this enclosure to ensure it would not impede movements to and from the St. Francis Boulevard driveway. • Chowking should use traffic cones and/or staff during peak periods to direct drive-through traffic to continue past the first east-west drive aisle after entering the site from Southgate Avenue to ensure that any excess drive-through queue is contained within the parking lot and does not impede traffic entering the shopping center from Southgate Avenue.

3. A 40% and 50% pass-by trip reduction was applied for Shopping Plaza (40-150k) and Fast Food Restaurant with Drive-Through Window, respectively, based the ITE average pass-by rates. Pass-by trip reductions were applied to the external trips (after reductions for internal captured trips).

Dear Mr. Chiu:
On behalf of Daly City’s Bicycle and Pedestrian Advisory Committee (B/PAC), we would like to express our concern regarding the proposed new drive thru restaurant at 79 St. Francis Square.
As a committee tasked with improving pedestrian and bicycle safety in Daly City, we oppose the drive thru being proposed at 79 St. Francis Square. We believe a drive thru at this location would negatively impact pedestrian and bicycle safety because:
1. The site is located along a High Injury Network, streets with a high concentration of fatalities and serious injuries for pedestrians, bicyclists, and motorists and adding a drive thru will make it even more dangerous
2. The site is located along a route used by many children to go to Daniel Webster Elementary School, Thomas Edison Elementary School, and Fernando Rivera Middle School and research has shown that children are at a greater risk of being involved in a vehicle collision because of proximity to drive-thrus
We have seen the many negative impacts drive thrus have had on our community from cars blocking sidewalks to cars queuing on public streets, to poor air quality from cars waiting in the drive thru lines.
While we are excited to have more restaurants in our city we do not support having a drive thru at this location and we respectfully request that the project applicant remove the drive thru component from their proposal.

Dear Planning Commissioners,
My name is Melinda and I am a parent of a future kindergartner at Thomas Edison. We are excited for the fall when we can walk our son to and from school. I am also a member of the Daly City Bicycle and Pedestrian Advisory Committee (B/PAC) and work at the San Francisco Municipal Transportation Agency (SFMTA).
While my family supports a new restaurant at 79 Saint Francis Square, we oppose the drive thru. This location is along a high injury network, where 83% of our serious and fatal crashes occur. For the safety of my son and for the other kids and elders using that route to get to school (Thomas Edison, Fernando Rivera, Daniel Webster), we urge the Planning Commission to approve the restaurant WITHOUT the drive thru.
The zoning code requires the Planning Commission to make a finding that the drive thru will not be detrimental to the health, safety, morals, comfort and general welfare of the persons residing or working in the neighborhood. As we have experienced in Daly City, drive thru’s absolutely are detrimental to the health, safety, and comfort of our residents. Also, we just have to look at shopping centers at Ranch 99 and King Plaza to see the how bad traffic will be at 79 St. Francis Square.
The Chow King has a location in SSF that does not include a drive thru which shows that it does not need a drive thru to be profitable. I don’t think Daly City residents have to suffer the negative impacts of drive thrus when other nearby cities don’t have to.
Given the reasons above, I urge the Planning Commission to recommend approving the restaurant WITHOUT the
drive thru.

Staff recommends that the City Council:

4. Accept all responsive bids and award a construction contract for the Base Bid only to Roadway Construction, Inc. of San Francisco, California, in the amount of $3,060,002.50; and
5. Authorize the City Manager to execute all necessary contracts to complete the project.
Background
The 2020-21 Street Resurfacing project includes pavement base failure repair, asphalt concrete (AC) overlay and pavement reconstruction. The total length of this project is approximately 1.56 centerline miles of City streets as shown on the attached location map. The streets to be rehabilitated were selected by a comprehensive evaluation through the City’s Pavement Management Program, recommendations from the Streets Maintenance Division, coordination with other planned City projects and availability of funds. Concrete curb ramps at street intersections within the limits of work will also be constructed in compliance with the Americans with Disabilities Act (ADA).
On June 12, 2023, City Council authorized the City Manager to execute a professional services agreement with Park Engineering, Inc. to provide construction management and inspection/support services for this 2020-21 Street Resurfacing project and the 2021-22 and 2022-23 Street Resurfacing project.

Roadway Construction, Inc. of San Francisco, California has been in business since 2012. This bidder holds the required Class A contractor’s license, which is current and in good standing. The contractor’s reference for work performed for the Town of Corte Madera as well as their references for work performed as a subcontractor in the City and County of San Francisco are acceptable.
The low bid for this project is 21.6% higher than the Engineer’s estimated cost. In the Bay Area’s current construction industry market, increased cost for skilled labor and raw materials has affected the bid prices of qualified contractors.
If the Base Bid only is awarded as recommended, construction is anticipated to proceed in August 2023 and be completed by the end of 2023.
Fiscal Impact
The total estimated construction cost for the 2020-21 Street Resurfacing project is $3,435,000.00, which includes the $3,060,002.50 construction contract, and $374,997.50 (12%) for construction contingency, contract administration, and staff time.
$2,606,281.99 is available in Transportation Fund CIP project account 17-312-580 – Street Resurfacing (20/21), $60,060.00 is available in Sanitation Fund project account 87-920-617 – Resurface S/S Streets, and $22,000.00 is available in Water Fund project account 41-385-617 – Street Resurfacing. An additional $746,658.01 is needed to fully fund the 2020-21 Street Resurfacing project.
This action will appropriate $746,658.01 of unallocated Measure A funds to fully fund the project.

MUNICIPAL CODE OVERSIZED VEHICLES AND COMMERCIAL PARKING PERMITS The City Council of the City of Daly City, DOES ORDAIN as follows:
SECTION 1. Section 10.32.150(A) of Chapter 10.32 of the Daly City Municipal Code is amended to read as follows:
10.32.150 Parking of oversized vehicles.
A. No person shall park any oversized vehicle on any street between the hours of five p.m. and seven a.m. For the purpose of this section, “oversized vehicle” means:
1 A single vehicle or combination of vehicles having more than two axles;
2. A vehicle with more than two wheels upon any single axle;
3. A truck tractor designed and used primarily for drawing other vehicles whether or not other vehicles, trailers, or other wheeled loads are attached;
4. A single vehicle or combination of vehicles twenty-two feet or more in length, or a single vehicle or combination of vehicles six feet six inches or more in width;
5. Any trailer as defined in Section 630 of the California Vehicle Code, with the wheels thereof either attached or detached;
6. A dump truck;
7. A commercial automobile transportation trailer or truck and trailer capable of transporting more than two automobiles;
8. A roofing asphalt kettle used to process, heat, or hold for heating roofing materials;
9. A commercial tank truck capable of transporting combustible or hazardous materials;
10. A vehicle having a manufacturer's gross vehicle weight rating of ten thousand pounds or more.
11. For purposes of this section, "vehicle" means any automobile or device, operable or inoperable, with or without wheels, by which any person or property may be propelled, moved, or drawn upon the street or highway, including but not limited to, automobiles, boats, mobile homes, house trailers, recreational vehicles and/or similar type trailers.
SECTION 2. Section 10.32.155(B) of Chapter 10.32 of the Daly City Municipal Code is hereby amended to read as follows:
10.32.155 Commercial preferential permit parking.
2 B. Issuance of Permits.
1. The department of finance shall issue permits, in the form of adhesive labels or decals, for commercial preferential parking to qualified applicants who have completed an application form supplied by the department of finance. Applicants for such permits shall present such proof as may be required of residence within the city, or of a business situated and operating in the city, and proof of current registration of the commercial vehicle to the resident or to the Daly City business. The Finance Department may develop administrative regulations for additional qualifications to obtain such a permit, as well as establish priorities as may be necessary. a. No more than two permits shall be issued for each qualified resident or business.
b. Commercial vehicles used by Daly City residents in their employment, wherein the commercial vehicle is: (i) not owned by the resident, and (ii) registered to the employer, may secure a commercial vehicle preferential parking permit for such vehicle upon satisfactory showing to the city that the resident needs such commercial vehicle in proximate location to his/her residence for valid employment or emergency purposes;
c. The finance department shall collect a commercial parking permit fee as set by resolution of the city council.
2. "Commercial vehicles" that may secure commercial preferential parking permits shall be those commercial vehicles as described in Section 10.32.150 of this code, or any amendments to Section 10.32.150 of this code; commercial limousines exceeding nineteen feet in length; or other such similar commercial vehicles. A commercial vehicle must be self-propelled, or a trailer attached to a motor truck (Vehicle Code §410); commercial preferential parking permits shall not be issued to any trailers that are not self-propelled, nor shall any trailer be permitted to park in a commercial preferential parking permit zone during the hours of permitted preferential parking without being attached to a motor truck. "Commercial vehicles" do not include recreational vehicles, boats, private towing trailers, roofing asphalt kettles, hazardous materials tank trucks or horse trailers.
3. Hours of Permitted Preferential Parking. Commercial Vehicle Parking Zones are designated between the hours of five p.m. and seven a.m. everyday including weekends and holidays.
4. Availability of Parking. A preferential parking permit shall not guarantee or reserve to the holder thereof on on-street parking space within any designated commercial preferential parking zone.
SECTION 3. Section 10.32.155(C)(2) of Chapter 10.32 of the Daly City Municipal Code is hereby amended to read as follows:
10.32.155 (C) Duration of Permit.
3 2. Permits otherwise valid pursuant to subsection (C)(1) of this section shall be renewed annually following the time of city renewal of business licenses (Chapter 5.04).
Commercial parking permits will be valid from January 1 through December 31.
SECTION 4.Section 10.32.155(J) of Chapter 10.32 of the Daly City Municipal Code is here by added to read as follows:
10.32.155J. Falsified or Fraudulent Permits. It shall be a violation of this Chapter for any person to display a falsified or fraudulent permit. Where any permit issued under this section has been procured through fraud or misrepresentation, or where the permittee has violated provisions of this section, the Police Department shall issue a citation and the permittee will be required to remove the permit from the commercial vehicle and return to the Finance Department. The permit will be invalidated in the system for the remainder of the of the year in which the permit was issued and the permittee will be permanently restricted from participating in the program.
SECTION 5.Section 10.32.155(K) of Chapter 10.32 is here by amended to read as follows:
10.32.55K. Illegal Dumping. Any permittee caught illegally dumping in violation of Chapter 8.32 will have the permit immediately invalidated in the system for the remainder of the year in which the permit was issued and the permittee will be permanently restricted from participating in the program.
SECTION 6. Severability. If any section, subsection, provision or part of this Ordinance, or its application to any person or circumstance, is held to be unconstitutional or otherwise invalid, the remainder of this Ordinance, and the application of such provision to other person or circumstances, shall not be affected thereby and shall remain in full force and effect and, to that end, the provisions of this Ordinance are severable.
SECTION 7. Environmental Determination. The City Council finds, pursuant to Title 14 of the California Code of Regulations, Section 15378, that this Ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) in that it is not a project as provided by the Act, in that it does not have a potential for resulting in a detrimental physical change in the environment, directly or ultimately, as provided in Title 14, Section 15378(a), and that it is also exempt under the definition of "project" in Section 15378(b)(3) in that it concern general policy and procedure making.
SECTION 8. Effective Date and Publication: Pursuant to the provisions of Government Code Section 36933, a summary of this ordinance shall be prepared by the City Attorney. At least five (5) days prior to the Council meeting at which this ordinance is scheduled to be adopted, the City Clerk shall (1) publish the summary, and (2) post it in the City Clerk’s office a certified copy of this ordinance. Within fifteen (15) days after the adoption of this ordinance, the City Clerk shall (1) publish the summary and (2) post in the City Clerk’s office a certified copy of the full text of this ordinance along with the names of those City Council members voting for and against this
4 ordinance or otherwise voting. This ordinance shall become effective thirty (30) days from and after its adoption.
