City Council Meeting Agenda ReportItem # _____
6/12/23
Meeting Date: October 23, 2023
Subject: Receive Update on American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Funds Expenditures and Adopt Resolution to Amend ARPA Capital Projects Recommended Action
It is recommended that the City Council receive an update on the expenditure of federal American Rescue Plan Act (ARPA) funds made available to local jurisdictions, the State and Local Fiscal Recovery Funds, and adopt the recommended amendments to ARPA funded capital projects.
Discussion
President Biden signed the American Rescue Plan Act (ARPA) into law on March 11, 2021. The legislation provided $1.9 trillion in economic stimulus funds to assist in the recovery from the COVID-19 pandemic. One component of the legislation was the Coronavirus State and Local Fiscal Recovery Funds (SLFRF) program, which provided funds directly to local jurisdictions to respond to the economic and public health impacts of COVID-19. The City of Daly City received $25.26 million in total SLFRF due to its size and demographics.
The City Council approved the City’s initial budget plan for the ARPA funding on November 22, 2021. Based on the adopted allocations in the initial budget plan, the City had spent or obligated $17.36 million of ARPA funds as of the end of FY 2023. Attachment A shows the original budget recommendation for the City’s ARPA funds and the amount that has been spent or obligated on those projects as of June 30, 2023.
On June 12, 2023, the City Council approved an amended budget for the ARPA funding. The revised budget authorized the City to recognize the remaining ARPA funds, those not spent or obligated as of the end of June 30, 2023, as revenue loss reimbursement. Since the beginning of the pandemic, the City has experienced close to $20 million in revenue loss. Although the City’s revenues have recovered from the lows of the pandemic, the increase in revenues has not kept up with the increase in expenses, which is one factor that led to the City’s budgeted deficit in FY 2024. The remaining ARPA funding, approximately $7.9 million, can now be recognized as revenue in the General Fund and can help reduce the budgeted deficit of $6.2 million in FY 2024.
In addition, at the June 12 meeting, the City Council approved funding any committed, but uncompleted, ARPA capital projects out of the General Fund or other appropriate funding sources. Attachment B shows the amount of General Fund dollars and Water Fund dollars needed to replace the ARPA funding in the approved ARPA capital improvement projects.
Fiscal Impact
The recommended amendments to the ARPA funded capital improvement projects will impact both the General Fund and the Water Fund. The City needs to appropriate an additional $5,901,000 from the General Fund to capital projects and an additional $1,604,845 from the Water Fund to capital projects to replace the ARPA funding. The allocation from the General Fund to capital projects will

be offset by the $7.9 million in ARPA funds that the City will recognize as General Fund revenue reimbursement in FY 2024.
Summary/Conclusion
Staff recommends the City Council adopt the proposed amendments to the ARPA capital improvement projects.
Staff is available to provide any additional information desired by the Mayor or City Council Members.

City Council Meeting Agenda ReportItem # _____

Meeting Date: October 23, 2023
Subject:Set Time and Place of Public Hearing – Approval to Implement an Automated License Plate Reader Program
Recommended Action
City Council to set November 13, 2023, as time, and City Council Chambers as place, for a public hearing to approve an Automated License Plate Reader (ALPR) program, as well as to authorize the City to enter a contract with Flock and Axon for ALPR systems and deployment.
Background
The Police Department currently has (8) Automated License Plate Reader (ALPR) systems, (5) affixed to patrol cars, (2) affixed to a Parking Enforcement vehicle, and (1) affixed to a trailer.
ALPR technology scans license plates at a high rate of speed and cross-checks those license plate numbers against law enforcement databases. These systems have provided valuable information to police officers by providing immediate notification of wanted/stolen vehicles and missing persons, as well as supporting efficient investigations into criminal activity. The Police Department complies with California Civil Code Section 1798.90.5 et seq. regarding ALPR technologies.
Public agencies are required to provide an opportunity for public comment at a regularly scheduled public meeting of the governing body of the public agency before implementing or changing the existing program.
Discussion
The Police Department is harnessing technology to address crime impacting our community.
Vehicle and retail related theft have become prominent issues, as has the general desire to reduce any other crimes impacting quality of life. ALPR technology provides real-time information to police officers on patrol by providing on-screen alerts for license plates identified within controlled law enforcement databases. These alerts are often related to missing persons and license plates entered in the stolen vehicle system associated to criminal activity. The associated ALPR database provides crucial investigative information towards solving crimes, as well as supporting efforts towards locating subjects wanted for criminal activity.
It is important to note that our ALPR program will not be used for administrative enforcement purposes (CA Values Act), general surveillance, nor will it be shared with agencies outside of California without a court order.
The ALPR program will include fixed ALPR devices provided by Flock, as well as the activation of the ALPR capabilities of our current Axon Fleet 3 dash cameras in police department vehicles.
Both systems integrate with each other and play a pivotal role in early notification and prevention of criminal activity in our communities.
Fixed ALPR devices will be strategically placed based on crime patterns affecting the city, or in locations of ingress or egress to the city, understanding criminal activity often comes from outside
City Council Agenda Report
Found. Meeting Page 2 of 3
of our city limits. These devices will alert on-duty personnel to license plates entered in law enforcement databases, as well as provide information towards solving reported criminal acts.
Our current Axon Fleet 3 dash camera systems record activity through the windshield of equipped vehicles during emergency responses or officer activity. The cameras can act as a mobile ALPR system. Activating ALPR on these existing cameras will support immediate notification to the officers in-car computer. An added benefit is the automation of license plate inquiries, reducing the need for manual input by the officer. This technology is also valuable for documenting license plates during critical incident investigations.
Incorporating an integrated fixed and mobile APLR program ensures a comprehensive approach, and therefore supports improvements in quality of life for our community through a reduction in crime and increased efficiencies conducting investigations. The automation of ALPR technology ensures accuracy and real-time alerts, however it will be the officer’s responsibility to further verify the reason for the alert through other means before taking any enforcement action.
The ALPR program will only be used to reduce crime through real-time alerting and to increase efficiency during investigations for reported crimes. Access to ALPR systems and databases require individual logins, ensuring controlled access and the ability to audit inquiries and use. Inquiries in related databases require a “need to know” and a “right to know.” This is consistent with state and federal database inquiries for law enforcement purposes. Users must provide a reason for inquiries, detailed enough to recall the intent during audits. General inquiries or surveillance will not be permitted.
ALPR technology is a significant force multiplier for law enforcement efforts, pivotal in a time where police officer staffing limits have been challenged. Fixed and mobile ALPR programs are currently in use by almost all San Mateo County agencies and a vast majority of agencies within the region, as well as by private businesses and residential associations within Daly City. Our ALPR program would allow for the activation of Axon Fleet dash cameras, as well as the installation of fixed ALPR cameras provided by Flock, an industry leader in ALPR technology, and currently the solution being deployed in nearly all ALPR programs within the Bay Area. Flock provides a cost effective and managed solution, best meeting the needs of the department.
ALPR data is stored in law enforcement compliant databases and follows strict retention and purge schedules. Our ALPR data is retained in vendor specific databases, and like our current ALPR data, will ultimately be uploaded into the Northern California Regional Intelligence Center (NCRIC) database. This data is retained for 1-year, which is the general industry standard, and NCRIC has the highest level of database security in the industry. NCRIC follows strict access requirements and conducts formal audits into access and data retrieval. NCRIC retains nearly all San Mateo County agencies ALPR data as well as ALPR data outside our county.

Fiscal Impact
Activating Axon’s Fleet 3 Dash Camera ALPR solution in our existing Axon Body Worn Camera and Patrol Vehicle Camera contract costs $18,290.00 per year for our current fleet of patrol vehicles. Initial funding was approved for the expansion of our department’s Axon program through Measure Q Funds in the FY 23/24 budget. The department requests funding for the additional two years of the Axon Fleet ALPR in the amount of $36,580 be covered by Measure Q Funds.
The first year of the three-year Flock contract includes the initial lease and installation costs of an estimated 45 Flock cameras in our city and is estimated to cost $150,000. Funding for the first year of the contract was previously appropriated in the FY 23/24 budget through Measure Q Funds.
After the first year, the annual contract amount is estimated to cost $135,000 per year for the remaining two years of the contract. Funding for the remaining two years estimated in the amount of $270,000 is requested to be supported through Measure Q Funds.
Additional funding in the amount of $476,500 was acquired through the BSCC Organized Retail Theft Grant to support and fully fund the cost of an additional estimated 42 Flock cameras for the next three years, which was accepted by Council on September 25, 2023.
Flock’s proprietary software algorithms improve the recognition of license plates and vehicle descriptors when paired with Flock’s proprietary and advanced various ALPR cameras (Flock Falcon, Falcon LR, and Falcon Flex), and directly integrate with the Axon Fleet ALPR solution further supporting investigations. Flock was recently awarded a competitive bid for a similar sized agency in San Mateo County due to their low and competitive prices; Daly City is extended the same prices on the majority of the cameras, qualifying this as a Piggy-back purchase (Daly City Municipal Code Section 3.12.020). A small subset of cameras is requested to be purchased as a sole source due to the proprietary software and hardware and to ensure compatibility with the rest of the solution.

City Council Meeting Agenda ReportItem # _____
Meeting Date: October 23, 2023
Subject:Approve Purchase of Unmanned Arial Systems for Use by the Police Department
Recommended Action
Request City Council approve the purchase of Unmanned Arial Systems (UAS’s) for use by the Police Department.
Background
The use of arial support has long been a critical asset for police departments, one commonly challenging to acquire due to cost, resource needs or general availability. While we have had success with mutual aid requests for arial support, resources, weather, or air traffic control restrictions frequently prohibit accessibility. The evolution of the UAS in the law enforcement profession has quickly become a viable option to the arial support component and provides for a solution to a critical asset to support responses to high-risk and critical incidents, as well as during community caretaking situations.
UAS’s are listed in AB 481 – Military Equipment Use (Daly City Municipal Code 9.56), and as such require Council approval for acquisition and use of in a law enforcement capacity.
Discussion
The Police Department has long relied on arial support, such as fixed wing planes, helicopters, and UAS’s from regional allied agencies. These air assets have effectively supported preplanned tactical operations, high-risk and critical incident overwatch, subject apprehension, and community caretaking situations involving missing persons, cliff rescues, and search operations. Air assets have proven successful, however availability is often restricted due to airspace and environmental conditions. Several local and regional Police Departments in the greater Bay Area have turned to UAS programs due to the ease of deployment and the lower altitude ceiling to overcome arial support challenges.
The police department believes a UAS program would greatly support organizational efficiency, and more importantly, improve the safety of the community and our officers during critical incidents, or during search operations. The use of the UAS’s will be strictly controlled and monitored through policy and procedural requirements, to include the following:
➢General surveillance will not be permitted, unless by court order or search warrant. ➢The UAS’s will not be weaponized in any manner.
➢Only used for communication and observational purposes (cameras/thermal imaging). ➢Deployment requires supervisor approval and subsequent notification to the Chief of Police. ➢Pilots must be certified and follow FAA requirements.
➢Measures taken to reduce unintended video of private spaces (backyards, inside residences) ➢Program managed and audited by UAS Coordinator for compliance.
City Council Agenda Report
Found. Meeting Page 2 of 3
As UAS’s are covered under the Military Equipment Use policy, all operational use will be reported to the Council annually as required. All UAS deployment video will be recorded to our Axon Evidence.com system and will follow and comply with the same policy and procedure that governs our body worn and fleet cameras.
The use of UAS’s will only be permitted during planned or spontaneous operational purposes, where the use of the UAS will enhance officer response and safety for all of those involved.
Examples of deployments would be:
➢Community caretaking situations, to include tracking of dangerous animals, cliff search and rescue operations for stranded hikers, downed paragliders, etc. ➢Searches for missing persons or those in distress whose whereabouts are unknown or include large open areas.
➢Planned high-risk tactical operations benefiting from an overwatch perspective to support the safety of officers and the community.
➢During critical incidents requiring an officer search operation, such as active burglary scenes, reported armed subjects in a neighborhood or open area. ➢Responses to violent or armed subjects or those potentially experiencing a mental health crisis, where the UAS would provide an opportunity to tactically plan a safe approach, providing for adequate resources and the ability to de-escalate and reduce the likelihood of confrontation.
➢To clear residences or buildings during lawful searches involving suspicious circumstances, active threats, or pursuant to a court order or search warrant. ➢During the management of open space fires, potential natural disasters, or hazmat scenes.
Uses for the UAS can vary from situation to situation, but the key intent is to provide a tool allowing officers to carry out tasks efficiently and safely. While the above examples are not all encompassing, any deployment will follow legal authority, policy and procedure, and the utmost consideration for the rights and privacy of those in the community. The UAS is designed to provide pertinent information to officers, ultimately allowing them to make informed tactical decisions to support de-escalation and reduce the likelihood of using force, all designed to ensure the safety and protection of the community.
UAS technology has evolved, ensuring effective and safe solutions for law enforcement deployments. The Daly City Police Department has evaluated many UAS suppliers through demonstrations, training courses, and through allied agency engagement and deployments. Axon, our contracted body and fleet camera provider, has UAS packages and accessories that are compatible with the required Axon Air licenses, which are part of our existing Axon contract. The Axon Air system ensures proper auditing, UAS tracking, data retention in our departments Axon evidence system, and overall UAS program monitoring.
The police department has identified the DJI Matrice 30T & Mavic 3T UAS’s as the solutions that best meet the needs of the department. The DJI Matrice 30T is a medium sized UAS that has dual batteries allowing longer flight time, higher quality imaging sensors that are weather resistant, and will best be deployed in situations requiring extended flight operations, flights involving large open areas, as well as during pre-planned UAS operations. The department is recommending the purchase of two (2) Matrice 30T systems to ensure availability should there be repair

considerations, or for complex or lengthy deployments requiring multiple systems. The DJI Mavic 3T is a smaller sized UAS, designed for quick deployments, with color and thermal imaging sensors, and the ability to communicate through a speaker. This smaller UAS is designed to support rapid deployments from a certified, on-duty patrol officer, who will have the system in their patrol vehicle. The department is recommending the purchase of three (3) DJI Mavic 3T systems to ensure there are multiple systems available in the field during routine patrol operations. The redundancy will expedite availability and deployments by certified operators for approved flights.
Both systems are Axon Air compatible, providing high quality cameras and thermal imaging systems to support deployments, and equally as important, they provide critical safety technology to ensure safe flight and contingency responses. These UAS’s have built-in systems to support flight capabilities through obstacle avoidance, as well as recovery solutions should they lose connectivity with the operator or run low on power by automatically returning to the takeoff location.
Fiscal Impact
The cost for three complete DJI Mavic 3T UAS kits is $22,467.24. The cost for two complete DJI Matrice 30T UAS kits is $25,117.43. Axon Air UAS Licenses are required to be used in the Axon Air system. The associated licenses required for these UAS’s total $7,816.90 for the first year.
The total cost in this fiscal year is estimated to be $55,401.57. This will cover the cost for the five (5) UAS Kits, accessories, and Axon Air Licenses. Funding for this purchase was previously appropriated in the FY 23/24 budget, from Measure Q funds, under the item of the Axon expansion projects.
In October 2024 and October 2025, $13,400.40 is due to renew the annual Axon Air UAS Licenses, totaling $26,800.80. Staff is requesting the Axon Air UAS’s to be continuously funded as a Measure Q program.

Meeting Date: October 23, 2023
Subject: Approval of the Annual Agreement between the City of Daly City and the Daly City-Colma Chamber of Commerce for a 12-month period
Recommendation
Staff recommends the City Council approve the proposed Daly City-Colma Chamber of Commerce Contract for a 12-month period and authorize City Manager to execute the agreement.
Background
The Daly City-Colma Chamber of Commerce has been accredited with the Better Business Bureau since 2/1/1993 and has been operating since 1956. It promotes the interests of businesses in Daly City, Colma and Broadmoor. They provide advertising opportunities, networking events, and business showcases and luncheons. The Board of Directors meet every second Thursday of the month. The City Council held Budget Study Sessions that prioritized the Daly City-Colma Chamber for this Fiscal Year. CITY staff met with the CHAMBER several times to draft a new contract. The CHAMBER is now known as the Daly City Colma Chamber 2.0 and believes that a strong, vital community goes hand-in-hand with a strong, vital business environment. The CITY has an Economic and Community Development (ECD) Specialist who has a role that serves as a compliment to the Chamber’s services.
The Board of Directors for the Daly City-Colma Chamber of Commerce seeks to renew the contractual agreement it has with the City of Daly City for a 12-month period. The CITY’S contribution to the CHAMBER under the terms of the proposed agreement is $60,000 payable in quarterly installments of $15,000 for a 12-month period.
