City Council Meeting Agenda ReportItem # _____
Meeting Date: January 8, 2024
Subject: Time Extension for Use Permit UPR-6-19-14076 and Design Review DR-6-19-14077 — Mixed-Use Apartment Building at 493 Eastmoor Avenue
Recommended Action
Approve the time extension to February 24, 2026, subject to the findings and Conditions of Approval adopted by the City Council on February 24, 2020.

Background
On February 24, 2020, the City Council approved a request by Core Affordable Housing to construct a seven-story mixed-use apartment building on a 0.37-acre vacant lot on the northwest corner of Eastmoor and Sullivan Avenues. The Conditions of Approval required that building permits be issued and construction diligently pursued within two years of approval of the use permit approval, otherwise the use permit and design review approvals would become invalid.

The applicant has cited an ongoing delay related to obtaining funding for the affordable housing development as the primary reasons for the construction delay and is therefore requesting an additional two-year time extension of the use permit and design review approvals associated with the project.

Conclusion
As the Planning Division has worked with the applicant to address the Conditions of Approval, which would remain unchanged, staff recommends approval of the Time Extension to February 24, 2026.

Respectfully submitted,

City Council Meeting Agenda ReportItem # _____
Meeting Date: January 8, 2024
Subject: Approve Memorandum of Understanding with County of San Mateo to Implement SB 1383 Regulations
Recommended Action
Staff recommends that the City Council approve a Memorandum of Understanding with County of San Mateo to implement SB 1383 Regulations.

Background
Senate Bill (SB) 1383, signed into law September 2016 by Governor Brown, was designed to reduce greenhouse gas emissions, like methane, by setting organic waste disposal reduction targets for California. The targets must reduce organic waste disposal 50% below 2014 levels by 2020 and 75% by 2025, as well as rescue at least 20% of currently disposed edible food to feed those in need by 2025.

SB 1383 Regulations require local agencies or jurisdictions, among other things, to implement programs requiring organic waste generators and Solid Waste Haulers to meet minimum standards for organic waste collection services, inspect waste containers for prohibited contamination of materials, provide education and outreach information to organic waste generators, report to CalRecycle on compliance with SB 1383 Regulations, and maintain records of compliance with SB 1383 Regulations.

The purpose of this MOU to designate certain roles and responsibilities that City of Daly City shall assume on behalf of the County to implement the SB 1383 Regulations in Broadmoor and Unincorporated Colma that are within the service area of the City’s Franchise Agreement with Republic Services.

Fiscal Impact
None.

Summary/Conclusion
Staff recommends that the City Council approve a Memorandum of Understanding with County of San Mateo to implement SB 1383 Regulations.

Staff is available to provide any additional information desired by the Mayor or Councilmembers.

Respectfully submitted,
Leilani Ramos
Assistant to the City Manager

Exhibit A. Sections Referenced in CalRecycle Senate Bill 1383 Regulation Section 18984. Combined Organic Waste Collection Services.

A jurisdiction may provide any combination of organic waste collection services specified in Sections 18984.1, 18984.2, and 18984.3 to generators subject to its authority.

Section 18984.1. Three-container Organic Waste Collection Services. (a) A jurisdiction may comply with the requirements of this article by implementing a three- container organic waste collection service and providing a green container, a blue container, and a gray container to each generator in the following manner:
(1) The green container shall be provided for the collection of organic waste. The green container shall be intended for the collection of organic waste only and not non-organic waste. The contents of the green container shall be transported to a facility that recovers source separated organic waste.
(A) Compostable plastics may be placed in the green container if the material meets the ASTM D6400 sections 5.1 through 6.4.2 standard for compostability as published May, 2019, which is hereby incorporated by reference, and the contents of the green containers are transported to compostable material handling operations or facilities or in-vessel digestion operations or facilities that have provided written notification annually to the jurisdiction stating that the facility can process and recover that material.
(2) The blue container shall be provided for the collection of non-organic recyclables only but may include the following types of organic wastes: paper products, printing and writing paper, wood and dry lumber and textiles. The contents of the blue container shall be transported to a facility that recovers the materials designated for collection in the blue container.
(3) The gray container shall be for the collection of non-organic waste only. (4) A jurisdiction may comply with this section by providing a container or containers that are split or divided into segregated sections, instead of an entire container, as long as the lids of the separate sections of a split container comply with the container color requirements and material limitations specified in this section. (5) Materials specified in this paragraph shall be subject to the following restrictions:
(A) Carpets, non-compostable paper, and hazardous wood waste shall not be collected in the green container.
(B) Hazardous wood waste shall not be collected in the blue container or gray container.
(6) A jurisdiction may require additional segregation of source separated organic waste by providing additional containers or additional sections of split containers in addition to the green container and blue container. The following types of additional containers can be provided pursuant to this paragraph.
(A) A brown container, or a brown section of a split container that is limited to the collection of separated food waste.
(B) If a jurisdiction segregates the contents of a blue container into an additional container or additional section of a split container in order to separate organic wastes specified in Subdivision (a)(2) from non-organic recyclables, the jurisdiction may use a darker shade of blue for the container or section of the container designated for the collection of organic waste, and a lighter shade of blue, or any color not already designated for other materials specified in this section, for the collection of non-organic recyclables.

Page 28 of 121 ends

Exhibits
(C) Additional containers, or sections of split containers provided for collection of additionally separated organic waste not specified in this section, may be provided in any color provided that the colors do not conflict with the container color requirements of this section.
(b) A jurisdiction that provides a three-container organic waste collection service that complies with Subdivision (a) may transport the contents of the gray container to a facility that processes and recovers organic waste. A jurisdiction that complies with Subdivision (a) is not required to transport the contents of the gray container to a facility that meets or exceeds the organic waste content recovery standard specified in Section 18984.3. A jurisdiction will not be considered out of compliance with Subdivision (a) if it allows carpet and textiles to be placed in the gray container.
(c) Notwithstanding Subdivision (a), a jurisdiction providing a three-container organic waste collection service may allow organic waste, such as food waste, to be collected in the gray container provided that the collection program complies with the following:
(1) The contents of the gray container shall be transported to a facility that meets or exceeds the organic waste content recovery requirements specified in Section 18984.3. (2) The gray container is labeled in a manner consistent with Section 18984.8 that identifies the types of organic waste content accepted in the gray container. (3) The jurisdiction otherwise provides green and blue containers in a manner that 1 complies with the requirements and limitations specified in Subdivision (a) of this section.

Section 18984.5. Container Contamination Minimization.
(a) A generator shall not place prohibited container contaminants in a collection container. A jurisdiction shall monitor the containers provided to generators using a three-container or two- container organic waste collection service pursuant to Section 18984.1 or 18984.2 to minimize prohibited container contaminants in a manner that complies with either the provisions of Subdivision (b) or the provisions of Subdivision (c) of this section. (1) A jurisdiction that implements a performance-based source separated collection service pursuant to Section 18998.1 shall monitor containers through waste evaluations as specified in the provisions of Subdivision (c).
(b) A jurisdiction may meet its container contamination minimization requirements by conducting a route review for prohibited container contaminants on containers in a manner that results in all hauler routes being reviewed annually. Containers may be randomly selected along a hauler route. This section should not be construed to require that every container on a hauler route must be sampled annually.
(1) Upon finding prohibited container contaminants in a container, the jurisdiction, shall notify the generator of the violation.
(A) The notice shall, at a minimum, include information regarding the generator’s requirement to properly separate materials into the appropriate containers and may include photographic evidence of the violation.
(B) The notice may be left on the generator’s container, gate, or door at the time the violation occurs, and/or be mailed, e-mailed, or electronically messaged to the generator. (2) If a jurisdiction observes prohibited container contaminants in a generator’s collection container(s), it may dispose of the container’s contents. (3) Notwithstanding Section 18995.1(a)(5), this chapter does not require a jurisdiction to impose administrative civil penalties on generators in violation of the prohibited container contaminants requirement in Subdivision (a), above.

Section 18984.6. Recordkeeping Requirements for Container Contamination Minimization. (a) A jurisdiction shall include the following information and documents related to its compliance with Section 18984.5, in the Implementation Record required by Section 18995.2 of this chapter.

The documentation shall at a minimum include dates of the studies, the location of the solid waste facility where the study was performed, routes, source sector (e.g., commercial, or residential), number of samples, weights and ratio of prohibited container contaminants and total sample size.
(4) Copies of all notices issued to generators with prohibited container contaminants. (5) Documentation of the number of containers where the contents were disposed due to observation of prohibited container contaminants.

Section 18984.7. Container Color Requirements.
(a)A jurisdiction shall provide containers, for collection services, to generators that comply with the container color requirements specified in this article. (b) Notwithstanding Subdivision (a), a jurisdiction is not required to replace functional containers, including containers purchased prior to January 1, 2022, that do not comply with the color requirements of this article prior to the end of the useful life of those containers, or prior to January 1, 2036, whichever comes first.

Section 18984.8. Container Labeling Requirements.
(a) Commencing January 1, 2022, a jurisdiction shall place a label on each new container or lid provided to generators consistent with the applicable container collection requirements and limitations of this article specifying what materials are allowed to be placed in each container. (b) A jurisdiction may comply with this section by:
(1) Placing labels on containers that include language or graphic images or both that indicate the primary materials accepted and the primary materials prohibited in that container; or
(2) Providing containers with imprinted text or graphic images that indicate the primary materials accepted and the primary materials prohibited in that container. (c) Labels shall clearly indicate primary items that are prohibited container contaminants for each container.
(d) A jurisdiction may comply with this section by using model labeling provided by the Department.

Section 18984.9 Organic Waste Generator Requirements.

(3) Periodically inspect organic waste containers for contamination and inform employees if containers are contaminated and of the requirement to only use those containers for organic waste.
(c) Nothing in this section prohibits a generator from preventing or reducing waste generation, managing organic waste on site, or using a community composting site. (d) A commercial business is not required to replace functional containers, including containers purchased prior to January 1, 2022, that do not comply with the requirements of this article prior to the end of the useful life of those containers, or prior to January 1, 2036, whichever comes first. (e) If a business does not generate any of the materials that would be collected in one type of container, then the business does not have to provide that particular container in all areas where disposal containers are provided for customers.

Section 18984.11. Waivers Granted by a Jurisdiction.
(a) A jurisdiction may grant one or more of the following types of waivers to a generator of organic waste:
(1) De Minimis Waivers.
(A) A jurisdiction may waive a commercial business’ obligation to comply with some or all of the organic waste requirements of this article if the commercial business provides documentation or the jurisdiction has evidence demonstrating that:

The project enables cities and the California Department of Transportation (Caltrans) to proactively manage daily traffic and non-recurring traffic congestion caused by diverted traffic due to major incidents on the freeway.

The current phase of the Smart Corridor Project will extend north into Daly City, Brisbane and Colma. The project will include the deployment of an interconnected traffic signal system, closed circuit video cameras, trailblazer/arterial dynamic message signs and vehicle detection systems, along with the installation of fiber optic communication network. These ITS elements will allow Daly City and Caltrans to deploy incident response plans to manage traffic congestion on Junipero Serra Boulevard and Bayshore Boulevard, the two primary parallel corridors to I-280 and US 101, respectively.

Discussion
The funding agreement with C/CAG will reimburse Daly City for costs the City will incur to lead the construction phase of the project within the limits of City of Daly City and Town of Colma. The City will administer and manage selected civil contractor, provide construction inspection services and prepare project reporting to the various grantors. The attached draft funding agreement will be finalized by the City Attorney’s office and County Attorney’s office.

A separate memorandum of understanding associated with the ownership, operations and maintenance of the Smart Corridor equipment will be brought to the City Council for approval at a later date.

Fiscal Impact
The estimated project cost for the construction phase, including construction contingency, contract administration and construction inspection costs, is $5,800,000. C/CAG has secured funds for the project and will reimburse the City for costs incurred to manage the construction contract, provide

inspection services, and staff time for project-related work. In the event the costs exceed the amount identified in Exhibit B of the Funding Agreement, a written amendment will be executed.

Summary/Conclusion
Staff recommends the City Council authorize the City Manager to execute the Funding Agreement with C/CAG for the construction phase of the Smart Corridor Project.

2 WHEREAS, C/CAG and the City of Daly City have entered into a separate purchase reimbursement agreement to specify items that the City will be reimbursed for by C/CAG on October 12, 2023; and

WHEREAS, C/CAG and the Parties will enter into a separate Ownership, Operations, and Maintenance (OOM) agreement to identify the commitment and responsibilities regarding ownership, operations, and maintenance of Smart Corridor equipment located within the Parties’ right-of-way; and

WHEREAS, C/CAG and the Parties desire to enter into an agreement to specify each Party’s obligations and responsibilities for the upcoming construction phase of the Project;

NOW, THEREFORE, in consideration of the recitals and the mutual obligations of the parties as herein expressed, the Parties and C/CAG agree as follows:

1. City and Town Performance.
a. Daly City’s General Roles and Responsibilities: The City of Daly City (the “City”) will lead the construction phase of the Project in the city/town limits of the City of Daly City and the Town of Colma (the “Town”). The City acknowledges and agrees to comply with all provisions of the Cooperative Agreement and its amendment (attached hereto as Exhibit C and incorporated herein by this reference) at all times while performing the City obligations under this Agreement. Duties include contract administration and management of the selected civil contractor, construction inspection and project reporting to the various grantors. As the implementing agency, the City shall be responsible for managing scope, cost, schedule, and quality of the work activities and products of the Project’s construction phase. The construction phase includes construction contract administration, surveying/staking, inspecting, quality assurance, and assuring regulatory compliance. This also includes reviewing requests for information (RFIs), change orders, and submittals. Due to the nature of the Project, the construction phase will also include system integration activities and may include the development of incident response timing plans.

b. Construction Advertisement and Rules Compliance: Prior to the advertisement of activities related to the construction phase, the City shall share document(s) that describe its procurement policies and its proposed bid documents with C/CAG. The City will manage the \procurement process, and will advertise, open bids, award, negotiate, and approve the construction contract in accordance with the California Public Contract Code, the California Labor Code, any relevant federal regulations, and the provisions of the Cooperative Agreement (Exhibit C). If the negotiated price, or the lowest responsible construction contract bid, is greater than the funding commitment identified in Exhibit B, Funding Summary, the Parties must agree in writing on a course of action within ten (10) business days from the bid opening or conclusion of price negotiations. If the Parties cannot agree on a course of action within ten (10) business days, the City will not award the construction contract and the Parties agree to consult in good faith regarding the next steps.

Page 52 of 121 ends

3 In addition to managing the contractor, the City shall ensure that contractors adhere to site and job specific safety requirements in accordance with Project contract documents and funding requirements.

The City shall perform inspection services in accordance with all applicable regulations.

Prior to final acceptance by City, the City and/or the City’s contractor(s) shall demonstrate to C/CAG that C/CAG, the Town, and Caltrans have the ability to observe CCTV inputs, operate and modify trailblazer sign messages, and monitor and control traffic signal operations.

The City shall provide and maintain accurate field data on a red-lined set of Project Plans, which are to be kept current and submitted to C/CAG as complete at the conclusion of the construction. These record Plans will be used as documentation for the preparation of “as-built” Plans. The City shall provide C/CAG a set of the “as-built” plans within a month of receipt of same from City’s contractor(s).

c. Town of Colma’s General Roles and Responsibilities: The Town shall work with the City throughout the construction phase of the Project. The Town acknowledges and agrees to comply with all provisions of the Cooperative Agreement and its amendment (attached hereto as Exhibit C and incorporated herein by this reference) at all times while performing the Town obligations under this Agreement. This includes participating in project team meetings, providing permits to allow the contractor to perform work within the Town’s jurisdiction, responding to RFIs and change orders, and performing inspection services of completed work within the Town’s limits, if desired.

2. Time of Performance; Termination. The term of this Agreement shall commence on the date first written above and end on December 31, 2025, unless further extended by an amendment to this Agreement, or sooner terminated by mutual consent of the Parties. In addition, either Party may terminate the Agreement with written notice in the event that the other Party breaches a material term or condition of this Agreement or is in violation of federal, state, or local law or regulation, and such breach or violation has not been corrected after thirty (30) days of advance written notice from the non-breaching Party. In the event that the Agreement is terminated early, C/CAG will disburse funds for authorized Project work performed up to the date of termination. C/CAG will also disburse funds for authorized Project close-up costs, including:

a. Early termination costs incurred from the construction contractor, b. Costs incurred from construction contractor demobilization, and c. Restocking fees for materials purchased by the construction contractor.

C/CAG may disburse funds for other authorized Project close-out costs not listed for up to 45 days after the termination date. The Parties shall provide supporting documentation for C/CAG to authorize Project close-out costs not listed in this Section.

3. Funding. In addition to C/CAG local funds committed by this Agreement, C/CAG will

Page 53 of 121 ends

4 receive State Transportation Improvement Program (STIP) and Local Partnership Program (LPP) for the Project’s construction phase. C/CAG will distribute these funds to the City as a funding sub-recipient. Accordingly, the City shall comply with all applicable federal and state laws and statutory regulations, Cost Principles, and any other requirements related to administering federal-aid projects. The City is also responsible for and will comply with all applicable audit and reporting requirements pursuant to conditions of receiving such funding.

Funding amounts are those set forth in Exhibit B, Funding Summary, of this Agreement. In the event that the funding details require revision, the Parties will approve such changes with an amendment to this Agreement updating and replacing Exhibit B, Funding Summary, in its entirety. Such amendments will be executed by a legally authorized representative of the respective Parties.

The Parties acknowledge that C/CAG, as the Project sponsor, shall fully fund those Project costs and expenses for work that are within the scope of the conformed Project plans and specifications, in excess of STIP and local funds. However, C/CAG will not reimburse the City and Town for costs beyond the amount of “Other Local Funds” identified in Exhibit B, Funding Summary, and obligated in this Agreement, without a written amendment to this Agreement. Work costs, except those that are specifically excluded in this Agreement, are to be paid from the funds obligated in Exhibit B, Funding Summary. Costs for work that is not within the scope of the conformed Project plans and specifications are either to be paid by the Party incurring the costs from funds that are independent of this Agreement or to be reviewed by the Parties pursuant to the Change Order process outlined in Section 4 below.

4. Contract Change Orders. The City and Town shall respond to Requests for Information and negotiate contract change orders, if necessary. When contractor(s) requests a change order, the City shall make the initial determination whether the requested change order is essential to completion or is within the scope of the Project. The City shall reject all change orders that are not essential to completion or are not within the scope of the Project, or may choose to implement the non-essential change order with funds that are independent of this Agreement. The City shall forward those change orders they deem essential to either the Project Design Engineer of record (“Designer”) or their Construction Manager for a final determination regarding whether the requested change order is essential to completion of the Project. In this context, “essential” shall mean the requested change order is for work within the Smart Corridor Project scope and critical to overall Smart Corridor operation. If the Designer or Construction Manager, depending on which is selected, determines the change order is essential, the City shall negotiate with the contractor on the cost and approve the change order, as long as the subject change order, and all cumulative change orders, do not exceed the total funds obligated in Exhibit B, Funding Summary. If the Designer/Construction Manager determines the change order is non-essential, the City may choose to pay for the cost of the change order from funds that are independent of this Agreement, or not implement the change, or the C/CAG Executive Director will decide whether to approve the non-essential change order.

Page 54 of 121 ends

5 In the event the City receives change order requests that will exceed the amount specified in Exhibit B, Funding Summary, the City will notify C/CAG and the Parties must agree in writing on a proposed course of action within fifteen (15) business days from receipt of the contract change order request. The City shall properly manage contract change orders and maintain proper documentation.

5. Reimbursement. The City shall submit reimbursement requests to C/CAG for the State Transportation Improvement Program (STIP) and Local Partnership Program (LPP) funds.

Reimbursement requests shall include all the necessary materials for C/CAG to submit invoices to Caltrans. The City shall submit an invoice reflecting Project expenditures, accompanied by supporting documentation. For local funds, C/CAG agrees to reimburse the City up to the amount identified as “Other Local Funds” in Exhibit B, Funding Summary, for the construction component. No funds in excess of the amount identified as “Other Local Funds” in Exhibit B shall be reimbursed without written amendment of this Agreement. The construction component includes activities that will, when complete, enable C/CAG, Caltrans, and the City and Town to observe CCTV inputs, operate and modify trailblazer sign messages, and monitor and control traffic signal operations, as described in Section 1 above. Upon receipt and approval of the invoices and accompanying documentation as provided herein, C/CAG shall reimburse the amount claimed under the invoice within thirty (30) calendar days. In the event that Caltrans deems an invoice and/or expenditures ineligible but C/CAG determines that the invoice is eligible as defined in this Agreement, the parties agree to engage in good faith efforts to identify sufficient local funding sources and to pursue an amendment to this Agreement to augment the funding set forth in Exhibit B.

Eligible expenditures for reimbursement include:
a. Payment to the construction contractor and system integrator, b. Fees for the City’s third parties to conduct inspections and manage construction, c. City staff time for Project-related work, and
d. Fees for testing agencies.

C/CAG may reimburse the City for additional, duly authorized Project related expenses that fall outside the aforementioned categories are not listed above. The City is required to furnish appropriate supporting documentation and secure approval in order to receive reimbursement.

6. Schedule. The Parties will manage the work schedule to ensure the timely use of obligated funds and to ensure compliance with any environmental permits, right-of-way agreements, construction contracts, and any other commitments. The Parties will communicate schedule risks or changes as soon as they are identified and will actively manage and mitigate schedule risks.

7. Permits and Approvals. C/CAG is responsible for coordinating, obtaining, implementing, renewing and amending encroachment permits, agreements, and approvals necessary to construct the Project within the State’s right-of-way, whether they are identified in the Project scope of work or become necessary in the course of completing the Project.

Page 55 of 121 ends

The Town is responsible for coordinating, obtaining, implementing, renewing and amending Project permits within the Town’s jurisdiction, whether they are identified in the Project scope of work or become necessary in the course of completing the Project, to enable the City to successfully construct the Project.

8. Construction Claims. As the implementing agency, the City may accept, reject, compromise, settle, or litigate claims arising from the Project construction activities, provided City shall not resolve any such claims without C/CAG’s prior written consent, which shall not be unreasonably withheld, and provided further that any settlement permitted under this Section shall not impose any financial or other obligation on C/CAG, impair any right of C/CAG, or contain any stipulation, admission, or acknowledgement of wrongdoing on the part of C/CAG without C/CAG’s prior written consent, which shall not be unreasonably withheld. The City shall notify C/CAG within five (5) business days when a claim has been filed against the Project.

The City is responsible for covering the cost of such claims. Work costs are to be allocated for payment pursuant to the requirements and procedures of Sections 3 and 4 above, unless such claims arose due to negligence of the City. In the event the City settles or accepts any claims that would result in a Project cost exceeding the amount specified in Exhibit B, Funding Summary, such costs shall be borne solely by the City and Town or the Parties shall pursue an amendment to this Agreement.

9. Reporting. The City shall provide a bi-weekly Resident Engineer’s report to C/CAG. In addition, the City shall provide a weekly statement of working days, update the schedule on a monthly basis, and maintain current information regarding critical and near-critical activities, milestones, progress and outstanding issues affecting the schedule.

10. Construction Meetings. The City, the Town and C/CAG will participate in biweekly Project coordination meetings with contractor to keep apprised of Project progress.

11. Accounting and Audits. The City will maintain and will ensure that any Project subconsultant or subcontractor will maintain, a financial management system that conforms to Generally Accepted Accounting Principles (GAAP), and that can properly accumulate and segregate incurred Project costs and billings.

Page 56 of 121 ends

City Council Meeting Agenda ReportItem # _____
Meeting Date: January 8, 2024
Subject: SETTING TIME AND PLACE OF PUBLIC HEARING – PROPOSED ORDINANCE AMENDING CHAPTER 6.04 OF THE DALY CITY MUNICIPAL CODE – RE:

ANIMAL CONTROL
Recommended Action
Staff recommends that the City Council set January 22, 2024, as the date and time for a public hearing – Ordinance amending Chapter 6.04 of the Daly City Municipal Code regarding Animal Control.

Background
The City is a party to an animal control services agreement with the County which provides for services through a contract with the Peninsula Humane Society. Pursuant to this Agreement, the City is required to have an ordinance that is substantially the same as the County of San Mateo.

The County of San Mateo recently updated the animal control ordinance to clarify existing definitions, enact additional requirements for animal control, and revise the fees for animal control services. The proposed ordinance will update the Municipal Code to be in alignment with the County of San Mateo.

Summary/Conclusion
Staff recommends that the City Council set January 22, 2024, as the date and time for a public hearing – Ordinance amending Chapter 6.04 of the Daly City Municipal Code regarding Animal Control.

Staff is available to provide any additional information desired by the Mayor or Councilmembers.

City Council Meeting Agenda ReportItem # _____
Meeting Date: January 8th, 2024
Subject:Authorize Execution for the StarChase Pursuit Management System for Use by the Police Department Utilizing Approved BSCC Retail Theft Grant Funds Recommended Action
Staff recommends Council authorize the City Manager or designee to execute an agreement with StarChase for their Pursuit Management System for use by the Police Department in alignment with and using California Board of State and Community Corrections (BSCC) Organized Retail Theft Grant funds.

Background
On September 25, 2023, Council appropriated $8,033,830 in grant funds from the BSCC for the Police Department to address organized retail theft (ORT). The StarChase Pursuit Management System was an identified item within the grant.

Discussion
The Daly City Police Department, in conjunction with the San Bruno and San Mateo Police Departments, received the BSCC grant to address ORT, given our shared challenges with our large retail centers. Commonly, people committing ORT-related crimes flee from police during attempts to stop them. The StarChase Pursuit Management System allows an officer to safely deploy an adhesive-tipped, reusable GPS tracking tag to the back of a fleeing vehicle. The GPS tag is deployed via a compressed-air system affixed to the grille of a police vehicle or by StarChase’s custom hand-held, electronic, compressed-air device. Once the tag is attached to the vehicle, it broadcasts secure web-based, real-time mapping data to officers, who can disengage from the pursuit and strategically locate the vehicle when it comes to a stop.

StarChase’s Pursuit Management System is utilized by several agencies throughout the Bay Area, including multiple agencies in San Mateo County. Funding provided by the BSCC ORT Grant will allow our department to purchase and outfit ten patrol vehicles with vehicle-mounted systems and provide for one hand-held electronic compressed-air device.

Fiscal Impact
Funding was appropriated and approved in the BSCC Organized Retail Theft Grant for the purchase of the StarChase Pursuit Management System in the amount of $122,000. StarChase is a sole-source manufacturer and vendor. This will cover the entirety of the 3-year grant for the police department.

Summary/Conclusions
Staff is available to provide any additional information desired by the Mayor or Council Members.

Respectfully submitted,

Cameron Christensen
Acting Chief of Police

On September 25, 2023, Council appropriated $8,033,830 in grant funds from the BSCC for the Police Department to address organized retail theft (ORT). Data collection and evaluation efforts are a requirement of the BSCC grant.

Discussion
The Daly City Police Department, in conjunction with the San Bruno and San Mateo Police Departments, received the BSCC grant to address ORT given our shared challenges with our large retail centers. BSCC requires quarterly progress reports, as well as having a Local Evaluation Plan developed, which states how we would assess the effectiveness of our strategies to combat relevant thefts. In addition, a Local Evaluation Report is required to determine if our strategies were effective in the goals identified in the Local Evaluation Plan. RDA Consulting has experience with BSCC grants, and they met our needs to provide the services to complete the quarterly progress reports, Local Evaluation Plan, and Local Evaluation Report.

Fiscal Impact
Funding was appropriated and approved in the BSCC Organized Retail Theft Grant for evaluation efforts in the amount of $382,564.00. This will cover the entirety of the 3-year grant for the police department.

Summary/Conclusions
Staff is available to provide any additional information desired by the Mayor or Council Members.

Respectfully submitted,

Cameron Christensen
Acting Chief of Police

City Council Meeting Agenda ReportItem # _____
Meeting Date: January 8, 2024
Subject: Finding of Public Convenience and Necessity PCN-11-23-16429 to Sell Alcoholic Beverages for Off-Site Consumption at Vira Market at 6189 Mission Street
Recommended Action
Consider a finding that the public convenience or necessity would be served by the issuance of a liquor license by the State Department of Alcohol Beverage Control (ABC).

Background
On December 12, the City Council voted unanimously to continue consideration of this item to allow staff time to gather additional information requested by the Council. The information requested related to the nature and volume of alcohol sales that were occurring at other businesses that are licensed for retail alcohol sales in the same census tract. Staff has updated the discussion section of the staff report to reflect additional information about these existing businesses. This additional information is underlined.

Discussion
The applicant, Vikas Saxena on behalf of Vira Market, has filed an application with ABC to sell beer, wine, and distilled spirits (Type 21 License) for off-site consumption at the new Vira Market, located at 6189 Mission Street (see Attachment A – Site Location). According to the applicant, the alcoholic beverages sales would be ancilliary to the govery store’s annual gross sales. The applicant estimates that 79 square feet or approximately nine percent of the store’s 873 square feet total sales floor area would be dedicated to the display of alcoholic beverages (see Attachment B – Grocery Store Floor Plan).

ABC has determined that a finding of Public Convenience and Necessity (PCN) by the Daly City City Council is necessary before it can issue the license. According to ABC, the subject site is located an area of overconcentration of liquor licenses. There are currently five active licenses, where two would normally be permitted. Although crime statistics are included in this staff report, high crime is not the basis for the PCN requirement, rather only the overconcentration of licenses.

In considering the request, the City Council must determine whether the issuance of the license will serve the public convenience or necessity. The applicant is contending that the allowance of alcoholic beverage sales would allow the store to offer residents general retail and groceries without necessitating a second trip to another store for beer or wine, or skipping the store altogether in favor of a grocery store that sells beer or wine.

City Council Agenda Report
Public Convenience and Necessity PCN-11-23-16420 January 8, 2024 Vira Market – 6189 Mission Street Page 2 of 3
Staff has prepared the following list of facts that the City Council may find useful in determining whether issuance of the license at Vira Market would serve the public convenience or necessity:

1. Vira Market has applied for a Type 21 license for 6189 Mission Street. This license allows for the sale of beer, wine, and distilled spirts for off-site consumption only.

2. The market is in Census Tract 6007.01 and is considered by ABC to be overconcentrated for alcohol sales. There are currently five licenses existing in this Census Tract, while two are normally allowed.

3. There are a total of 14 crime reporting districts in Daly City. According to the Daly City Police Department, there was a total of 10 police reports taken with the address of 6189 Mission Street listed. The date range searched for was from 01/01/2017 – 11/20/2023. They range from theft, burglary, battery to domestic disturbances.

4. Vira Market is situated in the C-1 Light Commercial zoning district, where retail stores – including grocery stores that sell alcohol – are a permitted land use. Vira Market is surrounded by other light commercial uses to the north, south, and west, and residential to the east.

5. The following are the uses within proximity to Vira Market that specifically attract and/or serve youth (see Attachment C – Uses That Attract or Serve Youth):
▪Lincoln Park, 901 Brunswick Street, Daly City
▪War Memorial, 6655 Mission Street, Daly City
▪Our Lady of Perpetual Help School, 80 Wellington Ave, Daly City ▪199 Santa Barbara Avenue, Daly City
▪Sears-Lessing Park, Southwest end of Sears Street, San Francisco

6. The Department of Alcoholic Beverage Control (ABC) allows up to two Off-Site licenses within census tract 6007.01. There are five current licenses issued within the census tract (see Attachment D – Existing Type 21 Licenses).
▪6147 Mission Street – Felix Grocery Store, Daly City. The original license was issued in 1991 and transferred to current owner in 1995. This is a Type 20 license, allowing the sale of beer and wine only.
▪6157 Mission Street – Morazan Market, Daly City. The original license was issued in 1982, transferred to new owners in 1996, 2005, 2007, and 2008, and the to the store’s current owner in 2014. This is a Type 20 license, allowing the sale of beer and wine only. ▪98 Crocker Avenue – Crocker Market and Liquor, Daly City. The original license was issued in 1987 as a Type 20 license, allowing the sale of beer and wine only, and then amended to a Type 21 license in 2013, allowing the sale of beer, wine, and distilled spirits (“hard alcohol). All this licensing was by current owners. ▪108 Los Olivos Avenue – BART Grocery, Daly City. The original license was issued in 1990 as a Type 21 license, which was canceled and reissued as Type 21 license in 1992.

This license was transferred in 2002, canceled, and re-issued as a Type 20 license in 2010,

Page 113 of 121 ends

City Council Agenda Report
Public Convenience and Necessity PCN-11-23-16420 January 8, 2024 Vira Market – 6189 Mission Street Page 3 of 3
which was transferred to the current store owners in 2020. The City Council authorized this license by finding Public Convenience and Necessity in 2010. ▪6001 Mission Street - La Loma Market #4, Daly City. The original license was issued as a Type 21 license in 1985, which was transferred in 1994, 1995, 1998, and then to the current owner in 2020.

All the above retailers, except for Crocker Market and Liquor (98 Crocker Avenue) are also small- to medium-size grocery stores, offering fresh foods (fruits, vegetables, and fresh/pre- packaged meat). All the retailers, with the exception of Crocker Market and Liquor, only offer beer and wine for sale. Crocker Market and Liquor is more of a convenience-store-type-retailer and offers beer, wine, and distilled spirits (“hard alcohol”). The floor area devoted to alcohol in each of the businesses is minimal (less than 10 percent) at Morazan Market, La Loma, and BART Grocery. Staff estimates the floor area devoted to alcohol sales at Felix Grocery Store and Crocker Market and Liquor exceeds 25 percent.

Summary
The City Council may desire to:

1. Deny the request that the public convenience or necessity would be served by the issuance of a Type 21 license to sell beer and wine at Vira Market located at 6189 Mission Street; or

2. Find that persons living in Census Tract 6007.01 are not adequately served by the existing alcoholic beverage sales outlets and that the public convenience or necessity would be served by the issuance of a license for the sale of beer and wine to Vira Market located at 6189 Mission Street.

1) Approve the design documents for the Mussel Rock Landfill Upper Disposal Area Pull- Back Project;
2) Affirm the CEQA determination of Categorical Exemption; 3) Accept all bids and award a construction contract to ETIC of Pleasant Hill, California, in the amount of $1,033,482.57; and
4) Authorize the City Manager to execute all necessary contracts to complete the project.

Background
The Mussel Rock Landfill is a closed landfill in Daly City located adjacent to the Pacific Ocean near Westline Drive. It contains over a million cubic yards of waste and is subject to continuous land movement and erosion. The site contains two, large landfill areas, more formally known as the Lower Disposal Area (LDA) within the middle and southern areas of the site, and the Upper Disposal Area (UDA) located in the northern portion of the site.

Currently there is exposed waste and continued landslide activity from recent storms on the North Bluff area of Mussel Rock. Additional excavation and solid waste relocation is required.

Discussion
The construction bid documents were prepared by Cotton, Shires and Associates of Los Gatos, California. The project was advertised on November 22, 2023 and seven (7) bids were received on December 13, 2023 with total bids ranging from $1,033,482.57 to $2,194,950.00. The three lowest bids and the Engineer’s Estimate are summarized as follows:

2. Schreder & Brandt MFG, Inc. $1,323,208.00 Responsive Bid

3. Brannon Corporation $1,578,727.00 Responsive
Bid
Engineer’s Estimate $1,560,000.00
Determination of the lowest bidder was based on the lowest total bid. ETIC of Pleasant Hill, California, has been in business since 1991. This bidder holds the required Class A contractor’s license, which is current and in good standing. The contractor’s references for work performed for other public agencies are acceptable including the San Joaquin County and Golden Gate Bridge Highway and Transportation District and for Southern California Edison.

The low bid for this project is 34% lower than the Engineer’s estimate. If approved, it is anticipated that the Mussel Rock Landfill Upper Disposal Area Pull-Back project would begin construction in February 2024 and be completed by September 2024.

Fiscal Impact
The total estimated construction cost for this project is $1,343,527.34, which includes the $1,033,482.57 construction contract and $310,044.77 (30%) for construction contingency, inspection and contract administration cost.

The City was awarded $750,000 in grant funds and previously appropriated $950,000 of unallocated solid Waste Franchise Fee for the project’s local match for the project. There are sufficient funds in Fiscal Year 2022-23 General Fund CIP – Mussel Rock North Bluff Mitigation and Stabilization Project – Upper Disposal Area Targeted Waste Removal project account 31-310- 546 to fully fund the project. No additional appropriation is needed at this time.
