City Council Meeting Agenda ReportItem # _____
Meeting Date: April 28, 2025
Subject: Accept Report Regarding the Potential Repayment to the County of San Mateo for the Cost of Installation of New Fare Gates at the Daly City BART Station Recommended Action
Accept Report Regarding the Potential Repayment to the County of San Mateo for the Cost of Installation of New Fare Gates at the Daly City BART Station.

Background
BART provides essential public transportation services to residents throughout the Bay Area, including in San Mateo County. On March 6, 2024, BART unveiled its Next Generation Fare Gate Project (“Project”), which involves a systemwide replacement of BART’s legacy fare gates with new, state-of-the-art fare gates at all BART stations. The Project will cost approximately $90 million to complete. Four cities within San Mateo County host BART stations; specifically, Daly City, Millbrae, San Bruno, and South San Francisco. In addition, the Colma BART Station is located in the unincorporated area, immediately adjacent to the Town of Colma.

The projected total cost of the Project for the above five BART stations in San Mateo County is $10,321,678. The allocation of the total cost among the jurisdictions—determined by how many fare gates are presently installed at each station—is estimated to cost $125,874 per fare gate. The Daly City BART Station has 11 fare gates and is estimated to cost a total of $1,384,614.

Discussion
The City supports the installation of new fare gates at the Daly City BART Station, as this Project will:
•provide security and safety by ensuring that only passengers who have paid for their ride can access the trains;
•improve accessibility for people with disabilities;
•alleviate congestion at the gates during peak commute hours, improving flow and reducing wait times for riders; and
•allow modern payment practices.

The San Mateo County Transit Agency (SMCTA) is responsible for overseeing transportation projects in San Mateo County, and part of its role involves allocating funds to various transportation agencies, including BART. BART intends to apply for a grant from the SMCTA Measure W Regional Transit Connection Program (“Measure W RTC Grant”) to cover the cost of the Project at the above stations in San Mateo County.

Since it will not be known until July/August 2025 whether BART will receive the Measure W RTC Grant, on March 25, 2025, the San Mateo County Board of Supervisors agreed to provide BART bridge funding in an amount up to $10,321,678.

City Council Agenda Report
Subject: Authorize the City Manager to Negotiate and Enter into a Memorandum of Understanding with the County of San Mateo Regarding the Potential Repayment for the Cost of Installation of New Fare Gates at the Daly City BART Station
Meeting Date: April 28, 2025

Page 2 of 2 ends

In the unlikely event that BART does not receive a Measure W RTC Grant, or if the grant is insufficient to cover the entire cost of the Project at the BART stations in San Mateo County, the County would seek repayment from Daly City, Millbrae, San Bruno, and South San Francisco for any funds the County provided for Project costs at BART stations in their respective jurisdictions, and each legislative Council shall take action to authorize repayment of any amounts ultimately advanced by the County for Project costs.

Fiscal Impact
The fiscal impact will depend on future events:

A. If, as expected, BART receives a grant to cover the full cost of the Project, there will be no repayment from the City of Daly City needed.

B. If a grant is not awarded, or if the grant is insufficient to cover the entire cost of the Project at the BART stations in San Mateo County, it is expected that Daly City will repay the County up to $1,636,364 for the projected cost of the installation of 13 new Fare Gates over a 10-year period with no accrued interest. The time frame of a no-interest repayment will be determined by the County Executive, in consultation with the County Attorney, and mutually agreed upon by the City. Staff will return to Council with the draft Memorandum of Understanding for review and approval.

Summary/Conclusion
While there is minimal risk and a low possibility that SMCTA will not award grant funding for this Project, staff wanted to inform the City Council in advance of the potential repayment.

Staff is available to provide any additional information desired by the Mayor or Councilmembers.

Respectfully submitted,
Leilani Ramos
Assistant to the City Manager

Meeting Date: April 28, 2025
Subject: Accept and Appropriate Grant Funding from CalRecycle Recommended Action
Accept and appropriate a $25,569 grant for FY 2024/25 from the California Department of Resources Recycling and Recovery (CalRecycle) for implementation of recycling and diversion activities.

Background/Discussion
CalRecycle is the California State agency that promotes recycling, waste reduction, and product reuse. Through the Beverage Container Recycling City/County Payment Program, grant funding is provided to jurisdictions to promote beverage container recycling and litter cleanup activities with a goal to reach and maintain an 80 percent recycling rate for all California refund value beverage containers—aluminum, glass, plastic, and bi-metal.

The City of Daly City will use these funds to expand water refill stations in parks and City facilities, increase recycling opportunities in public and other residentials areas, host litter clean-up events, conduct marketing and create advertisements to promote recycling, and provide educational opportunities for elementary and middle schools in the community. The City of Daly City has approximately two years to expend the funding award.

Fiscal Impact
The grant revenue from CalRecycle has been awarded in one full installment of $25,569. The grant revenue from CalRecycle will be fully expended at the end of Fiscal Year 2026/27.

Summary/Conclusion
Staff is available to provide any additional information desired by the Mayor or Councilmembers.

Respectfully submitted,
Leilani Ramos
Assistant to the City Manager

It is recommended the City Council authorize the City Manager to execute an agreement with the Jefferson Elementary School District (JESD) and appropriate grant funds of $1,041,701.57 for the Fiscal Year 2026 (School Year 2025-2026) for After School Education and Safety Program (ASES) at MPBrown Elementary School ($144,401.57) and the Expanded Learning Opportunities Program (ELOP) at Daniel Webster, MHTobias, Thomas Edison Elementary Schools and Fernando Rivera Intermediate School (up to $897,300).

Background
The Department of Recreation Services currently provides the Afterschool Youth Recreation Program (AYRP) at five (5) JESD sites (Daniel Webster, MHTobias, MPBrown and Thomas Edison Elementary Schools and Fernando Rivera Intermediate School). Programming is provided at the sites: ELOP through 5:30pm and ASES through 6:00pm. The components of the program include homework assistance, enrichment, snack/supper (depending on the site) and recreational activities. The AYRP is also offered at Panorama Elementary School (Brisbane School District) and Junipero Serra Elementary School (SSF Unified School District).

The ELOP funding is provided to the JESD and in turn they are contracting our services to provide a comprehensive program at the four school sites.

The ASES MPBrown Elementary School funding is provided directly by the State of California Department of Education to the JESD. The JESD serves as the pass-through and is contracting our services for the costs incurred by the City to deliver the ASES program.

Fiscal Impact
Funding for the ASES MPBrown Elementary School program in the amount of $144,401.57 should be appropriated into account number 01-131-141-3796. Funding for the ELOP at Daniel Webster, MHTobias and Thomas Edison Elementary Schools and Fernando Rivera Intermediate School in the amount of $897,300 should be appropriated into account number 01-131-141-3743.

Subject: Approval of Quitclaim of Public Service Utility Easement and Emergency Vehicle Access Easement on Map of Point Martin II to KB Home South Bay, Inc., and Acceptance of Public Service Utility Easements and Emergency Vehicle Access Easement from KB Home South Bay, Inc. – Point Martin II Recommended Action
Staff recommends that the City Council:
1) Approve offer of quitclaim of Public Service Utility Easement (PSUE) and Emergency Vehicle Access Easements (EVAE) on the Final Map entitled “Map of Point Martin II SUB-9-17-12296”, filed August 5, 2020, in Book 142 of Maps at pages 89-94, in the office of County Recorder of San Mateo County, as described and depicted in Exhibit A, to KB Home South Bay, Inc., a California Corporation;
2) Accept the Public Service Utility Easements (PSUEs) and Emergency Vehicle Access Easement (EVAE), as described and depicted in Exhibits B, C, D, and E, from KB Home South Bay, Inc. – Point Martin II, hereinafter called the Current Subdivider; and 3) Authorize the City Manager to execute all necessary documents for recordation.

Background
On June 22, 2020, the City Council approved the Point Martin II Subdivision Improvement Agreement (SIA) between the City of Daly City (City) and Point Martin LLC, hereinafter called the Original Subdivider, and approved the Final Map SUB-9-17-12296 for Point Martin II, along with all “public service utility easements” and “emergency vehicle access easements”. The SIA requires the subdivider to complete all subdivision improvements, including but not limited to, the streets, sidewalks, lighting, landscaping, utilities, and joint trench to complete the project at the developer’s sole expense. The SIA also calls for the posting of securities (bonds), sets a schedule for completion of all work, establishes a warranty period, and requires the subdivider to indemnify and defend the City for all claims arising from the subdivision. Finally, the SIA contains remedies to be utilized in the event of a default in performance by the subdivider.

On June 11, 2021 the City executed an Assignment and Assumption of Subdivision Improvement Agreement for Point Martin II (SUB-6-17-12296) between the Original Subdivider and the Current Subdivider, where the Original Subdivider assigned, sold, and transferred to the Current Subdivider, all of the Original Subdivider’s right, title, interest, and obligations in and to the Point Martin II SIA, and the Current Subdivider accepted such transfer and assignment and assumed and agreed to be bound by all terms and conditions of the Point Martin II SIA.

As part of the Point Martin II project, the Original Subdivider was required to grant a PSUE for the

construction, replacement, maintenance and repair of any and all public service facilities and appurtenances within said easement, as well as EVAEs for the rights of ingress and egress across the lands of the Current Subdivider by emergency vehicles, including but not limited to, fire trucks, ambulances, police vehicles, and other vehicles designated for emergency services. These easements had been dedicated to the City with the approval of the final map for Point Martin II SUB-9-17-12296.

Discussion
The Current Subdivider has requested the City to quitclaim the described easement areas (see attached Exhibit A – Quitclaim Deed) of each effected lot back to the Current Subdivider. The described areas of PSUEs and EVAE to be reconveyed back to the Current Subdivider will be replaced with new PSUEs and EVAE that encompass the lot line adjustments required for the project.

Acceptance of the new PSUEs will allow the City to access the property for the purpose of construction, replacement, maintenance and repair of any and all public service facilities and appurtenances within said easement.

Acceptance of the new EVAE will allow emergency vehicles rights of ingress and egress across the property.

The attached legal descriptions and plat maps for the Quitclaim of Easements, PSUEs, and EVAE have been reviewed and approved by staff and are now ready for City Council acceptance.

Fiscal Impact
There is no fiscal impact associated with these recommendations.

Summary/Conclusion
Staff recommends that the City Council:
1) Approve offer of quitclaim of PSUE and EVAE on the Final Map entitled “Map of Point Martin II SUB-9-17-12296”, filed August 5, 2020, in Book 142 of Maps at pages 89-94, in the office of County Recorder of San Mateo County, as described and depicted in Exhibit A, to KB Home South Bay, Inc., a California Corporation; 2) Accept the PSUEs and EVAE from KB Home South Bay, Inc. – Point Martin II, hereinafter called the Current Subdivider; and
3) Authorize the City Manager to execute all necessary documents for recordation.

City Council Agenda Report Item #
Meeting Date: April 28, 2025
Subject: Setting the Time and Place of the Public Hearing for Daly City’s National Pollutant Discharge Elimination System Program Regulatory Fee Recommended Action
It is recommended the City Council set a new time and place of a public hearing for 7:00 p.m., May 12, 2025 to review the local National Pollutant Discharge Elimination System (NPDES) Stormwater Regulatory Fee.

Background
The San Francisco Regional Water Quality Control Board reissued a consolidated Bay Area Municipal Regional Permit (MRP) on May of 2022. The permit conditions mandate numerous and costly municipal stormwater management activities over the following five years. The City/County Association of Governments continues to administer the General Program components. Each municipality is responsible for achieving specific program activities and filing an annual report on city specific and county-wide compliance activity. The City first established a stormwater fee in 1995 several years after the NPDES regulatory program was initially established in 1991 in order to finance the many new municipal activities required under to comply with this program.

Discussion
Since 1995, Daly City utilized the regulatory fee structure adopted in Ordinance No. 1219 to finance local specific activities to comply with mandated Stormwater Program requirements. This fee structure has not been amended or increased at any time in the past 29 years. This fee structure remains as follows for each Assessor Parcel Number:

Single Family/Duplex $9.80 Multi-Family (11-20 units) $36.76 Unimproved Land $4.90 Commercial/Retail/Manufacturing $56.84 Multi-Family (3-10 units) $19.60 Condominiums $4.90 On an annual basis, this local fee generates approximately $470,000. Its structure is based on the correlation between parcel size, land use and stormwater runoff, with the base fee assigned to single family/duplex parcels as they are the City’s predominant land use. To allocate costs proportionately, all other categories of use are assigned a factor compared to single family/duplex and take into account street frontage, impervious surface coverage and vehicle trips.

From its prior action, the City Council already authorized continued use of the San Mateo County Flood Control District to collect charges associated with the Countywide NPDES General Program.

Staff is available to provide any additional information desired by the Mayor or City Council members.

City Council Agenda ReportItem # _____
Meeting Date: April 28, 2025
Subject: Public Hearing - Proposed Increases and Updates to the Daly City Master Fee Schedule
Recommended Action
Staff recommends that the City Council adopt a resolution approving the proposed increases and updates to the Daly City Master Fee Schedule.

Background
In 2022, the City Council agreed to review any proposed increases and updates to the Fee Schedule on an annual basis. Additionally, Council agreed with staff’s recommendation to update the user fees incorporated into the Master Fee Schedule at an amount consistent with the negotiated Cost of Living Adjustment (COLA). The City Council last adopted the Daly City Master Fee Schedule for FY 2025 during the May 13th, 2024 meeting.

Discussion
Finance staff has made recommendations for the Master Fee Schedule with input from Department Heads. All the proposed updates and increases are included in Attachment A, Proposed FY 2026 Master Fee Schedule – Edited and Attachment B, Proposed FY 2026 Master Fee Schedule – Clean.

Previous years updates included increases consistent with the COLA for that fiscal year. For FY 2026, staff recommends a nominal 2% adjustment, as labor negotiations are ongoing.

Finance staff also asked the Library Department and the Recreation Department if they had any program fee changes, as these were not a part of the User Fee Study conducted in 2022. The Library Department had minor updates, and the Recreation Department took this opportunity to make edits to a handful of their fees.

Finance worked with the Fire Department to evaluate and adjust the New Occupancy/Business Inspection Fees and Annual Fire Inspection Fees based on Council’s request for a tiered cost structure. This assessment resulted in a recommendation of four tiers based on the square footage of the business; Tier 1 for businesses less than 10,000 square feet, Tier 2 for businesses between 10,000- 20,000 square feet, Tier 3 for businesses between 20,001-45,000 square feet, and Tier 4 for businesses above 45,000 square feet. The tiers are based on the increased level of service or time it takes to inspect businesses in Tiers 2, 3, and 4. Due to this change, it is also recommended that the current rate for both Fire Inspection fees are not increased for Tier 1 – businesses less than 10,000 square feet for FY 2026 to provide Tier 1 businesses a pause from fee increases. The tier structure will affect an estimated 31 business in Daly City by placing them in higher tiers. The new tier structure is included in Attachments A, B, and C.

Any fees operating outside of the 2% recommended increase, as well as fee additions and removals, have their reasoning explained in Attachment C.

Page 2 of 2 ends

The majority of these changes are proposed to take effect on July 1 st. However, certain annual fees will take effect on January 1st, which is stated in the Master Fee Schedule.

Fiscal Impact
Fee increases will be accounted for in the department revenue estimates for FY 2026, the budget for which will be brought before City Council for approval.

Summary/Conclusion
Staff recommends that the City Council adopt a resolution approving the proposed updates and increases to the Master Fee Schedule as listed in Attachment A.
