Zone Change ZC-06-26-017088 - Amendments to Chapter 17.47 - Inclusionary Housing Establishing Preference to Persons Who Live or Work in Daly City for Income-Restricted Affordable Housing Units
Acting Director of Economic and Community Development Michael Van Lonkhuysen provided the staff report recommending amendments to the Inclusionary Housing Ordinance, noting that Councilmember Manalo, a long-time advocate of affordable housing, requested that staff amend the ordinance to implement a local preference policy for affordable units. Based on the results of the Disparate Impact Analysis (DIA), staff recommended applying the local preference policy to 70 percent of the affordable units in residential developments. Van Lonkhuysen addressed questions on which housing developments are affected by the amendment and planned housing developments in the City.

It was moved by Mayor Sylvester to open the public hearing.

Speakers from Faith In Action Bay Area (FIABA), including long-time residents of Daly City, expressed support for the proposed amendment to prioritize affordable housing units for those who live or work in Daly City. They emphasized the community's need for more affordable, accessible, and dignified housing, particularly for low-income families and other vulnerable residents. They stated that prioritizing 2 CITY OF DALY CITY

local residents and workers would expand housing opportunities for people with strong ties to the community, help families remain in Daly City, and reduce the risk of displacement. Several speakers connected the amendment to the goal of ensuring that residents have access to safe, stable, and dignified homes. Speakers also highlighted the importance of strengthening tenant protections through the adoption of anti-harassment laws. They described such protections as necessary to prevent tenants from being mistreated or pressured out of their homes and connected the proposed amendment as an important small step toward establishing stronger tenant protections in Daly City. They noted that the anti-harassment legislation remains in process and urged the Council toward its adoption.

Van Lonkhuysen answered questions on whether the DIA addressed anti-harassment issues, clarifications on the proposed amendments, and the process for qualifying for affordable housing. City Attorney Rose Zimmerman clarified that establishing these preferences would not result in a disparate impact on any discrimination as it pertains to protected classes. She also noted that the ordinance currently includes an accessibility feature granting priority to individuals who require accessibility features, ahead of the preferences.

Mayor Sylvester requested a copy of the DIA in order to move forward. Mayor Sylvester and Councilmember DiGiovanni requested assurances that the proposed ordinance would comply with federal It was moved by Councilmember Manalo, and seconded by Councilmember Daus-Magbual and carried by unanimous roll call vote for the City Attorney to read the ordinance by title only.
