PUBLIC NOTICE
CITY OF DANA POINT
NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN THAT a public hearing will be held by the City Council of the City of Dana Point to consider the following:
General Plan Update to Circulation and Economic Development Elements (GPA22-0001) and Public Safety Element (GPA22-0002): Updates to the Circulation, Economic Development, and Public Safety Elements of the City’s General Plan to reflect a citywide vision statement and guiding principles through the adoption of goals, policies, and environmental review through the preparation of an Addendum to the City’s General Plan Environmental Impact Report (EIR). Additional updates include a refined introduction section, adoption of Transportation Impact Analysis (TIA) guidelines, and updates to Orange County Transportation Authority (OCTA) Master Plan of Arterial Highway (MPAH) designations.
Planning Commission Recommendation: On June 23 and September 8, 2025, the Planning Commission reviewed the proposed amendments and made recommendations that City Council adopt resolutions approving GPA22-0001 and GPA22-0002, Transportation Impact Analysis (TIA) Guidelines, updated Orange County Transportation Authority (OCTA) Master Plan of Arterial Highway (MPAH) Designations, and a CEQA Addendum to the City’s General Plan EIR. Planning meeting proceedings and discussions are available on the City’s website at danapoint.org.
Project Number: General Plan Amendment (GPA22-0001 and GPA22-0002) Project Location: Citywide
Applicant: City of Dana Point
Environmental: Pursuant to the provisions of the California Environmental Quality Act (CEQA), the proposed Public Safety Element is being processed as an Addendum to the City of Dana Point’s 1991 General Plan certified Environmental Impact Report (EIR), State Clearinghouse (SCH) No. 1991021054. The Addendum determined that there is no substantial evidence that the proposed project would result in significant environmental impacts not previously studied in the certified EIR, and accordingly, the project changes would not result in any conditions identified in CEQA Guidelines Section 15162.
In addition, neither the adoption of Transportation Impact Analysis Guidelines nor the adoption of updates to the Master Plan of Arterial Highways (MPAH) constitute a “project” as that term is defined in the California Environmental Quality Act because neither action would cause a direct physical change in the environment, nor will they cause a reasonably foreseeable indirect physical change in the environment. Separately and additionally, the actions are categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Title 14 California Code of Regulations Sections 15061 (b)(3) and 15378, in that it can be seen with certainty that the these actions do not propose an activity that might have a significant effect on the environment, and further, it will not cause a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. Adoption of these documents qualifies for a Class 8 Categorical Exemption under CEQA Guidelines §15308, as it involves actions taken by a regulatory agency to protect the environment, including the promotion of sustainable transportation planning and greenhouse gas reduction. Moreover, there are no unusual circumstances associated with either of these actions, and thus it is not subject to the unusual circumstances exception set forth in Title 14 California Code of Regulations Section 15300.2.
