NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on September 1, 2026, the City Council of the City of Dana Point will conduct a public hearing to hold a first reading of an Ordinance entitled:
Accessory Dwelling Units / Junior Accessory Dwelling Units
AMENDMENT TO THE DANA POINT ZONING CODE TO ADOPT ACCESSORY DWELLING UNIT (ADU) AND JUNIOR ACCESSORY DWELLING UNIT (JADU) REGULATIONS.
Planning Commission Recommendation: On July 13, 2026, the Planning Commission held a public hearing to consider the proposed amendment and made a recommendation to City Council to approve Zone Text Amendment 26-0002 to update the City’s zoning regulations related to Accessory Dwelling Units and Junior Accessory Dwelling Units, consistent with state law. Environmental: Pursuant to the California Environmental Quality Act (CEQA) Section 15061(b)(3), the project is covered under the commonsense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA.

Any action or proceeding to attack, review, set aside, or void and decision of the Dana Point City Council is controlled by Section 2.50.010 and Section 2.50.020 of the Dana Point Municipal Code.

Second Dwelling Units (Coastal Zone)
AMENDMENT TO THE DANA POINT ZONING CODE TO REINSTATE THE SECOND
DWELLING UNIT REGULATIONS THAT REMAIN OPERATIVE WITHIN THE COASTAL ZONE AND UNDER THE CITY’S CERTIFIED LOCAL COASTAL PROGRAM.
Planning Commission Recommendation: On July 13, 2026, the Planning Commission held a public hearing to consider the proposed amendment and made a recommendation to City Council to approve Zone Text Amendment 26-0003 to update the City’s zoning regulations to reinstate the second dwelling unit regulations that remain operative within the coastal zone and under the City’s Certified Local Coastal Program.
