ADMINISTRATIVE STAFF REPORT 8.5
TO: Mayor and Town Council July 21, 2026
SUBJECT: Resolution No. 63-2026, Appropriating Funds and Authorizing the Town Manager to Execute a Professional Services Agreement for Special Inspection and Materials Testing Services for the Town Green Pavilion and Town Studio (Arts District Maker Space), CIP B-628 and B-629

BACKGROUND
The Capital Improvement Program includes CIP Project B-628, Town Green Pavilion, and CIP Project B-629, Town Studio (Arts District Maker Space). Together, these projects will construct a new pavilion at the Town Green and a new Maker Space facility at 282 Front Street to support arts programming, classes, workshops, gallery space, and community use.

The Town recently awarded a construction contract for the Town Green Pavilion and Town Studio project. Construction of the project will include building, structural, site, utility, and related improvements that require inspection and materials testing during construction.

DISCUSSION
Certain construction activities require special inspection and materials testing to verify that the work is performed in accordance with the approved plans, specifications, and applicable Building Code requirements. Special inspections are performed by qualified inspectors or testing agencies independent of the contractor and are typically required for specific structural and life-safety related work.

For the Town Green Pavilion and Town Studio project, anticipated special inspection and materials testing services may include inspection and testing related to structural concrete, reinforcing steel, structural steel, welding, bolting, anchors, soils compaction, trench backfill, masonry or veneer systems, and other items identified in the approved plans, specifications, and applicable inspection requirements.

The Town solicited a proposal from ENGEO Incorporated of San Ramon, California, to provide special inspection and materials testing services for the project. ENGEO is qualified to perform these services and has provided engineering, inspection, and testing services for other Town projects.

Special Inspection Services 2 July 21, 2026
Town Green Pavilion and Makers Space
CIP No. B-628 & B-629
It is recommended that the Town authorize a Professional Services Agreement with ENGEO in an amount not-to-exceed $50,000. Staff also recommends authorizing use of a 20% contingency in the amount of $10,000 to address additional inspection or testing services that may be required due to field conditions, construction sequencing, retesting, or other project needs. The total authorization will therefore be $60,000.

PUBLIC CONTACT
Posting of the meeting agenda serves as notice to the general public.

FISCAL IMPACT
The Professional Services Agreement with ENGEO is in an amount not-to-exceed $50,000.

A 20% contingency in the amount of $10,000 will be reserved for use at the Town Manager’ s discretion, for a total special inspection and materials testing services budget of $60,000.

An appropriation of $60,000 from the Park Land Dedication Impact Fee Fund to CIP Projects B-628 and B-629 is needed to fund this work.

RECOMMENDATION
Adopt Resolution No. 63-2026, Appropriating Funds and Authorizing the Town Manager to Execute a Professional Services Agreement for Special Inspection and Materials Testing Services for the Town Green Pavilion and Town Studio (Arts District Maker Space), CIP B-628 and B-629.
