ADMINISTRATIVE STAFF REPORT 8.8
TO: Mayor and Town Council July 21, 2026
SUBJECT: Resolution No. 65-2026, accepting $102,706.06 from the California Highway Patrol for the Cannabis Tax Fund Grant Program, and authorizing the Town Manager to execute the Grant Program Agreement

BACKGROUND
In November 2016, California voters passed Proposition 64: The Adult Use of Marijuana Act. With the passage of Proposition 64, the California voters mandated the state set aside funding for the California Highway Patrol (CHP) to award grants to local governments and qualified nonprofit organizations for the purpose of Driving Under the Influence ( DUI) enforcement, education and prevention.

Per Revenue and Taxation Code Section 34019( F)(3)(B), funds will be disbursed, “ To the Department of the California Highway Patrol to fund internal California Highway Patrol programs and grants to qualified nonprofit organizations and local governments for education, prevention and enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis; programs that help enforcement traffic laws, educate the public in traffic safety, provide varied and effective means of reducing fatalities, injuries and economic losses from collisions and for the purchase of equipment related to enforcement of laws related to driving under the influence of alcohol and other drugs, including cannabis.”
The grant program established by Proposition 64 and the California Highway Patrol is referred to as the Cannabis Tax Fund Grant Program ( CTFGP). The Danville Police Department has participated in the (CTFGP) since 2023. The program has funded numerous projects including training for DUI Field Sobriety Test techniques, twenty- five DUI Saturation Patrol events, and two new traffic enforcement patrol vehicles. DUI Saturation Patrols funded by this grant program have resulted in 404 DUI investigative enforcement stops, and seventeen arrests ( including 16 for DUI related offenses).

The Danville Police Department has received a conditional award for $102,706.06 for the CTFGP 2026- 2027 grant cycle. The award includes overtime funding for Police Officers and Sergeants to conduct twelve DUI Saturation Patrols ($47,520.00) and to purchase and outfit a new traffic enforcement patrol motorcycle ($ 55,186.06). To enter into the Grant Agreement, the Town must adopt a Resolution accepting the award and execute the required documents.
