Dear Mayor Worden, Deputy Mayor Martinez and Councilmembers, I request you to consider our local scientists’ advice, Drs Chisari and Mosier: indoor masking and vaccination verification for indoor places of business.
12 residents submitted red dot letters two weeks ago specifically asking for the Council to schedule a special meeting to organize measures requiring evidence of full vaccination, including a booster, in addition to wearing a mask, as a condition for entry into all public indoor spaces in Del Mar. Here are the red dots for your handy reference: https://www.delmar.ca.us/AgendaCenter/ViewFile/Agenda/_01102022-2895 The Agenda for the Special Meeting of January 26th, 2022 contains discussion regarding extending measures to support businesses. Where are the measures to support your most vulnerable (beyond following basic public health orders)? Can’t we do both, support local businesses and protect our most vulnerable? Thank you,
Valérie Dufort-Roy & Sudeepto Roy

Dear Councilmembers,
We are writing to fully support the content of a letter you have received from two Del Mar citizens with deep professional expertise and experience on this subject: Dr. Donald Mosier and Dr. Frank Chisari. In their thoughtful and informed letter, they explain their logical and principled position. We totally concur and feel that it is of tremendous urgency that our City does everything possible to fight this pandemic. You, our City Council, need to mandate the same level of protection for the citizens of Del Mar as you now do for the City employees.
From the letter:
The proposed resolution “encourages” compliance with current COVID-19 precautions, but it does not mandate the same level of protection afforded to city employees. We (Dr. Frank Chisari and I) respectfully request that you require proof of full vaccination (including a booster shot that is essential to protect against hospitalization from the Omicron variant) for entry into restaurants and retail establishments. This would be enacted as an urgency ordinance in place for the next month, with renewal after that based on the number of new infections in Del Mar (currently at 429 as of last week) either declining (ordinance suspended) or increasing or holding steady (ordinance extended for one month).
We also respectfully request that you please enact this as an urgency ordinance that is in place by February – requiring proof of FULL vaccination (3 shots) for entry into Del Mar restaurants and retail operations.
Thank you,
Anne and John Farrell

Dear Council Members,
I am writing in support of the letter you received from Drs. Donald Mosier and Frank Chisari, two Del Mar residents with profound professional expertise and experience relevant to fighting this pandemic. It’s urgent that Del Mar do everything possible to fight the pandemic, and the City Council should mandate the same level of protection for the citizens of Del Mar as you now do for City employees.
As Drs. Chisari and Mosier request, the Council should "require proof of full vaccination (including a booster shot that is essential to protect against hospitalization from the Omicron variant) for entry into restaurants and retail establishments. RED DOT letter for Special Del Mar City Council Meeting, January 26, 2022 Dr. Donald Mosier, Rimini Road
Del Mar is unique in many ways, but when it comes to COVID-19, we are unique because of the age of our residents. According to the latest census, Del Mar has over 1,200 residents aged 65 or older, with the percentage of older residents twice that of the rest of San Diego County (27.3% vs 13.7%). Why is this important?
Adults over 65 years of age represent 80% of hospitalizations and have a 23-fold higher risk of death than those under 65 (AL Mueller et al., PMID 32470948). There are four documented reasons for the increased risk associated with age:
1. As age increases, the immune response weakens in general
2. The fraction of the population that fails to respond to the COVID vaccines goes up with age and the duration of the immune response is shorter in those over 65 who do respond
3. Comorbidities increase with age, including cancer, diabetes, heart disease, and obesity
4. Older individuals are more likely to believe COVID misinformation The City of Del Mar has done a good job in adopting policies that protect its employees and the public who make use of city facilities. Why not extend those policies to enhance protection of our 1,200 senior citizens who are at higher risk for hospitalization and death from COVID-19? The threat to these residents come from the 2 million plus visitors to Del Mar each year, with an estimated 500,000 unvaccinated (the latest data from the CDC indicates that 74% of US citizens have received at least one dose of vaccine) and the estimated 500,000 who refuse to wear masks (several recent studies show that 25% or more of the US population do not wear masks indoors). Any encounter with these visitors poses a clear and present danger to our residents, particularly the 1,200 older Del Mar citizens. Of these 1,200 individuals, it is estimated that 400 have not received booster shots (67% coverage in 92014 ZIP code) and 120 would be in the 10% who fail to respond to the vaccine, resulting in more than 500 highly susceptible seniors to infection with the Omicron variant.
5 January 26, 2022 Item 01
The importance of protecting our residents against serious disease and possible death seems to us to outweigh any temporary economic impact to our businesses. Let’s craft solutions that fit the unique population of Del Mar and not adhere to public health policies for a different demographic.
We appreciate your consideration of what we believe to be the most consequential decision any Del Mar City Council has faced.

I fully support the letter submitted to you from Dr. Donald Mosier and Dr. Frank Chisari regarding Item #1, Special Meeting, January 26,2022. We should all pay attention to these individuals who have an expertise in this field. "Encouraging" compliance will not stop unvaccinated individuals from using retail and restaurant establishments, thus exposing all customers to the highly transmissible Omicron. Please take a strong position to protect our citizenry, as you have our City employees, and stand by it.

Dear City Council,
It would be a great step in the WRONG DIRECTION to impose any type of vaccine mandates and impose enforcement by our city businesses or resources.
At this point in time, many countries are loosening restrictions and abandoning the need for vaccine passports and restrictions.
Luckily, the prevalent variant circulating is Omicron that has not proven to be serious or fatal. Further, the CDC and others have shown that the single and two course vaccines are proving to have very low effectiveness against Omicron.
There is no presented evidence of serious illness or fatalities in Del Mar related to Omicron, and there is no evidence that such illness or fatalities would be curtailed by vaccine requirements on our businesses.
Any potential health risks cannot outweigh the certain risks to our businesses. Our restaurants and shops are struggling as it is, and cannot stand to have ANY further burdens placed upon them.
Please don't consider imposing restrictions that are tighter than the rest of san diego.
Thank you,

Mayor Worden, Distinguished Council Members,
I am 91 years old. I am not a scientist, but I have lived a long time and seen many things.
Covid is scary, but the fear should not stop people from living their lives. I have been exposed to the virus, and by the grace of God, I have not contracted it. By my own decision, I've been vaccinated, but I have family members who are not, yet I still see them and hug them and enjoy the time I have with them.
I know the scientists and health officials mean well, but with every little detail they learn about this virus, the rules change, confusing and scaring people even more. Common sense tells us to avoid large crowds and stay away from people when we don't feel well, but total masking and vaccine mandates equals virtually total isolation and I prefer not to live that way.
As friends and neighbors, let's be responsible for our own health and our own decisions.
Sincerely,
Jim Watkins

Dear Del Mar Council Members,
As a business, we are required to follow State & County health orders and we will continue to do so. We all want our employees, residents and visitors to be safe. We ask that you be consistent with the County and State.
However, we urge the City Council not to consider any type of vaccine mandate for residents and visitors to our businesses. We have no way to enforce vaccine, nor any way to confirm the validity of the vaccine cards. We would not want to give anyone a false sense of security by thinking that requiring proof of vaccine will assure them from getting the virus.
We support & appreciate the suggestion of extending the urgency ordinances, especially those that allowing for more outdoor use for businesses. I spent significant money to add coverings over my patios and opening all my windows.
It has helped our businesses so much, and we hope the Council will consider making these changes permanent.
Respectfully,

I eat in Del Mar restaurants several times per week. I understand that there is talk of requiring vaccination papers in Del Mar restaurants! There is absolutely no reason that you should come up with any additional rules outside of the San Diego County health guidelines. There are enough people that would refuse to eat in Del Mar on principal if they had to “show their papers”. Requiring “papers" would only hurt Del Mar restaurants and businesses, cause lost tax revenue for the city and ruin Del Mar’s reputation as a tourist friendly location.
There is building evidence that suggest that the vaccine does not prevent transmission of covid variants. Please, just stick to the San Diego County guidelines for health requirements.

To the Del Mar City Council,
I am writing in regards to the special meeting tonight discussing extending and/or adding Covid measures.
I will keep it very simple:
I am in agreement with extending the current measures already in place.
I disagree with the addition of any new measures that are not in full alignment with the health guidelines currently being recommended by the San Diego County Health Department. Any new measures requiring full vaccination including boosters to enter public spaces or private businesses would be an over reach by our city which would not improve safety due to the now proven significant leakiness of these vaccines while opening our city to unnecessary lawsuits.

Dear Mayor and Members of the City Council,
There are a couple of additional thoughts we would like to share with you beyond the comments in our earlier Red Dot.
First, because it is likely that many shopkeepers and restaurant owners will not comply with your “encouragement” that they require customers and diners to be fully vaccinated and boosted to enter their establishments, we again encourage you to follow the lead of many other American cities that require proof of Covid-19 vaccination for admission to indoor public spaces:
Boston, Chicago, Los Angeles, Minneapolis, St. Paul, New Orleans, New York, Philadelphia, San Francisco, Seattle, Washington, DC, and many, many others.
We appreciate the fact that such a requirement, whether mandated or voluntary, could hurt shopkeepers and restaurant owners and their employees in the pocketbook. We suggest, however, that their pain must be balanced against the fact that Del Mar’s immunocompromised, Covid-vulnerable citizens have much more to lose, so their needs should be foremost in your mind when you vote today.
At the same time, we encourage the City to step up to soften the financial blow of either mandatory or voluntary compliance with a vaccination policy on the financial interests of the commercial side of the community. We know this will not be an easy decision, but we strongly encourage you to strive to achieve a balance that not only protects the financial interests of our merchants but will protect and, conceivably, save the lives of the most vulnerable citizens in Del Mar.

I just heard about this meeting today. I own 2 businesses in Del Mar and I follow all of the County health requirements to the best of my ability. Most people wear masks now, but if a customer comes into my shop, I would not be comfortable asking them about their vaccine status. I believe a voluntary or non-voluntary requirement for vaccination status will penalize businesses. First, this falsely promises non-exposure that is not based in science. The virus can be spread by those vaccinated or unvaccinated, and is contagious even if someone has no symptoms.
Second, as a business owner, I try to "stay in my lane". This could stigmatize businesses. We are all just trying to provide services to the residents and visitors and to make a living without the controversy of small town politics. Additionally, it is difficult to keep up with the ever changing rules and regulations. Please stay consistent with the County Health Orders.
I also want to say I'd be thrilled if the Council would extend the urgency ordinances put in place to help the businesses during Covid. When much of the country saw businesses shutting down, with the help of the government, and the support of the locals, most Del Mar businesses made it through. The changes have been wonderful and would be good to keep forever.

Stacey Railey

Dear council
I am shocked that our council would vote to have more strict vaccine mandates than the San Diego county!
Is anyone looking at the science? Complete science not just one MD.
In a community that is so reliant on tourism that you would require vaccines or no entrance! Who is going to enforce this ? Who is going to be checking for vaccines and then if they forgot card or whatever reason telling a possible patron to leave? Losing a potential customer? Oh and by the way many who are vaccinated are getting this variant! So vaccine data does not prevent transmission!
Many customers of our retail shops will be going somewhere else or online. Isn’t that what we are trying to avoid and wanting to help businesses?
Any public facilities….really?
Please rethink this and vote no on this request!
You were elected to support and represent ALL residents! Thank you

Thank you to the City of Del Mar for implementing urgency ordinances during Covid to help the businesses of Del Mar. The changes allowed for many new businesses and helped those struggling during this pandemic. I support the extension of these ordinances, and really hope they will be made permanent.
With respect to the City's proposed resolution to "encourages Del Mar residents and businesses to follow current public health orders and best practices including, but not limited to, vaccinations/boosters, mask wearing, and social distancing to prevent the spread of COVID-19;" This is very vague and open to interpretation. Del Mar is in the same position as every other City in San Diego County and should not be implementing health mandates without a public health advisory department. The City of Del Mar needs to have a policy to follow San Diego County guidelines or public health will continue to be a public debate without proper advisors. Any action would create inconsistent health guidelines in San Diego County and the State of California.
Almost all Del Mar restaurants have predominantly outdoor dining areas. The mandates / recommendations in other cities (Los Angeles, New York etc.) only require proof of vaccine for indoor areas. Also, in Los Angeles, the proof of vaccination did not extend to retailers because of the limited time that most people are in a store. Unvaccinated individuals are no longer the sole source of Covid-19’s current Omicron variant. The variant is now highly contagious and is spread by both unvaccinated and vaccinated individuals. An asymptomatic, vaccinated individual with a booster and a negative Covid-19 test can just as easily spread Omicron as a nonvaccinated individual. With Omicron, neither proof of vaccine nor testing can stop the spread of Covid-19 in retail and restaurant establishments. To say otherwise would be misleading the public. It would lead people to believe they are safe from the spread, and they are not. Please do not implement any type of mandate that would be unenforcable.
Thank you for your time,
Patty Brutten

Del Mar Mayor and Councilmembers,
I understand there is concern for the elderly population and the exposure to Covid, so the City is discussing ways to keep the residents safe. I wouldn't say that I am elderly, but many of my friends and neighbors are in their 90's. Unfortunately, this virus is spread very easily and there is no guarantee of safety. Just going to the grocery store, or having food delivered is a risk. We've been told that masking, social distancing, hand washing, vaccines and being outdoor minimizes the risk of transmission. I know some cities in other states are mandating vaccines and masks when entering public businesses, but most of those are in cold weather areas where they can't sit outside to enjoy a good meal with friends. We are fortunate to have beautiful weather and restaurants that take advantage of that. Simply said, we don't need mandates in Del Mar. The vaccine has proven it can beat all of our precautions. People need to assess their own situation and only take the amount of risk they feel comfortable with. Some may want to stay out of public spaces, but some may want to take advantage of our beautiful town and weather.
Sincerely,
Robb Dalton

Dear Del Mar Council Members,
As the owner of 2 restaurants in our beautiful Del Mar, I am required to follow the State and County Health Orders and will continue to do so. All of my employees are double vexed and most of them are now gotten the booster as well. I ask that you please be consistent with county and state.
I want all employees, guests and our local community to be safe but adding this mandate is simply not reasonable or realistic. It would cause guests/ shoppers to be angry with the business owners directly by simply asking for proof which I am pretty sure they don’t have to show. This could hurt our community businesses for months to come, people will simply go else where to enjoy themselves without having to show proof of vaccines.
I don’t understand why we are listening to 2 local doctors rather than what the CDC and other scientists are telling us.
As you know business for the past 2 years has been Very hard for everyone to navigate so please VOTE NO on this mandate if you want to save your businesses and continue to enforce STATE AND COUNTY laws.

I eat in Del Mar restaurants every week & they should only follow San Diego health and safety guidelines and not require Proof of vaccines !

I am the owner of Shimbashi Izakaya at the plaza. I was just informed of this vote 5 minutes ago. This is unfortunate.
I think this idea is very drastic. I doubt that any of my employees have all the shots - I have had the J + J and thats it.
Expect that over 50% of our customers also do not meet the criteria and will not adjust to the requirements.
The current Covid strain is very mild - and if you know your history something very similar occurred in 1968 - 1970. This last wave will affect nearly all and will make us immune.
So, representing Shimbashi, I object to this idea . Please also realize that we are just coming out of 2 difficult years and do NOT want to go back to where we were. Particularly when the circumstances with covid have very improved. I hope Shimbashi can remain a Del Mar restaurant and will not be forced to relocate.

Dear Del Mar Council Members,
I just learned about this meeting.
I disagree with requiring businesses and individuals to show proof of vaccinations in order to enter businesses in Del Mar.
There is increasing evidence that suggest the vaccine does not prevent transmission of covid variants regardless of vaccination status.
Requiring vaccine proof would only hurt Del Mar businesses. Please, just stick to the San Diego County guidelines for health requirements.
Sincerely,
Saori Matsumoto

Red dot letter to City Council. As longstanding property owners and a restaurant patron in Del Mar, we support proof of full vaccination for entry to Del Mar restaurants, retail operation and hotels.

2 January 26, 2022 Item 01
The importance of protecting our residents against serious disease and possible death seems to us to outweigh any temporary economic impact to our businesses. Let’s craft solutions that fit the unique population of Del Mar and not adhere to public health policies for a different demographic.
We appreciate your consideration of what we believe to be the most consequential decision any Del Mar City Council has faced.
