TO: Honorable Mayor and City Council Members
FROM: Sarah Krietor, Administrative Services Manager/City Clerk Monica Molina, Finance Manager/Treasurer
Nestor Machado, Management Analyst

DATE: December 12, 2022
SUBJECT: Amendment to the Miscellaneous, Part-Time, Temporary and Hourly Employees Salary Schedule Related to Minimum Wage Changes REQUESTED ACTION/RECOMMENDATION:

Staff recommends that the City Council adopt the Resolution (Attachment A) amending the Miscellaneous, Part-Time, Temporary and Hourly Employees Salary Schedule (Exhibit A to Attachment A) to reflect a State mandated increase to minimum wage effective January 1, 2023.

DISCUSSION/ANALYSIS:

The City of Del Mar does not have a municipal minimum wage and instead complies with California minimum wage requirements. On July 27, 2022, the State Director of the Department of Finance certified that based on the annual inflation rate from July 1, 2021- June 30, 2022, under Labor Code section 1182.12(c)(3)(A), the state hourly minimum wage must be increased, effective January 1, 2023, to $15.50 an hour (regardless of the number of workers employed by an employer).

In order to comply with the provisions of the California Labor Code, staff recommends the City Council adopt the Resolution (Attachment A) amending the Miscellaneous, PartTime, Temporary and Hourly Employees (Part-Time Salary Schedule) to reflect an increase in minimum wage from $15.00 to $15.50 per hour effective January 1, 2023 (Exhibit A to Attachment A). The proposed amendment to the Part-Time Salary Schedule will result in compensation changes outlined below. No other City employee salaries are affected by the required increase to minimum wage.

As a result of the minimum wage increase, the Seasonal Worker I, Student Lifeguard, and Intern salaries will increase slightly, which will result in minor salary adjustments for 27 seasonal City employees. The additional salary costs are nominal and it is anticipated that sufficient funding is available in the Fiscal Year 2022-2023 Operating Budget. 1 December 12, 2022 Item 02
City Council Agenda Report
Minimum Wage Adjustment to Part-Time Employee Salaries for 2023 December 12, 2022

Page 2 of 2 ends

Additionally, the vacant and unfunded Minute Clerk, Clerical Assistant, Planning and OnCall Clerical, Secretarial Aide, Student Firefighter, Student Paramedic, and Call Firefighter salaries are also being adjusted and will remain on the Part-time Salary Schedule should the City wish to utilize these positions in the future.

FISCAL IMPACT:

There is no fiscal action to be taken at this time resulting from approval of the recommended action for this item. The proposed changes to the Part-Time Salary Schedule have minimal impact to the FY 2022-2023 Operating and Capital Budget. If necessary, any required funding will be requested during the FY 2022-2023 Mid-Year Financial review.

EMPLOYEES, TO REFLECT A STATE MANDATED MINIMUM
WAGE INCREASE EFFECTIVE JANUARY 1, 2023
WHEREAS, on July 27, 2022, the Director of the Department of Finance certified that based on the annual inflation rate from July 1, 2021-June 30, 2022, under Labor Code section 1182.12(c)(3)(A), the state hourly minimum wage must be increased, effective January 1, 2023, to $15.50 an hour (regardless of the number of workers employed by an employer); and
WHEREAS, to comply with the state minimum wage requirement, the salary schedule for the City of Del Mar Miscellaneous, Part-Time, Temporary and Hourly Employees group has been revised to reflect an increase in the minimum wage from $15.00 to $15.50 per hour; and
WHEREAS, the City Council has been presented with and has reviewed the revised salary schedule for Miscellaneous, Part-Time, Temporary and Hourly Employees of the City of Del Mar.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Del Mar, California, that the above recitals are true and correct.

BE IT FURTHER RESOLVED by the City Council of the City of Del Mar, California, that the City Council does hereby approve and adopt the amended salary schedule for Miscellaneous, Part-Time, Temporary and Hourly Employees as shown in Exhibit “A” to this Resolution, effective January 1, 2023.

TO: Honorable Mayor and City Council Members
FROM: Mayor Dwight Worden and Council Member Dave Druker, Liaisons to the Sustainability Advisory Committee
Prepared by Nestor Machado, Management Analyst
DATE: December 12, 2022
SUBJECT: Sustainability Advisory Committee Appointments REQUESTED ACTION/RECOMMENDATION:

The City Council Liaisons to the Sustainability Advisory Committee (SAC) recommend the City Council: 1) Reappoint Silvia De Dea to the SAC as a voting member to serve a second three-year term effective February 2, 2023, and ending February 28, 2026; and 2) Appoint Ken Olson to SAC as an ex-officio, non-voting member to serve the balance of a vacant term, starting December 12, 2022, and ending on March 31, 2025.

DISCUSSION/ANALYSIS:

The Sustainability Advisory Committee (SAC) advises the Del Mar City Council on climate change, sustainability, and other environmental issues on which the Council may wish to act. SAC also takes the lead advising the Council on how and when to update the City’s Climate Action Plan (CAP), which was developed by the SAC in June 2016, and assists in informing Del Mar residents and businesses about implementing the City’s CAP and on environmental and climate action issues. Finally, SAC monitors the activities of the Clean Energy Alliance (CEA) and provides recommendations to the City Council.

SAC consists of nine members, including seven voting members and two ex-officio, nonvoting members. Of the voting members a minimum of six must be residents of Del Mar and one may be a non-resident. Ex-officio, non-voting members may be residents of Del Mar or non-residents and shall be appointed based on their professional experience with environmental and/or sustainability issues. All members serve three-year staggered terms.

There is currently one upcoming voting member vacancy on SAC due to Silvia De Dea’s term expiration on February 1, 2023. City staff advertised the vacancy, and three Citizen Interest Forms were received during the recruitment period from Silvia De Dea, Rick Ehrenfeld, and Marisa Hildebrand-Criqui (Attachment A). Rick Ehrenfeld withdrew his application on December 6, 2022. The Council Liaisons to the Committee have reviewed 1 December 12, 2022 Item 03

the applications and recommend the City Council reappoint Silvia De Dea for a second full three-year term effective February 2, 2023, and ending on February 28, 2026.

Additionally, there is currently one ex-officio, non-voting member vacancy on SAC due to the resignation of Strowbridge Watson on November 1, 2022. City staff advertised the vacancy, and one Citizen Interest Form was received during the recruitment period from Ken Olson (Attachment B). The Council Liaisons to the Committee reviewed the application and recommend the City Council appoint Ken Olson to serve the balance of the vacant term starting December 12, 2022, and ending on March 31, 2025.

If the recommended appointments are approved, SAC will have a full roster with no remaining vacancies. A copy of the current roster is included as Attachment C.

Agenda Report
________________________________________________________________________________________________________ City Council Action:

TO: Honorable Mayor and City Council Members
FROM: Nestor Machado, Management Analyst
Sarah Krietor, Administrative Services Manager/City Clerk Via Ashley Jones, City Manager
DATE: December 12, 2022
SUBJECT: Design Review Board Interviews and Appointments REQUESTED ACTION/RECOMMENDATION:

Staff recommends that the City Council: 1) Review the Citizen Interest Forms and interview the applicants; and 2) Appoint two resident to serve as voting members on the Design Review Board.

DISCUSSION/ANALYSIS:

The Design Review Board (DRB) evaluates planning applications for their consistency with the provisions of the Del Mar Community (General) Plan, City's Zoning Ordinance and the applicable design review standards included in the Design Review Ordinance (DRO).

There is currently one voting member vacancy on the DRB due to the resignation of Gala Yayla on October 31, 2022, and one upcoming vacancy on February 2, 2023, due to the term expiration of Beth Levine. The City advertised the vacancies and received three applications from Arlene Prater, Mark Handzel and Linda Judd (Attachment A). All applicants indicated that they meet the requirements of Del Mar Municipal Code Section 2.38.020 (Attachment B) in order to serve as voting members on the DRB.

Staff recommends that the City Council review the Citizen Interest Forms, interview the applicants and vote to appoint two applicants to serve on the DRB. Additionally, staff requests that the Council specify which applicant is being appointed to fill the balance of the vacant term from December 12, 2022 to July 1, 2025, and which applicant is being appointed to a full term from February 3, 2023 to February 1, 2027.

Pursuant to Council Policy 200, “Committees – City Council Advisory Committees, Boards and Commissions,” an applicant must receive three affirmative votes in order to be appointed.

If three affirmative votes are not received, the Council can choose to vote again or to direct staff to reopen the vacancies to solicit additional interest.

Qualifications for appointment and/or reasons for application (attach additional pages as needed):

I have been a resident of Del Mar since 1977 when my husband and I purchased our home on Zuni Drive, where we still live and where we raised ourtwo children. We went through the Design Review process ourselves in 1979, when we added an upstairs bedroom. We are now the homeowners who have resided the longest on lower Zuni. We have obviously seen a great many changes in Del Mar and the surrounding areas, and in many ways it is quite a different City but in many waysit continuesto be the same – a beautiful, scenic place to live and to enjoy the beach and the local businesses. We have both supported and opposed projects in our area that have been before the Design Review Board and/or the City Council over the years. We have always appreciated and relied on the City and the DRB to do their best to protect our environment, our views and the quality of development in the City.

As detailed below, I am a partner at a law firm and I have represented public agencies for over forty-five years. I have also served, and continue to serve, on several non-profit boards. I have always wanted to get more involved in the community in which I live, but my work and family kept me from having the time to do so in the past. I have now changed my status at my law firm and I am working less hours and I have more time to devote to my community and I want to do so in a way that I can make the most of my qualifications and my interests.

THIS IS A PUBLIC RECORD SUBJECT TO DISCLOSURE.

Note: Personal information may be withheld from public view as allowed by law. 11 December 12, 2022 Item 04
While I do not have design or architectural training or experience (other than with Titles II and III of the Americans with Disabilities Act), I have shown through other ways my practical ability to work with competing interests to apply the controlling laws and regulations. I am now in a position to be able to apply these skills to help develop and continue the environmentally sensitive design requirements in Del Mar that have made the environment I have lived in for so many years such a special place, as well as interpret and apply new State and local laws that impact the City. My legal and non-profit experience provide strong qualifications for this appointment. My legal career (as detailed in the Job Experience Section below) has been spent in the main part advising and representing public agencies throughout California and this experience and knowledge puts me in a unique position to serve on an appointed Board of a City.

I have also been an American Association of Arbitrators certified Arbitrator for many years.

I also have extensive experience being on non-profit boards: I am in my third nine-year term on the San Diego Botanic Garden (and on the Executive Committee and Chair of the Governance Committee). I am in my third six-year term with the non-profit organization Serving Seniors (where I was Board Chair and on the Executive and Governance Committees). I served two terms on the Board of Planned Parenthood of the Pacific Southwest and continue to serve on their Risk Management Committee. I served on the board of a San Diego disability access non-profit and have been involved in various local and state legal organizations. All this has given me an excellent background to work with others in considering diverse points of view and making a decision in compliance with the controlling laws/regulations/policies and all applicable considerations.

Education:

University of Wisconsin, Madison – BA
University of San Diego Law School – JD 1975
Admitted to California State Bar – 1975
Job Experience:

I have included with this application a copy of my qualifications from the Best Best & Krieger’s website, which gives an overview of my experience in representing public agencies, including many cities throughout California (as well as private employers), mainly in employment-related matters but also in many other areas and working with the laws and requirements unique to public agencies, such as compliance with the Brown Act, the Public Records Act, Ethics laws, Public Contracting laws and Government Policy and Public Integrity laws, among others. I conduct trainings, such as sexual harassment avoidance trainings, for elected officials as well as public employees and I am a frequent speaker on employment and related issues throughout the state. I work closely with management, as well as with public officials on a regular basis and I am skilled in listening to both public employees, and members of the public, who have competing interests and helping decision-makers work through and resolve issues. I am also an Arbitrator with the American Association of Arbitrators, handling employment and consumer arbitrations.

I have also advised public agencies on, and for public agencies have litigated, federal and state cases under the Americans with Disabilities Act, Title II, as to public agencies’ requirements to make their services, programs and activities accessible to disabled members of the public. In that capacity I have worked with building officials and other public agency officials, as well as members of the public and the disabled community, to bring public facilities into compliance THIS IS A PUBLIC RECORD SUBJECT TO DISCLOSURE.

SUBJECT: Planning Commission Interview and Appointment
REQUESTED ACTION/RECOMMENDATION:

Staff recommends that the City Council: 1) Review the Citizen Interest Form and interview the applicant; and 2) Appoint one resident to serve as a voting member on the Planning Commission or direct staff to reopen the vacancy and solicit additional interest.

DISCUSSION/ANALYSIS:

The Planning Commission (PC) is charged with the administration of the Community Plan, the Zoning Ordinance and Map, and review of related plan applications. The Commission conducts public hearings and considers land use applications such as variances, conditional use permits, coastal development permits, zoning ordinance interpretations, and determinations of allowable uses.

There is currently one voting member vacancy on the PC due to the resignation of Don Countryman on October 20, 2022. City Council Policy 200 “Committees – City Council Advisory Committees, Boards and Commissions”, Section C(4) states that, “If, by the application deadline, the number of applications received by the City for such board or commission equals or is less than the number of vacancies, then there shall be an automatic extension of time to accept applications.” However, the City advertised the vacancy and extended the application deadline on two occasions. During the extended recruitment period, the City received one application from Jas Grewal (Attachment A). The applicant indicated they meet the requirements of Del Mar Municipal Code Section 2.34.020 (Attachment B) to serve as a PC voting member.

Staff advertised the unscheduled vacancy for more than ten (10) days as required by the Maddy Act. The City Council has the discretion to waive the provisions of Policy 200 Section C(4) related to the automatic extension of Commission recruitment deadlines, should they desire. The policy requirement has occasionally been waived in the past when it was determined by the City Council it was in the City’s best interest. 1 December 12, 2022 Item 05

Pursuant to Council Policy 200, an applicant must receive three affirmative votes in order to be appointed. Staff recommends that the City Council review the Citizen Interest Form, interview the applicant, and vote to appoint the applicant to serve the balance of the vacant term from December 12, 2022, to June 30, 2023. If three affirmative votes are not received, the Council can choose to vote again or to direct staff to reopen the vacancies to solicit additional interest.

DATE: December 12, 2022
SUBJECT: General Plan Amendment (GPA22-001), Rezone (R22-001), and Local Coastal Program Amendment (LCPA22-002) to Correct Inconsistencies in Map Records and Rezone Various City-Owned Properties
REQUESTED ACTION/RECOMMENDATION:

It is recommended that the City Council adopt the Resolution (Attachment A) adopting General Plan (“Community Plan”) Amendment GPA22-001 and introduce an Ordinance (Attachment B) amending the Del Mar Local Coastal Program (LCPA22-002) and rezoning (Rezone R22-001) eight City-owned properties.

BACKGROUND/DISCUSSION:

In 1996 and 1997, the City Council adopted a series of resolutions and ordinances, as further described in the table below, amending the corresponding land use designations and zoning for eight City-owned properties. The General Plan Amendments took effect at the time of Council action in 1996 and 1997.

However, the 1996/97 rezone actions were not processed correctly through the associated State approval process required by the California Coastal Act. An amendment to the certified Local Coastal Program (LCP) land use plan and implementing zoning is required to be processed via the California Coastal Commission, in order for the respective locally adopted amendments to become effective. At this time, the maps on record with the Coastal Commission for the certified LCP do not reflect the prior 1996 and 1997 Council actions for the subject City-owned parcels. Since it has now been more than five years since the public hearings were held, a new rezone action must be processed with the required Local Coastal Program Amendment (LCPA).

The proposed amendments will be consistent with the existing land use designations in the Community Plan and the zoning designations on the Official Zoning Map, as 1 December 12, 2022 Item 06

amended. As a result, the LCP Land Use Plan and LCP zoning will also be consistent with the Community Plan and Official Zoning Map, as amended.

The City’s certified LCP includes the LCP Land Use Plan (initially certified by the Coastal Commission in 1993 with subsequent amendments thereafter) and the LCP Implementation Plan (initially certified by the Coastal Commission in 2001 with subsequent amendments thereto), which includes a Land Use Map and Zoning Map.

The following table identifies the eight subject City-owned parcels (at seven locations), the prior City Council actions, the land use designation/zoning status, and the additional processing required in order for the desired map corrections and consistency between the City’s Community Plan, Zoning Map, and Local Coastal Program Land Use and Zoning Maps.

On October 11, 2022, the Planning Commission reviewed the proposal and voted unanimously in a duly noticed public hearing to recommend approval of the proposed GPA, Rezone, and LCPA to the City Council.

Identified below is an explanation of how each associated planning document and corresponding map will be updated as part of this action.

General Plan (Community Plan) Amendment
Land use designations and zoning are separate planning-related delineators that identify the use classification type and development potential for specific properties; zoning regulations implement the Community Plan land use. In accordance with State law, they must be consistent with one another. California Government Code Section 65860 4 December 12, 2022 Item 06

requires the planned land use designations adopted in the City of Del Mar Community Plan be consistent with the City’s adopted zoning. The Community Plan provides detailed descriptions of each land use category and the following are the land use designation categories applicable to the requested action (see also the Community Plan page 83 in Report found in “Attachment C”):
• Public Facilities - “Limited to publicly owned land set aside, or in use, to support public schools and governmental offices and facilities.” • Public Parkland - “Limited to publicly owned land designated for use as a community park or open space preserve.”
The proposed action (applicable to eight City-owned parcels) is consistent with the Community Plan as further described below:
• The proposed action for the Pine Bluff Preserve would amend the underlying zoning to Public Parkland consistent with the Community Plan per GPA-96-01 as adopted by the City Council in 1996 (see table above). The existing use of the parcel is natural open space preserve and the proposed action would maintain the site as open space.
• The proposed action for the four water tower sites, the library site (two parcels), and vacant parcel on 28th Street would amend the underlying zoning to Public Facilities consistent with the Community Plan per GPA-97-02 as adopted by the City Council in 1997 (see table above). The proposed action would maintain the existing public facilities on those sites that are currently occupied. The 28th Street parcel is currently vacant, and is city-owned property; therefore it would be consistent to change the zoning to public facilities, consistent with the GPA that was previously adopted.

The existing Community Plan land use designation map is located on page 85 of the Community Plan, contained in the Community Development Element (Attachment D).

This action will ensure this map is correctly updated to reflect the previously adopted General Plan Amendments. The proposed map is included as Attachment E, which shows the current land use designation for all eight parcels respectively as public facilities or public parkland designation. Because the City’s Community Plan is not presently part of the City’s certified LCP, the General Plan Amendments previously adopted by the City Council cannot be implemented as part of the LCP process.

Certified Local Coastal Program (LCP) – Land Use Plan Map The certified LCP Land Use Plan is intended to ensure all land use and development activities within the City of Del Mar are in conformance with the California Coastal Act of 1976. Attachment F to this report shows the existing LCP land use designation map. The 5 December 12, 2022 Item 06

proposed LCP Land Use Plan map, with the proposed Public Parkland (PP) and Public Facilities (PF) land use designations, is included as Report Attachment G. This cleanup and consistency actions will ensure that the land use designations in the LCP Land Use Plan are consistent with the Community Plan land use designation for each of the eight subject parcels.

Certified LCP Implementation Plan – Zoning Map
The certified LCP Implementation Plan includes Implementing Ordinances and a Zoning Map that are intended to implement the provisions of the City’s certified LCP Land Use Plan and applicable sections of the Coastal Act. The existing certified LCP Zoning Map shows the zoning of each parcel (Attachment H). The proposed updated LCP Implementing Ordinances Map is included as Attachment I to this report. The proposed rezone of eight parcels will ensure that the LCP Zoning Map is consistent with the Community Plan and LCP Land Use Plan land use designations for each of the eight subject parcels and consistent with the City’s Official Zoning Map.

Official Zoning Map
The City’s Official Zoning Map illustrates the applicable zones for properties throughout the City’s jurisdiction (see “Attachment J”). While rezones were previously adopted by the City Council in 1996 and 1997, the rezones did not take effect because the required LCPA was not processed at that time. This requested action will complete the required rezoning and LCPA actions via City Council and the Coastal Commission as necessary to implement the intended zoning (Public Facilities or Public Parkland) of the eight subject parcels consistent with the General Plan and LCP. The proposed Zoning Map reflecting these actions is included as Attachment K to this report.

NEXT STEPS:

City Council action on GPA22-001 (adoption of the resolution) will constitute final action.

The ordinance related to R22-001 and LCPA22-002 requires a second reading, to occur at the next available City Council hearing. City Council action on R22-001 and LCPA22- 002 will not take effect until the Coastal Commission unconditionally certifies the ordinance.

HOUSING IMPACT STATEMENT:

The proposed actions are consistent with the City’s adopted Housing Element. The City Council initially adopted the 6th Cycle Housing Element in March 2021 and re-adopted it in December 2021 as required to incorporate revisions requested by HCD. While the City State certification of the Housing Element is pending, implementation of the required housing action programs is underway. Housing Element Program 1H commits the City to processing of zoning-related actions applicable to the Public Facilities zone, including processing of the proposed clean-up rezone/LCPA specific to the vacant parcel on 28th Street, which is a small City-owned parcel that is listed in the 6th Cycle Housing Element sites inventory as a potential site for future housing of up to three lower income 6 December 12, 2022 Item 06

households. Subsequent processing of additional amendments to complete Housing Element Program 1H (i.e., amending Del Mar Municipal Code) Chapter 30.31 to specify that residential is an allowed use in the Public Facilities zone) will occur via a separate process.

FISCAL IMPACT:

There is no fiscal impact or fiscal action to be taken by the City Council related to this agenda item.

ENVIRONMENTAL IMPACT:

The proposed action does not constitute a “project” as defined in California Environmental Quality Act (CEQA) Guidelines Section 15378 because this action will not have a potential to result in a direct or indirect physical change in the environment or create any significant environmental impact and is, therefore, not subject to CEQA.

NEXUS TO CITY COUNCIL GOALS AND PRIORITIES:

The proposed GPA, Rezones, and LCPA are consistent with the City’s adopted Housing Element, which is a Tier 1 priority for the City Council.

Agenda Report
________________________________________________________________________________________________________ City Council Action:

TO: Honorable Mayor and City Council Members
FROM: Sarah Krietor, Administrative Services Manager/City Clerk Via Ashley Jones, City Manager
DATE: December 12, 2022
SUBJECT: Results of the 2022 General Municipal Election REQUESTED ACTION/RECOMMENDATION:

Staff recommends that the City Council: 1) Adopt the proposed Resolution (Attachment A) declaring the 2022 General Municipal Election results for Del Mar; and 2) Direct the City Clerk to administer the Oath of Office and issue Certificates of Election to the newly elected Council Members.

DISCUSSION/ANALYSIS
The City of Del Mar held a General Municipal Election on November 8, 2022. The Election was consolidated with the County of San Diego and conducted as required by law.

Pursuant to Del Mar Resolution No. 2022-32, adopted June 6, 2022, the San Diego County Registrar of Voters (ROV) provided the 2022 General Election results for Del Mar to the City on December 8, 2022 (Exhibit A to Attachment A). Del Mar voters were asked to elect two members to the City Council to serve full four (4) year terms. There were no Del Mar specific ballot measures.

Members of the City Council
The certified results provided by the ROV indicate that the three candidates who ran for City Council received the following votes: Terry Gaasterland (1,606); Dwight Worden (1,038); and Steve Quirk (977). Based on these results, Terry Gaasterland and Dwight Worden have been elected to serve four-year terms as Members of the City Council beginning December 12, 2022, and ending December 2026.

At the time this agenda report was published, the precinct results referenced in Resolution (Attachment A) have not been received from the ROV. Staff will distribute a Red Dot with the final Resolution (Attachment A) and precinct results prior to the City Council meeting.

ENVIRONMENTAL IMPACT:

The action is not a “project” as defined under the California Environmental Quality Act (CEQA) and is exempt from environmental review.

City of Del Mar
Agenda Report
________________________________________________________________________________________________________ City Council Action:

TO: Honorable Mayor and City Council Members
FROM: Sarah Krietor, Administrative Services Manager/City Clerk Nestor Machado, Management Analyst
Via Ashley Jones, City Manager
DATE: December 12, 2022
SUBJECT: Selection of the 2023 Mayor and Deputy Mayor
REQUESTED ACTION/RECOMMENDATION:

Staff recommends that the City Council appoint from its members a Mayor and Deputy Mayor to serve for a one-year period beginning on December 12, 2022, through December 2023 in accordance with Council Policy 100.

DISCUSSION/ANALYSIS:

Council Policy 100, Selection of the Mayor and Deputy Mayor (Attachment A), outlines the traditional rotation of the Mayor and Deputy Mayor. In choosing the Mayor and Deputy Mayor, it is the tradition of the City Council to place the two highest vote getters in any one election into a queue to rotate into the position of Mayor and Deputy Mayor. In the 2020 General Municipal Election, Deputy Mayor Tracy Martinez was the highest vote getter followed by Council Member Dan Quirk. In accordance with Council past practice, Deputy Mayor Martinez would rotate into the role of Mayor for 2023, and Council Member Quirk would move into the role of Deputy Mayor. Appointments for the role of Mayor and Deputy Mayor require three affirmative votes of the City Council.

The appointed Mayor and Deputy Mayor will serve in these roles for a one-year period beginning on December 12, 2022, and ending in December 2023.

CITY COUNCIL POLICY BOOK
100 SELECTION OF MAYOR AND DEPUTY
MAYOR
DATE REVISED: 12/15/14
BY RESOLUTION: 2014-92
PAGES: 1 OF 1
POLICY:

Del Mar Municipal Code, Section 2.20.020 A and B, addresses when the City Council shall meet to install newly elected Council members and states that its members shall choose one of its members as Mayor and one of its members as Deputy Mayor by motion of the Council and three affirmative votes. It further states that the Mayor and the Deputy Mayor shall serve a term of one year, or until a successor for each position is chosen.

1. The Mayor and Deputy Mayor are members of the City Council and are annually elected by majority vote of the City Council at the first regular meeting in December or, in the case of an election year, upon certification of the election results. As a member of the City Council, the Mayor and Deputy Mayor shall have all the powers of a member.

2. In choosing the Mayor and Deputy Mayor, it is the tradition of the Council to place the top two vote getters in any one election into a queue to rotate into the position of Mayor and Deputy Mayor. In each City Council election, the person with the most votes shall be placed first in the rotation of that group, the second highest vote getter will be placed second, and in the years when there is a third seat contest, the third highest vote getter will be placed third in that rotation. However, the Council member who received the third most votes in an election year filling three seats will not be in the queue for either Deputy Mayor or Mayor but would be in rotation should the Council member traditionally rotating into the Deputy Mayor or Mayor position be unavailable to serve in that role.

3. In case of appointment to the City Council to fill a vacancy, that person will occupy the last position in the current rotation. Each new election will determine the rotation only for the group in that election. Should any City Council member not be available to take their regular place in the established rotation, the next person in the rotation will be elevated to the Deputy Mayor’s position and the rotation will continue as previously set.

4. In the event there are members of the City Council appointed in lieu of an election, the appointed City Council members will go into a Mayoral rotation based on tenure (seniority) on the City Council. The City Council member with the most tenure on the City Council will be placed first in the rotation of that group. If no seniority exists (e.g. members have the same tenure), then the appointed City Council members will be rotated based on a coin toss conducted at a publicly noticed meeting.
