Dear City Council,
Yesterday I sent in a red dot support of the Short Term Rental draft. I seem to not have read it thoroughly. I do NOT agree with that the STR owner have to use the STR as their primary residence.
o Accommodation of nonconformities would include:
▪ Owners operating full-time STRs (not in a primary residence).

Like I have said in earlier red dot letters, let's grandfather in those STR who have already been used as STR (and not have had complains), especially those who live in Del Mar and can be there within the requested 30 minutes to solve any problems and are part of Del Mar. Many of these owners use their STR themselves at times for family reunions etc. I understand that hotels does not fit all (large families, pets, etc) so we do need STRs, and above setting is the perfect with the owner actually living in Del Mar and sometimes using it themselves. If I were to decide, I would give Del Mar residents priority in STR permits and non-residents go on a second waiting list to fill up the 129 cap. However, if a non-resident have used a unit for STR and done so splendidly without complains, that person could be given priority on the second list.

In regards to a restriction of only one STR per R2 lot, I have mixed feelings. What if my neighbor (on my R2 lot) gets a permit for an STR, should that automatically cut me out to apply too? It doesn't feel fair and it will also pull down the price on the lot that can never apply. I do not agree with this (despite feeling bad for the neighbors of two STRs right by them).

In conclusion - grandfather in those who have already used their unit as STR without complains, and especially those who are Del Mar residents. I do not at all agree with that they would have to have the unit as a primary residence. As long as we have a cap on the amount of STRs in the city, we will still have an alive town where most people are residents and care about the area.

Sincerely,
Camilla Rang

Dear city manager and council members:

I have reviewed the staff report and recommendations and proposed Chapter 30.96.

I commend you all for drafting an all inclusive policy for short term rentals taking all the recommendations from residents as well as comparing across the state data regarding short term rentals. Most communities across the state have been actively addressing short term rentals for all.

I agree with a 5% cap on short term rentals. I would have liked to see a smaller percentage but understand the need for 5%.

I feel STRs are businesses and feel that these businesses should have both a business license and STR permit.

I’m happy to see that the STRs would be owned by individuals and no longer businesses.

I am a bit disappointed that the north beach has 60% of the total STRs while the hills neighborhood is at 15% and South bluffs is 25%. That does seem a bit unfair that the residents of the north beach have 60% non residents and have to deal with STRs all the time everywhere. I thought at one point there was a proposal to limit the number of STRs per street?? Your principal stated “minimize adverse impacts to adjacent private properties and the surrounding neighborhood”. 60% in north beach does not meet this principal! I look forward to seeing the rental signs coming down.

I would recommend you put a limit on daily guests. This unstated has a potential for getting out of control. I have reviewed many other cities STRs regulations and they did put a limit on the number of daily guests.

Thank you for all your hard work.

I look forward to finally having Short term rental regulations for all of us to follow 3 January 22, 2024 Item 07

Dear Mayor Druker and Council Members:

While I appreciate that there is a relatively modest cap of 19 STR’s, I think there is an argument for only grandfathering in the existing STR’s and not allowing any new STR’s in the Hills neighborhood. As the Council will recall, something in excess of 80 percent of the ADU’s in the City are being constructed in the Hills neighborhood along with 100 percent of future SB-9 development. Furthermore, fully 100 percent of the City’s Very High Fire Hazard Severity Zone (VHFHSZ) is located in the Hills neighborhood. There have been significant concerns raised about the City’s ability to safely accommodate all the potential ADU’s in the VHFHSZ, and the City is planning to update the Public Safety Element of the Community Plan to try to address these concerns. It’s hard to see how the STR proposal will not add to these concerns.

For example, consider the potential safety impacts of a typical new Del Mar build home with 4 bedrooms upstairs and a full size basement (+/- 2500 s.f.) used as an STR. The Zoning Code only requires off-street parking for 4 bedrooms — the basement bedrooms have no off-street parking requirements. Assume the basement has a 5 bedroom configuration for maximum rental revenue potential — the basement’s STR occupancy capacity at 2 people per bedroom plus two will accommodate 12 people per the draft outline. So, there are 20 potential guests total on two levels with three required parking spaces — which suggests at best a lot of Ubering on our narrow and winding streets and more people to complicate evacuation in an emergency. Assume also that the street this STR is located on is less than 20 feet wide. The City may try to limit the number of guest vehicles, but can we really be certain that guests without parking spaces will not try to park somewhere nearby? Can staff take this example and explain how this STR can be safely operated in the VHFHSZ? If STR owners want to provide additional off-street parking to increase occupancy, is it reasonable to expect the DRB to override the hardscape restrictions to allow it? Excessive hardscape is a recipe for neighborhood incompatibility. There are already too many examples of front yards turned into parking lots that detract from the charm of our streetscape.

Obviously there is a lot to consider here and public safety should be paramount in your decision-making. I think the City should wait for the Public Safety Element update before committing to increasing the traffic and parking burden in the VHFHSZ with STR’s.

Sincerely,
Rich Jamison

Honorable Mayor and Councilmembers,
Lots wrong with the new proposed STVR ordinance.....

This is basically Attrition in 5-10 years? STVRs are written into our Community Plan (per the Judge when we got to Coastal last time), they are here to stay. Please remove that entire section. Where the heck did that come from?????
I work, and have worked for, multiple LONGSTANDING big name Del Mar homeowners that have two units on one parcel (old school, not considered ADUs). They must each be allowable, as a precedent has been set and these units have been operating for decades.

You open The City of Del Mar up to alot of exposure with City Mandated Onsite Inspections. Not anything I would recommend. Leave that up to the Homeowner. Supply a checklist that the OWNER has to fulfill. You will need alot more staff in that Dept to do these as well. Silly.....

Make this simple, nothing is broken or wrong, other than our City losing out on TOT for the last several decades.

Occupancy: 2 per bedroom, plus two for the house
Noise: Quiet hours 9pm-9am out of respect for the neighborhood.

No parties and gatherings EVER
Trash & Parking: Follow all City rules already in place Permits: Reasonable fee, 3 VALID strikes and you are out TOT: I am fine with TOT, others are not. I'm not sure if this needs to go to a public vote or not, but I support whatever the legal way to deal with this issue is...

Please stop with the government overreach, again.....

2 STVRs are here to stay. This staff report is shocking..... I feel like Dwight Worden learned nothing over the last 8 years of bleeding City Money on this topic (refer to Ralph's letter and his new PIR request). Our City lost out on millions of dollars over this time period, between the non collection of TOT and all the Litigation around the Del Mar STVR issue. Here we go again.....

Dear Council Members:

My name is Royce Chrys. I am a physician and a homeowner with my family members of an apartment located at 2721 Camino Del Mar. Our position as a family on this regulation is that we all strongly oppose the proposed STVR regulations in Del Mar.

Our family acquired our unit in the building specifically as a necessary source of rental income for our family which funds my father’s care at age 98, and to enjoy ourselves, as one of the few condo buildings within walking distance to the local Del Mar beaches, the racetrack and other area amenities. We are horse owners and have run horses at the Del Mar racetrack since 1970.

The regulation of limiting the ability for short-term rentals in Del Mar condo buildings will not only significantly impact our family and the value of our real estate investment which are huge issues, but also those of many other families and renters that have enjoyed coming to Del Mar for decades to enjoy everything this city has to offer.

As you know, short-term rental units in Del Mar are one of the few opportunities people have to enjoy close proximity to public access to our beautiful beaches. We have been responsibly renting our apartment since 2015, before the 2016 moratorium. I feel that the proposed restriction in the short term rental situation is a selfish proposal by a small group of narrow minded individuals and should be summarily rejected.

We are very appreciative of your re-consideration of this strict limitation of your STRV proposed regulation.

Respectfully,

Dear Mayor and Council Members,
Thank you for your work on the short-term rental issue. As a property owner and landlord I encourage the city to consider long-term tenants and neighborhoods first. Please do not be persuaded by those who profit at the expense of those looking to make a life in Del Mar.

For 40 years we have resisted the urge to jack up rents and cash in on the short-term market. We rent at lower than market rates to stable long-term tenants. Everyone benefits, including those tenants, neighbors, and local businesses.

I recently attended a gathering at a short-term rental. Nearby neighbors told me they lived with a constant stream of coming and going. I wonder if out-of-town owners and rental brokers would like their homes to be surrounded by these mini-motels?

Hello Planning Commission,
My family has been renting its beachfront home for over 50 years. I don't think it's fair for you to take that away because of some irresponsible bad actors. The money we get helps us maintain the home which as you probably know is very expensive on the coast. There used to be a LOT of rentals on the beach that were rented to both horse racing fans and track workers, but now many of those have been purchased by billionaires and appear to be empty much of the time. I can't believe that it's beneficial to the city to have a bunch of empty homes with no one supporting the local economy. I ask you to please allow beachfront owners to continue to rent their home as has been done since before probably the majority was even born or at least grandfather in people that were doing it before Airbnb disrupted the rental ecosystem.

Sincerely,
Bill Lyon

Dear Honorable City Council Members,
I wish to express my concerns regarding the wasted money and time on this matter. I question the real concern in connection with STRs in Del Mar.

If I were to interpret the information provided in the agenda, the proposed regulation would limit STRs to 5% of the dwellings in Del Mar or 129 in number. This would suggest there are 2,580 dwellings in the entire city.

How many of such dwellings actually are inhabited by owner residents? I suspect it is a rather small percentage of the total dwelling stock in Del Mar. It would serve to reason that these non resident owners have alternative housing and their dwellings sit under utilized for extended periods of time.

We should be encouraging a vibrant, accessible community to support our local economy and businesses. STRs provide many with an affordable access to our beach community and the businesses we strive to support. STRs also offer those residents that actually call this community their full time residence flexibility to defray their personal real estate investment costs, if they choose or the need arises. Our owner residents should not have to deal with a cumbersome and costly process as proposed in these STR regulations.

I respectfully ask that you reconsider these burdensome, unnecessary and inequitable STR regulations for our community.

Sincerely,
Jennifer Belezzuoli

I support the City's draft ordinance regulating STR businesses in Del Mar.

I support strong limits on STRs in Del Mar, and strong regulation of those that exist. The limits and regulations of the draft ordinance advance these objectives:
• Enhance neighborhood cohesion by keeping houses occupied by long-term neighbors • Keep the maximum number of residential housing units for full time residents to help allieve the housing shortage in California.

The City's draft ordinance limit of a maximum of 5% of housing units be allowed for STRs is generous but reasonable. That limit should not be raised. The minimum stay duration of 5 days will reduce the friction with neighbors.

The community has provided a number of excellent suggestions for how to avoid overcommercialization of Del Mar residential zones. Please consider adding these elements to the draft ordinance:
--An STR should not be licensed on any property which has title held by an LLC, a corporation, or a business entity;
--New full-time STRs in residential zones should not be licensed on properties that are not the owner's primary residence. Full time STRs are hotel businesses, not residential uses.

Del Mar City Council
January 22, 2024 Agenda
Re: Item 7–Short Term Rentals
RED DOT From 34 Residents of North Hills Neighborhoods Dear Mayor Druker and City Council Members:

As longtime residents of Del Mar’s hillside neighborhoods, we are concerned that the approval of the Short Term Rental Ordinance may lead to an increase in applications for rooftop decks, which are discouraged in hillside areas by our Citywide Design Guidelines but are not prohibited by our Municipal Code. Over the last few months, there have been two applications for rooftop decks—one of which was approved—that have been heard by the Design Review Board, after years of no submittals.

Our concerns with rooftop decks include the increased likelihood of excessive noise and the decrease in privacy for surrounding neighbors. In addition, allowing this design element—at least in hillside neighborhoods where this feature does not exist is sure to have a negative impact on neighborhood character. Moreover, the visual impact of bulk is often magnified when decks become enclosed by fireplaces, barbecues, wet bars with backsplashes, umbrellas, propane heaters, etc. Given these serious concerns, it is not surprising that Laguna Beach, Manhattan Beach, and Rancho Palos Verdes—Del Mar peer cities that are diligent about protecting property values—do not allow rooftop decks.

As the legal status of short term rentals evolves, there is likely to be an increased interest on the part of some STR owners to maximize investment in their properties. Rooftop decks would be an attractive investment option for STR owners because guests prefer to congregate wherever there is a view. Consequently, the rooftop deck is where the party will get started.

While we believe the entire City of Del Mar would be best served by a ban on rooftop decks, we are asking the Council to at least consider a permanent ban on rooftop decks in hillside areas, especially now that an increase in STR’s is looming ahead of us. As the Council considers a new STR ordinance, these potential negative impacts on our quality of life and neighborhood character must be considered. For your consideration, attached is a highlighted copy of the Rancho Palos Verdes Municipal Code section that bans rooftop decks for your reference.

Dear Mayor Druker and Council Members:

For the most part, we support the staff recommendations regarding short-term rental businesses, a phenomenon that, if allowed to proliferate unfettered and with the minimum controls desired by the STRB owners and operators, could devastate the community spirit of Del Mar. These short-term rented houses and apartments essentially disguised hotel businesses that want to operate in residential and non-commercial neighborhoods. Please be aware that there is an enormous group of citizens who do NOT want to live next-door to a “hotel” with a revolving cast of hotel guests coming in and out and all the problems that result. We support the guiding STRB principles that you as a Council established in July and September 2023, and hope that you will not be swayed by the few assertive and loud real estate entities that are profiting mightily from STRBs and are now lobbying you heavily to go along with their wishes.

Just a quick Google search of VRBO showed that right now there were 128 houses, 53 condos, and other vacation rentals available in Del Mar, with prices ranging from $300 to $2,000 a night. Clearly, there is big money to be made in short-term rental businesses, and no wonder the owners and operators want the regulations to be minimal. They want to have a free hand to rent on a short-term basis without much oversight or consequence.

But what about Del Mar citizens – the general public of our community? The character of our residential neighborhoods diminish, our peace and quiet shattered by noisy weekend parties. We lose that sense of knowing our neighbors and being able to count on them in an emergency. At a time when lack of housing is such a pressing issue, every STRB that is reserved for high-price rentals for a few days or a week means another housing unit that is unavailable for long-term residency.

The debate over STRBs is a heated one that has gone on for a long time, in cities all over the world. Desirable coastal cities are especially vulnerable to properties being bought up by investment companies solely for shortterm rentals; we have seen it happen already right here in Del Mar. The STRB issue forces you, as our City Council representatives, to consider “community character, privacy, and neighborhood” versus “the free market;” and it is the latter being touted to you now by the Del Mar STRB owners/operators.

The City Council has within its power to stand firmly on the side of community character, privacy, neighborhood, and your town’s citizens, and we hope that you will do so.

Del Mar City Mayor and City Council,
We are all shocked as to the sudden turn of events and inclusion of all sorts of new restrictions (buried deep in the information) after the previous meetings where it appeared that the city had a reasonable approach to the STR framework of the future.

As Kimberly pointed out, nothing is broken or wrong and these extreme newly added requirements do not pave a path for community and Coastal Commision acceptance.

I work, and have worked for, multiple LONGSTANDING big name Del Mar homeowners that have two units on one parcel (old school, not considered ADUs). They must each be allowable, as a precedent has been set and these units have been operating for decades.

2 You open The City of Del Mar up to alot of exposure with City Mandated Onsite Inspections.

STVRs are here to stay. This staff report is shocking..... I feel like Dwight Worden learned nothing over the last 8 years of bleeding City Money on this topic (refer to Ralph's letter and his new PIR request). Dear City Clerk,
I strongly support the proposal to accommodate the Existing STRs with non-conforming operations for a period of 5 years, but it might be better to just grandfather all existing STRs that are known to Staff if they have a record of causing no problems or have not rented their place to too many guests at one time. That action by the Council may reduce lawsuits on the entire STR issue.

I also believe that there should be written “good neighbor” policy with heavy penalties, including a loss of permit.

Once the maximum number of permits is issued, any new applications will have to wait in line until an existing permit is terminated.

Multi-unit condos with more than the number of suggested STRs , but absolutely no complaints, should be able to continue operations, with no additional units being added. Any future complaints should be strictly enforced and could cause a loss of their permit.

The Permit Registration Application should be EASY TO FIND on the City website and weekly DEL MAR NEWS publication.

It should also be easy to understand and easy to complete, with instructions as where to send it upon completion. The DEADLINE DATE should be Clearly Visible to all applicants.

I know that this is going to be a difficult process for the Council but it should not be rushed at all.

I wish you the best of luck in trying to satisfy the suggestions and complaints of all who are interested in this issue.

The new STVR ordinances are too complicated. The Attrition Section should be completely removed.

Precedents that have been operating for decades must be adhered to, and city mandates are invasive. This is yet another example of government overreach; has Mr. Worden not seen the bleeding of city money the last 8 years? Keep it simple and stop stifling our property rights.

Dear Del Mar City Mayor and City Council,
I am shocked and disappointed by the 50 page draft regulatory framework.

At the end of last year when council created the guiding principles and objectives, I honestly thought that the council was going to work towards a reasonable resolution in good faith. You even stated at a council meeting to give you a chance, to wait and see that you would be creating something that was fair and reasonable and that it wouldn’t be contentious like last time, but instead one of the council members must have been directing staff to create a plan that looks for every possible way to ban, exclude and limit vacation rentals while using smoke and mirrors to try to make it seem like you are allowing STRS in these new commercial areas. Areas that in a 100 year history of this town, have not seen a single vacation rental.

In my opinion, this framework would bring an end to 95% of existing vacation rentals within 5 years. And that few if any new vacation rentals would ever be permitted again.

The council should be looking to protect the historic vacation rentals of Del Mar. We expect you to stand up for us and honor us, not wipe us all out in 5 years. 1 January 22, 2024 Item 07
2 The Del Mar beach area was founded and established as a town of vacation homes. That is our history. That is our legacy. That has been our gift to San Diego and to California.

That cannot be ignored.

What am I shocked about in particular? I am shocked that you led us to believe that existing STRs would be grandfathered in. But you are not doing that. I don’t consider elimination within 5 years to be “grandfathering.” That is the “soft landing” former city council members proposed during the last illegal ban attempt. You are likely classifying 95% of pre-existing STRs as “non-conforming” and that they will be eliminated in 5 years. This is NOT ACCOMODATING and also does not meet the council adopted guiding principles and objectives #1, #3 and #12.

Accommodating existing STRs – All language about removing what are classified as “non-conforming” after 5 years (or on any timeline) should be removed. All existing STRs should be grandfathered until at least the sale of the property. And more thought given to if the rights should transfer with the property as is typical of property rights.

Non-primary residence STRs – This means SECOND HOMES are non-conforming. So, if you live in your home for 6 months or less, you CANNOT apply for a permit to rent out as a vacation rental. I estimate that at least 90% of the existing STRs are in second homes and these would all be eliminated in 5 years. That’s insane. This makes it clear that a ban is the goal. Non-primary rentals should be allowed.

I understand that you want to “maintain housing stock” but isn’t that already accomplished with the 129 - 5% cap? And this cap already far reduces the historic number of STRs which was approximated as between 300-400 just 7 years ago.

And I understand that you quote the CCC as wanting to limit STRs to primary-home only so that long term tenancies are maintained for lower-income households. One idea is to have primary-home STRs jump to the top of the waiting list for available permits. But also, in the little microcosm in the north beach area, that idea is absurd.

For example, my rental is a family home that we have rented out for over 35 years and is located on 25th St which is in the beach-accessible R1-5B zone. And I live in that zone as 2 January 22, 2024 Item 07
3 well. For the CCC reading this letter, this is the zone where the properties have direct beach access with no streets or railroads to cross or bluffs to get down. And the minimum price that a home has sold for recently is 8 million. Yes, Bill Gates owns a home in this zone. I know each and every property currently listed as STRs within this zone. 100% of those rentals are second homes. This regulation would eliminate ALL current beachaccessible accommodations. Since I’ve lived here since 1988, I can give you a view of how this area has evolved. I’ve watched it turn from an area of around 60-75% second homes where about half of those were rented out as STRs and the other half sat empty to now where that same 60-75% mostly sit empty. It is only the older homes that are being shared with visitors as vacation rentals. Now, a full-time primary home resident has become a bit of a unicorn. The billionaires have pushed out the millionaires and they can afford to not be bothered with rentals. Older homes are purchased, rebuilt and then sit empty the majority of the year. No regulations can stop this trend.

So, what should we and also the CCC prefer? Would we prefer to help families hold onto older homes to be used and loved and shared as vacation rentals or would we rather they be sold to become the next inaccessible property?
Personally, we are just trying to hold onto our home so our family can use it. We don’t want to rent it out full-time, or we could not enjoy it ourselves. And believe me, running a vacation rental is not a big money maker. Our goal is just to break even each year.

Limiting STRs to non-business entities – This exclusion should be studied more. In general, I agree with the idea that ‘big bad corporations” shouldn’t be buying up properties and converting them to STRs. But this is not the case in Del Mar. The homes are far too expensive so that it does not even come close to penciling out as an investment. Try figuring out the carrying costs of an 8 million dollar home. Also, new tax laws are encouraging homeowners to move their properties from Trusts to LLCs. Most wealthy homeowners are now moving their primary residences into LLCs. There should not be discrimination based upon how title is held. This needs to be thought out better.

STRS of 2 on one lot – I think this should be studied more. I see 2 situations which should be treated differently.
a. 1 owner of 2 STR on one lot – phase this out upon sale of the property b. 2 owners of 1 STR each on one lot – these should be allowed. There are some properties (like the old 5 original Fletcher beach homes) that have 2 units on one lot where 3 January 22, 2024 Item 07
4 the property is owned 50/50 and Del Mar will not allow them to condominium. Properties like these should be grandfathered in.

Neighborhood Caps - I think these need to be adjusted more to better reflect the community plan which highlights the significant portion within the beach area and to also better reflect the existing rentals. I think the North Beach should be closer to 70% and the Hills neighborhood should be lowered to approximately 5%. 30 minute response – That is far too short! The response time should be within 2 hours.

What if I’m taking a shower, surfing, running, walking the dog, etc. In my 35 years of being an owner, I have always responded in a timely manner. And if it’s an emergency, call the police.

What about 2 weeks total a year rentals? - There is no mention made about those wishing to rent their homes for 2 weeks total a year. Federal tax law allows any property owner to rent their primary residence for at most 2 weeks a year without paying any federal tax and without reporting. I think a special waiver should be crafted for all homeowners that honors.

Guiding Principles
The council created “Council adopted guiding principles and objectives” which included the following:

1. Honor the existing policies in the Del Mar Community Plan – a. Reminder that the Community Plan specifically mentions the significant portion of “Transient”– daily/weekly rentals within the beach area and the task force chose to not discourage them in any way.

3. Honor the tradition of vacation rentals during the summers, holidays, and horse-racing season. a. Reminder there is a tradition of vacation rentals. And not just during the summer and not owned by any one type of property owner.
4 January 22, 2024 Item 07
5 12. Work towards a solution for STRs that works for Del Mar and will pass muster with the Coastal Commission.
a. This framework needs to work for Del Mar. Not just to protect us from being overrun by too many vacation rentals, but also to protect the historic rentals. This means that you don’t strip property rights away unfairly and trigger more lawsuits. b. The CCC not only want to maintain the housing stock, but also wants to maintain beach-accessible visitor serving accommodations. There has to be a balance to this.

Del Mar only has the Del Mar Beach Hotel that is accessible. All other Del Mar hotels are not beach-accessible without crossing railroad tracks or making an illegal journey across tracks and down a 60 ft bluff. The other nearest beach accessible hotels are The La Jolla Shores Hotel 10 miles to the South or the Alila Marea Beach Resort in Encinitas 13 miles to the North. Beach assessability for that 23 miles is primarily served by STRs.
c. Stop using Pismo beach as a comparison to us. The entire Pismo beach is littered with beach-accessible hotels.

Summary of Suggestions:
 Grandfather existing STRs permanently
 Non-primary residence full-time STRs – make allowable.  STRs owned by LLCs – make allowable
 Owner with more than one STR on different lots - Remove non-conforming phase out by timeline and instead let them phase out when a property is sold.  Owner with more than one STR on a single lot – Remove non-conforming phase out by timeline and let them phase out when a property is sold.
 To help prioritize primary home STRs, If the cap of 129 STRs is reached and a waiting list is utilized, primary residence STRs should have preferential treatment and should be added to the list above the non-primary residences.
 Look at adjusting the neighborhood caps
 Adjust 30 minute response time to 120 minutes
5 January 22, 2024 Item 07
6  Create a 2-week total a year waiver

Subject: NEW PROPOSED SHORT-TERM RENTAL RULES
CAUTION: This email originated from outside of the organization. Do not click links or open attachments unless you recognize the sender and know the content is safe.

We are submitting my comments to the Red Dot Committee as we are not able to attend the meeting scheduled for tonight.

Our house is very affordable, but still walkable to the beach. That is extremely rare for Del Mar, and, frankly, we are surprised that the City is moving to restrict this. This seems to be an elitist move against the spirit of the California Coastal Act providing for reasonable access to the beach for those with modest means . I presume these restrictions will need to be approved by the Commission? If the matter is put before the Commission, would that open the door for further state review of various Del Mar ordinances? That may be beneficial here.

If we can't rent our property, we will likely sell it to someone who will tear it down and build a bigger home which won't be available for those with modest means. Is that the goal? Depriving us of our property rights is not the way to proceed without an expectation that we will fight it.

My wife and I have owned our home in Del Mar since 1991, We have always viewed our home as both a great place for us to vacation, but also as a source of income. Over the past 30+ years, for the most part, our rentals have been short term, especially in the summer season. As we are now retired, the income from our property is even more important. In addition to the purchase price, over the years we have invested many hundreds of thousands of dollars in the property. We are not opposed to reasonable ordinances, but not permitting STRs or not permitting them except during the summer, holidays and racing season is, in our view, an unacceptable taking of our property.

There are many reasons for people to utilize short term rentals, not just vacations as some have said. We have had tenants over the years that are working or being treated at Scripps and need a place to stay near the hospital for a short term. We have had people who need to have their homes fumigated rent our house on a short term basis. Because we allow pets, we have had tenants who have had no other choice but to rent homes that allow pets. These are not limited to summers or holidays. Most of our rentals are for long weekends--3 days/nights. We have a reputable agent who manages many of the STRs in Del Mar and we are very strict about rules to limit the number of people in the home (it is a 3 bedroom home and we limit the number of guests to 6). We also installed outside cameras to make sure that there are no extra guests than what we allow. We limit noise after 9 p.m. (even though there are no such limits on residents). We do not allow guests to have large gatherings--we've seen and heard much larger parties at properties that are not rented out.

Del Mar does not have an abundance of hotel rooms available, and those that do exist are not affordable for many families (especially those that need more than one room). Not allowing or limiting short term rentals will deprive many who cannot afford expensive hotel rooms and drive that business to other beach communities that are not so restrictive. This is not a benefit to Del Mar who will lose those tourist dollars. Moreover, those that work in service businesses here in Del Mar will lose income that has already been greatly harmed by the 1 January 22, 2024 Item 07
2 pandemic and its aftermath. Now is not the time to seek ways to harm these businesses or their employees.

Finally, as we have owned and operated our property for the past 30+ years, we have been grandfathered in with respect to rentals (with no limitations). If the City decides to move forward with restrictions on STRs, we request that our property be grandfathered in under the existing rules.

Respectfully submitted,

Dear Councilmembers,
My name is Danielle Nicholas and I am opposed to the current STR regulations. STR should not be tied to whether or not it is the primary residence of the homeowner nor should each property/homeowner be limited to one STR. There should not be a restriction on the number of days a property can be rented.

As a native of North County San Diego and a graduate of Torrey Pines High School, I grew up on the beaches of Del Mar.

Del Mar was founded as a seaside resort and has always catered to a tourist population. The current STR regulations do not honor Del Mars history and, in fact, corrode that which has kept it an economically viable and desirable town.

Currently, there is a pro golfer in one of my units who is playing in the tournament up at Torrey Pines. Would you rather he spend his money down in Mission Beach instead? That is what would happen under your current rules.

Additionally, many people from out of state come to seek treatment at nearby Scripps Hospital. Would you rather their dollars go to other areas of San Diego?
Del Mar is a year-round destination. It is not limited to summer and race season.

The proposed STR rules violate rights of property owners and undermine the historical integrity and economic viability of the City of Del Mar.

I urge you to vote NO on the proposed STR regulations.

Sincerely,
Danielle Nicholas

Dear Del Mar Council,
I realize this red dot letter is coming in late, but I commend all the work on providing “balance” to STR’s in Del Mar. I agree especially with the limit percentage related to all locations in Del Mar. The Beach Colony is especially impacted by STRs, so I appreciate the concern to protect my neighborhood from excessive STR’s due to the proximity to the beach. I would love to have more homeowners/neighbors living on my street versus renters both long term or short term. I am saying this knowing that STRs provide higher rent amounts versus long term rentals encouraging new homeowners to purchases and participate in the high income from STRs Please protect our Del Mar Neighborhoods!! I do support an occupancy tax benefitting Del Mar directly.

Thanks,
Barbara Johansen

To Whom It May Concern :

The condominium I own offers excellent access to the beach which is one block from the ocean. It is one of 16 units and allows STRs in the City of Del Mar. The Homeowners Association Costa Del Rey is well-managed.

I am currently serving on the board as a Treasure along with Gina C. Mattern the president of the board. My unit offers a family affordable access to Del Mar's two miles of flat shoreline. I have a single-level unit that can accommodate people with disabilities. The beach at Del Mar is very unique in that it is flat and has good access for people with disabilities. The short-term rental gives my guests the ability to enjoy the coastline and beauty of Del Mar's beaches and allows my family to enjoy the beach as well.

Thank you.

We were very disappointed to learn of the staff recommendation that the City of Del Mar no longer include the San Dieguito River Valley Conservancy on the list of approved non-profits who can use City of Del Mar facilities.

It is hard to imagine a more appropriate partner for the City. The Conservancy itself was founded by several Del Mar residents, and it continues to have its membership reflect the participation of many former council members on its board and committees.

For many years, the Conservancy has participated and spearheaded funding for San Dieguito River projects within the City of Del Mar.

SDRVC took the lead in raising significant funds for River Path.

SDRVC developed a campaign that succeeded in saving a portion of the Boardwalk to provide an overlook within the San Dieguito Lagoon; the Boardwalk is located within the City of Del Mar, and is a significant amenity enjoyed by residents and visitors to the City of Del Mar.

The Conservancy’s educational and outreach programs have greatly enhanced our citizens’ knowledge about environmental issues relating to the San Dieguito River Valley, including the River and Lagoon.

Given that the City of Del Mar, its residents, and SDRVC have long worked together to promote the restoration, protection and conservation of the San Dieguito River, Lagoon, and watershed, the staff recommendation to remove SDRVC from the list of approved non-profits who can use City of Del Mar facilities should be rejected. SDRVC has long been a vital fundraising, educational, and conservation partner of the City of Del Mar, and it is in Del Mar's interests to maintain a strong and effective working relationship with such a vital partner.

Dear City Clerk and Clem,
Enclosed is a letter addressing Item 8 on tonight's City Council Agenda. The San Dieguito River Valley Conservancy (SDRVC) has established a longstanding partnership with the City of Del Mar, focusing on habitat conservation and restoration within the city. Additionally, SDRVC is dedicated to educating residents and providing responsible recreational opportunities not only for Del Mar residents but also for community members throughout San Diego.

SDRVC has played a crucial role in the successful completion of the River Path Del Mar, actively involving community members both locally and from across San Diego. This collaborative effort is designed to enhance public understanding of the importance of the San Dieguito River Valley, San Dieguito Lagoon, and the Coast to Crest Trail and its connection to River Path Del Mar.

Given the long-standing and successful collaboration between the City of Del Mar, its residents, and SDRVC to promote the restoration, protection and conservation of the San Dieguito River, Lagoon, and watershed, I urge you to reject the staff recommendation to remove SDRVC from the list of approved non-profits for City facilities and amend the proposed criteria to allow Non-Profits on the City of Del Mar list either be based in Del Mar AND/OR have a Del Mar community serving mission statement and/or mission statement that directly benefits or serves the Del Mar community. Your attention to this matter is greatly appreciated. We value the City's ongoing collaboration and support in our joint commitment to environmental stewardship.

Cheryl

Dear City Council,
Please send the letter to SANDAG to raise our concern about them (not surprisingly) again are trying to redirect earmarked Del Mar bluff stabilization funds to a different project.

Sigh. It never ends. Over and over they show that we constantly have to be on guard for broken promises and shady behavior.

Sincerely,
Camilla Rang
