Del Mar City Council,
In light of the Superior Court ruling in Olson vs City of Del Mar (37-2023-00023407-CU-PT-CTL), please amend Carmel Valley Precise Plan paragraph 8(C) to read:
Landscape limitations shall ensure that no vegetation can exceed the maximum roof elevation allowed in that lot, except for the Torrey Pine tree.
This was suggested as a possible fix by Judge Gregory W. Pollack. “if the intent behind 8(C) is to prohibit any tree (other than that of a Torrey Pine tree) once it actually reaches or exceeds a certain height, then it needs to simply say that” This simple fix will preserve the intent of the landscape height limitation to protect scenic views from uphill properties. Preserving scenic view corridors from uphill properties was a key intent of the Carmel Valley Precise Plan and critical to garnering support for this specific plan from property owners in the neighborhood.
