Agenda Item #8, Award of Construction Contract for the Hoska Alley Street and Storm Drain Improvements Project
Dear Mayor and Council Members,
We are writing regarding the award of the construction contract for the Hoska Alley Street and Storm Drain Improvement Project. This award is scheduled to be heard as Agenda Item #8 at your upcoming October 7, 2024 City Council Meeting.

We ask that the City Council approve the award of the construction contract.

Please consider the following items in your decision making process:

I. Alley Storm Drainage
- Currently, approximately 300’ of the eastern portion of the Hoska Alley drains to a storm drain inlet at the low point of the alley. This City designed and installed storm drain inlet discharges storm water into the backyards of privately October 7, 2024 Item 08
owned residences located on 8th street and has already caused property damage.

The City has known about this condition since at least 2018 and the drainage problem has not been remediated.
- The existing storm drainage system has already caused property damage to the residences on 8th Street. If the storm drainage system is not fixed, a major storm can easily cause future property damage that will exceed the amount of the proposed construction contract to be awarded. The City would be liable for this damage.

II. Alley Paving
- The Hoska Alley is a City of Del Mar owned street that has remained a dirt road for over sixty years. This is the only unpaved street in Del Mar and it’s time to remediate this situation.
- As an unpaved dirt road, each vehicle utilizing the alley creates a dust cloud that settles on residences, personal property and in the lungs of all the residents adjacent to the alley. The City of Del Mar is likely the largest daily contributor of air borne pollution in the City.
- The Hoska Alley fails to meet even the most basic American With Disabilities Act (ADA) requirements and the City has made no efforts to make the alley ADA compliant. The ADA has been in effect for over 30 years and the fact that the alley remains unchanged increases the City’s liability under the ADA.
- The Hoska Alley provides primary vehicle access to City mandated off street parking and garages for at least ten residences. The residents of the Hoska Alley should enjoy the same benefit of paved road access to their off street parking as all other Del Mar residents.
- The City has been aware of the poor condition of the Hoska Alley for many years. The “dirt road” condition of the Hoska Alley was brought to the attention of the City Council at the Council’s 2018 spring budget workshop.

At the conclusion of that meeting, the Council asked the alley residents to “be patient a little while longer”. After meeting with several of the Council October 7, 2024 Item 08
members over the past two years, the alley residents were told “you won’t be forgotten”. The alley residents have been very patient and we ask the Council to respond in support of the alley improvements now.

In closing, this has been a long journey for both the City and the residents affected by the Hoska Alley. We ask for your support and request that you approve the award of the construction contract for the Hoska Alley Street and Storm Drainage Improvements.

Thank you,
Kathy and Carter Chappell

Mayor and Council Members,
My wife and I have lived at 421 9th Street in Del Mar since 1991, and I have owned the property since 1973.

During that time, we have had numerous instances of flooding and siltation in our driveway connected to Hoska Alley, causing expensive cleanups. I have resorted to installing a toxic chemical curb across the alley on my property line to reduce the risk of further flooding and siltation. It's time to end the problem.

Fortunately, the lowest bid received for the work is below the Engineer's estimate.

With that fortunate bid result, we hope you will quickly approve the contract so that we can get on with the work without further risk of flooding and siltation this winter season.

Thank you.

Re: October 7, 2024 City Council Meeting
Agenda Item #8, Award of Construction Contract for the Hoska Alley Street and Storm Drain Improvements Project
Dear Mayor and Council Members,
We are writing this letter regarding the award of the construction contract for the Hoska Alley Street and Storm Drain Improvement Project.

We have lived next to this dirt alley for over 30 years. Many neighbors have access to their garages only via the alley. Multiple times a day, we see clouds of dust arise whenever a vehicle travels along the alley, polluting the air and coating our properties with dust.

After significant rainstorms, erosion creates an irregular ditch down the alleyway and washes away some of the gravel. It sometimes becomes difficult for vehicles to have enough traction to drive up the incline.

Dirty water has poured into the back yard garden of at least one of our neighbors multiple times over the years. A new storm drainage system is needed to remediate this situation.

The irregular surfaces and incline make it difficult for people with disabilities to navigate the alley. One man actually used his electric wheelchair to go up and down the alley in order to be picked up on paved Hoska Drive by a van in order to get to his appointments. I know that that was challenging and uncomfortable for him.

We urge you to award the contract for the storm drain improvement and the paving of the alley in order to make this alley more functional.

Sincerely,
Jill Ellis and Judd Westover

Dear City Council,
I am happy to see that there is an amendment coming up for the TSVS. It has been needed for a long time. However, I don't see any specifics so I will add here what I and many more want to see changed. The economical burden for any TSVS application - and solutions!, are as up to date solely on the applicant, whether the applicant turns out to be right or wrong.

This has to be changed. If someone is building a wall in the form of a long row of trees that is blocking the view for neighbors and the neighbors file a TSVS application, the applicant has to first the $4,000 (or perhaps it's more expensive now), plus that if the applicant "wins" the case, the APPLICANT has to pay for trimming the blocking trees for all foreseeable future. This is plain wrong. If the person who is blocking the view is determined having to have the trees trimmed according to Del Mar's TSVS's rules, that person should pay for trimming! I would even like to see that the person in wrong should have to split the application cost with the applicant. As things are now, there is absolutely NO need for intent of the view blocking neighbor to do anything. The best and cheapest thing for the view blocker is to just lean back and get his/her trees trimmed for free for the rest of his/her life.

We are required to show proof of failed communication and have gone through failed mediation already before dropping off a TSVS application so I don't understand what the City Staff mean by the applicant having to do more before applying. What more can we do? The view-blocker is not even required to split the cost for the mediation. I have been through all this and know how unfair and skewed pro-view blocker the TSVS system is. It has to change to distribute the economical burden equally between applicant and view blocker, at least once the case has been decided in favor of the applicant.

The other thing that needs to be changed is that we should be able to apply as a group.

One neighbor living west of a block should not be able to hinder the view for everyone east of them and having every single affected neighbor having to go through an individual $4,000 application. Affected neighbors within the required 300 foot distance should be able to apply together as a group.

Sincerely,
Camilla Rang

Do not click links or open attachments unless you recognize the sender and know the content is safe.

Dear Planning Department & City Councilmembers,
I was pleased to learn that Chapter 23.51—Trees, Scenic Views, and Sunlight Ordinance will be amended. I have read the packet outlining the Guiding Principles of this effort and noticed that the document only contains the word “sunlight” because Sunlight happens to be in the ordinance's title, but Sunlight isn't mentioned anywhere else. Sunlight must not be overlooked.

Its role is equally vital to our overall quality of life in Del Mar and should be considered during the review.

What affects Sunlight (not related to weather)? A Hedge. Guiding principal Item 9 references Hedge; however, it is directly tied to a Scenic View.

Provide an object balance between the privacy provided by hedges and a neighbor’s established scenic views through consideration of height regulations.

It is an oversight not to specify Sunlight as well as Scenic Views.

The TSVS definition of a Tree says “potential to obstruct scenic views or sunlight," and "or" means a Scenic View obstruction can be unrelated to a Sunlight obstruction.

Chapter 23.51.020 – Trees, Scenic Views and Sunlight definition:

S. Tree shall mean any perennial plant growing on public or private property, having a self-supporting woody main stem or trunk with the potential to obstruct Scenic Views or Sunlight, including but not limited to Trees, shrubs, hedges, and bushes or any plant material planted or growing in a dense continuous line so as to form a thicket barrier or naturally grown fence. References to "Tree" shall include the plural.

This definition brings us to the F word—Fence—and Del Mar has a definition for Fence and for Screening:

30.04.060 - "F" Words and Phrases Defined.

October 7, 2024 ITEM 09
2 C. Fence means a free standing structure resting on or partially buried in the ground and rising above ground level, and used for confinement, privacy, protection, screening or partition purposes. See "Landscaping, screening."

30.04.180 - "S" Words and Phrases Defined.

A. Screening means solid walls, solid fences or dense hedges for the purpose of concealing from view the area behind such structure or hedges. See also "Fence" and "Landscaping."
The TSVS defines a Hedge as a naturally grown Fence, and Attachment A - Jurisdictional View Ordinance Comparison Chart has a column labeled “Living Fence (Hedge) Ht. Limits Apply”. In this chart, thirteen of the 28 cities listed have been checked as having hedge height limits.

However, this list barely touches on the many California cities with local fence, wall, and hedge height ordinances, which often limit the height to six (6) or eight (8) feet. For example, our neighbor Solana Beach’s Municipal Code 17.60.070 Fences and Walls - E. Standards Applicable to Required Walls and Fences (All Zones):

4. Hedges and Landscaping. A hedge or other dense landscaping may satisfy a requirement for a view-obscuring fence. Such hedge or other dense landscaping shall be maintained in accordance with the provisions of Chapter 17.56 SBMC (Landscaping Regulations) and shall be replaced with another hedge, other dense landscaping or an appropriate fence or wall when it ceases to serve the purpose of obscuring views.

However, no such hedge shall be grown or maintained at a height greater than that permitted by those regulations for a wall or fence.

A Google search quickly revealed additional cities:
• Pismo Beach - Hedges, walls, and fences can be up to six feet tall in rear and interior side yards. Solid hedges, walls, and fences cannot be taller than 42 inches in front yards, side yards, or the street side of a corner lot. • Irwindale - Hedges, walls, and fences can be 36 inches tall on any part of a lot in an R zone. On an interior lot, hedges, walls, and fences can be up to six feet tall anywhere on the lot, except in the front yard.
• Fremont -
https://www.codepublishing.com/CA/Fremont/html/Fremont18/Fremont18171. html#18.171.010
• Corona - https://codelibrary.amlegal.com/codes/corona/latest/corona_ca/0-0-0- 54026
• San Pablo -
https://www.codepublishing.com/CA/SanPablo/html/SanPablo17/SanPablo1745 .html#17.45.030
• Escondido -
https://www.escondido.gov/DocumentCenter/View/4490/Ordinance-Number2018-07-R-PDF • and I'm sure there are many more cities with Hedge ordinances.

The County of San Diego has amended their water-efficient landscapes zoning ordinance:
“However, no such hedge shall be grown or maintained at a height greater than that permitted by these regulations for a fence or wall.” And their ordinance 6700 Fencing and Screen – Title and Purpose says:

October 7, 2024 ITEM 09
3 The provisions of Section 6700 through 6714, inclusive, shall be known as the Fencing and Screening Regulations. The purpose of these provisions is to prescribe standards for fences, walls and screening within San Diego County for the protection of property, the assurance of safety and security, the enhancement of privacy, the control of dust, and the improvement of the visual environment including the provision of a neat appearance in keeping with neighborhood character.
https://www.sandiegocounty.gov/content/dam/sdc/pds/zoning/january-2024-zoupdate/ZO%20Update,%20Section%206000,%20Full%20Section.pdf Providing a neat appearance in keeping with neighborhood character certainly resonates with Del Mar’s Community Plan!
In many of our neighbors, the side yard setbacks are such that homes are close to towering hedges that block natural light, and frequently, these hedges grow and result in scenic view blockage. Of course, there are exceptions, but usually, privacy can be preserved with a 6-foot hedge, so there is rarely a reason to have a towering hedge that blocks sunlight, and there is no reason for a hedge to be unkempt.

I request that the Planning Department include Sunlight during their review by balancing Privacy Hedges against Del Mar's existing objective fence ordinances. TSVS complaints will drop once Hedges are treated for what they are—a Fence.

Sunlight is essential, and everyone has a right to light! Sincerely,
Janet Wilson

Dear Mayor Druker and Councilmembers,
We understand that Ted Bakker’s name has been put forward to fill the Council seat vacated by Dwight Worden, and we just wanted to let you know that we enthusiastically support this appointment. John served for four years with Ted on the Planning Commission, and in that role, he saw what a smart, sensible, effective leader Ted was.

Ted knows and values our ordinances, our community character, the Community Plan, and our local government issues and challenges, and would be able to step into the City Council position seamlessly. He also works very well in a group setting – listening to all sides, making informed decisions, articulately expressing his positions, and conducting business in a collegial fashion. Like Dwight, he epitomizes the Civility standard that Del Mar has adopted.

We can think of no one more appropriate to fill the Council opening, and we urge you to appoint Ted Bakker for the remainder of Dwight’s term.

Dear Council Members,
I'm writing to ask for your vote to appoint Ted Bakker to fill the vacant City Council seat left by Dwight's retirement.

Years ago, I was appointed to the Planning Commission with no prior experience in committees within our City government and had to learn fast about the intricacies of exactly how our Community Plan works, why it has become so very important to us, and how we can protect it. Ted Bakker has now had 12 years' experience of learning, leading other members of the Planning Commission, and protecting these very concepts.

But times are much different now, during this time of upheaval and uncertain changes required by recent state mandates, and the huge, complicated decisions regarding the railroad tunnel, not to mention future concerns on SLR and how it will affect our town, I now feel that having prior experience on the Planning Commission is vitally important for any newly appointed City Council member.

I think it would be strongly advantageous for any candidate to have experience on the Planning Commission before taking on the role of City Council member at this very convoluted and emotionally charged time.

I truly applaud Ted for applying to take on this challenging role as a City Council member in the midst of these challenges. I've known him for over 40 years as a strongly supportive neighbor, a close friend, a fine husband to Gale, a father of 2 great (now adult) children, and as a truly outstanding citizen of our town.

I'm asking for your vote to appoint Ted Baker to fill the vacant City Council seat.

Sincerely,

Re: Red Dot re: City Council Appointment, Agenda Item # 11 Meeting Date: Oct. 7, 2024
From: Claire McGreal, Stratford Ct., Del Mar 92014
Dear Mayor and Members of City Council,
I am writing this Red Dot in support of your appointment of Ted Bakker to Del Mar City Council.

I have known Ted and Gale for many years, since their kids were very young, and Gale and I worked together on the Children’s Committee of the Del Mar Foundation, now Young Del Mar.

The Bakkers are a terrific couple, and have raised their 2 children in Del Mar: Garrett now works with Ted in his business, and Claire is in medical school.

I got to know Ted lots better since working with him on Del Mar’s Planning Commission. I was appointed to Planning in 2020 and finished serving in June 2024. Ted has been on Planning Commission for 12 years, serving as Chair for at least 6 or 8 of those years.

Ted chaired Planning Commission for most of my four-year tenure. Ted attended all meetings, came thoroughly prepared to address the issues, was always very familiar with the facts of each matter, and routinely asked inciteful questions of staff and meeting participants. What was most impressive to me while sitting at the dais with Ted, was the depth of his knowledge of Del Mar’s Community Plan and individual city ordinances, and Ted’s ability to apply those rules to the issue at hand. Whether it was a request for a Variance, a proposed Zoming change, a Conditional Use Permit, a TSVS application, or review of a draft ordinance to meet the everchanging State laws dealing with housing, Ted always came armed with questions and hypotheticals to test the applicability of the relevant rule to the set of facts.

Ted’s personal demeanor is very well suited to City Council. He is a true gentleman, and always treats people with respect and courtesy. Ted exhibits great patience, explains things very cogently, and is able to make things understandable to everybody. These talents are assets not only in city meetings, but also in the wider arena of working on regional boards, which is such an important aspect of representing the city of Del Mar.

For these reasons and more, I strongly urge you to cast your vote to appoint Ted Bakker to Del Mar’s City Council.

Respectfully Submitted,
Claire McGreal, Former Planning Commissioner

Dear City Clerk:

Kindly submit the following red-dot communication to the City Council for Item 11 of the October 7, 2024 meeting agenda.

Dear Honorable Mayor and Distinguished Members of the City Council:

I am a long-time resident of Del Mar.

I strongly support the candidacy of Jeff Sturgis to fill the City Council vacancy left open for Dwight Worden’s remaining tenure.

I serve on the board of directors with Jeff for a non-profit organization dedicated to the preservation of the Del Mar Bluffs, which, among other things has opposed illegal fencing on the Bluffs, and have found him to be collaborative, analytical, pro-active and knowledgeable. His financial background and work on the City’s finance committee would be an asset to the City Council. Thank you.

CORRECTION OF SPELLING MISTAKE. Please replace former email with this:

Dear City Council,
I am happy to know that you will vote in a new member to fill in after Dwight leaving the council. Those are some big shoes to fill! I want to take the opportunity to officially thank Dwight for all his time and effort he has put in for our city and that I hope he will continue doing as an involved private citizen. Thank you, Dwight.

In regards to voting in a new member, I do understand this is not supposed to be a popularity contest but I cannot speak highly enough about Jeff Sturgis. I know Mr. Sturgis from the Fence Fight against NCTD that tried (and still trying) to destroy our fragile and beautiful bluff with a fence, cutting us all off from the beach. Mr. Sturgis is an outstanding and involved Del Mar citizen, standing up for what is right and not afraid of fighting the evil and corrupt. He is a strong leader and listener and highly intelligent. It would be an honor and privilege for Del Mar to have Mr. Sturgis on our City Council. I know he will always stand up for what is right and take no sh-t. We need strong people on the Council, especially now that we are in for a huge train reroute conflict with both Solana Beach, the Fairground, and SANDAG where we have to make sure our voices are heard.

I do not know the other two applicants. I am sure they are fine in their own ways, but since I know the characters of Jeff Sturgis, I know he will be an outstanding member of the City Council, a choice you will never regret.

Sincerely,

I am writing in support of Ted Bakker to fill the opening left in Dwight Worden’s term.

Ted is a worthy person to stand in for Dwight. As was Dwight, I know Ted to be a person of integrity who is fair-minded and trustworthy. Ted’s values match those of Del Mar, and he will uphold the core tenets of the Community Plan. Ted is a person of compassion and the highest moral standing who will look at all sides of every matter coming before the Council. He is collegial and will be a reliable partner to the other Council members.

I have complete confidence that Ted, with his long record of service to our town notably on the Planning Commission, has the background and experience to step into this important role and understand the complex issues facing us—from Day 1.

Ted is the best person for this position.

City of Del Mar
Dear City council Members,
I am asking for your vote to appoint Ted Bakker to fill the vacant City Council seat left open by Dwight Worden’s retirement.

Ted’s service on the Planning Commission for the past 12 years uniquely qualifies him for a seat on the City Council. He has a thorough working knowledge of City Ordinances, zoning and land use matters and how they interact with our Community Plan.

Ted understands the affordable housing issue and the Housing Element and has helped the city adopt the State mandates in a way that protects the character of our community.

His experience in dealing with the State mandates and the Coastal Commission requirements will allow him to serve on the regional committees that are so important to the challenges facing Del Mar today.

Ted has shown good judgement, clear thinking and a willingness to do the detailed work required of a Planning commissioner. He has the kind of work ethic that will make a good Council member.

Please appoint Ted Bakker to the City Council.

To: Del Mar City Council Members
I am writing to support the appointment of Ted Bakker to fill the open position on the City Council.

In my opinion, there are three important attributes of a successful member of our City Council: 1) dedication to Del Mar; 2) knowledge of Del Mar and the issues facing us; and 3) the ability to work with others, including fellow Council members and City staff. Through his 12 years on the Planning Commission, Ted has demonstrated his commitment to our City and has gained valuable knowledge and experience.

Further, as many of us know, success both in addressing routine matters and tackling problems, is often dependent on interpersonal skills, including the willingness and ability to work with others. It is clear Ted has such skills and would work well with others on the Council.

Yours truly,
Glenn Warren

My wife and I have lived in Del Mar for almost 35 years and have seen our little beach community evolve greatly over that time. During that time, the Sturgis family has been very involved in protecting and enhancing our community (in fact, Jeff’s mom served on the DRB with my wife in the green versus gray days). Jeff has continued in his family’s footsteps working tirelessly for our community. He is smart, and more importantly, reasonable and open minded to everyone’s opinions. He would make a great addition to our city council. For these reasons I am hopeful you will appoint him to complete Dwight Worden’s position. Tom Grindle

Dear Members of the Del Mar City Council,
I am writing to offer my enthusiastic endorsement of Jeff Sturgis for the open seat on the Del Mar City Council. As a longtime resident and active participant in our community, I firmly believe that Jeff is uniquely qualified to serve and make meaningful contributions to our city’s future.

Jeff has been a resident of Del Mar for 40 years, which has provided him with a deep, personal connection to our community and an extensive knowledge of the city’s history, needs, and aspirations.

His longstanding commitment to Del Mar is unparalleled, and his familiarity with the community’s unique character and challenges makes him an ideal candidate for the Council.

In addition to his deep roots in Del Mar, Jeff has demonstrated exceptional leadership through his service on the city’s Finance Committee, where he is currently serving his fifth term. His profound understanding of Del Mar's finances and the financial challenges we have faced over the years has been invaluable.

Whether navigating the 2008/2009 equity market downturn, helping steer the city through the recession during the COVID-19 pandemic, or addressing the ongoing challenges posed by employee pension obligations, Jeff has been a steady, thoughtful presence. His financial acumen has helped the city weather these turbulent times while maintaining a focus on fiscal responsibility and long-term sustainability.

Jeff’s commitment to Del Mar goes beyond financial matters. He has also served on the Historic Preservation Advisory Committee, where he helped protect the rich heritage of our community.

Furthermore, his involvement in critical issues such as sea level rise, affordable housing, and the train track challenges demonstrates his dedication to addressing both the current and future needs of Del Mar’s residents.

One of Jeff’s most admirable qualities is his unwavering support for the Del Mar Community Plan and his dedication to protecting Del Mar’s unique character. He has been a vocal advocate against state housing mandates that could undermine our city’s distinctive charm, ensuring that the values of our community are preserved for future generations.

Jeff’s focus on maintaining healthy city finances, combined with his deep love for Del Mar and experience navigating complex issues, makes him the ideal candidate for this City Council appointment. I am confident that Jeff will continue to serve with integrity, intelligence, and a vision for the sustainable future of our city.

Thank you for considering my endorsement of Jeff for this important role. I am confident that his leadership and dedication will greatly benefit our city and its residents.

Dear Council Members,
Please vote for Ted Bakker to fill the unexpired term of Dwight Worden. I have met Ted and had several discussions with him. Without reservation, I recommend him as the best candidate for the following reasons

1. Long term experience on the Planning Commission is indicative of solid experience and a keen understanding of city matters;

2. Recommendation of two commissioners who have worked with Ted Bakker and Jeff Sturgis; such close at hand experience to see how a candidate thinks and votes about issues is the best “interview” possible for your consideration;

3. No contact or information on the third applicant; and

4. Geographical representation enhances the City Council’s decision making; while Del Mar does not have “districts”, the location of Ted’s home means that when issues arise about that segment of the city, the City Council member can give firsthand information to add in the collective decision making.

My endorsement for Ted Bakker is also predicated on the fact that I believe Ted understands the broad needs for community safety in the same way that I believe City Council decisions should be made for the benefit of the entire community. I believe this is demonstrated by the number of people supporting his appointment from all interests and areas of the city. It is also critical to the ongoing projects in our community that the candidate be supportive of our existing professional staff and has a good working relationship with them.

Honorable Mayor and Council Members,
I heartily encourage you to appoint Jeff Sturgis to the open Council seat. Jeff is the correct person for this Council.

As you know, Jeff is currently serving his 5th term on the Finance Committee. He has a deep understanding of Del Mar’s finances which is critically needed at this time when our pension obligations have grown from an unsettling $20+ Million to a terrifying $50+ Million in just a few short years, with no end to the increases in sight. There is also discussion of borrowing funds to pay to finish undergrounding utilities. More debt obligations for a city that has only modest revenue growth? I understand the city already borrowed against future TransNet revenue to complete the City Hall and downtown revitalization. Is borrowing against future funding really the best way to run this city? I think not, certainly not to the magnitude approved by prior Councils.

The Council’s role is to set policy; that important responsibility requires in-depth knowledge of city finances, available options, external influences, and rational thinking influenced not by a personal agenda but rather by a commitment to do what is best for the entire community now and for the future. Jeff is the right person to fill this role.

A 40+ year resident of Del Mar as I am, Jeff is an avid supporter of the Community Plan and protecting Del Mar’s unique character, especially in the face of state housing mandates that threaten our community. His leadership on city committees has given him broad experience in many aspects of city issues and makes him the right person for this Council.

Please appoint Jeff Sturgis to the open Council seat.

Dear City Council Members,
We are writing this letter in support of your appointment of Ted Bakker to replace Dwight Warden on the Del Mar City Council. We believe that Ted's long tenure on the Planning Commission has made him uniquely capable to step into this position at a time when Del Mar is facing difficult and complicated decisions regarding the railroad tunnels and state housing mandates.

As Chair of the Planning Commission, Ted has proven himself willing and able to work with others in a professional and collegial manner to uphold our Community Plan. On a personal note, when a small project at our home was before the PC last year, Ted not only took his time to come to see our project in person but also patiently and thoroughly walked us through the process ahead. We were impressed with his professionalism and the level of care he took in evaluating the situation.

We urge you to vote to appoint Ted Bakker to Del Mar's City Council.

Hello City Council Members,
I am writing you today to express my disapproval of appointing Ted Bakker into the interim spot left vacant by Dwight
Worden. Ted Bakker, my westside neighbor, is currently the defendant involved in a Trees, Scenic View, and Sunlight Permit dispute that is pending. The City Council should already be wary about a potential Council applicant when, as a long-term Planning Commissioner, he is the defendant in a Trees, Scenic View, and Sunlight dispute that I had to pay thousands of dollars to initiate. The original hearing was scheduled for September 10, 2024; however, Mr. Bakker, at the time, was on the Planning Commission scheduled to hear the case against himself. The city decided to postpone the hearing until December 10th so that he would not have to recuse himself. While the delay cost me time and money, I agreed to postpone that hearing. I suspect that I may ultimately have to appeal my Trees, Scenic View and Sunlight case to the City Council, because of Ted's continued influence on the Planning Commission. However, if he is appointed to the City Council, he would now be on the Council that hears the appeal of the Planning Commission! He would essentially have his hands in both jars. You have two additional choices for the City Council vacancy. I urge you to choose someone other than Ted Bakker.

Re: Red dot for City Council Item #11 – Council Interviews and Appointment Dear City Council Members,
In my mind, the biggest issues facing Del Mar for the next few years will revolve around land usage, including how we relocate the train line away from our homes and businesses, and how we work to integrate numerous housing laws that our legislature and Governor continue to send our way.

Ted Bakker has the experience to evaluate and address these challenges on day one, and this is why I ask you to vote for him to fill the vacant City Council seat left open by Dwight Worden.

Ted served for three terms on the city’s Planning Commission, which has allowed him considerable experience with city ordinances and our city’s land use and zoning issues. And from what I have observed while watching the Commission’s meetings (most of you know my husband John Spelich is a fellow Commissioner), they have been focused on protecting our Community Plan and protecting the character of Del Mar while also ensuring we do not run afoul of the state regulators. He has also done his best to meet the needs of residents.

From my observation, Ted has shown good judgment, and a willingness to engage with others on the Commission and work through any issue in order to come to the right answer for Del Mar. It’s obvious that he’s not about grandstanding; he’s about getting the work done. We need that kind of person on City Council as we confront the challenges Del Mar will face in the next few years.

I strongly urge you to appoint Ted Bakker to Del Mar’s City Council.

Sincerely,
Lacey Logan

ITEM 11 RED DOT COUNCIL VACANCY INTERVIEWS AND APPOINTMENT Oct 6, 2024
Dear Mayor Druker, Deputy Mayor Gaasterland, Council members Martinez and Quirk:

I support the appointment of Ted Bakker to fill the position left vacant by the early retirement of Dwight Worden.

I’ve gotten to know Ted in a during my 18 months of service on Planning Commission. Ted, who has served for more than a dozen years, was clearly experienced and more importantly was open and helpful in trying to impart his expertise and view of the issues. He also has demonstrated time and again an openness to discuss matters in a calm, rational way and to reason as part of our group to achieve a proper outcome for residents.

To me, this is an important quality for City Council members. While on Planning, he never made it about him. He and I, it seemed, might not be immediately aligned but we came to an agreement. Same with the other commissioners. During my time on the Commission, we only once had a split vote. For the vast majority of items, we always talked it through and came to consensus.

The toughest issues confronting the Council in the coming years will revolve around land usage, including how we relocate the train line away from our homes and businesses, and how we work to integrate the stream of housing laws that our legislature and Governor continues to send our way, and how we handle the undergrounding project. With his experience, Ted Bakker will be able to contribute on day one. He knows our ordinances, and his commitment to the Community Plan and preserving what we all love about Del Mar is obvious. For those of you who’ve watched him, he’s also a practical guy who likes to cut to the chase and reduce issues to what they are really about.

In short, with Dwight and Dave leaving this year, he’s the kind of person we need right now on City Council.

I strongly urge you to appoint Ted Bakker to Del Mar’s City Council. Thank you.

Dear Mayor and Council,
I am writing in support of Jeff Sturgis to be appointed to the City Council. Jeff has served diligently on the Finance Committee over many years and is its present Chair. He is well respected by his fellow Committee members and by the residents of our community. He is an intelligent and independent thinker and listens to all sides before making a decision. Jeff’s family roots in Del Mar go way back in time and he has the blood of Del Mar in his veins.

I served on the Friends of the Powerhouse Organization with his mother, Myrna Sturgis, and Jeff is a reflection of her kindhearted soul. In short, he would be a great replacement council member and serve our community well. I urge our City Council members to vote for Jeff Sturgis. Thank you, Hershell Price

Dear Council Members,
Please appoint long-term Del Mar Finance Committee member and former chair Jeff Sturgis to the City Council.

I have had the privilege of working with Jeff on the city’s Finance Committee over the last two years. He has served on that Committee for over 12 years and through 12 different budget cycles that included the severe financial shocks of the pandemic and two recessions.

As chair of the Finance Committee, he displayed not only mastery of the city’s budget but also diplomatic skills in working with staff and fellow committee members in advancing successful initiatives that generated over $150,000 in investment gains for the city and will save millions more in long-term pension obligations by pre-funding these obligations in a pension trust fund.

As the city council reviews financing options for city-wide undergrounding of dangerous overhead power lines that could potentially cost over $100M and providing the incentives necessary to develop affordable housing at the Del Mar Fairgrounds and city-owned sites, Jeff’s financial and business operating experience and insights would be most helpful.

Jeff is also well versed in the city’s significant legal and land-use issues with HCD, 22nd DAA, NCTD, Coastal Commission, and STB including affordable housing, safeguarding Del Mar’s crumbling bluffs, and proposed train realignment. He brings invaluable long-term perspective on environmental and economic issues as a 3rd generation Del Mar resident whose family has been in our community since the 1940s.

Even more significantly, Jeff would be an effective colleague and representative of Del Mar residents on the city council as well as regional boards with his judicious manner, detailed analysis of issues, and communication skills.

Thanks for your consideration,
Laura

Dear Council Members,
I hope that each of you whole-heartedly support Jeff Sturgis for City Council.

Jeff has been a valuable long-term member of the finance committee and is a generational resident of Del Mar. He will hit the ground running with his thorough knowledge of all the major issues facing Del Mar (train, housing, climate adaptation, undergrounding etc.) He is level-headed, well-balanced, competent, very even-tempered and soft-spoken in his approach.

He can be counted on to work seamlessly with others and to make bridges between council members where needed.

Jeff is a perfect complement to current city council.

Dear City Council Members,
I hope this message finds you well. I am writing to express my thoughts on the upcoming decision regarding the appointment of a new council member on Monday October 7, 2024 versus allowing the public to vote on this matter.

I want to voice my concerns of placing my neighbor, Ted Bakker in this position. I’m sure our neighbors and community would voice their concerns also of placing a un-neighborly person in this position. Ted has a long history in our community by serving 3 terms on the planning commission. While I’m sure there must be one council member that enjoys his company the feeling on our street and in our community is different. Ted has had on going issues with almost all the adjacent neighbors on La Amatista and currently going to be involved in a hearing regarding blocking their neighbors ocean views with their foliage, instead of being neighborly and trimming/working with them. He paints his curb red so people can’t park in front of his house, holds neighbors building permits hostage as he has had an ongoing building permit for 25 years without finishing, list goes on and on.

We don't appreciate the way the Bakkers treated us and many other neighbors, while at the same neglecting to take care of their own personal matters (do what I say, and I'll do what I want). That's not the type of person we want to represent the City nor ourselves.

Thank you for considering my perspective on this important issue. I look forward to seeing how the council chooses to proceed.

Unfortunate neighbors of the Bakers.

Dear Members of the Del Mar City Council,
I am writing to express my strong OPPOSITION to the appointment of Ted Bakker to the Del Mar City Council.

I have lived next door to Ted Bakker for many years, having purchased my home in 2003. We had many good years of nice relations. However, over the years, I have seen a different story emerge.

Ted has been a 3 term member of the Planning Commission, yet the Bakkers have been remodeling their home for over 25 years!! A typical permit for a home project has a 2 year time limit, so they are extreme outliers. Somehow, just TWO WEEKS ago, he paid to reactivate his previously expired Building Permit, originally issued in the 1990s. Hence, while he was sitting on the planning commission voting on people's projects, he himself was living out of compliance in a non permitted house! His position on the Planning Commission is the fox guarding the henhouse as rules don't apply to him.

While leaving his own project unfinished, he manages to interfere with and obstruct the projects of others in the neighborhood. In 2013-2015, we had a huge neighborhood undergrounding project. The Bakkers signed a legally binding promissory note and pledged to donate, but then stiffed the women who organized the project. The neighbors decided to not enforce his initial pledge and were forced to cover his portion--all the while he directly benefited from the project without paying a cent. Around the same time, a group of neighbors got a permit to take down a few fire hazard eucalyptus trees in the city alley; the Bakkers found and spent money to block that project. The Bakkers have tried to block a security system project at the neighbors' across from them. They caused a lot of grief to the next door neighbor to their west, who rebuilt a dilapidated house into a beautiful new home. During the building process and while the new neighbors were out of town, the Bakkers moved the mailboxes (including their own) that were in front of their house to be in front of the new neighbors house. Moving mailboxes like that is a federal crime!! Now, regarding us, we have had to file an expensive and time consuming TSVS application against them because their overgrown vegetation is blocking our ocean view, including our protected primary view. The hearing is pending and having Ted Bakker on the City Council will be a conflict of interest as the city council hears appealed cases from the Planning Commission which originally hears the TSVS. In short, the Bakkers have proven themselves to be bad neighbors.

2 I live in Reno now, but I still own 341 La Amatista. I am expressing my objection to the appointment of Ted Bakker along with my adult son who lives in the ADU on the property. In addition, we are a voice for the current long term tenant who asks us why the Bakkers are so unneighborly.

Ted has shown he is not for the neighbors, he is uncooperative, and he is for himself. The current Council Members had to spend months campaigning and letting the people get to know them. I still don't understand how the Council appointed him to the Planning Commission, but it would be irresponsible to appoint him to the City Council.

Dear Councilmembers,
This letter is to express our strong support of Ted Bakker to fill the vacant Council position that was held by Dwight Worden. We have reviewed the information submitted to the Council by the three candidates, and it evident to us that Ted is the most qualified person for the position and he will best serve the many pressing needs of the City and its citizens.

In his many years serving Del Mar on the Planning Commission, Ted has shown that he knows how to uphold the Community Plan, how to solve problems, and how to make very knowledgeable and informed decisions in the best interests of the City. He works so well with decision-makers in reaching consensus and so well with citizens in understanding and explaining the issues. He has shown himself to always be fully informed on the issues and he knows how to conduct City business in an exemplary and civil manner, which is so important for all public agencies, and particularly for our City during these sometimes contentious times.

The citizens of Del Mar deserve everything that Ted will bring the position of Councilmember and we urge the Councilmembers to appoint him to fill the remainder of Dwight Worden’s term.

Thank you.

We would like to extend our support for the appointment of Jeff Sturgis to the current City Council opening.

Jeff’s professional background, his longstanding history of active community service and his depth of knowledge of the important issues facing Del Mar, make him an ideal candidate to sit on City Council.

As a 40 year plus resident of Del Mar, Jeff understands the uniqueness of our community and the leadership required to direct the challenges we currently face with affordable housing, the train issue, and our ongoing financial challenges. As a five-term member of the finance committee, Jeff has a deep knowledge and understanding of our city’s finances, with sound strategies of how to make better and stronger financial decisions for our community.

I’ve had the privilege of working with Jeff in a variety of situations related to community service and have great respect for his knowledge, his commitment to Del Mar and his forever willingness to work for this community!! He is one smart man whose analysis and logical thinking on the Del Mar challenges make him a person we need in a leadership role to take us forward!!

Mayor and Council,
It is very important to fill the council vacancy with a knowledgeable community member who truly understands and lives Del Mar’s values in his daily life. I’m speaking here of Jeff Sturgis, who grew up here as the son of Myrna Sturgis. He is a stellar member of the city Finance Committee and a strong advocate and supporter of the Del Mar Community Plan. He has a patient and friendly demeanor and will be a real asset in dealing with the many issues facing Del Mar. He gets along well with the public and will make a stellar council member. We really need someone on the council of his character, temperament and knowledge.

Please appoint Jeff Sturgis to the council vacancy.

I am writing to express my strong OPPOSITION to the appointment of Ted Bakker to the Del Mar City Council.

The appointment would be circumventing democracy. The community should have the right to vote on who they would like to represent them. A special election should be held. We have not even been given the opportunity to voice our opinions on an appointment/special election.

Ted Bakker has proven himself to be untrustworthy and not honorable. He is of the "rules don't apply to me" mindset. Given the information regarding his 25 year permit to remodel his home, while he oversees the planning commission which limits permits to two years! He should never have been installed on that commission with an active permit (or out of compliance permit) in place. While he was sitting on the planning commission voting on people's projects, he himself was living out of compliance in a non permitted house that was just recently reactivated! He has proven himself to be dishonorable by his own neighbors who have called him out for stiffing them for the underground project, wreaking havoc on their building projects, and illegally moving mailboxes.

Del Mar can and should do better. Please do not appoint Ted Bakker (or anyone else) to the vacant position, instead, hold a special election.

Hello,
I made an error in my previous email. I think Ken Sturgis would be a great choice to fill Dwight Warden’s City Council seat, not Adam Wallace. Hurrying to get this email off to you wasn’t a good idea for accuracy. I also would like you to consider the sources of those who are for or against Mr. Bakker. Those of us who are his neighbors have very different interactions with him than more social or casual ones.

The impact he has on his neighbors daily lives is significant and ongoing over the years.

I want to let you know that I have many concerns about Ted Bakker’s possible appointment. There have been a number of situations involving Mr. Bakker that inform my opinion. Here is what I have already sent…
…..
“I want to voice my concerns about Ted Bakker. While we were undergrounding in our neighborhood (Loretta Morris and I co-chaired this process), we learned a lot about working with our neighbors. Ted was one of the problematic ones. Since then, neighbors have asked me to help with conflicts that included blatant “misinformation.”
I think you should select one of the other candidates….Adam Wallace?” ……..

I urgently suggest Sturgis, NOT Ted Bakker. As my neighbor, he has been diicult for many people for multiple reasons.

Note I have changed my suggestion from Wallace to Sturgis….

Thank you for your assistance.
