Agenda Report
________________________________________________________________________________________________________ City Council Action:

TO: Honorable Mayor and City Council Members
FROM: Jennifer Gavin, Associate Planner
Karen Brindley, Planning and Community Development Director Via Ashley Jones, City Manager
DATE: December 2, 2024
SUBJECT: Parcel Map PM24-001 for Tentative Parcel Map TPMC23-001 to Convert two Existing Detached Single Residential Units Contained within a Duplex into Condominium Ownership Units Located at 730-750 Stratford Court (APN 300- 181-07-00)
REQUESTED ACTION/RECOMMENDATION:

Staff recommends the City Council adopt the Resolution approving Parcel Map PM24-001 (Attachment A).

BACKGROUND:

The subject property is located at 730-750 Stratford Court and comprises a single lot measuring 7,994 square feet and is developed with two (2) detached, two-story residential units that were constructed in 2012 and pursuant to approved Design Review Permit DRB08- 20 and Coastal Development Permit CDP08-11. The lot is defined as a corner lot with frontages on Little Orphan Alley to the south, 8th Street to the north, and Stratford Court to the east. Access is off Stratford Court for both residences. The property is rectangular in shape, compliant with minimum size and dimensional standards for the R2 Zone (High Density Mixed Residential) and is landscaped with mature vegetation. The site’s topography is relatively flat with the property to the west terraced down at a lower elevation. All surrounding properties are developed with exclusively single-family or duplex residential structures of similar age, scale, and massing.

On August 13, 2024, the Planning Commission unanimously recommended City Council approval of applications TPMC23-001 and CDP24-004 via Resolution (Attachment B). On September 9, 2024, the City Council approved the Tentative Parcel Map (TPMC23-001) and Coastal Development Permit (CDP24-004) to convert an existing detached residential duplex (two detached dwelling units) to condominium ownership.

DISCUSSION/ANALYSIS:

The process of condominimizing a lot is a two-step process. The first step requires approval of a Tentative Parcel Map (TPM) and Coastal Development Permit (CDP) by Council after 1 December 2, 2024 Item 04
City Council Agenda Report
Approval of PM24-001
December 2, 2024

Page 2 of 3 ends

first securing recommendations from the Planning Commission. As part of this process, the City includes conditions with the approval of the TPM to ensure that the newly formed condominium lots will conform to applicable standards of development and not result in adverse impacts to the surrounding environment.

The second step in the process is the approval of the Parcel Map (PM24-001), which does not require a public hearing. The City Council must approve the Parcel Map (PM) if it is found to be in conformance with the previously approved TPM and all conditions of approval. The PM has been reviewed by the City’s on-call Engineering firm, Michael Baker International, and the City’s Public Works and Planning Departments for conformance with the Del Mar Municipal Code (DMMC) and the California Subdivision Map Act. All reviews found the PM to be compliant with all applicable standards for development and conditions of approval for TPMC23-001.

Pursuant to DMMC Chapter 24.21, a condition of approval included with TPMC23-001 required an In-lieu Housing Mitigation Fee be paid by the applicant to the City. This fee is currently established at $35 per square foot of habitable area. The habitable area between the two units is 4,393 square feet, and as a result a $153,755 fee has been paid and will be placed into the City’s Housing Assistance Fund. In addition, the applicant elected to pay an in-lieu fee of $10,930 to the City of Del Mar for road improvements along 8th Street since this property is in the project area of the 1A Undergrounding District that is currently under construction. These improvements were included as Engineering conditions of approval in TPMC23-001. The fee was calculated by the Public Works Department by utilizing the the Civil Engineer’s Cost Estimate for said improvements and incorporating the latest construction unit pricing. This fee has been paid by the applicant, and all conditions associated with TPMC23-001 have been satisfied.

FISCAL IMPACT:

There is no fiscal impact to the City, as this is a private development proposal. All fees associated with entitlement processing, long-term maintenance, and satisfying conditions of approval have been paid for by the applicant.

ENVIRONMENTAL IMPACT:

This project is listed among the classes of projects determined to have less than significant adverse impacts to the environment, therefore, exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15315, Class 15 (Minor Land Division), projects which involve the division of property into four or fewer parcels are exempt from environmental review. Staff has further determined that none of the six exceptions to the use of a categorical exemption would apply to this project because there are no new significant environmental impacts associated with this project per CEQA Guidelines Section 15300.2.

HOUSING IMPACT:

The recommended action will not have any impact to the number of residential units in the City as the existing units will remain. An In-lieu Housing Mitigation Fee has been paid to accommodate future low-income housing efforts for the City. 2 December 2, 2024 Item 04

TO: City Council Members
FROM: Mayor Dave Druker and Councilmember Dan Quirk
Liaisons to the Lagoon Committee
Prepared by Denise Galvan, Management Analyst
DATE: December 2, 2024
SUBJECT: Lagoon Committee Appointment
REQUESTED ACTION/RECOMMENDATION:

The City Council Liaisons to the Lagoon Committee recommend that the City Council appoint Nitza Leichtling to the Lagoon Committee as a voting member to serve a full three-year term starting December 2, 2024, and ending on December 31, 2027.

DISCUSSION/ANALYSIS:

The Lagoon Committee is charged with monitoring the preservation and enhancement of the portions of the San Dieguito and Los Penasquitos Lagoons located in the City of Del Mar, as well as actions outside the City of Del Mar that impact the lagoons. The Committee participates at both the local and regional level. Regionally, the Committee coordinates with the activities of the San Dieguito River Valley Joint Powers Authority (JPA) and monitors the lagoon’s restoration plan. Locally, the Committee monitors reports on the health of the lagoons, investigates additional public access opportunities, and encourages lagoon related educational and informational programs. The Committee also monitors and comments on all developments that may impact the two lagoons.

The Committee consists of seven (7) voting members, all of whom must be Del Mar residents.

There is currently one (1) vacancy on the Committee due to Robert B. Chase’s term expiration on October 19, 2024. City staff advertised the vacancy, and one Citizen Interest Form was received during the recruitment period from Nitza Leichtling (Attachment A). Currently, Councilmember Dan Quirk is the only assigned Council liaison to the Committee. In accordance with Council Policy 200, Mayor Druker served as the second Council Liaison to review the application and recommend the City Council appoint Nitza Leichtling for a full three-year term effective December 2, 2024, and ending on December 31, 2027.

If the recommended appointment is approved by the City Council, the Committee will have a full roster with no remaining vacancies. A copy of the current Committee roster is included as Attachment B.

TO: Honorable Mayor and City Council Members
FROM: Deputy Mayor Terry Gaasterland and Councilmember Dan Quirk, Liaisons to the Measure Q Citizen Oversight Committee
Prepared by Denise Galvan, Management Analyst
DATE: December 2, 2024
SUBJECT: Appointment to the Measure Q Citizen Oversight Committee REQUESTED ACTION/RECOMMENDATION:

The Council Liaisons to the Measure Q Citizen Oversight Committee recommend the City Council appoint Nancy Stoke to the Measure Q Citizen Oversight Committee as a voting member for a full three-year term from December 2, 2024, through December 31, 2027.

DISCUSSION/ANALYSIS:

The purpose of the Measure Q Citizen Oversight Committee (Committee) is to review, provide oversight, and report to the City Council on Measure Q revenues and expenditures. The Committee meets bi-annually or as-needed. A primary responsibility of the Committee is verifying that revenues from Measure Q are properly reserved for projects approved by the City Council and that related expenditures are accurately tracked.

The Committee is composed of five members: two (2) Finance Committee Members (or Finance Committee Members within the last five years), and three (3) at-large community residents of Del Mar with the goal that one (1) member is from the Del Mar business community.

There are currently two (2) vacancies on the Committee: one at-large vacancy due to the term expiration of Michael Chiappetta on December 17, 2023, and one Del Mar Business community vacancy. City staff advertised the vacancies, and one Citizen Interest Form was received during the recruitment period from Nancy Stoke (Attachment A). The Council Liaisons to the Committee reviewed the application and recommend the City Council appoint Nancy Stoke as an at-large voting member for a full three-year term starting on December 2, 2024, and ending on December 31, 2027.

If the recommended appointment is approved by the City Council, the Committee will have one remaining vacancy from a member of the Del Mar business community that has historically remained vacant due to a lack of interested applicants. A copy of the current Committee roster is included as Attachment B for Council’s reference.

TO: City Councilmembers
FROM: Mayor Dave Druker and Councilmember Tracy Martinez City Council Human Resources Subcommittee
DATE: December 2, 2024
SUBJECT: Recommended Compensation Adjustment Related to the City Manager’s Performance Evaluation
REQUESTED ACTION/RECOMMENDATION:

The City Council Human Resources Subcommittee recommends the City Council adopt the Resolution (Attachment A) approving changes to the City Manager’s compensation effective December 13, 2024, and updating the Management and Professional Compensation Plan to reflect those changes (Exhibit A to Attachment A).

BACKGROUND:

The City Council began the annual City Manager evaluation process in November 2024. As part of the process, the City Council met as a group during closed session to review and discuss the City Manager’s performance for the period December 13, 2023, through December 13, 2024.

DISCUSSION/ANALYSIS:

Through this collaborative effort, the City Council concluded that the City Manager’s overall performance was highly favorable and met the City Council’s expectations.

Below are some examples of the City Manager’s significant accomplishments during the evaluation period:
• Executed an Exclusive Negotiating Rights Agreement (ENRA) with the Del Mar Fairgrounds that was approved by the 22nd District Agricultural Association (DAA) on February 20, 2024, and by City Council on March 4, 2024. • Maintained a strong and cohesive organizational work culture that is appreciated by employees and has produced a high-volume of quality work citywide. • Achieved significant progress on several important capital improvement projects for the City including the initiation of construction on Undergrounding Utility District (UUD) 1A, the completion of the final design for UUD X1A, and the completion of the San Dieguito Drive Improvements Project with construction to begin in coordination with UUD X1A.

Resolution Adjusting the City Manager’s Compensation
December 2, 2024

Page 2 of 2 ends

• Made significant progress or completed several important City Council special projects including development and adoption of Short-Term Rental Regulations, presenting and implementing a citywide comprehensive streets analysis, and completion of a water and wastewater study.
• Maintained a balanced Operating and Capital Budget for Fiscal Year (FY) 2024-2025. • Continued to build strong working relationships with staff; the City Council; leadership at outside agencies such as the San Diego Association of Governments, North County Transit District, and California Coastal Connections, as well as city leaders throughout the County; and most importantly the Del Mar community. Members of the City Council consistently receive positive feedback from the community and others regarding the City Manager’s performance.

As part of the standard annual evaluation process, Human Resources staff conducted a market analysis of city manager salaries across the San Diego region. Based on the results of this research, the City of Del Mar City Manager’s pay is approximately 6.5% below the regional median.

Additionally, Section 7(c) of the City Manager’s employment agreement provides that:

Upon satisfactory performance, the City Council shall adjust the Manager’s compensation annually (“Annual Adjustment”), which will be based upon the San Diego Regional Consumer Price Index (CPI) as reported by the Bureau of Labor Statistics and regional compensation data, in an amount generally not less than 3% (unless CPI is less than 3%, in which case the increase may be less, consistent with CPI) nor more than 5% (even if CPI exceeds 5%). The City Council has the discretion to implement the Annual Adjustment as a base salary adjustment, one-time bonus, or a combination thereof. The Annual Adjustment will take place annually on Manager’s anniversary date (December 13), and shall be subject to taxes and other required withholdings.

The San Diego Area Consumer Price Index (CPI) from January 2023-Janaury 2024 was

3.8%. Based on the City Manager’s highly favorable performance, review of regional compensation for city managers, and CPI data over the past year, the Human Resources subcommittee recommends a 4% base salary increase for the City Manager effective December 13, 2024, as required by the City Manager’s employment agreement.

FISCAL IMPACT:

Approval of this item will have a $6,430 fiscal impact to the FY 2024-2025 Operating Budget.

However, there is no fiscal action to be taken by the City Council related to this agenda item as sufficient funds are available in the current fiscal year budget.

Mayor Druker and Councilmember Martinez recommend the City Council adopt the Resolution (Attachment A) approving City Council Policy Referral of Public Communications and Concerns Regarding City Operations (Exhibit A to Attachment A).

BACKGROUND:

The City of Del Mar operates under a Council-Manager form of government, as established by the general laws of California, Del Mar Municipal Code, Del Mar City Council and City Manager Guiding Principles, and the City Manager’s employment contract. Councilmembers occasionally receive comments and concerns from residents and members of the public regarding City operations such as issues with facilities, open space, roadways, sidewalks, City staff, or City services. The proposed City Council Policy Referral of Public Communications and Concerns Regarding City Operations (Policy) outlines the roles and responsibilities of Councilmembers and the City Manager in responding to these public inquiries. The goal of the Policy is to ensure timely, accurate, and appropriate responses to public communications and concerns related to City operations.

The Policy states that Councilmembers should promptly refer public communications or concerns regarding City operations to the City Manager for handling. Once received, the City Manager will assess the issue, respond in a timely manner, and keep the City Council informed as appropriate.

Staff recommends the City Council adopt the attached Resolution (Attachment A) conditionally approving Long-term Major Encroachment Permit (EP) 24-115 to retain private encroachments at 1737 Grand Avenue.

BACKGROUND:

On September 16, 2024, the Applicant filed an application to remove unpermitted encroachments in the form of vegetation, irrigation lines, and approximately 60 feet of a five-foot-tall wrought iron fence in the unimproved (paper) alley immediately south of the property at 1737 Grand Avenue. During staff’s review of the application, it was discovered that portions of the same perimeter iron fence and an adjacent concrete drainage ditch on the east side of the property line encroaches approximately two feet into the public right-of-way.

Staff determined that the iron fence and concrete drainage ditch were approved by the City (EP08-78) to be fully on the property at 1737 Grand Avenue but were partially installed over the property line into public right-of-way during the development of the lot sometime between 2006 and 2009. The Applicant is requesting that the City Council approve Long-term Major EP24-115 for those portions of the encroaching iron fence and concrete drainage ditch on the east side of the property, as discussed further in this report.

A site plan depicting the removal of the unpermitted encroachments in the paper alley south of the property and the encroaching portions of the iron fence and concrete drainage ditch on the east side of the property that would be permitted under Long-term Major EP24-115 is included as Attachment B.

As part of the EP, the Applicant will relocate the encroaching iron fence on the south side of the property onto private property and remove the other unpermitted encroachments in the paper alley, which includes irrigation lines and Podocarpus hedges (Exhibit A to Attachment C). The Podocarpus hedges will be relocated from the paper alley to the Applicant’s property. The Applicant will install Coyote Bush ground cover in the paper alley to stabilize the grade and prevent erosion. The planting of the Coyote Bush ground cover is exempt from requiring an EP per DMMC §23.28.050 so long as the vegetation will not exceed a height of thirty inches at the time of installation or at maturity.

In addition, a standalone six-by-five-foot iron gate installed without City authorization east of the property and in the public-right-of way at the top of a slope, adjacent to Camino Del Mar, will be removed by the Applicant under the proposed EP (Exhibit B to Attachment C). However, a set of wood stairs supported by a retaining wall and vegetation previously authorized by EP08-78 within this area would remain.

ANALYSIS/DISCUSSION:

Under Del Mar Municipal Code (DMMC) §23.28.020, a Long-term Major Encroachment Permit is defined as any improvement designed to or having a permanent appearance and intended for use for a period of 365 days or more and includes, but is not limited to, structures or portions thereof, balconies, cornices and other architectural projections, awnings, below grade vaults, earth-retaining structures extending 12-inches or more in height above the adjacent grade, planter boxes, ramps, fences or walls, and curbs extending 12-inches or more in height above the adjacent grade.

Required Findings
Pursuant to DMMC § 23.28.070, there are six (6) required findings for approval of a Longterm Major Encroachment Permit that generally relate to public safety, intended use of the right-of-way, community character, aesthetics, and conversion of public land for private use. An EP shall only be approved if the City Council can make all six findings:

Finding 1: That the issuance of the EP will not endanger public health, safety or welfare, or the surrounding property.

Retaining portions of the iron fence and concrete drainage ditch on the east side of the property would not endanger the public’s health, safety, or welfare, nor would it endanger the surrounding property. The fence has been in this location for many years with no record of incident or reported adverse impact. The fence has and will continue to act as a safety barrier between the Applicant’s backyard and the public right-of-way due to the steep slope and high retaining wall in the back of the property.

Finding 2: That the issuance of the EP will not unreasonably interfere with the intended use of a City Right-of-Way or Easement.

EP24-115 (1737 Grand Avenue)

Page 3 of 4 ends

The existing encroachments that would be authorized under the EP will not unreasonably interfere with the use of the paper alley and will not block the accessible route of travel because there are no plans to develop the land in the public right-of-way. The topography is steep and the City has no plans to create an accessible public trail. If the City of Del Mar identifies a future need for this public area, the EP is conditioned to be revocable, and the property owner is obligated to remove the private improvements/encroachment.

Finding 3: That the issuance of the EP will not have an adverse impact on the welfare of the community or on the community’s appearance or aesthetics.

The existing encroachments have been in the City’s right-of-way for many years without any known complaints from the public and is consistent with the appearance of other properties in the area.

Finding 4: That the issuance of the EP will not cause an unnecessary change in the character of the community.

The existing encroachments are consistent with other fences and vegetation located in the community and as a result will not cause any unnecessary changes to the character of the community. The area surrounding the property and neighboring properties is mature vegetation within a hilly slope. The existing fence is not visible from public view.

Finding 5: That the issuance of the EP will not be to the detriment of the interests of the general public.

The private improvements have not and will not interfere with any present or future public use. The encroachments do not interfere with existing public use of the surrounding rightof-way nor does the City have plans to transition the right-of-way into public access in the foreseeable future.

Finding 6: The proposed Encroachment will not convert significant area of public property to private use.

The existing encroachments extend approximately two feet into the public right-of-way. The fence and concrete drainage ditch are located near a steeply sloped area at the northeast and southeast corner of the property that is shielded from public view. This area is not used by the public because of the steep slope.

Staff consulted with the Public Works Department, Community Services Department, and City Manager’s office and determined that retaining the iron fence and concrete drainage ditch on the east side of the property would not endanger public’s health, safety, or welfare, nor would it endanger the surrounding property. The fence has been in this location for many years with no record of incident or reported adverse impact. The fence has and will continue to act as a safety barrier between the Applicant’s backyard and the 3 December 2, 2024 Item 09

public right-of-way due to the steep slope and high retaining wall in the back of the property. As shown in the photographs in Attachment C, the Applicant’s backyard is at a significantly lower grade than the slope in the public right-of-way to the east. If the iron fence and concrete drainage ditch were removed, it may make the area less safe (e.g., fall hazard) than if the encroachments remain in place given the steepness of the location and the drop off onto the private property below.

As a condition of approval of the requested EP, a covenant will be recorded on the property that would require that all private improvements in the public right-of-way be maintained by the property owner in accordance with the EP and the owner will be required to indemnify the City should there be a claim of liability. As is typical with EPs, the permit conditions and covenants will ensure that should the City need this public space in the future, the iron fence and concrete drainage ditch will be removed by the owner at their sole expense. Based on the above, all required findings can be found to be satisfied. Therefore, staff recommends approval of Long-term Major EP24-115.

FISCAL IMPACT:

There is no fiscal impact or action to be taken by the Council related to this agenda item, as this is a private development proposal. All fees associated with entitlement processing are paid for by the Applicant.

ENVIRONMENTAL IMPACT:

Pursuant to the California Environmental Quality Act (CEQA), the proposed project has been analyzed and determined to be Categorically Exempt pursuant to CEQA Guidelines Section 15301(d)(Class 1 – Existing Facilities), in that the Project proposes retention of an existing structure. Further, it has been determined that none of the six exceptions to the use of a Categorical Exemption are applicable because the project will not generate any significant environmental impacts. (See: Guidelines Section 15300.2).

WHEREAS, oral and written evidence was submitted and considered to include without limitation:
a. Plans submitted by the applicant;
b. Written information submitted with the application;
c. Agenda Report, dated December 2, 2024, incorporated by reference as though fully set forth herein; and
e. Additional information submitted and testimony provided during the hearing.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Del Mar that Encroachment Permit EP24-115 is hereby approved based on the following findings in DMMC Chapter 23.28.070(C):

Findings:

1. Retaining the iron fence and concrete drainage ditch on the east side of the property would not endanger the public’s health, safety, or welfare, nor would it endanger the surrounding property. The fence and drainage ditch have been in this location for many years with no record of incident or reported adverse impact. The fence has and will continue to act as a safety barrier between the Applicant’s backyard and the public right-of-way due to the steep slope and high retaining wall in the back of the property.

2. The existing encroachments that would be authorized under the EP will not unreasonably interfere with the use of the paper alley and will not block the accessible route of travel because there are no plans to develop the land in the public right-of-way. The topography is steep and the City has no plans to create an accessible public trail. If the City of Del Mar identifies a future need for this public area, the Encroachment Permit is conditioned to be revocable, and the property owner is obligated to remove the private improvements/encroachment.

3. The existing encroachments will not have an adverse impact on the welfare of the community or on the community’s appearance or aesthetics, because the encroachments have been located in the City’s right-of-way for many years without any known complaints from the public and is consistent with the appearance of other properties in the area.

4. The existing encroachments are consistent with other fences and vegetation located in the community and as a result will not cause any unnecessary changes to the character of the community. The area surrounding the property and neighboring properties is mature vegetation within a hilly slope. The existing fence is not visible from public view.

5. The private improvements have not and will not interfere with any present or future public use. The encroachments do not interfere with existing public use of the Attachment A 6 December 2, 2024 Item 09

surrounding right-of-way nor does the City have plans to transition the right-of-way into public access in the foreseeable future.

6. The existing encroachments extend approximately two feet into the public right-ofway. The fence and concrete drainage ditch are located near a steeply sloped area at the northeast and southeast corner of the property that is shielded from public view. This area is not used by the public because of the steep slope.

NOW, THEREFORE, BE IT FURTHER RESOLVED by the Council that approval of EP24-115 shall be subject to the following conditions:

________________________________________________________________________________________________________ City Council Action:

TO: Honorable Mayor and City Councilmembers
FROM: Matt Bator, AICP, Principal Planner
Karen Brindley, Planning and Community Development Director Via Ashley Jones, City Manager
DATE: December 2, 2024
SUBJECT: Identification of Issues for Updating the Trees, Scenic Views, and Sunlight Regulations
REQUESTED ACTION/RECOMMENDATION:

Staff recommends the City Council receive an informational update and provide feedback and direction regarding proposed issue areas to be amended in the City’s Trees, Scenic Views, and Sunlight regulations.

BACKGROUND:

The City Council Work Plan for Fiscal Year 2024-2025 includes updating Del Mar Municipal Code (DMMC) Chapter 23.51, also known as the Trees, Scenic Views, and Sunlight (TSVS) Ordinance, and the City’s Tree Policy Manual and associated code/regulations (DMMC Chapter 23.50) with the goal of protecting and enhancing the City’s urban forest tree canopy while managing the City’s wildfire risk.

On October 7, 2024, staff presented to the City Council nine “guiding principles” to inform and influence the updating of the TSVS. The City Council received public testimony, discussed the draft guiding principles, and provided additional direction to ensure that the preservation of “sunlight,” in addition to scenic views, is given equal weight in the guiding principles and revisions to the TSVS regulations. The guiding principles have been included as Attachment A.

DISCUSSION:

Since the City Council’s acceptance of the guiding principles, staff has evaluated the reoccurring issues that have arisen while processing TSVS applications since the original adoption of the TSVS Ordinance (No. 747) in July 2002. Additionally, staff has reviewed information and reports pertaining to view regulations in twenty-seven (27) other jurisdictions, identifying common implementation issues and how the respective regulations have been modified and improved over time.

Through this research staff has identified a series of amendments/revisions that implement the guiding principles and the direction they provide for improvement of Del Mar’s TSVS regulations, process, and procedures. Staff also met with the City Council’s 1 December 2, 2024 Item 10
City Council Agenda Report
TSVS Update – Issue Identification
December 2, 2024

Page 2 of 2 ends

Planning Process Subcommittee (Mayor Druker and Deputy Mayor Gaasterland) as part of this issue identification process.

Of the five issue areas identified, staff is seeking early input and direction prior to proceeding with draft language for introduction of an ordinance to amend the TSVS regulations (DMMC Chapter 23.51). The five specific issues are related to: 1) the time period for which view restoration can be sought; 2) required findings for determining unreasonable scenic view and/or sunlight obstruction; 3) cost apportionment; 4) claims against City trees; and 5) unregulated hedge heights. Staff review and discussion of these issue areas is provided in Attachment B, and each discussion includes a specific policy question, associated background information, staff’s recommendation, and the guiding principles that apply. Following the five policy inquiries is a list of additional sections and components of the TSVS regulations identified for proposed revision.

Staff requests that the City Council review and provide feedback and direction as to whether staff should proceed with drafting amendments to DMMC Chapter 23.51 as indicated and recommended in Attachment B.

FISCAL IMPACT:

There is no fiscal action to be taken by the City Council related to this agenda item.

ENVIRONMENTAL IMPACT:

There is no environmental impact on receiving the report. The proposed City Council action does not constitute a “project” under the definition set forth in the California Environmental Quality Act (CEQA) Guidelines Section 15378 because it will not have a potential to result in a direct or indirect physical change in the environment and is not subject to CEQA.

NEXUS TO CITY COUNCIL GOALS AND PRIORITIES:

Updating the Trees, Scenic Views, and Sunlight Ordinance is an identified Tier 2 Council priority for Fiscal Year 2024-25.

TSVS Code/Process Update
“Guiding Principles”
(Accepted by City Council on 10/7/2024)

1. Ensure administration of the new regulations will not overburden City resources (including staff/legal resources);

2. Establish objective application criteria and processing framework;

3. Rely upon precise, objective, and documentable decision findings to reduce appeals and legal challenges to the greatest extent possible;

4. Incorporate a clear and expedited process for applications involving “City” and “Protected” trees;

5. Ensure an equitable cost allocation process to initiate the view/sunlight restoration process, perform view restoration work, and maintain restored scenic views;

6. Encourage and create a pathway for neighbors to seek an alternative route to successful dispute resolution outside of the City TSVS process;

7. Balance and acknowledge the needs of private view/sunlight protection with all benefits provided by tree and vegetation growth, the goals of the Climate Action Plan, the goals and provisions of the Design Review process and the City’s tree policies and regulations;

8. Address the applicability of “accidental” views (downed trees, fire impacts, etc.) and “good neighbor” view creation in the context of view rights established by the regulations;

9. Provide an objective balance between the privacy provided by hedges and a neighbor’s established scenic views and/or sunlight through consideration of height regulations.

ATTACHMENT A
3 December 2, 2024 Item 10
TSVS Issue Identification for Code Amendment
Issue #1: Rights Established (DMMC §23.51.030)
“A person shall have the right to seek restoration and preservation of Scenic Views or Sunlight that existed at the time they purchased or occupied a property or in the last ten years, whichever is shorter…”
Policy Question - Should the “ten-year” criteria be kept, changed, or eliminated? • Most view Ordinances allow for view rights dating back to property purchase, Ordinance adoption, or both.
• In order for residents to be able to use the new TSVS Ordinance to restore views obstructed prior to its adoption, the (then) City Council determined that going back ten years was an appropriate amount of time.
• Del Mar is the only city with a view Ordinance that provides a specified time limit in addition to the purchase/occupancy date.
• When the regulations were being created, it was important to the Council that property buyers would not have a right to a view that didn’t exist at the time of purchase.

Staff Recommendation – Replace “ten years” with “the adoption of Ordinance No. 747 (July 1, 2002). This will allow residents to seek restoration of scenic views and/or sunlight obstructed since the time they purchased the property, or since adoption of the TSVS process, whichever timeframe is shorter.

Associated Guiding Principle - #1 Ensure administration of the new regulations will not overburden City resources (including staff/legal resources) Issue #2: Standards of Determining Unreasonable Obstruction (Findings) are not Objective
Policy Question - Should the criteria in the City’s Design Guidelines and California Solar Shade Control Act be used to make the Standards of Review “objective?” • 100% view restoration was never the intent of the TSVS Ordinance, otherwise the word “unreasonable” would not have been incorporated as a metric. • Objective criteria for view obstruction have already been adopted by City Council for proposed projects subject to Design Guidelines and considered by the Design Review Board.
• California Solar Shade Control Act criteria can be referenced to locally enforce existing State Code.
• DMMC §23.51.050(B) (“Standards for Determining Unreasonable Obstruction”) factors 8-17 are already stated in DMMC §23.51.060 as “Criteria for Determining Appropriate Restorative Action.”
4 December 2, 2024 Item 10
• Thirty-six (36) applications have been submitted to the City in twenty-two (22) years since the regulations became effective:
o Fifteen (15) resulted in City decisions (including five being denied); and o Only one (1) out of ten (10) determinations of unreasonable view obstruction resulted in an order to remove a tree (Deftos/White).
o Updated application submittal materials will include photographic documentation and exhibits that visually calculate the percentage of obstruction.

Staff Recommendation – Narrow the “Standards of Review” down to specific, objective, verifiable findings of fact (5 or 6) for each view obstruction scenario (Scenic View, Sunlight to Solar Panels, Sunlight to Primary Living Area (PLA)).

Associated Guiding Principles:
#1 Ensure administration of the new regulations will not overburden City resources (including staff/legal resources); and #2 Establish objective application criteria and processing framework”
Issue #3: Allocation of Costs
Policy Question – Should some of the cost burden of the TSVS process be shifted to the Tree Owner and if so, how?
• The original apportionment of assigning all of the financial burden on the Applicant has been changed or updated by most jurisdictions to include the Tree Owner to some degree.
• Assigning part of the cost burden on the Tree Owner will encourage alternative conflict resolution.
• Improvement of the TSVS process by requiring more technical information at submittal, being more objective, and reducing staff time should reduce application costs.

Staff Recommendation - Inclusion of the following revisions:

A. Application fee should remain the responsibility of the Applicant.

B. Restoration cost is split 50/50 for Trees/Vegetation planted or sprouted after July 1, 2002 (initial adoption of TSVS Ordinance).

C. Tree Owner pays 100%:
i. When refuses to resolve early or mediate;
ii. Plants tree/vegetation against written objection of neighbor (Applicant);
iii. For all on-going maintenance trimming in accordance with Restoration Plan; and
iv. Applicant pays 100% for all other circumstances.

D. The applicant pays restoration costs in all other cases. 5 December 2, 2024 Item 10
Associated Guiding Principles - #5 Ensure an equitable cost allocation process to initiate the view/sunlight restoration process, perform view restoration work, and maintain restored scenic views; and #6 Encourage and create a pathway for neighbors to seek an alternative route to successful dispute resolution outside of the City TSVS process Issue #4: View/Sunlight Obstruction by City Trees
Policy Question – How should TSVS claims be handled when the obstruction is caused by City trees?
• City has been a “good neighbor” relative to the TSVS process, working with residents to resolve the view blockage concern through the Encroachment Permit process, allowing the Applicant to trim City trees in order to restore views when appropriate.
• The City’s process for addressing City trees is not defined in the Ordinance. • Trimming and cost have always been resident responsibility, but City trimming could be a consideration to discuss when the subject tree is identified for routine City trimming within the next trimming cycle.

Staff Recommendation – Differentiate City trees that are in the right-of-way fronting a private property vs. City trees in parks, medians, and City-owned lots. Residents are responsible for trees between the street and their property line. For “City Trees,” create new DMMC subsection that includes a process similar to TSVS that uses the Encroachment Permit process, making the TSVS determination a staff decision, appealable to the City Council.

Associated Guiding Principle - #4 Incorporate a clear and expedited process for applications involving “City” and “Protected” trees
Issue #5: Hedge Height Regulations
Policy Question - Should the City consider creating regulatory height limits for hedges, similar to or the same as fence heights regulations?
• Thirteen (13) of twenty-six (26) jurisdictions with View Ordinances surveyed also have hedge height restrictions.
• Most jurisdictions with hedge regulations consider hedges the same as fences in the front, rear and side yard setbacks.
• Need to consider how existing over-height hedges would be addressed. • Approximately 1/3 of all TSVS application submitted since 2002 involved hedges or hedge-like plantings of trees.
• Could add “hedges” where applicable in DMMC Section 30.86.090.A.1-3 (Fences/Retaining Walls), and this would not require a Local Coastal Program Amendment (LCPA).
6 December 2, 2024 Item 10
Staff Recommendation – Regulate hedges with heights found to be appropriate by the City Council. Incorporating hedges into DMMC §30.86.090 would not allow hedges to exceed six (6) feet in most setback areas, solving traffic sightline issues, “tunnel effect” on streets, etc. Hedges taller than the fence/wall regulations could be planted in the “buildable” area of the lot and would be more susceptible to TVSV claims.

Associated Guiding Principle - #9 Provide an objective balance between the privacy provided by hedges and a neighbor’s established scenic views and/or sunlight through consideration of height regulations
