ITEM 7: UNDERGROUNDING PROGRAM SAN DIEGO GAS & ELECTRIC ROADMAP (CLERK’S FILE NO. 1001-2)
An introduction to the item was provided by City Manager Jones who explained that the agenda report is focused on SDG&E’s processes/procedures, roles and responsibilities, and time required for each stage of the Undergrounding process. A presentation was provided by Principal Engineer Martin Boyd.
Council questions and discussion focused on whether SDG&E outsources designers and project managers for Del Mar projects or uses in-house SDG&E staff; whether the roadmap also increased efficiencies and potential for cost savings; whether there is opportunity to decrease the time of the planning phase; desire to continue to look for efficiencies in the undergrounding process; factors prolonging the design phase; clarification on the time estimate of the design phase; and role of the trench inspector.
There were no public speakers for the item.
ITEM 8: CITIZENS’ INITIATIVE MEASURE TO AMEND THE CITY’S ORDINANCE REGULATING RETAIL ANIMAL SALES IN DEL MAR (CLERK’S FILE NO. 401-4, 402- 8)
Administrative Services Manager/City Clerk Krietor provided the following statement, “Prior to this evening’s meeting, staff received a question regarding whether the proponent of a Citizens’ Initiative Measure must be a resident of Del Mar since the sole proponent of the retail pet sales initiative is not a resident or elector of Del Mar. While it does not appear that the Elections Code requires a proponent of a local initiative to be a resident or elector of the City, there is case law authority that appears to support this. In order for staff and the City Attorney’s office to have sufficient time to research this question, provide a response on this inquiry to the Council, and determine whether the petition is sufficient (as presented by the proponent), staff recommends that the City Council continue this item to a date certain of January 21, 2025.”
Council questions focused on the requested continuance and whether Council could consider an ordinance outside of the initiative process, if the petition is found insufficient.
There were no public speakers for the item.
Council consensus was to continue the item to the January 21, 2025, City Council meeting.
IT WAS MOVED BY MAYOR GAASTERLAND, SECONDED BY DEPUTY MAYOR MARTINEZ TO CONTINUE ITEM TO THE JANUARY 21, 2025 COUNCIL MEETING. (VOTE 4-0) Ayes: Mayor Gaasterland; Deputy Mayor Tracy Martinez; Councilmembers Dan Quirk and John W.

1) Angie Neglia
2) Diana Kutlow representing State Senator Catherine Blakespear 3) Shirli Weiss

TO: Honorable City Councilmembers
FROM: Mayor Terry Gaasterland and Councilmember John Spelich, Council Liaisons to the Finance Committee
Prepared by Denise Galvan, Management Analyst
DATE: January 21, 2025
SUBJECT: Finance Committee Appointment
REQUESTED ACTION/RECOMMENDATION:
The City Council Liaisons to the Finance Committee recommend the City Council appoint John Fry as a voting member to the Finance Committee to serve a full three-year term effective January 21, 2025, and ending on January 31, 2028.
DISCUSSION/ANALYSIS:
The Finance Committee (Committee) serves as an advisory committee to the City Council and provides recommendations on City finances including updates to the City’s operating and capital budgets, budget forecasts and trends in revenues, expenditures, project costs and cash flows; Annual Comprehensive Financial Report (ACFR); CalPERS Cost Sharing Pool Reports and the related annual contributions to the Pension Reserve Fund; City’s Pension Reserve Policy; City’s financial metrics; and other assignments from the Council.
The Committee consists of seven members who must be residents of Del Mar.
Currently, one vacancy exists on the Committee due to the term expiration of Laura Pierce on July 31, 2024. City staff advertised the vacancy, and one Citizen Interest Form was received during the recruitment period from John Fry (Attachment A). The Council Liaisons to the Committee reviewed the application and recommend the City Council appoint John Fry as a voting member for a full three-year term starting on January 21, 2025, and ending on January 31, 2028.
If the recommended appointment is approved by the City Council, the Committee will have a full member roster. A copy of the current Committee roster is included as Attachment B for Council’s reference.

SUBJECT: Acceptance of a Donation from Friends of the Powerhouse for the Powerhouse Deck Trellis Replacement Project
REQUESTED ACTION/RECOMMENDATION:
Staff recommends that the City Council: 1) Accept a donation up to $66,000 from the Friends of the Powerhouse for the Powerhouse Deck Trellis Replacement Project (Project); and 2) Amend the Fiscal Year 2024-2025 Operating and Capital Budget as described in the Fiscal Impact section of the agenda report.
BACKGROUND:
The Powerhouse Community Center includes a second story deck for guests to walk out and enjoy a view of the Pacific Ocean. A portion of the second story deck was protected from the sun by a 25-year-old wooden trellis. By the summer of 2024, the trellis’ wood had rotted and deteriorated into an unsafe condition requiring removal by the City’s Public Works Department. The trellis’ two concrete support pillars remain but appear unfinished and unsightly. Additionally, the upper deck is currently entirely exposed without any sun protection, making it undesirable for use by Powerhouse guests.
DISCUSSION/ANALYSIS:
Pursuant to the Del Mar Municipal Code (DMMC) Chapter 7.20 – Alternative Bid Procedures for Public Works Projects, staff solicited alternative construction bids to reconstruct the trellis and received the lowest responsive and responsible alternative bid from West Coast Deck. A construction contract with West Coast Deck will be awarded by the City Manager, pursuant to DMMC Chapter 7.20.050. The project is expected to cost up to $66,000 as summarized in the following table below.
Description Fee
West Coast Deck: Construction, Labor, Equipment, Materials $ 58,280 Plan Check Fee $ 650
Building Permit Fee $ 810
Construction Contingency $ 6,260

Donor Recognition for the Powerhouse Deck Trellis Replacement Project January 21, 2025
TOTAL $ 66,000
To minimize impacts to the public and planned events at the Powerhouse, project construction will occur between February 2 and February 21, 2025.
The Friends of the Powerhouse, a Del Mar non-profit 501(c)(3) organization, has graciously agreed to donate up to $66,000 for the Project. Upon project completion, staff will invoice the Friends for actual expenses, up to $66,000.
FISCAL IMPACT:
Approval of this item will require amending the Fiscal Year 2024-2025 Capital Budget as listed below. This budget adjustment will have a net zero budget impact since funds to cover the costs will be paid by contributions made by the Friends of the Powerhouse.
ENVIRONMENTAL IMPACT:
The proposed project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to State Guidelines Section 15301(d) [Restoration or Rehabilitation of Existing Facilities], and 15302 [Replacement or Reconstruction], which allows for the operation, repair, maintenance, or minor alteration of existing public structures, facilities, and pavement resurfacing; 15302 [Replacement or Reconstruction], which allows for the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structured replaced. The proposed project will reconstruct a wooden trellis that was removed due to rot. The reconstructed trellis materials consist of wood and will be located on the second story deck of the existing Powerhouse Community Center building.

DATE: January 21, 2025
SUBJECT: Continued from January 6, 2025: Submitted Citizens’ Initiative Petition to Amend the City’s Ordinance Regulating Retail Animal Sales in Del Mar REQUESTED ACTION/RECOMMENDATION:
Staff recommends the City Council receive an update on a submitted citizens’ initiative petition proposing to amend the City’s Retail Pet Sales Ordinance (Attachment A) and provide direction to staff as needed.
BACKGROUND:
Currently, Del Mar Municipal Code (DMMC) Chapter 4.09 provides it is unlawful to “display, offer for sale, deliver, barter, auction, give away, transfer, or sell any live dog, cat or rabbit in any pet shop, retail business, or other commercial establishment located in the City, unless the dog, cat or rabbit was obtained from a city or county animal shelter or animal control agency, a humane society, or a non-profit rescue organization.” On May 8, 2024, the City received a Notice of Intent (Attachment B) to circulate an initiative petition from a proponent seeking to amend Chapter 4.09 of the DMMC to include additional animal classes, namely arachnids, birds, mammals, amphibians, reptiles, and fish. The subsequent petition was received by the City on October 30, 2024, and found by the County of San Diego Registrar of Voters (ROV) to contain the required number of Del Mar elector signatures (10% of registered voters or 327 signatures).
However, prior to the January 6, 2024, City Council meeting, staff received a question regarding whether the proponent of a local initiative must be a resident of Del Mar, as the initiative’s sole proponent is a resident in the City of San Diego and is not a Del Mar resident. Accordingly, staff and the City Attorney’s Office requested, and City Council granted, a continuance of the Item to the next Council meeting to allow sufficient time to research this question, provide a written response to the Council, and determine whether the initiative petition, as presented by the sole, non-resident proponent, is acceptable for the City Clerk to certify its sufficiency.
1 January 21, 2025 Item 06
City Council Agenda Report
Citizens’ Initiative Measure to Amend Retail Animal Sales Ordinance January 21, 2025
DISCUSSION/ANALYSIS:
The City Attorney’s Office conducted a legal analysis and found that while the California Elections Code does not require a proponent of a local initiative to be a resident or elector of the city in which the initiative is proposed, case law and the local initiative power under the California Constitution authority appears to support the opposite: that the proponent must be a resident. The rationale is that proponents who propose amendments to local laws should be members of the political community that will be impacted by those laws.
As such, the City Clerk informed the sole proponent of the retail animal sales initiative that the proposed initiative cannot be certified as sufficient because there must be at least one measure proponent who is a resident of Del Mar. Because the initiative petition is not certified by the City Clerk, it cannot be adopted or ordered for election by the City Council.
At the January 6, 2025, City Council meeting, Mayor Terry Gaasterland expressed interest in considering a similar ordinance, should the initiative petition be found insufficient. The City Council may wish to consider and provide direction to staff regarding the potential inclusion of a work plan item to bring forward a similar ordinance to be drafted by staff on the City’s 2025-26 Work Plan, which will be reviewed in detail at the upcoming City Council Goals & Priorities Workshop targeted for late February/early March 2025.
FISCAL IMPACT:
There is no fiscal impact or action to be taken by the City Council related to the recommended action.
