DATE: February 18, 2025
SUBJECT: City of Del Mar Wildfire Preparedness and Response Update REQUESTED ACTION/RECOMMENDATION:

Staff requests that the City Council receive an informational joint presentation from Captain Shane Watts with the San Diego County Sheriff’s Department and Chief Josh Gordon from the Del Mar Fire Department on the City of Del Mar’s wildfire preparedness and response efforts (Attachment A).

BACKGROUND:

The recent wildfires in Los Angeles County were devastating and underscore the need for coastal communities like the City of Del Mar (City) to prepare for times when fire conditions are high. The City takes fire prevention and response planning seriously and is committed to working alongside the community to minimize risk and ensure safety.

The San Diego County Sheriff’s Department and Del Mar Fire Department remain steadfast in protecting the safety and well-being of residents through comprehensive preparedness, response planning, and collaboration with regional partners. The Del Mar Fire Department is fully staffed and, through mutual aid agreements with neighboring jurisdictions, is prepared to respond promptly and effectively to all emergencies within the City of Del Mar.

The City's Emergency Operations Plan (EOP), which was recently updated in July 2024, is a comprehensive document that provides for a coordinated response to all hazards by City staff and emergency partners. The EOP can be viewed on the City’s website at https://www.delmar.ca.us/AgendaCenter/ViewFile/Agenda/_07082024-3484/#page=58.

Complementing the EOP, the Crest Canyon Evacuation Plan serves as a vital tool to enhance the safety of residents. This plan supports firefighting and law enforcement personnel in coordinating safe and efficient evacuations, prioritizing life-saving measures, and fire suppression efforts. The evacuation plan is also available on the City’s website at https://www.delmar.ca.us/DocumentCenter/View/8477/Crest-Canyon-Evacuation-Plan_FINAL.

DISCUSSION/ANALYSIS:

To prepare for wildland fire events, the Del Mar Fire Department engages in extensive countywide training with regional fire departments and law enforcement agencies, including the San 1 February 18, 2025 Item 01

Diego County Sheriff’s Department. These joint training exercises ensure uniformity in standard operating procedures, strengthening the department’s ability to manage emergencies effectively and efficiently.

City staff also play an important role in emergency response in their trained capacity as designated disaster service workers for the City. This designation requires related Federal Emergency Management Agency (FEMA) and participation in ongoing Emergency Operations Center (EOC) training to prepare for different types of disaster events, including wildland fires.

The City also emphasizes wildfire prevention and mitigation. In partnership with the Del Mar Fire Department and EDCO, the City’s trash and recycling hauler, the City offers a fuel reduction program each summer to assist residents in clearing hazardous vegetation. As part of this program, approximately 340 Del Mar properties in the Wildland-Urban Interface area receive notices from the City informing them of mandatory property inspections and brush clearance.

Furthermore, the Fire Department conducts annual and state-mandated fire inspections of schools, hotels, motels, lodging houses, and multifamily buildings to identify and reduce structure fire risks, ensuring the community remains as safe as possible.

In the coming months, the Fire Department will host a Fire Preparedness workshop for residents.

In the interim, and in response to public inquiries stemming from the LA fires, the City has published electronic notifications on how residents can stay safe and prepare for emergency events like wildfires, which include the following:

1. Visit the City’s Emergency Preparedness webpage to learn more about how to prepare for an emergency.
https://www.delmar.ca.us/281/Emergency-Preparedness

2. Develop an emergency plan to help prepare for, respond to, and recover from an emergency or disaster.
https://www.alertsandiego.org/en-us/preparedness/make-a-plan.html

3. Register cell phones and email address with AlertSanDiego, the notification system used by first responders to alert individuals in the event of an emergency. https://www.alertsandiego.org/en-us/preparedness/alertsandiego.html

4. Sign up for power outage alerts from SDG&E.
https://www.sdge.com/notifications

5. Download the GENASYS PROTECT and SD Emergency apps for alerts. https://protect.genasys.com/search?z=14&latlon=33.739744%2C-116.41279 https://www.alertsandiego.org/en-us/preparedness/SDEmergencyApp.html

6. Remember it is important to plan before the emergency happens, to evacuate early and follow all fire and law enforcement emergency orders.

Staff from the San Diego County Sheriff’s Department and Del Mar Fire Department will provide a joint informational presentation on how the two departments coordinate, prepare and respond to wildfire events, which includes the information described above and more, at the February 18, 2025, City Council meeting. The PowerPoint presentation slides are included as Attachment A.

FROM: Clem Brown, Assistant City Manager
Via Ashley Jones, City Manager
DATE: February 18, 2025
SUBJECT: Presentation Regarding San Diego LOSSAN Rail Realignment Value Analysis Process and San Dieguito Double Track and Special Events Platform Project REQUESTED ACTION/RECOMMENDATION:

Staff requests that the City Council receive an informational presentation from the San Diego Association of Governments (SANDAG) on the San Diego LOSSAN Rail Realignment Value Analysis process and the San Dieguito Double Track and Special Events Platform project.

BACKGROUND:

LOSSAN Rail Realignment Project
The City of Del Mar has closely monitored SANDAG’s San Diego LOSSAN Rail Realignment project since public outreach began in 2020. The project includes studying options for removing the rail line from the fragile Del Mar coastal bluffs to an inland location by 2035.

Given the potential for significant temporary and permanent impacts to the City if the rail line were to be relocated from its current location, the project has generated a high level of community concern and engagement. More detailed information about the project can be found at https://www.sandag.org/projects-and-programs/featured-projects/lossan-corridorimprovements/lossan-rail-realignment.

The project is currently in the environmental review phase, which began with the issuance of a Notice of Preparation (NOP) of a Draft Environmental Impact Report (EIR) on June 4, 2024.

The issuance of the NOP was the preliminary step in the State’s California Environmental Quality Act (CEQA) process that will determine the technical studies needed to develop an EIR for the project.

In response to the significant input received on the three alignment alternatives included in the NOP (Alternative A – I-5 Alignment; Alternative B – Crest Canyon Alignment; and Alternative C – Camino del Mar Alignment), SANDAG initiated a Value Analysis (VA) process in September 2024 to technically evaluate and improve upon the existing alignment alternatives and/or potentially identify new alternatives for further consideration. Participation in this technical exercise included representatives from key agency stakeholders including 1 February 18, 2025 Item 02

the cities of Carlsbad, Del Mar, Encinitas, San Diego, and Solana Beach; Fairgrounds; North County Transit District; and Caltrans. The City of Oceanside and the Metropolitan Transit System were also invited to participate, but did not attend.

The City had a seven-member team participate in the VA process, which included recently retired Mayor Dave Druker; Councilmember Tracy Martinez; City Manager Ashley Jones; Assistant City Manager Clem Brown; Public Works Director Joe Bride; Planning & Community Development Director Karen Brindley; and Principal Engineer Martin Boyd.

The City’s participation was largely informed by the concerns expressed by the Del Mar community along with the comment letter approved by the Del Mar City Council and submitted as part of the previous NOP process. Additionally, the City’s planning and engineering team members provided technical comments and suggestions during the technical working group sessions based on their experience and areas of expertise.

In December 2024, a draft VA Study Report was reviewed by the participating agency stakeholders at a meeting on December 20, 2024. On February 7, 2025, SANDAG released the Final VA Study Report, which analyzes 16 proposed alignment alternatives that include Alternatives A, B and C from the NOP. The Final VA Study Report can be found at:
https://mailchi.mp/sandag/lossan-rail-realignment-dec24-6098207?e=24e9090dc8.

On February 10, 2025, SANDAG issued a press release with additional updates on the project and next steps (Attachment A). After finalization of the VA Study Report, SANDAG staff have reviewed the conceptual ideas from the VA process, as well as prior studies and public feedback, and will propose the following five options (Figure 1) to the SANDAG Board of Directors for consideration to advance to environmental review at their meeting on February 28, 2025:
 Under Crest Canyon (Under Jimmy Durante to I-5 Knoll): Realigned to minimize subsurface easements by routing below Crest Canyon. Corresponds to VA Study Alternative 6. Similar to NOP Alternative B. Blue line on Figure 1 map below.  Under Camino Del Mar (Under Jimmy Durante to Torrey Pines Road West):

Aligned to minimize subsurface easements by following below Camino del Mar.

Corresponds to VA Study Alternative 8. Similar to NOP Alternative C. Purple line on Figure 1 map below.
 San Dieguito Bridge to I-5 Knoll: Aligned to minimize impacts to Del Mar, the Fairgrounds, and San Dieguito Double Track Bridge. No corresponding VA alternative. Similar to NOP Alternative A. Yellow line on Figure 1 map below.  Del Mar Bluffs Double Track Reinforced: Maintains current alignment, adds double track along the bluffs and through Los Penasquitos Lagoon with bluff reinforcement and more robust seawalls. Corresponds to VA Study Alternative 12. Green line on Figure 1 map below.

 No Build: Includes continuation of major stabilization efforts that would be required to protect the existing single-track alignment.

Figure 1
San Dieguito Double Track and Special Events Platform Project SANDAG's San Dieguito Double Track and Special Events Platform (SDDT) project is a $347 million capital improvement project along the rail line between the cities of Solana Beach and Del Mar that will improve rail operations and safety in the LOSSAN rail corridor. The project includes 1.1 miles of new double track, replacement of the over 100-year-old wooden railroad trestle bridge, a new special events platform at the Del Mar Fairgrounds, a pedestrian undercrossing on the south side of the San Dieguito River, and other improvements. More detailed information about the project can be found at https://www.sandag.org/projects-andprograms/featured-projects/lossan-corridor-improvements/double-tracking-projects/sandieguito-double-track.

The project is fully funded and has completed environmental review. It is scheduled to go out for construction bidding this summer and start construction in early 2026 with a four-and-ahalf-year construction duration.

Since construction activities will take place within the City, an encroachment permit for the project, similar to the permit for SANDAG’s Del Mar Bluffs Stabilization Project 5 that is currently in construction, will be required. Staff is also coordinating with SANDAG and the North County Transit District (NCTD) on multiple license agreements that are required because the project includes the relocation and upgrades to City water and sewer 3 February 18, 2025 Item 02

infrastructure located in NCTD right-of-way that falls within the project’s footprint. The new pedestrian undercrossing component of the project will also require a future license agreement between NCTD and the City.

DISCUSSION/ANALYSIS:

Staff from SANDAG will provide an informational presentation on these two projects at the February 18, 2025, City Council meeting. Representatives from NCTD will also be in attendance to discuss the SDDT project. The following day, on February 19, 2025, SANDAG will deliver the same presentation on the San Diego LOSSAN Rail Realignment VA process during a 6:00 PM public informational meeting at the Del Mar Civic Center Town Hall.

A copy of the presentation was not available to include with this report; however, it will be made available to the public prior to the Council meeting on February 18, 2025.

SANDAG RELEASES VALUE ANALYSIS STUDY FOR LOSSAN TRACK RELOCATION SANDAG Board to Consider Recommendations on February 28 On Friday, SANDAG released the value analysis study report for the LOSSAN Rail Realignment Project. The value analysis study was conducted in response to public feedback received on the Notice of Preparation (NOP) for the project. The study's goal was to examine alternatives proposed in the NOP and identify enhancements or new route alternatives for relocating the tracks.

The value analysis was a technicalstudy done by representatives with technical expertise from Carlsbad, Del Mar, Encinitas, San Diego, Solana Beach, 22 nd District Agricultural Association, North County
Transit District, and Caltrans. The Metropolitan Transit System and the City of Oceanside were also invited.

SANDAG staff has been reviewing the conceptual ideas that were raised through the value analysis study, as well as prior studies, and public feedback, and will be proposing alternatives for the Board of Directors to consider at its meeting on February 28. This will also be the next opportunity for public feedback.

Below is a brief description of the recommendations that staff are currently studying:

Under Crest Canyon (Under Jimmy Durante to I-5 Knoll): Realigned to minimize subsurface easements by routing below Crest Canyon Under Camino Del Mar (Under Jimmy Durante to Torrey Pines Road West): Aligned to minimize subsurface easements by following below Camino Del Mar San Dieguito Bridge to I-5 Knoll: Aligned to minimize impacts to Del Mar, the Fairgrounds, and San Dieguito Double Track Bridge Del Mar Bluffs Double Track Reinforced: Maintains current alignment, adds double track along the bluffs and through Los Penasquitos Lagoon with bluff reinforcement and more robust seawalls No Build: Includes continuation of major stabilization efforts that would be required to protect the existing single-track alignment About SANDAG

CITY ATTORNEY CLOSED SESSION REPORT
The January 21, 2025, City Council Closed Session was conducted at the end of the Open Session and therefore City Attorney Leslie Devaney reported out on that meeting at the next regularly scheduled Open Session which is today, February 3, 2025. City Attorney Leslie Devaney reported that while there were no legally reportable actions for the January 21, 2025, City Council Closed Session meeting, she reported that the City Council meet on two significant exposures to litigation items concerning San Dieguito Drive and misstatements made by Councilmember Quirk concerning the initial and final investigations into his conduct. She reported that Councilmember Quirk and City Manager Ashley Jones were absent, as conflicted, for a portion of the discussion concerning the misstatement of Councilmember Quirk.

City Attorney Devaney reported out on the January 23, 2025, City Council Closed Session regarding a significant exposure to litigation item concerning the misstatements of Councilmember Quirk pertaining to the initial and final investigations into his conduct. Both Councilmember Quirk and City Manager Jones were not present at that Special Closed Session due to conflicts. There were no legal reportable actions for that Closed Session.

City Attorney Leslie Devaney reported that there were no legally reportable actions for the January 30, 2025, City Council Closed Session meeting regarding a significant exposure to litigation item concerning the misstatements of Councilmember Quirk pertaining to the initial and final investigations into his conduct. Both Councilmember Quirk and City Manager Jones were not present at that Special Closed Session due to conflicts. There were no legal reportable actions for that Closed Session.

City Attorney Leslie Devaney reported that there were no legally reportable actions for the February 3, 2025, City Council Closed Session meeting. She reported that for Item A, related to Undergrounding Program (UP) options, Councilmember Quirk has put the City on notice that he intends to file a claim against the City related to UP project costs. Given the questions and advice the Council received on that item, Councilmember Quirk was not conflicted. For Item B, Amicus Curiae Brief in Casa Mira Homeowners Association v. California Coastal Commission, there were no legally reportable actions. 3 February 18, 2025 Item 03

For Item C, related to City Manager Performance Evaluation, there were no legally reportable actions and Councilmember Quirk was recused from a portion of the discussion. The City Council directed the City Attorney to provide the following report out, “Over the next two days the City Council will release a packet of emails concerning Councilmember Quirk’s communications with the City Manager which are problematic. These communications are based on direction to the City Manager to come to the City Council when necessary to invoke the protections of the censure against Councilmember Quirk as a result of the investigation.” Councilmember Quirk was called back to Closed Session but did not attend.

In response to a question received from a City Councilmember, City Attorney provided guidance related to the effect of abstention(s) on voting with a four-member City Council. She stated that an abstention would be considered a “yes” vote for purposes of the record. She further noted that per Attorney General opinion, Councilmembers should state the reason they are abstaining on the record as abstentions are frowned upon by the Attorney General who has opined that Councilmembers have a duty to vote on all items unless conflicted.

Councilmember questions focused on the recent Closed Sessions related to the misstatement made by Councilmember Quirk; First Amendment rights of Councilmembers; Brown Act noticing requirements for closed and open sessions; definition of quorum; whether City Attorney Devaney was recused from the first investigation; purpose of Closed Session; and clarification on the email packet that will be made public.

CITY COUNCIL OTHER BUSINESS
ITEM 8: CONSIDERATION OF UNDERGROUNDING PROGRAM FINANCING OPTIONS (CLERK’S FILE NO. 203-3, 1001-2)
City Attorney Devaney reported that Councilmember Quirk has by email and newsletter blast, announced that he intends to file a claim and lawsuit against the City and is therefore initiating litigation against the City based on his desire to receive material per unit cost information for City capital projects including undergrounding. The City will review that claim and respond to that claim when it is received, as is required by law.

She reported that there is no such claim to make against the City as the appropriate procedure is for Councilmember Quirk to request this information, which he has done on multiple occasions and the City has responded that it is not in possession of the information which is because Del Mar, along with other municipalities in California, uses lump sum bidding which is proven to be the most cost effective for the City as the process incentives contractors to provide the lowest and most cost effective price to be the selected bidder.

City Attorney Devaney announced that the item before the City Council this evening is to receive a presentation from staff and NHA Advisors and give direction on financing options, if the City decides to finance. The item is not to noticed to discuss the City’s bidding process and line-item project costs. She 6 February 18, 2025 Item 03

advised that the City Council not engage Councilmember Quirk on the topic of bidding because Councilmember Quirk has indicated he will be suing the City on that topic. City Attorney Devaney advised again that should Councilmember Quirk wish to discuss transitioning from a low bid to a time and material bidding process in open session, he may bring an item forward with another Councilmember for City Council consideration.

A presentation was provided by City Manager Jones and consultant Craig Hill, Principal with NHA Advisors. Principal Engineer Martin Boyd and NHA Vice President Leslie Bloom were available to answer questions.

Council questions focused on the funding needed for UUDs X1A and 1B and clarification on which portion would be funded by financing; base cost estimate for UUD 1B; clarification on the timing for completing construction of various districts under the various financing scenarios; whether there will be a future agenda item when City Council will discuss the UP project costs; clarification on private loan interest rates; index used for municipal bonds; whether NHA provides projections on interest rates; whether interest rates will vary depending on the loan amount; borrowing from iBank for the Civic Center; rational for borrowing to finance UUD 1B; bridge loans from the General Fund; General Fund reserve balance; clarification on the decision before the Council this evening; whether the economic impact of the rail location can be stress tested and whether the potential impacts would differ from the COVID Pandemic stress test completed by staff; overhead utility fire risk; relationship between interest rate and the City’s credit rating; clarification on the total financing cost; impact of the loan term on the total financing cost; and clarification on the cost and construction timing impacts of excluding UUD 1B from an initial borrowing.

Mayor Gaasterland opened the item to public comment and the following people spoke:
1) Laura DeMarco Chair of the Finance Committee
2) Shirli Weiss Chair of the Undergrounding Program Advisory Committee (UPAC) 3) Suren Dutia with a donation of time Jas Grewal
4) Steve Quirk
5) Tom McGreal
6) Richard Jamison
7) Dolores Davies Jamison
8) Mark Rittenbaum
Mayor Gaasterland closed the item to public comment.

Council discussion focused on appreciation to staff, Finance Committee, and UPAC for their work on this item; wildfire risk; community concerns surrounding financing; consideration to restrict financing for UUD X1A; clarification regarding the potential “sunk” costs associated with deferring and not financing UUD 1B; consideration of public, private, and iBank financing; clarification on whether NHA receives more or less compensation depending on the financing; whether iBank has longer transaction costs and/interest rates than the public offering; desire to receive 15 year iBank loan information; timing difference from iBank versus a public or private offering; clarification on a master lease versus single obligation lease structure; whether iBank will limit financing due to the fires; and other possible fire mitigation measures for the City Council to consider in the future.

________________________________________________________________________________________________________ City Council Action:

TO: Honorable City Councilmembers
FROM: Mayor Terry Gaasterland and Councilmember John Spelich, Undergrounding Program Advisory Committee Council Liaisons Prepared by Denise Galvan, Management Analyst
DATE: February 18, 2025
SUBJECT: Appointments to the Undergrounding Program Advisory Committee REQUESTED ACTION/RECOMMENDATION:

The City Council Liaisons to the Undergrounding Program Advisory Committee recommend that the City Council reappoint Amy Cheshire and Wade Walker to the Undergrounding Program Advisory Committee (UPAC) as voting members to serve full three-year terms starting March 2, 2025, and ending on March 31, 2028.

BACKGROUND:

UPAC works with the Utility Undergrounding Program (UUP) staff team to move the City’s UUP forward in a timely manner, track progress on the goals and tasks, and evaluate ongoing project success and lessons learned to make recommendations for adjustments as necessary. UPAC consists of seven Del Mar residents serving three-year terms. For continuity, UPAC members may continue to be appointed for additional three-year terms through completion of the UUP.

DISCUSSION/ANALYSIS:

There are currently two upcoming vacancies on UPAC due to the term expirations of Amy Cheshire and Wade Walker on March 1, 2025. City staff advertised the vacancies, and two Citizen Interest Forms were received during the recruitment period from Amy Cheshire and Wade Walker (Attachment A).

If the recommended appointments are approved by the City Council, UPAC will have a full roster with no remaining vacancies. A copy of the current roster is included as Attachment B for the Council’s reference.

________________________________________________________________________________________________________ City Council Action:

TO: Honorable City Councilmembers
FROM: Mayor Terry Gaasterland and Councilmember John Spelich, Lagoon Committee Council Liaisons
Prepared by Denise Galvan, Management Analyst
DATE: February 18, 2025
SUBJECT: Lagoon Committee Appointment
REQUESTED ACTION/RECOMMENDATION:

The City Council Liaisons to the Lagoon Committee recommend that the City Council appoint Nitza Leichtling to the Lagoon Committee as a voting member to serve a full three-year term starting March 1, 2025, and ending on March 31, 2028.

DISCUSSION/ANALYSIS:

The Lagoon Committee is charged with monitoring the preservation and enhancement of the portions of the San Dieguito and Los Penasquitos Lagoons located in the City of Del Mar, as well as actions outside the City of Del Mar that impact the lagoons. The Committee participates at both the local and regional level. Regionally, the Committee coordinates with the activities of the San Dieguito River Valley Joint Powers Authority (JPA) and monitors the lagoon’s restoration plan. Locally, the Committee monitors reports on the health of the lagoons, investigates additional public access opportunities, and encourages lagoon related educational and informational programs. The Committee also monitors and comments on all developments that may impact the two lagoons. The Committee consists of seven (7) voting members, all of whom must be Del Mar residents.

There is currently one upcoming vacancy on the Committee due to Carol Kerridge’s term expiration on February 28, 2025. City staff advertised the vacancy, and two Citizen Interest Forms were received during the recruitment period from Nitza Leichtling and Susan Maronde (Attachment A). Council liaisons to the committee reviewed the applications and recommend the City Council appoint Nitza Leichtling for a full three-year term effective March 1, 2025, and ending on March 31, 2028.

If the recommended appointment is approved by the City Council, the Committee will have a full roster with no remaining vacancies. A copy of the current Committee roster is included as Attachment B.

Hi Kaitlin,
I had applied to be on Lagoon committee in November or December 2024.

I would like to submit my application once again. I believe it was being held for that purpose. Do I need to do any other process?
Thank you,

Agenda Report
________________________________________________________________________________________________________ City Council Action:

TO: Honorable Mayor and City Councilmembers
FROM: Deputy Mayor Tracy Martinez and Councilmember Dan Quirk, Parks and Recreation Committee Council Liaisons
Prepared by Denise Galvan, Management Analyst
DATE: February 18, 2025
SUBJECT: Parks and Recreation Committee Appointments
REQUESTED ACTION/RECOMMENDATION:

The City Council Liaisons to the Parks and Recreation Committee recommend that the City Council: 1) Reappoint Arlene Prater as a voting member to the Committee to serve a second full three-year term starting April 1, 2025, and ending on April 30, 2028; and 2) Appoint Susan Maronde to serve a first term as a voting member to the Committee for a full three-year term starting March 3, 2025, and ending on March 31, 2028.

DISCUSSION/ANALYSIS:

The Parks and Recreation Committee (Committee) was established to advise the City Council on matters related to City parks and open space lands, recreation facilities, trails and scenic preserves, and to plan for specific development of Del Mar’s open space. The Committee reviews the City’s need for park and recreation facilities and guidelines governing the use and enjoyment of public parks and open space lands; makes recommendations to City staff regarding the efficient and adequate maintenance of City parks and open space lands; and reviews guidelines governing the use of the City’s trails and the Adopt-a-Spot Program. The Committee consists of seven voting members serving three-year terms. One member may be a non-resident.

There are currently two upcoming vacancies on the Committee due to the term expirations of Arlene Prater on March 31, 2025, and Claire McGreal on March 2, 2025. City staff advertised the vacancies, and two Citizen Interest Forms were received during the recruitment period from Arlene Prater and Susan Maronde (Attachment A).

If the recommended appointments are approved by the City Council, the Committee will have a full roster with no remaining vacancies. A copy of the current Committee roster is included as Attachment B.

All aspects of Del Mar’s parks and recreation interest me, but if I had to choose, it would be the area encompassed between 15th, Dog Beach and the lagoon. More focus on continuity in this area would benefit both children and adults as well as draw visitors to Del Mar that have passion for the outdoors.

The lagoon is a Del Mar treasure! That said, it seems like it goes unnoticed by residents and visitors. As a result, the beauty of the lagoon is not maximized, cherished or embraced! We need to bring more awareness to our residents about the awe and beauty of the lagoon as well as the threats!!!!! Would love to be a part of this effort!

Agenda Report
________________________________________________________________________________________________________ City Council Action:

TO: Honorable Mayor and City Councilmembers
FROM: Councilmembers Dan Quirk and John Spelich, Traffic and Parking Advisory Committee Council Liaisons
Prepared by Denise Galvan, Management Analyst
DATE: February 18, 2025
SUBJECT: Traffic and Parking Advisory Committee Appointment REQUESTED ACTION/RECOMMENDATION:

The City Council Liaisons to the Traffic and Parking Advisory Committee recommend that the City Council reappoint Zach Groban as the at-large, business representative voting member on the Traffic and Parking Advisory Committee to serve a full three-year term starting February 18, 2025, and ending on February 29, 2028.

DISCUSSION/ANALYSIS:

The Traffic and Parking Advisory Committee (TPAC) was established with the purpose of developing advisory recommendations to the City Council on specified traffic and parking items referred to the Committee by City staff or the City Council. The Committee relies on the advice of City staff, including the City’s traffic and engineering consultants, and the Sheriff’s Department.

TPAC also has the authority to refer specific concerns to the City’s contract traffic engineer, upon approval of the City Manager. TPAC consists of seven voting members, one of which is a business representative member representing a business located in Del Mar. The business representative may be a non-resident. Geographic diversity is desirable and is taken into account when the Council appoints members to the Committee.

There is one business representative vacancy on the Committee due to the term expiration of Zach Groban on January 30, 2025. City staff advertised the vacancy, and one Citizen Interest Form was received during the recruitment period from Zach Groban (Attachment A).

If the City Council approves the recommended appointment, the Committee will have one remaining vacancy. A copy of the current Committee roster is included as Attachment B.

TO: Honorable Mayor and City Councilmembers
FROM: Deputy Mayor Tracy Martinez and Councilmember John Spelich Prepared by Clem Brown, Assistant City Manager
DATE: February 18, 2025
SUBJECT: Appointment to the Air Pollution Control District Governing Board – District 3 REQUESTED ACTION/RECOMMENDATION:

Deputy Mayor Tracy Martinez and Councilmember John Spelich request that the City Council discuss and provide direction to Mayor Terry Gaasterland on the upcoming appointment to the District 3 seat on the San Diego County Air Pollution Control District (APCD) Governing Board.

BACKGROUND:

The APCD is a government agency established in 1955 that strives to reduce air pollution within San Diego County. The APCD’s 11-member Governing Board sets the policy direction for the organization and consists of:
 Two county supervisors
 The mayor or a city councilmember at-large from the City of San Diego  One city councilmember from each of the five county supervisorial districts  Three members of the public, including:
o Physician or public health professional
o Environmental justice representative
o Individual with a scientific or technical background in air pollution In November 2024, the APCD requested that the County of San Diego’s City Selection Committee (CSC) make appointments to the five county supervisorial district seats for fouryear terms that will expire on March 9, 2025. The CSC consists of the mayors of all cities within County of San Diego with the purpose of appointing representatives to boards, commissions, and agencies, such as the APCD, as required by state law.

At the CSC’s meeting on January 13, 2025, the appointment to represent District 3 on the APCD, which includes the cities of Carlsbad, Coronado, Del Mar, Encinitas, San Diego, and Solana Beach, was continued to the next meeting of the CSC because there were tie votes.

Del Mar Mayor Terry Gaasterland participated in the January 13, 2025, vote and cast her ballot for City of Coronado Mayor John Duncan along with Mayor Bruce Ehlers (City of 1 February 18, 2025 Item 10
City Council Agenda Report

Encinitas) and Mayor John Duncan. The other three cities (Carlsbad, San Diego, and Solana Beach) voted for the other candidate, City of Carlsbad Councilmember Teresa Acosta, resulting in the tie vote and the continuance of the appointment to the next meeting. Both candidates presented a verbal summary of their qualifications for the position at the January 13, 2025, meeting that can be viewed at https://www.youtube.com/watch?v=Qyu4JqM4ifg.

DISCUSSION/ANALYSIS:

The CSC will convene again to make the appointment to the APCD District 3 seat at a Special Meeting on March 10, 2025. The agenda packet for that meeting is included as Attachment A. To address the potential of another tie vote, County staff is proposing amendments to the CSC rules and regulations that would allow the full CSC to vote to resolve a tie, not just the cities represented by District 3. These proposed revisions would only apply to APCD appointments moving forward.

Deputy Mayor Tracy Martinez and Councilmember John Spelich request that the City Council discuss and provide direction to Mayor Terry Gaasterland on how the City should vote for the APCD District 3 appointment at the March 10, 2025, Special Meeting. A copy of the public comments received at the January 13, 2025, CSC meeting regarding the nominations for the five county supervisorial district seats to the APCD is included as Attachment B.

Good afternoon City Selection Committee Clerk and Mayors of County Supervisorial District 3, My name is Nicholas Paul, I am an Air Quality Policy Advocate with the Environmental Health Coalition and I’d like to submit this letter of support for councilmember Teresa Acosta of Carlsbad as the District 3 representative for the Air Pollution Control District. As detailed in the letter, the listed labor unions and environmental/ environmental justice non-profits believe councilmember Acosta to be highly qualified to serve on the air pollution control district.

Please let us know if there are any questions regarding the letter.

To the Mayors of County Supervisorial District 3,
We are very pleased to have the opportunity to provide our recommendation for the County District 3 seat on the San Diego Air Pollution Control District Governing Board. The coalition below, is made up of some of the leading non-profit and labor organizations in San Diego County advocating for cleaner, safer, and healthier communities. The organizations below share a common belief that all people regardless of zip code have the right to live, work and play in a clean and safe environment. According to the American Lung Associations 2024 State of the Air Report, San Diego County ranked 8 worst for high ozone days out of 228 metropolitan areas throughout the country.1
Unfortunately, residents throughout San Diego County, continue to suffer negative health impacts from exposure to harmful air pollutants. These conditions necessitate passionate and collaborative leadership at the Air Pollution Control District.

We write this letter today to respectfully request that you support Carlsbad Councilmember Teresa Acosta as the County District 3 representative on the San Diego Air Pollution Control District (SDAPCD) Governing Board.

Teresa has critical prior experience in air quality — serving as an air quality consultant to governing board members in the South Coast Air Pollution Control District — which will enable her to hit the ground running and deliver results for our region. Teresa has also represented the city of Carlsbad at several regional organizations:

League of California Cities Environmental Quality Committee, Clean Energy Alliance, Carlsbad Chamber of Commerce, Encina Wastewater Authority, and North County Transit District (Alternate). Her experience combined with her commitment to improving air quality and preserving the environment make her an excellent fit for the SDAPCD.

Our organizations look forward to your support of Teresa Acosta to represent Carlsbad and County District 3 at APCD to reduce air pollution in San Diego.

The Honorable Mayor John Minto
Chair, City Selection Committee of the County of San Diego County Administration Building
1600 Pacific Highway, Room 402, San Diego, California 92101 Subject: Recommendations for Air Pollution Control District Appointments Dear Chair Minto,
The undersigned stakeholders represent a broad spectrum of pro-business organizations and advocates in San Diego County and respectfully submit our recommended slate of highly qualified candidates for appointment to the Air Pollution Control District (APCD) Governing Board. Each of these elected leaders has shown a strong understanding of the delicate balance of environmental issues and economic prosperity and has a deep respect for scientific data.

This group believes that the APCD will benefit from balanced leadership that ensures responsible air quality management for our region, while balancing the economic realities of our region. Given the scientific nature of the Governing Board, we believe it is critical to appoint leadership that prioritizes evidence-based decision making. Therefore, we submit the following names for your consideration:

Supervisorial District 1: Councilmember Mitch McKay – Imperial Beach - Councilmember McKay served as a representative of Imperial Beach to the United States International Boundary & Water Commission (IBWC) Citizen Forum Board prior to his election to the Imperial Beach City Council and currently serves on the Shoreline Preservation Working Group and SANDAG. During his time on the Council, he has proven to be a balanced voice and shown a deep understanding of the environmental issues facing Imperial Beach.

Supervisorial District 2: Councilmember Laura Koval – Santee - Councilmember Koval has served as the Director of Park and Recreation for Santee Lakes Recreation Preserve for over 10 years and represents the City of Santee on multiple Attachment B 39 February 18, 2025 Item 10
committees such as MTS, SANDAG, and the Stowe Trail Taskforce. Councilmember Koval has a proven knowledge of environmental issues including land, water, and air in East County.

Supervisorial District 3: Mayor John Duncan – Coronado
- Mayor John Duncan is an attorney with over 25 years of experience in complex business, finance, asset management and real estate law. In his prior role as a Councilmember, he demonstrated a fair and balanced approach to regional issues serving outside agencies including SANDAG and MTS. He also serves on the city's Transborder Sewage SubCommittee advocating for solutions to sewage flows that are contaminating the waters off Coronado, demonstrating both knowledge and passion for environmental related health issues that would be an asset to APCD.

Supervisorial District 4: Councilmember Dr. Jennifer Campbell – San Diego - Councilmember Dr. Jennifer Campbell is an M.D., serving for many years as a Family Physician. She has experience as Chair of San Diego’s Environment Committee and led the creation of San Diego Community Power and serves on the San Diego River Conservancy Board. As a doctor, she is highly qualified to address environmental health issues with experience and data on the APCD Governing Board.

Supervisorial District 5: Councilmember Judy Fitzgerald – Escondido - Councilmember Judy Fitzgerald is a newly elected member of the Escondido City Council, but she has already shown her immense care for her community, serving as a businesswoman, law enforcement officer, and board member of the Escondido Chamber of Commerce. We believe Councilmember Fitzgerald would be a great community advocate.

We believe these candidates will be collaborative, responsible, and data driven as representatives to the APCD Governing Board. For these reasons, we respectfully ask the Committee to consider our recommended slate of candidates when making appointments. Should you require any further information, please reach out to Justine Murray, Executive Director of Public Affairs at the San Diego Regional Chamber of Commerce, at [email protected].
