City of Del Mar
Agenda Report
________________________________________________________________________________________________________ City Council Action:
TO: Honorable City Councilmembers
FROM: Mayor Terry Gaasterland and Deputy Mayor Tracy Martinez, Sustainability Advisory Committee Council Liaisons
Prepared by Denise Galvan, Management Analyst
DATE: December 1, 2025
SUBJECT: Appointments to the Sustainability Advisory Committee REQUESTED ACTION/RECOMMENDATION:
The City Council Liaisons to the Sustainability Advisory Committee (SAC) recommend that the City Council appoint Chelsea Nelson and Susan Leckband as voting members to the SAC to serve full three-year terms beginning on December 1, 2025, and ending on December 31, 2028.
BACKGROUND:
The Sustainability Advisory Committee (SAC) advises the Del Mar City Council on climate change, sustainability, and other environmental issues on which the Council may wish to act.
The Committee also takes the lead advising the Council on the City’s Climate Action Plan (CAP) and assists in informing Del Mar residents and businesses about implementing the City’s CAP and on environmental and climate action issues.
The committee currently consists of six total members, including five voting members and one ex-officio non-voting member. All voting members are required to be residents of Del Mar and shall be appointed based on their professional experience with sustainability and environmental issues.
DISCUSSION/ANALYSIS:
There are currently two voting member vacancies on the Sustainability Advisory Committee due to the resignation of Valerie Dufort-Roy on October 13, 2025, and the vacated seat of Silvia De Dea on November 4, 2025. City staff advertised the vacancies, and three Citizen Interest Forms were received during the recruitment period from Chelsea Nelson, Barbara Aufiero and Susan Leckband. The Council Liaisons reviewed the applications (Attachment A) and recommend appointing Chelsea Nelson and Susan Leckband as voting members for a full three-year term beginning December 1, 2025, and ending on December 31, 2028.
If the recommended appointments are approved by the City Council, the SAC will have a full roster of five voting members and one ex-officio member. A copy of the current roster is included as Attachment B for the Council’s reference.

Excited for the opportunity to apply for the Sustainability Advisory Committee! I’ve always loved the environment and do my best to live sustainably in my personal life. However, individual actions only go so far, and I’d love to join a team that’s making an impact on a broader community level. As a sustainability professional for the past 5 years with a background in marine science research, I believe my work and education background would be a great fit for the team.
Work experience aside, I just love this city so much and strive to make it a better place. All of my favorite hobbies – surfing, freediving, volleyball, taking my dog to the beach – involve the ocean and beaches around Del Mar, so I want to do everything I can to protect these amazing places for us and future generations! I see so many opportunities to make our city even better than it already is and want to be part of the solution.

1. Sustainability Advisory Committee
The Sustainability Advisory Committee members are community leaders on environmental issues.
In what ways would you like to contribute to a more sustainable world either in your personal life or on a broader community level?
Please describe any outreach or public education efforts you have participated in related to environmental issues or in other areas. Do you have skills or experience in outreach that you could bring to the Sustainability Advisory Committee?
In my personal life, I try my best to be sustainable, but there’s always room for improvement! My latest zero-waste undertaking is getting rid of paper towels and switching to reusable ones.
In my community, I’d love to contribute to efforts that reduce plastic and make lower impact packaging, like compostables and reusables, more available. For example, the new Better Buzz packages everything in single-use plastic – even if you’re drinking/dining in. Stratford Café, another one of my favorites, packages to-go orders in flimsy plastic bags and always includes plastic utensils even though you’re supposed to request them. I’d also love to contribute to improvements in organics recycling. Keeping food out of the landfill is essential to reduce our footprint, and I think a lot of people still struggle with the idea of putting food scraps in their green bin. Finally, it would be great if we had more events, cleanups, etc. to get the community more involved/get people thinking more about sustainability in their everyday lives.
In my current role as Director of Environmental Impact at Jimbo’s, I lead projects to reduce food waste, reduce packaging waste, conserve water, and increase energy efficiency. A lot of what I do involves outreach and education to both customers and staff. For example, I lead sustainability trainings with new hires to teach them proper sorting methods. I also create Instagram videos, email blasts, and impact reports to share our sustainability mission with our customers.
In my previous role, I was a consultant for government agencies to help them meet stormwater pollution prevention outreach and education requirements. I led campaigns to inform the public of the importance of picking up pet waste, keeping trash out of storm drains, and properly disposing of HHW to prevent stormwater pollution. I also helped agencies roll out their organics recycling programs. In 2022 when SB1383 was picking up, I ran a pilot program with the City of Salinas to test the most effective ways to get residents to compost their food scraps. The intervention methods included outreach like mailed educational flyers, normative messaging, and kitchen pails delivered door-to-door, and the pilot program informed their city-wide rollout.

The Committee also reviews the City’s Annual Comprehensive Financial Report (ACFR), CalPERS Cost Sharing Pool Reports and the related annual contributions to the Pension Reserve Fund, Pension Reserve Policy, City financial metrics, and other assignments from the Council, such as long-term planning, fee assessments, and sources of possible revenues.
The Committee currently consists of six (6) resident voting members with the membership to be reduced to five (5) voting members over time through attrition, not affecting members completing their first term who are eligible and willing to serve a second term.
There is one voting member vacancy on the Committee due Micheal Minter’s first term expiration on November 30, 2025. City staff advertised the vacancy, and three Citizen Interest Forms were received during the recruitment period from Micheal Minter, Marcelo Penha and Caitlin Laipeneiks (Attachment A). The Council Liaisons to the Committee have reviewed the applications and recommend that the City Council reappoint Michael Minter as a voting member for a second full three-year term starting on December 1, 2025, and ending on December 31, 2028.
If the recommended appointment is approved by the City Council, the Committee will have a full member roster. A copy of the current Committee roster is included as Attachment B for Council’s reference.

DATE: December 1, 2025
SUBJECT: Approval of Task Orders with Stephen Dalton Architects and Keyser Marston Associates Inc. to Complete Feasibility Studies and Conceptual Designs for Three Potential Affordable Housing Sites on 22nd District Agricultural Association Property in the City of Del Mar in Accordance with the City’s Certified 6
th Cycle Housing Element Program 3A
REQUESTED ACTION/RECOMMENDATION:
Staff recommends the City Council: 1) Approve a $67,000 Task Order with Stephen Dalton Architects (Attachment A) and a $175,000 Task Order with Keyser Marston Associates Inc. (Attachment B) to complete feasibility studies and conceptual designs for three potential affordable housing sites on 22nd District Agricultural Association property in the City of Del Mar; and 2) Authorize the City Manager to execute the Task Orders.
BACKGROUND:
Consistent with the City’s certified Housing Element Program 3A, the City continues to vigorously pursue opportunities to build lower income housing on 22nd District Agricultural Association (District/Fairgrounds) property in the City of Del Mar, which has involved execution of multiple binding agreements:
• Multiple consultant agreements since 2021 executed with Stephen Dalton Architects (SDA) and Keyser Marston Associates, Inc. (KMA) for consulting services to complete pre-development due diligence studies to build lower income housing on District property. In 2022 SDA and KMA finalized initial site-specific massing concepts and financial feasibility analysis that demonstrated high feasibility to build lower income housing on District property.
• Multiple grant agreements with the San Diego Association of Governments (SANDAG) and the California Housing and Community Development Department (HCD) for use of Housing Acceleration Program (HAP) grant funds allocated by the State and administered by SANDAG for the Cycle 1 (2021-2023) and Cycle 2 (2024-2026) HAP 1 December 1, 2025 Item 6

grant cycles to complete various studies and complete other pre-development tasks to implement the City’s Program 3A Fairgrounds Housing plan. • City and District execution of an Exclusive Negotiating Rights Agreement (ENRA) in March 2024 to mutually identify a site for development of housing on the Fairgrounds property.
• Execution of a Memorandum of Agreement between the City and District in May 2025 for use of Cycle 2 HAP grant funds to cover pre-development studies currently in process at various stages through March 2026 in accordance with five task orders executed between the District and Harris Associates to implement the ENRA.
District consultant, Harris & Associates, completed a Housing Sites Assessment in November 2025 that studied five potential sites on Fairgrounds property including three sites in the City of Del Mar and two sites in the City of San Diego. Harris has multiple additional deliverables pending such as biological resources and cultural resources assessments, transportation studies, water and sewer analysis, and sea level rise and vulnerability assessments.
To build upon this work, the City is seeking additional consulting services from SDA and KMA to complete feasibility studies and conceptual designs for three potential affordable housing sites on District property as further described below.
DISCUSSION/ANALYSIS:
In consideration of the District’s Housing Site Assessment Report, staff requested proposals from SDA and KMA. Under the proposed Task Orders, SDA and KMA will complete supplemental feasibility studies and conceptual plans for three potential affordable housing sites within the City of Del Mar’s jurisdiction on District property as identified in the scope of services in the respective consulting services agreements in Attachments A and B.
The work to be completed will include new feasibility studies for one potential housing site South of the East Main Stables and revised feasibility studies for two additional sites that were previously studied and determined to be feasible including the East Main Stables Site (2022 studies) and Site Adjacent to Fire Station (2023 studies).
Once complete, the updated feasibility studies and conceptual plans will be presented to the City Council and District Board for consideration in accordance with the ENRA objective to identify a conceptual development program and mutually agree on a location for affordable housing on District property. Subsequent actions would include negotiating the terms and conditions of a ground lease for execution in preparation for construction of affordable housing development by June 2031.
Staff reviewed the respective consultant proposals and determined the firms are well-qualified to perform these task orders. Both firms previously produced excellent work products related to affordable housing feasibility and conceptual plans that exceeded the City’s expectations.
SDA’s cost proposal of $67,000 and KMA’s cost proposal of $175,000 are in line with market costs for this type of work.

SCOPE OF SERVICES
AFFORDABLE HOUSING FEASIBILITY ANALYSIS
CITY OF DEL MAR
OBJECTIVE
The City of Del Mar (City) has requested that Keyser Marston Associates, Inc. (KMA) provide assistance related to feasibility assessments for potential multi-family housing developments on three (3) publicly owned sites on the State Fairgrounds property (Fairgrounds) within the City limits.
As background, in 2021 KMA and urban design consultant Stephen Dalton Architects (SDA) were retained by the City to analyze the market and financial feasibility of selected affordable housing or mixed-income housing development scenarios on publicly owned sites. The objective of the KMA/SDA analysis was to formulate development scenarios for feasibility testing and estimate the magnitude of public financial contribution that would be required to facilitate development. The scenarios analyzed by KMA/SDA included 100% affordable projects as well as projects with a mix of affordable (20%) and market-rate units. The KMA/SDA analysis was completed and presented to the Del Mar City Council in June 2022. In April 2023, SDA completed a supplemental study to create potential affordable housing architectural concepts for an additional site on the southerly portion of the Fairgrounds adjacent to the fire station.
The City has since entered into an Exclusive Negotiating Rights Agreement (ENRA) with the State of California 22nd District Agricultural Association (District) to identify a site for the development of at least 61 lower income units on the Fairgrounds. The District has retained Harris & Associates (Harris) to evaluate the development feasibility of potential sites based on financial feasibility, eligibility for tax credit financing, environmental constraints, ability to adhere to State and local requirements, impact to Fairground operations and events, and any potential public health, safety and security concerns. To that end, the District and Harris have identified three potential sites for further study:
• Site 1: 1.50 acres east of the main stable gate, previously analyzed by KMA/SDA in 2022 • Site 2: 1.50 acres south of the main stable gate
• Site 3: 1.0 acre adjacent to the fire station site, previously analyzed by SDA in 2023 The City has requested an update of the feasibility analysis prepared by KMA for Site 1 and preparation of feasibility analyses for Sites 2 and 3. In response to the City’s request, KMA has formulated the following work program.

SCOPE OF SERVICES
Task 1: Initiation and Background Research
a) Data Collection and Review – KMA will participate in a virtual meeting with City staff and SDA to review the City’s objectives and collect relevant background information such as maps, plans, and other documents. We will review this information and follow up with City staff regarding any necessary clarifications and/or additional data needs.
b) Identification of Potential Development Prototypes, Tenure, and Affordability Levels – KMA will work with City staff and SDA to identify representative site/prototype scenarios for testing the feasibility of senior housing and family housing alternatives on each of the three (3) sites, with variations in terms of unit count and affordability mix, as described below.
Senior Housing Family Housing
Units Affordability Mix Units Affordability Mix
61 Units • 100% Affordable 61 Units • 100% Affordable
95 Units
• 100% Affordable
• Mixed-Income
82 Units
• 100% Affordable
• Mixed-Income
128 Units
• 100% Affordable
• Mixed-Income
KMA will require conceptual drawings and building area tabulations from SDA for each multi-family housing development prototype on each site, for a total of 15 alternatives. KMA will use these prototype development concepts to test the feasibility of developing housing at various income/affordability levels. KMA will participate in one (1) meeting with SDA and City staff to receive feedback on the potential development prototypes and finalize the alternatives/scenarios for financial feasibility testing.
Task 2: Potential Funding Sources
a) Assessment of Potential Funding Options – KMA will identify potential funding sources for each site/development prototype. This may include 9% and 4% Low Income Housing Tax Credits, and other State and Federal sources such as the Affordable Housing Sustainable Communities (AHSC) Program, the Multi-Family Housing Program (MHP), the Mixed-Income Program (MIP), the HOME Investment Partnership Program, among others. For each funding source, KMA will prepare an overview of key features, requirements, and eligible uses. We will also assess the applicability and level of competitiveness for each development prototype/scenario to receive funding. We will 11 December 1, 2025 Item 6

summarize our assessment in a high-level summary matrix, ranking various features in terms of viability and potential magnitude of funding.
Task 3: Financing Feasibility Analyses
a) Financial Pro Forma Analyses – For each of the 15 site/development scenarios identified above, KMA will prepare financial pro forma models with variations in terms of affordability levels, as described below.
Affordability Level Tenure Parameters
100% Affordable Rental
For each 100% affordable scenario KMA will prepare one
(1) financial pro forma model financed with Low Income
Housing Tax Credits (LIHTC)
Mixed-Income
(20% Affordable)
Rental
For each mixed-income prototype, KMA will test 20% of the total unit count restricted to Lower Income households and the remaining units (80% of total unit count) at market-rate The pro forma analysis for each prototype will include estimates of development costs, developer fee or target profit, rental income and expenses, value upon completion, and will incorporate estimates of funding from public and private sources based on KMA’s assessment of potential funding sources in Task 2.
The pro forma analysis will rely on data provided by City staff and/or other City consultants with regard to cost estimates related to extraordinary off-site infrastructure and/or extraordinary site preparation costs.
The outcome of each pro forma analysis will yield estimates of the residual land value supported by each development prototype. In some cases, the residual land value conclusion will be a negative number, indicating that the project has a financing gap even if the public agency contributes the land at no cost. The financing gap represents the City subsidy, or local public financial contribution, that would be required for a given site/development scenario to be feasible. b) Peer Review – KMA will conduct a peer review of the financial feasibility analysis prepared by the District’s consultant, Harris. Harris is preparing a Financial Feasibility Memorandum that will include a comprehensive financial feasibility analysis and assessment of each site’s competitiveness for tax credit financing. KMA will review the Harris analysis and note key issues and concerns, if any, and conclude whether the Harris methodology, assumptions, and conclusions are appropriate and supportable. KMA will participate in up to one (1) meeting with City staff, District staff, and/or Harris to discuss necessary clarifications regarding the Harris analysis. 12 December 1, 2025 Item 6

Task 4: Presentations and Report
a) Presentation of Draft Findings to City Staff – KMA will participate in one (1) in-person or virtual meeting with City staff to review the findings of the feasibility analyses and peer review. Based on feedback from the City, KMA will make appropriate changes to the financial models and summary tables.
b) Presentation of Draft Findings to District Staff – Following the receipt of comments from City staff, KMA will participate in up to one (1) in-person or virtual meeting with District staff to review the findings of the feasibility analyses and peer review.
c) Report – KMA will prepare both a summary report and detailed technical appendix. The summary report will be written for a wide audience and will include a concise synthesis of the analysis and findings. The appendix will present the methodologies, data sources, assumptions, and results of the financial feasibility analysis. To the extent possible, the report will include user-friendly exhibits and graphics, as well as clear, easy-to-understand terminology. The KMA report will be presented in a maximum of three (3) successive versions: Administrative Draft, Draft, and Final.
Task 5: Public Meetings
a) District Meetings – KMA will prepare for, and attend, up to two (2) public meetings and/or workshops with the District to present the KMA findings. Preparation will include presentation materials, handouts, and/or responses to comments from District officials. b) City Council Meetings – KMA will prepare for, and attend, up to two (2) public meetings and/or workshops with the City Council. Preparation will include presentation materials, handouts, and/or responses to comments from public officials and/or stakeholders. c) Response to Comments – The City may receive questions or comments related to the KMA Report from other City staff, City officials, the District, and/or other parties. As needed, KMA will review these questions or comments and prepare written responses or clarifications as appropriate.

DATE: December 1, 2025
SUBJECT: Pavement and Traffic Striping Improvements for Jimmy Durante Boulevard REQUESTED ACTION/RECOMMENDATION:
Staff recommends that the City Council Receive an update on the Pavement and Traffic Striping Improvements Project for Jimmy Durante Boulevard.
BACKGROUND:
The City of Del Mar maintains a network of approximately 25 miles of arterials, local streets, and paved alleys. The City’s Street Maintenance Program completes pavement repairs annually to preserve the integrity of the City’s roadways. Traffic striping modifications are typically scheduled during major roadway repairs to maximize their useful durations.
In 2024, the City completed a comprehensive pavement condition assessment and prepared a five-year Pavement Management Plan (PMP) that created guidelines and a strategic approach to prioritize street repairs and guide funding decisions. Pavement network conditions are measured through the Pavement Condition Index (PCI), which is a numerical rating system used to assess the condition of a pavement segment based on visible surface distress.
The highest possible PCI score is 100 (Excellent) and lowest possible PCI score is 0 (Failed).
The citywide weighted PCI was determined to be 76, which is an overall “Good” condition rating. Del Mar’s PCI is comparatively higher than many of our neighboring jurisdictions, including City of San Diego (63) and City of Solana Beach (73). The City Council committed to funding a minimum of $750,000 annually to increase the PCI to 80.5 at the end of the next five-year period in 2029.
DISCUSSION/ANALYSIS:
As identified in the PMP, Jimmy Durante Boulevard’s PCI ranges from 49 to 62, and most of the pavement has a “Poor” condition rating. Due to its low PCI and high vehicular, pedestrian, and bicycle usage, staff recommended pavement improvements to Jimmy Durante Boulevard (JDB) be prioritized early in the PMP schedule and funding was included in the Fiscal Year (FY) 2025-2026 budget to complete this project.
1 December 1, 2025 Item 7
City Council Agenda Report
Pavement and Traffic Striping Improvements on Jimmy Durante Boulevard December 1, 2025
This project will complete pavement improvements to JDB between the San Dieguito River Bridge and the southern side of the intersection of Via de la Valle. This road segment is approximately three quarters of a mile and ranges in width from 40 feet to 112 feet. It includes multiple lanes in each direction, dedicated turn lanes, a striped median, and northbound and southbound bicycle lanes.
The improvements will fit within the existing curb-to-curb width; existing curbs, gutters, and sidewalks will remain as-is. Project improvements will include a grind and overlay and asphalt replacement, structural repairs to the subsurface if needed, and new reflective traffic striping.
Modifications to Traffic Striping
The repaving of JDB between the San Dieguito River bridge and Via De La Valle presents an opportunity to update the existing traffic striping of the roadway to better serve the community.
The City’s Traffic Engineer reviewed the existing striping for safety, compliance with roadway standards, and operational improvements. Attachment A includes a conceptual traffic striping modification plan.
Where possible, the following improvements are proposed: 1) additional buffers to the bicycle lanes, 2) conflict areas with green paint, 3) more clearly defined pedestrian spaces, and 4) proper merging conditions. The draft plans also take into consideration how traffic lanes are used by the Fairgrounds, and include dedicated turn lanes, pavement legends to guide drivers, and areas that can be adjusted during events to provide emergency vehicle access and added entry/exit capacity.
The goal is to create a final plan that will reduce vehicle speeds, allow for flexible traffic flow, and provide more conspicuous facilities for vulnerable users such as cyclists and pedestrians.
The modifications have been discussed with staff from the Fairgrounds and were developed to improve traffic circulation and complement their typical traffic control for special events.
Project Timeline & Next Steps
On September 22, 2025, the City Council approved a Task Order with Michael Baker International (MBI) to complete the design for the Jimmy Durante Boulevard Pavements Improvement Project. MBI has completed the 90% design drawings, and the biddable plans and specifications will be completed by the end of December 2025. Following the completion of the design, the project will be advertised for public bid with an anticipated bid opening in late January 2026. The construction phase is anticipated to take approximately three months and will be completed by May 2026, which will avoid impacts to large events scheduled to occur at the Fairgrounds.
Estimated Project Cost & Funding
Funding for this project has been included in the approved FY 2025-26 Operating and Capital Budget. A total of $3.5 million was allocated to the project from several funding sources, including the General Fund, SB-1, TransNet, Measure Q, State and Local Fiscal Recovery Funds (SLFRF), and Regional Transportation Congestion Improvement Program (RTCIP). 2 December 1, 2025 Item 7

City of Del Mar
Agenda Report
________________________________________________________________________________________________________ City Council Action:
TO: Honorable Mayor and City Councilmembers
FROM: Amanda Lee, Principal Planner
Karen Brindley, Planning and Community Development Director Via Ashley Jones, City Manager
DATE: December 1, 2025
SUBJECT: Update on Pending California Coastal Commission Action to Approve PostCertification Maps for the City of Del Mar’s Certified Local Coastal Program REQUESTED ACTION/RECOMMENDATION:
Staff requests the City Council receive an informational report regarding pending California Coastal Commission (CCC) action on December 10, 2025, to approve post-certification maps for the City of Del Mar’s certified Local Coastal Program (LCP) as shown in Attachment A.
BACKGROUND:
The City has a certified LCP that includes two main components consistent with the Coastal Act:
• LCP Land Use Plan – This policy document identifies the City’s coastal land use policies and corresponding maps certified by the CCC. It was initially certified on March 18, 1993, and has since been amended multiple times. Following is a link to the current document:
https://www.delmar.ca.us/DocumentCenter/View/9114/LCP-Land-Use-Plan-CompleteRev-1-2024 • LCP Implementation Ordinances – This package of land use and zoning regulations in the Del Mar Municipal Code (DMMC) implements the LCP Land Use Plan policies as certified by the CCC. The initial package of LCP Implementation Ordinances was certified by CCC on September 11, 2001, and has since been amended by ordinances adopted by the Del Mar City Council and certified by the CCC. Following is a link to the history of Del Mar’s LCP implementing regulations in DMMC Title 30 Zoning Code (2001 – 2025):
https://www.delmar.ca.us/DocumentCenter/View/9928/LCP-Chapters-June-2025 Following LCP certification on September 11, 2001, the City assumed permit authority to issue its own Coastal Development Permit (CDP) approvals in accordance with the certified LCP. Prior to LCP certification, Del Mar applicants were required to submit their CDP applications directly to the CCC for processing and issuance of permits. Once the City obtained permit authority in 2001, the permit approval process became more streamlined. Implementation has been based on the initial draft maps prepared with an understanding that CCC’s statewide mapping unit would follow up to work with the City to finalize the post-certification maps for CCC approval at a future date. 1 December 1, 2025 Item 8
City Council Agenda Report
Pending CCC Approval of LCP Post Certification Maps
December 1, 2025
Typically, after a local jurisdiction’s LCP is certified by the CCC, Commission staff are expected to prepare post certification maps to clearly delineate areas within the local jurisdiction where the CCC has retained permit authority over CDP approval decisions, distinguish those areas from locations where CCC has delegated permit authority to the local government, and identify locations where local decisions on CDPs are appealable to the Coastal Commission. CCC approval of final permit authority maps is required. However, this mapping effort has been delayed for local jurisdictions statewide until recent efforts by CCC to prioritize completion (e.g., Pacifica’s LCP was certified 1994 and CCC approved post certification maps October 2025).
In May 2024, CCC’s statewide mapping unit reached out to resume discussions with Del Mar regarding next steps to complete the post certification maps. CCC staff will be presenting the item to CCC for approval on December 10, 2025. Following is a link to CCC Agenda Report Item W15a:
https://www.coastal.ca.gov/meetings/agenda/#/2025/12
DISCUSSION/ANALYSIS:
CCC approval of the post certification map record is following the Coastal Act procedure (Coastal Act Section 30613) for processing of maps to reflect a formal permit jurisdiction transfer. The main criteria for approval is that property is designated for urban use/development and either has existing development or the site was previously developed.
CCC adoption of the final post certification map will continue to apply the existing streamlined permit process that has been in place since the City obtained permit authority in 2001. The main difference will be availability of an official map record that memorializes the City’s permit jurisdiction to minimize the potential for interagency disputes over permit authority.
Refer to Attachment A for the post certification map exhibits showing the locations being officially transferred to City permit authority and Attachment B for the corresponding City of Del Mar Zoning Map exhibit. The official post certification map record reflecting transfer of permit jurisdiction from the CCC to the City in 2001 will apply to a total of 161 lots and 17 public rights-of-way as follows:
North Beach Residential Neighborhood and adjacent Public Right-of-Way locations • RM-East zone (Medium-Density Mixed Residential): Zone allows single dwelling and duplex development on lots 5,000 square feet or more. The map action would transfer 103 lots and 12 adjacent public rights-of-way (Court Street, multiple segments of Camino del Mar, and segments of 21st Street through 29th Street) to City permit jurisdiction (local permit decisions appealable to CCC). All lots are developed with existing residential dwelling units.
• Public Facilities zone City-owned property at 28th Street (APN 299-030-12-00): The property is located in the existing developed North Beach neighborhood and is a previously developed site that is designated and zoned “public facilities” in the Del Mar Community Plan (General Plan) Land Use Element and is designated in the City’s certified Housing Element for development of up to three small dwelling units for lower income households. Would transfer lot to City permit jurisdiction (local permit decisions appealable to CCC).

City Council Agenda Report
Pending CCC Approval of LCP Post Certification Maps
December 1, 2025
• Public Parkland zone City-owned 21st Street Tennis Court (APN 299-133-01-00): The property is located in the existing developed North Beach neighborhood and is developed with public recreational facilities and a pump station that is maintained by the City. Would transfer lot to City permit jurisdiction (local permit decisions appealable to CCC). • R1-10B zone (Low Density Residential-Beach): Zone allows single dwelling development on lots 10,000 square feet or more. The map action would transfer 11 lots to City permit jurisdiction (local permit decisions appealable to CCC). All lots are developed with existing residential dwelling units. Note the Camino del Mar Bridge that crosses the San Dieguito Lagoon did not meet the criteria for a transfer of permit jurisdiction and will remain in the CCC’s permit jurisdiction.
• RM-West zone (Medium-Density Mixed Residential): Zone allows single dwelling and duplex development on lots 5,000 square feet or more. The map action would transfer 40 lots and 4 adjacent public rights-of-way segments of Camino del Mar, Sand Barr Lane, 20th Street, and Santa Fe Avenue) to City permit jurisdiction (local permit decisions appealable to CCC).
North Commercial and adjacent Public Right-of-Way locations • North Commercial (NC) zone: Zone allows commercial and light industrial uses, and one dwelling unit accessory to commercial development as well as multi dwelling unit development with an affordable housing component on parcels south of San Dieguito Drive. The map action would transfer 5 lots to City permit jurisdiction (local permit decisions appealable to CCC) and all five properties are currently developed with commercial development.
This includes the northwesterly portions of sites along Jimmy Durante Boulevard that are identified as potential housing sites within the City’s certified 6th Cycle Housing Element as well as the Viewpoint Brewing Company lot and adjacent developed lot on San Dieguito Drive. Note the NCTD-owned parking lot and undeveloped parcels located north of San Dieguito Drive and adjacent to the Lagoon did not meet the criteria for a transfer of permit jurisdiction and will remain in the CCC’s permit jurisdiction. • Jimmy Durante Boulevard public right-of-way (excluding bridge): This location includes a transfer of the segment north of the bridge that connects to Via de la Valle.
Note the Jimmy Durante bridge that crosses San Dieguito Lagoon did not meet the criteria for a transfer of permit jurisdiction and will remain in the CCC’s permit jurisdiction.
While these developed locations are mapped “historic tidelands” where the Coastal Commission typically retains permitting authority; these locations are already developed with existing uses (or were previously graded and developed) and are located within developed neighborhoods that are designated for urban use and are therefore, consistent with the Coastal Act, are eligible for transfer to the local jurisdiction’s permit authority. This was confirmed in a letter determination made by the State Lands Commission on January 24, 2025, which confirmed these areas meet the criteria for transfer under Public Resources Code Section 30613. 3 December 1, 2025 Item 8
City Council Agenda Report
Pending CCC Approval of LCP Post Certification Maps
December 1, 2025
Benefits of the map update in process with the CCC include:
• Ability for Del Mar to maintain local control over permit issuance in specified areas. • Consistency with the existing permit process that has been utilized by CCC staff and the City of Del Mar since LCP certification in 2001, which has primarily involved City CDP permit decisions with relatively few appeals filed with CCC and a relatively small number of CDPs issued directly by CCC as applicable to development along the shoreline. • Greater certainty regarding permit and appeal jurisdictional boundaries on the new maps in place of older paper maps that lack precision and, in some circumstances, required follow up research and discussions with CCC staff to determine the applicable boundaries. • Replacement of older static maps with more precise maps using Geographic Information System (GIS) data that provides a more spatially accurate representation of jurisdictional boundaries.
• Clarification of applicability for parcels bisected by the appeals jurisdiction (i.e., the five parcels in NC zone being transferred to City jurisdiction) that proposed development located outside of the appeals boundary is generally not appealable to CCC. As proposed, this scenario will continue to apply during implementation of the proposed post certification map. Through the map action in process, property owners with bisected parcels can request to have the map adjusted to identify their entire parcel as within CCC permit appeal jurisdiction (thereby transferring greater permit authority to CCC), but are not allowed to make any adjustment to further remove the parcel from CCC permit or appeal authority because that boundary is set geographically along the shoreline, without consideration of property line boundaries, pursuant to the California Coastal Act law. • Transition to an official post certification map record is expected to occur seamlessly for the respective agencies, property owners, and general public. The City’s certified LCP already identifies the permit procedures for proposed development that is subject to CCC or City permit authority and no areas of potential controversy have been identified.
Essentially, the parcels previously mapped as CCC permit jurisdiction that are being transferred to City permit jurisdiction would continue to be subject to City permit decisions and appealable to CCC consistent with the existing procedure since 2001. As noted above, the geographic location of the appeals boundary along the shoreline where permits may be appealed to CCC did not change.
• The maps will take effect immediately upon CCC action to approve the maps.
