Effective Dates:

The policy is effective immediately upon adoption, and the paid leave benefits provided herein shall be retroactive to January 1, 2022.

SPSL benefits expire after September 30, 2022, except that the City of Delano will provide a Covered Employee who is on SPSL at the time of the expiration of such benefits the full amount of SPSL to which the Covered Employee would otherwise be entitled.

Unless the underlying law is extended, this policy will expire by operation of the law after September 30, 2022, except that certain Covered Employees may continue to use SPSL after that date as described above.

Employees Eligible for SPSL:

All City of Delano Covered Employees are eligible for SPSL if they are unable to work or telework for one or more of the enumerated reasons related to COVID-19 as provided below.

Qualifying Reasons for SPSL:

A Covered Employee qualifies for SPSL if they are unable to work or telework for one or more of the following reasons:
1) The employee is subject to a quarantine or isolation period related to COVID-19 as defined by an order or guidelines of the California Department of Public Health (“CDPH”), the federal Centers for Disease Control and Prevention (“CDC”), or a local health officer who has jurisdiction over the workplace; 2) The employee has been advised by a health care provider to self-quarantine due to COVID-19;
3) The covered employee is attending an appointment for themselves or a family member to receive a vaccine or a vaccine booster for protection against COVID-19 (May take only up to three (3) days under this qualifying reason unless employee provides verification from a health care provider);
4) The covered employee is experiencing symptoms, or caring for a family member experiencing symptoms, related to a COVID-19 vaccine or vaccine booster that prevent the employee from being able to work or telework (May take only up to three (3) days under this qualifying reason unless employee provides verification from a health care provider that employee or family member was continuing to experience symptoms related to the COVID-19 vaccine or vaccine booster past the three days); 5) The covered employee is experiencing symptoms of COVID-19 and seeking a medical diagnosis;
6) The covered employee is caring for a family member who:
a) Is subject to a CDPH, CDC, or local health officer order or guidance to isolate or quarantine, or
b) Has been advised by a health care provider to isolate or quarantine; 7) The covered employee is caring for a child whose school or place of care is closed or otherwise unavailable for reasons related to COVID-19 on the premises; or 8) The covered employee, or a family member for whom the covered employee is providing care, tests positive for COVID-19.

If an employee requests SPSL for reason 8, the City of Delano may require that the employee provide the positive test result to confirm that the employee qualifies for such leave. The City of Delano may also require that the employee provide the family member’s positive test result if the employee is requesting leave in order to provide care to a covered family member. The City may not accept self-administered and self-read test results.

The City of Delano is not obligated to pay SPSL if employee fails to provide documentation of the positive test results pursuant to Labor Code 248.6 subdivision (b)(2)(D)(iv).

The City of Delano may also require an employee who has taken SPSL for qualifying reason 8 to test for COVID-19 on or after day five, following the initial positive test. If the City of Delano requires such a test, the City of Delano will provide the test at no cost to the employee.

Amount of SPSL for Qualifying Reasons 1 - 7:

1. Leave taken as SPSL is in addition to any other statutory and/or contractual leave to which the employee is otherwise entitled, and which is not specific to COVID-19.

2. Employees who worked at least 40 hours per week in the two weeks before they take SPSL, or who the employer considers to be full-time employees, are entitled to 40 hours of SPSL for qualifying reasons 1 through 7, above.

3. Part-time Covered Employees are entitled to SPSL in the following amounts:
a. If the part-time Covered Employee has a normal weekly schedule, the total number of hours the Covered Employee is normally scheduled to work for the City of Delano over one week for qualifying reasons 1 through 7; or b. If the part-time Covered Employee works a variable number of hours, the Covered Employee is entitled to 7 times the average number of hours the Covered Employee worked each day for the City of Delano in the six (6) months preceding the date the Covered Employee took SPSL. If the employee has worked for the City of Delano fewer than six months, then the employer calculates the average hours worked for the entire employment period and multiplies the daily average by seven. If an employee works variable hours and has only worked for the City of Delano seven days or fewer, then the employee receives an amount of SPSL equivalent to the total number of hours worked for the employer.

Amount of SPSL for Qualifying Reason 8:

Employees taking additional COVID-19 supplemental paid sick leave under qualifying reason 8 are entitled to an amount not to exceed that which the employee received under qualifying reasons 1-7.

Covered Employees may determine how many hours of SPSL to use based upon a qualifying reason, up to the total number of hours to which the Covered Employee is entitled.

If a Covered Employee is provided SPSL retroactively for qualifying leave before adoption of this policy, the City of Delano will count the retroactive SPSL provided against the SPSL to which the Covered Employee is entitled.

For Covered Employees that request retroactive SPSL, the City of Delano will request that the employee sign a “COVID-19 Supplemental Paid Sick Leave Acknowledgment,” acknowledging the accuracy of the amount of leave designated retroactively.

Compensation While on SPSL:

Covered Employees are entitled to compensation for SPSL at their regular rate of pay or the employee’s total wages less any overtime premium pay, including pursuant to any applicable collective bargaining agreement, subject to a cap of $511 per day and $5,110 in the aggregate.

Employee Notice of Supplemental Paid Sick Leave:

Covered Employees must notify the City of Delano that they intend to take SPSL. The Covered Employee may provide such notice either orally or in writing to City of Delano’s Human Resources Department.

Employee Status While on Leave:

The City of Delano will compensate Covered Employees who use SPSL according to the manner described in this policy and will otherwise treat Covered Employees who use COVID-19 Supplemental Paid Sick as if they are using paid sick leave according to the City of Delano’s Rules and Regulations Sick Leave Policy.

Employee Obligations for Requesting Retroactive Payments for Prior Leave that Qualified as SPSL:

Employees are entitled to SPSL retroactive to January 1, 2022.

If the City of Delano did not compensate the employee for leave that would otherwise have qualified as SPSL between January 1, 2022 and the effective date of this policy, in an amount equal to or greater to what the employee would have been entitled to under this policy, the employee is eligible for a retroactive payment from the City of Delano for such leave.

In order to receive payment for such leave, employees must make an oral or written request to be paid for such leave to the City of Delano’s Human Resources Department.

For any such retroactive payment, the number of hours of leave corresponding to the amount of the retroactive payment shall count towards the total number of hours of SPSL that the employer is required to provide to the Covered Employee.

Adopt a resolution of the City Council of the City of Delano declaring there are unmet transit needs within the City of Delano which are reasonable to meet.

Discussion
As a requirement to receive State Transportation Development Act (TDA) Funds, the receiving agency must annually hold a public hearing review of its transit program to determine if the needs of individuals or groups are being met. The funding sources for TDA are from two sources, the Local Transportation Fund (LTF) and the State Transit Assistance (STA).

On March 7, 2022, staff of the City of Delano Transit (DART) held a public hearing to receive input from the public regarding unmet transit needs. Prior to this, staff developed fliers in both Spanish and English and posted them on the transit buses, transit center, Bakersfield Californian, and City Hall Building.

During the Public Hearing, the following comments were received:
• Resume Saturday Service
These comments were evaluated and staff has determined that at this time there is an Unmet Transit Need. Staff will be resuming Saturday Service on April 23, 2022. Staff has hired a part-time Bus Driver and Dispatcher, and they are in training to meet the proposed date.

Budget Impact

Staff recommends to award Long Range Transit Plan to Moore & Associates’ and authorize the City Manager to execute all necessary agreements.

Discussion
As a recipient of federal transportation funding, the City of Delano is required to prepare a Transit Development Plan on a five-year cycle. The City’s prior transit planning report was completed in mid-2017. Historically, the City has approached this requirement through a combined Short- and Long-Range Transit Plan incorporating a planning horizon of ten years.

The proposed Plan would address five objectives: 1) present an objective analysis of recent DART performance, 2) identify practical strategies to ensure DART addresses the community’s mobility needs in a post-pandemic world, 3) present recommendations supporting compliance with the State of California’s Innovative Clean Transit (ICT) regulations mandating transition to a 100-percent “zero emissions” transit fleet, 4) include recommendations supporting DART’s continued compliance with federal Title VI and the Americans with Disabilities Act (ADA), and 5) present recommendations supporting the City’s proposed development of a dedicated Transit Operations and Maintenance Facility.

Staff recommends selection of Moore & Associates Inc. as the consultant for this project.

Based in California, Moore & Associates’ sole focus is public transit. Since 1991 the firm has successfully assisted more than 250 communities throughout the West with a wide array of transit service evaluation and planning projects including prior assignments with the City of Delano and the Kern Council of Governments.

Attached herein is Moore & Associates’ proposed Scope of Work which was prepared through discussions with City and COG staff. Moore & Associates anticipates a project completion timeframe of approximately six months. The fee to complete the proposed Work Plan presented herein is $49,850 which is nearly identical to the fee which the City paid for its 2017 Long-Range Transit Plan. The Transit Department has sufficient funding to cover the proposed project fee.

Selection of Moore & Associates to prepare the City’s 2022 Long Range Transit Plan would benefit the Delano community in a number of ways including 1) continued eligibility for federal transportation funding, 2) provide professional guidance especially with respect to a post-pandemic Operating Plan, and 3) support the City’s required transition to a zeroemissions transit fleet.

Budget impact
Delano will pay the consultant as per the proposal and add an additional $50,000 to the Professional/Technical Account 75-5524-350

Subject: City of Delano Long-Range Transit Plan
Dear Viviana,
Thank you for the opportunity to present our firm’s proposal to prepare a Long-Range Transit Plan on behalf of the City of Delano. The City’s prior LRTP was completed in mid-2017, and transit planning studies of this type typically have a “useful life” of five years.

By way of introduction, Moore & Associates, Inc. is a public transportation-focused consulting firm based in California. Founded in 1991, the firm’s core competencies include transit service evaluation and planning, performance audits, transit capital and infrastructure planning, and marketing and public communications. Collectively, our Associate Team has assisted nearly 300 publicly funded transportation organizations throughout California and the West, including every transit operator in both Kern and Tulare counties.

In preparing Short- and Long-Range Transit Plans, many consultants employ a “cookie cutter” approach. And while Moore & Associates’ anticipated project report would feature many of the typical “building blocks,” we are committed to providing Delano with greater value: 1) a “reimagining” of the City’s public transit program given the impacts of the COVID-19 pandemic, 2) inclusion of recommendations supporting compliance with the State’s Innovative Clean Transit (ICT) regulations mandating transition to a 100-percent zero-emissions transit fleet, 3) report content supporting continued compliance with Title VI and the Americans with Disabilities Act (ADA), and 4) report content supporting the City’s proposed development of a dedicated Transit Operations and Maintenance Facility.

As the City’s potential project partner, we view the proposed LRTP as much more than simply a recurring service evaluation and planning exercise. Rather, we see this project as 1) an opportunity to “reimagine” public transit in and around Delano within the context of the post- City of Delano 2
pandemic world, and 2) an opportunity to assist the City and its project partners with crafting an innovative cost-effective service development strategy. Simply put, the pandemic has changed the mobility needs and priorities of Californians, now and into the future. And public transit providers such as DART must also adapt in order to remain relevant.

Moore & Associates’ anticipated approach to this project can best be summed up in three words:
practical, cost-effective, and sustainable. Rather than raising unreasonable expectations with a Plan which suggests significant increases in transit service, we pledge to work with the City and its project partners to identify innovative mobility solutions which can be realized within the confines of current (and near-term) transit funding. In doing so, Moore & Associates will help varied (and potentially competing) constituencies achieve consensus as to realistic future demand, service priorities, anticipated ROI, and industry “best practices” to support the identification of a preferred future service strategy – one which has the greatest appeal to the broadest spectrum of Delano residents at the lowest reasonable cost to the taxpayer.

We look forward to the opportunity to discuss our proposed project approach, credentials, and professional experience with you and your colleagues. Thank you for your consideration of Moore & Associates, Inc.

Sincerely,
Stephanie Roberts
City of Delano 3
Proposed Scope of Work
Moore & Associates’ proposed project methodology includes a combination of data and document review, on-site observations, transit customer and community engagement, and frequent interaction with City staff. Collectively this translates to a project approach which will effectively address the project goals identified in our cover letter.

Task 1: Project initiation and visioning
Task 1.1: Conduct project initiation meeting
Upon receipt of the City’s Notice to Proceed, our project team will facilitate a project initiation meeting with the City’s project manager and other project participants as identified by the City.

The purpose of the meeting is to achieve consensus regarding project objectives, key deliverables, sequencing of individual project tasks/activities, and public engagement tactics and logistics.

All in-person project activities will be conducted in compliance with CDC guidelines related to COVID-19 protocols in effect at the time.

Task 1.2: Conduct tour of the project area
Following the project initiation meeting our project team will complete a “familiarization tour” of the city and the DART service area to be hosted by City staff. While our proposed project team possesses familiarity with the city and its transit program, the proposed tour will ensure we are up-to-date regarding current conditions, key activity centers, and new and emerging residential and commercial developments. The tour will also include a visit to the site of the proposed Transit Operations and Maintenance Facility.

Subsequent to the project initiation meeting, Moore & Associates will provide a summary of the meeting discussion, summary of the familiarization tour, and a list of “next step” action items.

Task 1.3: Visioning workshop
As discussed in our cover letter, the COVID-19 pandemic has significantly changed how Californians work, their transportation needs, and their mobility priorities. Recent experience gained through completion of similar projects in other California communities has revealed the popularity of traditional “large bus” public transit services has waned considerably; while desire for flexible, more personalized forms of on-demand transport has increased. One recent example is the “refocusing” of the City of Visalia’s public transit program so as to increase service City of Delano 4
frequency on a handful of key routes/arterials; and to supplement such “trunk lines” with a series of on-demand (small vehicle) feeders.

We propose conducting at least three community workshops with City staff, community stakeholders, and the general public. Each session will invite participants to complete a short survey, provide first-hand feedback regarding transit needs and preferences, and to learn more about the project. We also recommend offering a “virtual” workshop option for Delano residents who either may not be able to attend a traditional workshop or who still may be hesitant to attend in-person activities.

Task 2: Update Transit’s goals, objectives, and performance standards.

Similar to nearly every public transit provider in California, DART has experienced significant declines in annual ridership as well as fare revenue. Further, given the ongoing impacts of the pandemic, Moore & Associates does not predict transit ridership in California will return to prepandemic levels for many years to come. As stated earlier, how people work, attend school, shop, etc. has changed significantly along with their mobility needs.

Therefore, Moore & Associates will work with City staff to identify a slate of realistic goals, objectives, and performance standards to guide the City’s transit program across (at least) the next five years.

The deliverable for this task will be a Technical Memo presenting a slate of potential evaluation criteria along with discussion of the latest industry “best practices.” Task 3: Conduct service evaluation
Task 3.1: Rider and community engagement
The City operates both a fixed-route transit and a paratransit program, the customers for which generally fall into two distinct groups. Therefore, our proposed methodology for engaging each customer type differs. In addition to its utility to the LRTP, the survey data can also be used to support the City’s future Title VI reporting.

We recommend conducting a bilingual survey of registered dial-a-ride customers who used the service within the past year. This would include a direct mail distribution of at least 250 surveys.

The survey will be printed using a larger font and will be accompanied by a postage-paid envelope to facilitate the completed survey’s return. All respondents will be entered into a random drawing for a modest participation incentive.

City of Delano 5
With respect to surveying customers of the City’s fixed-route service, we recommend a twopronged approach: 1) a physical (printed) survey to be distributed onboard the vehicles as well as at the City’s Transit Center and 2) a parallel online version. All survey materials will be available in both Spanish and English. This survey will be promoted via a combination of onboard notices as well as social media messaging. All respondents will be entered into a random drawing for a modest participation incentive.

Finally, we propose to conduct a bilingual survey of Delano households intended to identify current transportation needs, priorities, and preferences as to service delivery approach. A bilingual postcard promoting an online survey will be mailed to at least 1,000 Delano households.

All respondents will be entered into a random drawing for a modest participation incentive..

Task 3.2: Evaluation of service performance
Our project team will utilize a combination of data review and direct observation to prepare a comprehensive assessment of current transit program performance. We will work with City staff to obtain performance data from monthly performance reports, driver daily logs, the farebox, etc. This analysis will include riders, on-time performance, load, and wait-time (for dial-a-ride).

Individual route performance will be assessed where available. We will also consider individual service day and day-part where appropriate.

The deliverable for this task will be a Technical Memo summarizing the survey results and the consultant’s findings specific to the current service offerings.

Task 4: Needs Assessment and Service Options
Moore & Associates will approach preparation of the proposed needs assessment from two perspectives. First, the identification of needs expressed by Delano residents, project stakeholders, and City staff; identified through direct observations by our project team; revealed through an analysis of service/system performance; or documented via the City’s most recent “Unmet Transit Needs” process.

The second component will be an analysis of latent (transportation) need based on community demographics, and mobility needs forecasting (e.g., aging in place). Historically, ride-dependent individuals have included seniors, youth, persons with disabilities, and low-income individuals.

Changes in demographics specific to these population segments can offer insight into future mobility and transit needs. Our analysis will also consider current and planned land uses to identify future commercial and residential developments likely to need/desire transit service.

The Needs Assessment will be provided as a Technical Memo, and ultimately incorporated into the project report.

City of Delano 6
Task 5: Operations Plan
Using the Needs Assessment as guidance, Moore & Associates will prepare a matrix of service development opportunities for discussion with City staff. Our typical approach is to present recommendations as a menu of scenarios, given administrative or policy-related recommendations may be relevant regardless of changes to the service itself. All recommendations will identify the catalyst for the recommendation; be it community input, support for a system goal or objective, an observed operational deficiency, etc. Cost estimates will be calculated for each preliminary recommendations as well as anticipated benefits.

Preparation of the Operations Plan will include recommendations specific to the City’s anticipated ICT compliance (i.e., transition to ZEV fleet). Further, the consultant will include recommendations to support the City’s future ADA Paratransit reporting.

Recommendations in the Operations Plan will be prioritized based on factors such as lead-time needed for implementation, complexity, cost, and availability of funding. The Operations Plan will be detailed in a Technical Memo.

Task 6: Financial and Capital Plans
This task begins with preparation of a status quo (baseline) Financial Plan. Doing so will enable our project team to effectively quantify the cost impacts of each recommendation as well as offer alternative scenarios as warranted. The Financial Plan will also consider current, potential, and likely funding sources as well as constraints and requirements associated with specific funding.

The Capital Plan will identify and evaluate those capital expenditures necessary to support both the status quo as well as the slate of potential service scenarios across a ten-year horizon. Each capital cost will identify the year of implementation as well as most-likely funding source(s).

Recommendations specific to service expansion will include forecasts regarding ridership, fare revenue, improved access to employment/schools/healthcare, and “greenhouse gas” reduction.

The Financial and Capital Plans will be presented in a Technical Memo, which will ultimately be incorporated into the project report.

Task 7: Project report
The draft LRTP will incorporate interim deliverable developed throughout the course of the preceding tasks into a single cohesive document. The project report will include the following elements:

City of Delano 7

1. Executive Summary,

2. Goals, objectives, standards,

3. Service evaluation,

4. Community engagement,

5. Needs Assessment,

6. Operations Plan,

7. Financial and Capital Plans, and

8. Appendix.

Following completion of the draft project report, and after an appropriate City staff review period, we recommend facilitating a discussion with City staff. This approach typically results in a streamlined finalization of the project report. A presentation of the final draft project report to the Delano city council is included.

Fee proposal
Our fee to complete the work plan presented herein is $49,850. We anticipate a project completion time frame of six months following contract execution.

This proposal serves as an agreement for the above scope of services. This proposal is subject to the Service Agreement between Moore & Associates and City of Delano. It will assume the terms and conditions as set forth executed contract. If accepted, please have an authorize official to sign and return. Upon receipt of accepted quote,Moore & Associates, will authorize the above described product and/or services to be delivered to the City of Delano. ____________________________ ______________________

STAFF REPORT
March 21, 2022
Agenda Item: 9
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Roman Dowling, PE, Public Works Director/City Engineer SUBJECT: Resolution of the City Council of the City of Delano approving the application for grant funds for the California Natural Resources Agency Urban Greening Program
Recommendation:

Approval of Resolution of the City Council of the City of Delano approving the application for grant funds for the California Natural Resources Agency Urban Greening Program.

Discussion:

The City of Delano purchased the church property across the street from City Hall in 2021, which included the entire block frontage on the south side of 11th Avenue, and this now provides an opportunity to install beautification improvements to include landscape, trees, and a parking lot.

The understanding for this project involves the closing of 11th Avenue and merging both City properties on either side of the street into one campus, for a better and more orderly future development of the City’s facility.

This project has been and will continue to be discussed in the General Plan draft workshop discussions.

Fiscal Impact:

Possible grant funding for the project if awarded.

SUBJECT: Discussion and consideration of eliminating yard sale fees for the issuance of yard sale permits. (Alindajao)
Discussion
On the February 22, 2022 city council meeting, council member Alindajao requested for the city council to discuss and provide direction to staff for consideration of eliminating yard sale fees for the issuance of yard sale permits. The city of Delano’s ordinance that regulates garage sales in residential zoning districts within the city is chapter 6.22. Per section 6.22.040 garage sale fees are $15.00 per yard sale permit.

Budget impact
Pre-pandemic fiscal years the city was issuing approximately 1,015-yard sale permits that brought in $15,225 yard sale fees to the general fund. During the pandemic years, the city noticed a decrease in yard sale permits ranging from 771 to 523 which amount to $11,565 to $7,845 in yard sale fees collected, respectively.
