He also thanks Mr. Chavez for his time as City Clerk and welcomed the new City Clerk.
Council Member Morris: She thanked fellow council members and everyone that participated in the Read Across America event. She said it was a great event for the schools and that all the children were very excited to have someone read to them in the classroom. She said it takes a lot of time and effort to be able to attend and that it is amazing how fun it is to read to kids.
She thanked Mr. Chavez for all the help he gave her every time she would go into City Hall and also said she had already met the new City Clerk and already warned her that she will be calling her for help and welcomed the new City Clerk.
Council Member Vasquez: She thanked City Clerk Ricardo Chavez and welcomed the new City Clerk.
Mayor Pro Tem Solorio-Ruiz: He second Council Member Morris appreciation for Reading Across America and the crowd of kids now are not like before and that council meetings are easier. He said that overall, it was meaningful for the children and saw many photos on social media of various individuals that also participated. He also mentioned that he attended the San Joaquin Valley Air monitoring meeting and gave a shout out to Sumeet for assisting coordination for him to attend. He said that he is also working with city staff and City Manager on upcoming events. He mentioned that on April 23rd he will possibly host “Day of Remembrance” for Cesar Chavez 30th anniversary of his passing. He said that the City of Delano is the hometown and birthplace of the farm labor worker movement and believes it is appropriate for the event. He hopes to see everyone there and as soon as the flyers are developed, they will be posted and shared. He also mentioned that on March 25th the Dog Adoption Fair will be hosted at the Delano Animal Shelter. He said it is going to be a huge event because currently the Delano shelter, as well as many other shelters across the county, are overcrowded. Meaning that dogs cannot be accepted and hoping for a good turnout. He invited everyone to visit the shelter and adopt a dog. He said that he will be having future discussions with community leaders to possibly coordinate and establish a circle group where they heal and talk about help for tough issues and invited anyone that is interested to let him know. He also addressed the comment given by Mr. Bravo and has a solution because it did come up during his day job. He believes that the Delano Police Department, per request, can go in and possibly conduct a type of protocol scenario to show them what to do in case of an emergency.
He said he that is not directing staff but it is a possible solution.
Mr. Solorio Ruiz also responded to Mayor Alindajao invitation to say a few words to Mr. Chavez in his last council meeting as City Clerk. He said he felt emotional that Mr. Chavez was moving but that he would still be with the city. He shared that he feels that Mr. Chavez has always been there and has always been a good mentor for council members because he feels that he has the capacity, having been a council member himself and that is phenomenal the way he gives feedback. He also welcomed the new City Clerk Diana Garcia and congratulated them both.
Mayor Alindajao: He did not have any additional comments other than directed City Attorney Rachel Richman to place for discussion and approval to adopt the Rosenberg Rules of Order for the second city council meeting in April. He believes no rules have been adopted on how meetings are ordered in the code section. He also informed everyone that it was Mr. Ricardo Chavez last council meeting as City Clerk and wished him well in his new position and expressed his appreciation of the growing friendship that has grown between him and Mr.
Chavez and welcomed the new Delano City Clerk, Mrs. Diana Garcia.

Adopt a resolution of the City Council of the City of Delano declaring there are no unmet transit needs within the City of Delano
Recommendation
Adopt resolution of the City Council of the City of Delano declaring there are no unmet transit needs within the City of Delano.
Discussion
As a requirement to receive State Transportation Development Act (TDA) Funds, the receiving agency must annually hold a public hearing review of its transit program to determine if the needs of individuals or groups are being met. The funding sources for TDA are from two sources, the Local Transportation Fund (LTF) and the State Transit Assistance (STA).
On March 6, 2023, staff of the City of Delano Transit (DART) held a public hearing to receive input from the public regarding unmet transit needs. Prior to this, staff developed fliers in both Spanish and English and posted them on the transit buses, transit station, Bakersfield Californian, and City Hall Building.
During the Public Hearing, the following comments were received:
• Add a bench to the existing stop on 23rd and Princeton St.
These comments were evaluated, and staff has determined that at this time there are no Unmet Transit Needs. Although replacing or adding a bus shelter to all stops is not considered a transit need, staff has reviewed the ridership and this particular stop has minimal boardings and deboardings.
Budget Impact
None.

Staff recommends that the City Council of the City of Delano adopt the attached resolution authorizing the City Manager/designee to enter into a purchase agreement with Dell Technologies for the Delano police department's computer equipment.
Discussion
The City of Delano’s IT department maintains approximately 47 computers for the Delano police department. Staff has found that approximately every three years computers are evolving therefore equipment must be updated to meet the demands of a challenging workplace. On April 2, 2019 the city council approved to purchase computer equipment for the department. The computer equipment at the Delano police department is in need of replacement therefore, staff recommends entering into a purchase agreement with Dell to replace aging equipment because it spreads capital costs and allows us to maintain up-to date computer equipment.
Budget Impact
The cost of the proposed equipment is $51,119.47; staff is requesting an appropriation be made in the computer information systems fund for this equipment.

STAFF REPORT
March 20, 2023
Agenda Item: 10
TO: Honorable Mayor Alindajao and Members of the City Council FROM: Maribel Reyna, City Manager
By: Rachel Richman, City Attorney
SUBJECT: Discussion and Direction on a Draft Rent Stabilization Ordinance of the City of Delano
RECOMMENDATION
Staff recommends that the City Council review and discuss the draft ordinance and provide further direction as it so determines
BACKGROUND
Assembly Bill 1482 (AB 1482), known as the Tenant Protection Act of 2019, established statewide rent control and eviction protections for a period of 10 years and was signed by the Governor on September 14, 2019. AB 1482 or the Tenant Protection Act of 2019, which went into effect January 1, 2020, limits rent increases that can be imposed by a property owner in an amount not greater than 5-percent plus CPI, or 10-percent per year, whichever is lower.
Enforcement of AB 1482 is primarily placed on the tenants to enforce in the courts. This Act applies across the State in jurisdictions that do not have their own rent control program. AB 1482 applies to multi-family rental units, except for the following major exemptions and must also comply with Costa Hawkins Rent Control Act:
• Units that have received Certificates of Occupancy after February 1, 1995. • Condominiums and single family homes, unless they are owned by a corporation or real estate investment trust.
• Duplexes where the owner lives in one of the units.
• Tenants who have lived in the unit for less than one year.1 Cities may adopt their own rent control ordinances and programs provided it does not violate the exemptions under Costa Hawkins the main one of which does not allow rent control on apartments that were built after February 1, 1995. This allows cities to impose 1 There are other minor exemptions mentioned in the Agenda Report to the Council on October 3, 2020 but that are very narrow and not likely to be implicated in the City, but would be laid out in any potential the ordinance to be consistent with state law
LA #4874-5715-2338 v1
07257-0001
amounts lower than what state law provides, although legal challenge may result if the amount does not allow for a fair return on investment as discussed in the Staff report of October 3, 2022.
At the City Council meeting of October 3, 2022, per the request of Mayor Osorio, the City Council had a brief discussion on rent control. At the conclusion of that discussion, direction was given to bring back more information on rent control and considerations and elements that could be a part of a rent control program.
On December 5, 2022, the City Council further discussed the possibility of a rent stabilization ordinance and directed staff to prepare a draft rent stabilization ordinance that is limited to 70-percent CPI or 3-percent cap per year, whichever is higher. No other direction was provided. The draft ordinance therefore is based on the City of Bell Gardens as a starting point for review and direction, therefore significantly more review, deliberation, outreach and direction are still required in order to ensure the ordinance is what the City Council and community desire.
DISCUSSION
Rent Stabilization Chapter 7.22
The purposes of this Chapter are to protect tenants from excessive rent increases and to promote long-term stability and certainty for tenants in the rental market while providing landlords an ability to receive a fair return on their rental property. Chapter 7.22 would place a cap on the annual rent increases for covered residential dwelling units within the City.
The Chapter would only apply to certain covered rental units consistent with State law.
This Chapter would also limit the frequency of increases to no more than one increase in any 12-month period and require that the landlord provide the tenant with 30-days written notice. The landlord must register all eligible units, comply with laws and may not "bank" unused portions of the maximum allowable increase to be imposed in future years. The landlord may set the initial rent for new tenancies pursuant to State law.
Additional rent adjustments would be allowed if the landlord is charging rent that is less than 80 percent of "fair market rents" for a “comparable unit.” Subject to approval by the Panel established by the City Council, or Department, rent may increase by an additional 3-percent (until the 80 percent of FMR threshold is reached). Fair Market Rents would be determined based on The U.S. Department of Housing and Urban Development's most recently published Small Area Fair Market Rents calculated for the City of Delano Zip Code.
Landlords would be permitted to pass-through up to 50-percent of eligible capital improvement costs to the tenants. Capital improvements must be for the primary benefit of the tenants, amortized over a useful life of at least 5 years, and permanently fixed. This includes substantial remodel and excludes repair & maintenance from normal wear or due LA #4874-5715-2338 v1
07257-0001
to landlord's failure to upkeep. Approved increases must not exceed 5-percent of rent or be imposed more than 60 months (may allow extended amortization period to allow costrecovery). The landlord must provide written notice to tenants prior to the commencement of any approved capital improvement pass-through charge.
The Chapter also establishes a landlord fair return petition process allowing landlords to apply to the Panel established by the City Council, or the Community Development Department to request an additional rent increase. There is a rebuttable presumption that annual net operating income plus allowable increases provides a fair and reasonable return, and no approved increases may exceed 10-percent. The landlord must provide written notice to tenants prior to charging an approved increase.
The Chapter would require the establishment of a rental registry. Commencing in 2023, a landlord must register rental units and pay a fee annually as established by City Council resolution (of which 50-percent may be passed through to the tenants). Provisions of this Chapter pertaining to a rental registry are proposed to take effect September 2023, allowing for an onboarding period to implement the new program.
The Chapter also includes provisions pertaining to security deposits, noticing requirements, administration, and enforcement.
Unlike the State's Tenant Protection Act, which is set to expire January 1, 2030, this Chapter does not include a sunset provision.
Budget Impact
Cost is an important consideration when designing a permanent rent stabilization program. Local stabilization control will require administration and enforcement.
Additional staffing, consulting fees and legal counsel will create costs, which will be dependent on the features of the program and direction given by Council. By way of example, the following cities with local rent stabilization programs have the stated annual budgets:
• Inglewood had an operating budget of $3.1 million for 2021/22; • West Hollywood had an operating budget of $2.4 million for 2017/18; and • Culver City had an operating budget of $2.3 million for 2021/22; • The City of Santa Ana adopted their Rent Stabilization and Just Cause Eviction Ordinances in 2022 and has expended $350,000 to perform a fee study in establishing fees toward the implementation and enforcement costs, as well as for their potential rent board and rental registry.
At this time, it is unknown what the rent stabilization protections program will cost the City of Delano to administer and enforce.
The proposed ordinance would allow for rental registration fees to recover costs. Such fees are intended to recover the City's reasonable costs to implement, administer and LA #4874-5715-2338 v1
07257-0001
enforce its rent stabilization regulations. However, such fees may not be charged until a fee study is conducted and the fee is established by resolution of City Council. All initial costs will be appropriated from the City's General Fund.
Revenue raised would depend on the number of registered rental units and the registration fee established once the fee study is complete and the fees are adopted. Other cities charge the following fees:
• Culver City $167/unit (approximately 7,991 rental units) • Inglewood $206/unit (approximately 24,485 rental units) • West Hollywood $144/unit (approximately 20,452 rental units) A fee study will be required to be performed by the City in order to determine the cost of administering, implementing and enforcing the new program and to establish a Rental Registry Fee. The fee study would be considered at a future City Council meeting.

7.22.040. Permitted Rent Increases for Covered Rental Units.
A. A Landlord shall not increase the Rent for a Covered Rental Unit by more than seventy percent (70%) of the change in CPI, or three percent (3%), whichever is lower. H. A Tenant of a Covered Rental Unit subject to this Section shall not enter into a sublease that results in a total Rent for the Rental Unit that exceeds the allowable Rent authorized by this Section. Nothing in this Section authorizes a Tenant to sublet or assign the Tenant's interest where otherwise prohibited
I. A Tenant may refuse to pay a Rent increase which is in violation of this Chapter. Such refusal to pay the unallowed increased amount in excess of permitted Rent charges shall be an affirmative defense in any action brought to recover possession of a Rental Unit or to collect the Rent increase owed.
7.22.050. Permitted Rent Increases for Below Fair Market Rent.
A. If the Landlord of a residential real property charges an existing Tenant Rent for a Covered Rental Unit that is less than 80% of Fair Market Rent for a Comparable Unit, upon approval of the Department, a Landlord may increase the Rent, in addition to the annual Rent increase allowed under Section 7.22.040, by an amount not to exceed three percent (3%) subject to the following:
1. The Department shall only approve adjustments to Rent increases under this subsection until the Rent equals or exceeds 80% of Fair Market Rent for a Comparable Unit.
2. The U.S. Department of Housing and Urban Development's Office of Policy Development and Research's (HUD PD&R) then most recently published Small Area Fair Market Rents (SAFMRs) calculated for the Delano Zip Code shall be used for determining Fair Market Rent. In the event HUD PD&R ceases publishing such Small Area Fair Market Rent, the City Council, by resolution, may identify an alternative source of Fair Market Rent.
LA #4868-4268-1928 v3
3. The Landlord files an application with the Department to request approval for a permitted below market rent increase in accordance with the Department's procedures and guidelines.
4. A Landlord may not increase the Rent under this Section until the Department approves the Landlord's application and the Landlord registers each affected Rental Unit pursuant to Section 7.22.090. Only one additional Rent increase may be approved in any 12-month period.
5. The Landlord shall provide Tenants with written notice of the Rent increase authorized by the Department.
6. Nothing in this Section shall be interpreted to authorize a Rent increase for a Covered Rental Unit in excess of the amount authorized pursuant to California Civil Code section 1947.12.
7.22.060. Capital Improvements Pass-Through Cost Recovery.
A. A Landlord may pass-through 50% of Capital Improvement costs to existing Tenants in Covered Rental Units in accordance with the provision of this Section.
B. Capital Improvements must be for the primary benefit, use and enjoyment of Tenants, cost-factored, and amortized over a useful life of at least five (5) years, and permanently fixed in place or relatively immobile and appropriate to the use of the rental property.
C. Capital Improvements eligible for pass-through cost recovery include, but are not limited to:
1. The addition, but not the replacement, of the following improvements to a Rental Unit or common areas of the building in which the Rental Unit is located: air conditioning, security gates and other security items, swimming pool, sauna or hot tub, fencing, children's play equipment permanently installed on the premises, and other similar improvements as determined by the Department.
2. Replacement or substantial modification of any structural, electrical, plumbing, or mechanical system that requires a permit pursuant to State or local law.
3. Abatement of hazardous materials, such as lead-based paint, mold or asbestos, in accordance with applicable federal, State, and local laws.
D. Capital Improvements cannot include regular maintenance or repairs from wear and tear, or be the result of a Landlord's failure to perform regular maintenance and repairs, or repairs covered by insurance.
E. Application Process.
LA #4868-4268-1928 v3
1. A Landlord must apply to the Department for recovery of Capital Improvement costs, on a form approved by the Department, within one hundred eighty (180) days of completion of the Capital Improvement.
2. The pass-through application must contain the following information, and be accompanied by copies of relevant supporting documentation:
a. A description of the completed Capital Improvement;
b. A copy of all estimates, contracts, bills, invoices, and other documentation reasonably necessary to establish the cost of the Capital Improvement; c. The proposed amortization period to be used based on the Department's procedures and guidelines, if the period differs from 60 months; d. A list of Tenants that will be affected by or benefit from the Capital Improvement;
e. The formula used to calculate the pro rata share of each Tenant; f. The monthly cost to each affected or benefiting Tenant; g. The commencement and completion dates of the Capital Improvement; and
h. Such other information as the Department may reasonably request.
3. Within five (5) calendar days after submission of the application with the Department, the Landlord shall serve each affected Tenant with notice of the application via personal service or certified mail return receipt requested. The notice must include a copy of the application.
4. Within ten (10) calendar days after submission of the application, the Landlord shall file with the Department a proof of service signed under penalty of perjury stating that a copy of the application was served upon the affected Tenant. Such proof of notice is required before the application will be reviewed by the Department.
F. Landlord may not pass-through costs of Capital Improvements to Tenants until the Department approves the Landlord's application and the Landlord registers each affected Rental Unit pursuant to Section 7.22.090.
G. No pass-through cost-recovery shall be approved in an amount that would exceed five percent (5%) of the Rent in effect at the time the pass-through application is filed with the Department. If the total amount of calculated pass-through costs would result in an increase that exceeds five percent (5%), the pass-through cost amortization period may be extended beyond the established amortization period to allow the Landlord to recover
LA #4868-4268-1928 v3
eligible Capital Improvement costs while not exceeding the maximum increase authorized by this subsection.
H. A Landlord shall provide written notice of an approved pass-through cost to Tenants in accordance with California Civil Code section 827 and the notice shall be delivered at least thirty (30) days before the approved pass-through cost takes effect.
I. The approved pass-through cost should appear as a separate line item on a Rent statement along with the end date of the amortization period and any remaining pass-through balance. An approved pass-through cost is not considered Rent for purposes of this Chapter.
J. Pass-through cost recovery applications will be considered and determined by the Director in accordance with guidelines and procedures established by the Department; and the Director's determination may be appealed to a Hearing Officer in accordance with the procedures set forth in Section 7.22.120.

A. Landlord’s Application for Rent Increase. A Landlord may file an application with the Department to request an increase in Rent for a Covered Rental Unit in excess of that which is permitted under Sections 5.52.040 and 7.22.050 to in good faith ensure a fair and reasonable return on the Landlord's investment.
1. Presumption. It shall be a rebuttable presumption that the annual net operating income earned by a Landlord, and Rent increases allowed under Sections
7.22.040 and 7.22.050, provide the Landlord with a fair and reasonable return on their investment. A Landlord shall have the burden to prove the necessity of any additional Rent increase necessary to earn a fair and reasonable return.
2. Nothing in this Section shall be interpreted to authorize a Rent increase for a Covered Rental Unit in excess of the amount authorized pursuant to California Civil Code section 1947.12.
3. Approval of the Landlord's application for Rent increase may become effective only after all of the following:
a. A Landlord has provided written notice to the Tenant of the approved Rent increase for the Covered Rental Unit in accordance with California Civil Code section 827; and
b. A Landlord has registered each Rental Unit in the rental property, and is current on payment of registration fees, pursuant to Section 7.22.090.

LA #4868-4268-1928 v3
i. The Department determines the Rent increase in the amount requested by Landlord is necessary and appropriate to ensure the Landlord receives a fair and reasonable return on the Landlord’s investment, and will not cause an undue financial burden on the affected Tenant.
ii. The Department determines a lesser Rent increase than the amount requested by Landlord more appropriately ensures a fair and reasonable return on the Landlord’s investment and will not cause an undue financial burden on the affected Tenant.
iii. The Department determines no additional Rent increase is necessary and appropriate to ensure the Landlord receives a fair and reasonable return on the Landlord’s investment.
c. Nothing in this Section shall be interpreted to authorize a Rent increase for a Covered Rental Unit in excess of the amount authorized pursuant to California Civil Code section 1947.12.

3. Decrease in Housing Services. A Tenant may file an application for adjustment with the Department for a Service Reduction in Housing Services, without a
LA #4868-4268-1928 v3
corresponding reduction in Rent, which may be considered an increase in excess of permitted Rent.
4. Prior to filing an application for adjustment with the Department, a Tenant shall provide the Landlord all of the following:
a. Written notice identifying the potential violation(s) of excess Rent, fees or charges, failure to maintain habitable premises and/or decrease in housing services; and
b. A reasonable opportunity for the Landlord to correct the issues.

6. Notice upon Filing Application for Adjustment. Within five (5) calendar days after submission of an application for adjustment with the Department, the Tenant shall provide written notice of said application to the Landlord via personal service or certified mail return receipt requested.
C. Application Submittal to Department for Rent Increase or Adjustment. Upon receipt of an application, the Department shall review and evaluate whether there should be a Rent increase or adjustment in accordance with this Section and the Department's procedures and guidelines.
LA #4868-4268-1928 v3
1. The application shall be on a form approved by the Department, signed under penalty of perjury, and must be accompanied by an application fee, if any, and must include the following:
a. The specific Rent increase or adjustment requested; and b. Copies of any books, records, papers, or other financial information relevant to the review of the application; and
c. Other documentation reasonably required by the Department relevant to the application.

Any increase in the security deposit shall be clearly stated in the written notice of the annual rent increase and shall not exceed the maximum amount authorized by State law.
B. As used in this Section, security deposit means any "security" as defined in California Civil Code section 1950.5.
7.22.090. Rental Unit Registration.

construction of small structures. The Ordinance, therefore, is categorically exempt from further CEQA review under CEQA Guidelines §§ 15301; 15303, 15304(e); 15305; and 15311. Further, the Ordinance is also exempt from review under CEQA pursuant to CEQA Guidelines § 15061(b)(3) because the Ordinance is for general policies and procedure-making. It can be seen with certainty that there is no possibility that the Ordinance may have a significant effect on the environment. Individual projects utilizing these regulations will each be separately subject to an environmental assessment.

SECTION 7. Reliance on Record. Each and every one of the findings and determinations in this Ordinance are based on the competent and substantial evidence, both oral and written, contained in the entire record relating to the project. The findings and determinations constitute the independent findings and determinations of the City Council in all respects and are fully and completely supported by substantial evidence in the record as a whole.
SECTION 8. Limitations. The City Council’s analysis and evaluation of the project is based on the best information currently available. It is inevitable that in evaluating a project that absolute and perfect knowledge of all possible aspects of the project will not exist. One of the major limitations on analysis of the project is the City Council’s lack of knowledge of future events. In all instances, best efforts have been made to form accurate assumptions. Somewhat related to this are limitations on the City’s ability to solve what are in effect regional, state, and National problems and issues. The City must work within the political framework within which it exists and with the limitations inherent in that framework.
SECTION 9. Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable.
