ITEMS FROM THE PUBLIC
1. Janet Tapia, Representative for Senator Melissa Hurtado, shared that she is here to serve the City of Delano on various issues during the pandemic.
2. Anthony Cortez stated he believes that the council consider themselves as justice warriors. He referenced the tragic death of George Floyd, there was a visual event outside of City Hall. I was told not to attend because of Black Lives Matter being there, but he chose to attend anyway. He was given a opportunity to speak and at his feet was an acronym “A.C.A.B.” which meant “All Cops are B_____” he added people could fill in the blank. He stated that was naïve at the time and didn’t know what it meant, but he believes that black lives matter, but is not supportive of the organization. He stated that he understands some of the Agenda Item No. 3
council members want to move up in politics, but he encourages them to remember to leave a legacy. He asked everyone to be transparent and simply admit to their mistakes.
3. Pastor David Vivas he shared that he appreciates the police officers being recognized and stated that he heard every word the mayor read in the proclamation. He shared about his son Adam tragic story and what he must live with every day. He stated about the event previously mentioned on May 31, there was a group of young adults which the mayor is friends with, had the acronym “All Cops are Bastards.” He emphasized that is not what Delano is about, so he kindly asked to denounce that statement.
4. Citlali Toscano shared her concern over their safety ever since Hall Ambulance has taken over as the sole provider for emergency service vehicles, there has been an increase in response times to emergency situations. She shared about a hit-and-run accident where a man’s leg was crushed the ambulance took about 15-20 minutes as the closest vehicle was assisting at another city, but if was not for the quick response for attending police officers this man could have bleed to death. She asked if there is anything that can be done to ratify the contract with Hall Ambulance where at least one ambulance must be stationed in Delano.
5. Lydia Rodriguez expanded on Pastor Vivas’ statement. She shared that Adam is her son. She has never known this town to be a racist city. She stated that her father referred to their home as an international home. She disagreed with the criticism of the police department.
6. Claribel Gutierrez stated that most of us are instigating to do our dirty work with these posses. She stated that the city is growing, and they need more ambulances. She added that all lives matter and she wish they fly the Puerto Rican flag for a month as well. She rehearsed the pledge of allegiance and emphasized that it is for “all.” She thanked the City Council for participating in the taco fiesta event in behalf of the Kiwanis.
7. Abraham Jimenez stated that he walked down Cecil Avenue from Cecil Park to Randolph, and it is a mess.
He stated that the trees at Delano High School are out of control. He thanked Chief Davis for his service and putting a street speed sign on Cecil Avenue.
8. Lupe Martinez – “First I want to thank Mayor for inviting us, myself and some of the other guardians to the day of prayer and I thought that was my first time and felt very good about it and I think that it was very moving in the first place. I just wanted to thank you for inviting us to be your guests. The other one is it's difficult sometimes to grasp everything. I heard the chief given thanks to everybody for support and also to the community for the relationships. And then I hear that we hate them and we do all this other stuff to the police because there is something that we've got to remember, or at least from my past, from being raised in Fremont Street and those areas there, the past has not been very bright or very much lit. It was dark, it was bad. I remember the times when we as kids wanted to come towards Cecil or come this way and there were some injustices committed by the police department. I know that there's a change in the police department, but those things are still there. Maybe some of us older folks who have already left are not here but their kids, their grandkids. I'm sure that they've been told the stories of what took place. It wasn't just the police department, it was also the sheriff's department. If you lived through the sixties and seventies, you know what I'm talking about. You were incarcerated, you were beat through Chavez. All those things have taken a toll and even further back, not just the but even further back. However, I do want to thank the chief we did meet with him. Thank you. And I think those conversations sometimes need to take place in order for us to start understanding each other. I certainly don't see what I used to see back in the sixties. It has changed, so I'm trying to stay positive at this point. I got a whole lot more, but I'll give it back.”
9. Bianca Mendez – “I do have something to add to what the gentleman was just saying. In particular with the specific person, staff member dispatcher, they're with the police department. Ongoing concerns that have been for over 20 years of living next door to this person that is supposed to represent the department and has gotten to an extreme where this person with their uniform and without their uniform has made physical threats, threats, I'm sorry, to physically harm. And also, just the code of conduct has been questionable for years. This person is supposed to represent the department. I feel like at this point moving forward with the new chief, we can hopefully figure out a solution to this problem. It is something that we have struggled with in our neighborhood for a couple of decades now with, I don't see any repercussions to this person and I am fully aware that there are other officers that are aware of this ongoing issue and other people in higher positions that have been aware of this ongoing issue, but it just has not been resolved. And at this point she is a trained officer. I'm concerned for my family's safety, and I would like to meet and have my family meet with Mr. Tyson.”
10. Veronica Soto – “I just wanted to remind everyone in case they were not aware that this Wednesday there is going to be a mental wellness resource fair happening at 4:30 to 6:30 PM at 375 Dover Parkway.
There's going to be lots of great people out there providing great information. They're going to be giving free haircuts, free health screenings. So if everybody can go ahead and share that information, that would be wonderful.”
11. Virginia Espino – “My comment is in regards to requesting to rent local centers in Delano because apparently these centers are supposed to be for the community. However, the Jefferson Center and the Civic Center, I've called before to book these events, but I'm being told that they are not available.
However, I'm seeing a lot of events being held at these facilities. These, from what I'm understanding, these facilities are for the community. If they're not available, then I need transparency and clarity in the website or just throughout the whole aspect as to how I can book this event. I just heard a council member saying that there would be an event in July, however am trying to book this event for a pride prom for youth members in Delano Fresno and local areas. I'm trying to provide a meaningful event for these youth.
However, I'm being told that I can't book the event, but I'm seeing other members book the event. So I need proper channel lines as to how I can book the event or a clarity as to no, you cannot book the event. I’m just asking for clarity on booking these community events because these events or these centers aren't for community members and community events, but I'm seeing you all have events, but I can't book the event.
These centers are for community members again and the community. I need transparency and clarity about getting this event.”
12. Yolanda Vega – “I was hoping that Delano Little League baseball field that the city owns could be back on the agenda soon. I do recall that there were monies put to that field and Little League had an ongoing lease and I believe they've reached out numerous times and they haven't received a response. I think the last time was about a year ago and they've been trying to get in contact with the city manager, so I'm not quite sure how that's gone about, but if we could get it back on the agenda, I'd greatly appreciate it.”

COUNCIL STATEMENTS AND REPORTS
Council Member Alindajao: “My understanding of the cemetery issue, the issues that are going on at the cemetery district have been one of jurisdiction. That's my understanding, doing some research, talking to county folks. I'd like to put that on the agenda for a discussion and vote. I guess we'll iron those things out with Ms. Richman between now and perhaps the second meeting in July, what those jurisdictional issues are. I understand that's the issue and it takes an ordinance change is my understanding. I'd like to put that for the second half of July for the second meeting in July, we have formed a Veteran's Day parade committee to host Delano's first-ever Veterans Day committee. I'd like to invite for discussion and vote a co-sponsorship with the city of Delano for the Veterans Day parade happening in November. Also, I'm not sure if this is right yet for a discussion, but this issue with Hall Ambulance, the issue that I believe it was a young lady that talked about Hall Ambulance with the gentleman in the car wreck on the day of the National Day of Prayer. I was contacted by a school board member for the high school district about another incident that occurred at RFK where you had a young lady who was on the soccer field unconscious. When they called the ambulance for medical, it wasn't going to be for another at least 30 minutes. The fire department had a response. we're seeing issue after issue after issue with Hall Ambulance. We've talked to them and I'm not sure what we need to do and that's why I'm sort of thinking out loud. I'm not sure if this is right for discussion in a vote yet, but perhaps we can not make this an agenda item yet. I'd like to discuss that further with the city manager and the city attorney in terms of what we can do in terms of an ordinance change legislation to have those kinds of important public services somehow get the city involved in authorizing or sanctioning those contracts. This is getting out of hand. I'm not sure anyone has been irreparably harmed by the lack of response times.” Council Member Morris: “I was going to give a report today on League of California Cities. We all belong, our community belongs to the California League of Cities as well as most all communities in our division. Our division runs anywhere from Tehachapi all the way to Madera. California League of Cities legislates for good things for cities and they legislate for things that are not good against our cities. I wanted to give that report and so I'm going to hold off on that until the next time we come, but hopefully we can put it up in front somewhere so we can, because people out there or the audience, they need to hear what we're legislating for and what we're working on and what California League of Cities is doing for them and our communities. So can we do that somewhere up front. I think that's all I have, and thank you for all of those that participated in the Taco Fiesta thing and helped us out, appreciated those that attended and helped us do good things for kids.” Council Member Solorio-Ruiz: Absent.
Mayor Pro Tem Vasquez: No comment.
Mayor Osorio: “I just wanted to say all the council attended the National Day of Prayer a couple of weeks ago and it was good to see the council at an event together, especially one that we helped co-host for. Today's just another example of the city co-hosting important events in Delano's periphery. I think I did want to echo the comments that Mr. Alindajao mentioned around the cemetery, I had brought that up before, but it's a bit difficult navigating the jurisdictional items in that because there's complaints that deal directly with the cemetery and then there's the complaints about public safety and that's where I would want to direct city's attention towards. I want to remind for American Red Cross on Saturday, if you can try to invite folks to be out there so they can get informed.”

ITEMS FROM THE PUBLIC
1. Pastor David Vivas: “This past Saturday, July 30th, our nation celebrated 66 years of our National Motto in which President Dwight Eisenhower signed into law “In God We Trust”. As a minister who certainly reveres God, and he is sure that most of the council members do believe in the true and the living God. God is not a fictional character he is a true and a real being and our dependance and reliance should be solely upon him. This is the reason why we have it here in our chamber, also at the entrances of City Hall. It is in him we trust. We can’t trust in government; we can’t trust in our economy. He is so thankful that we do have people that work in improving our economy, work in improving our government but all of us are human and we are subject to human failure. So, our reliance should be upon God if we truly believe in God with firm conviction. He wanted to state that because he attended an event on Saturday in Bakersfield, the annual “In God We Trust Event”. Judge Supreme Court Justice Roy Moore was the guest speaker. Delano was mentioned in that meeting. They recognized Delano as being the 3rd City in Kern County to put on in our chamber “In God We Trust” and now it has gone nationwide in various government chambers. That is our National Motto. He does have friends that are sceptics, atheists, and agnostics. They understand that we are not promoting a religion when we say ‘In God We Trust” because it is our National Motto, and it is law. He wanted to state that. Secondly, tomorrow, and is sure the Chief may emphasize this later, tomorrow is National Night Out. He believed that majority of the citizens of Delano truly appreciate the men and women in uniform that serve and protect the Delano Police Department. He sincerely appreciates all their efforts. If anybody ever has an issue with the police officer, they can always address that at the Community Law Enforcement Liaison meetings or go to the Delano Police Department because they have Agenda Item No. 4
internal affairs and they do investigate complaints against an officer. I truly appreciates the police department. National Night Out begins at 5:00pm tomorrow at Veneto Park by Wonderful Academy.”
2. Gina Martinez (Via Zoom): “I wanted to address a pamphlet that she received in the mail. I has been outreaching to many of the seniors that they can attend the Monday through Friday from 10:30am11:45pm availability of the meals. It was brought to my attention that it says on the flyer that a $3.00 suggestion for donation and for non-seniors a $6.00 fee. Is the money for the meals already paid through the General Fund or are we in collaboration with County or something where that is already paid for? My question is why is there a suggestion of the donation if its already paid for? When they ask me to explain I do not know how to explain. She doesn’t know how to explain to tell them because in Spanish is says “Tres dólares donación sugerida” and that gives them the interpretation that it is suggested that you pay the $3.00. It doesn’t say anything about it being free. So, when they ask her she doesn’t know how to answer that. So perhaps somebody can be nice enough to explain to her and if the miscommunication or misunderstanding on the flyer is already paid for and its free, if there is any way that we can get that removed?”
(Mayor Osorio inquired to City Manager Reyna if it would be appropriate for a follow up conversation or could she clarify that. City Manager Reyna stated she can clarify it, or she can have staff contact the speaker. She stated the food program is the County’s nutritional program so that is a suggested amount that is placed there by the County.
It does not go towards the senior program it goes to the County. It is free to the seniors; it is just a suggestion placed there by the County.)
3. Anita Lopez: “My question doesn’t have to do with the food program but the Senior Center. I am under the understanding, since they are talking about money, that we generate, and people donate money to the City or the Senior Center. I assume or I was told that there was $1,100. But because they can’t do their bingo for money and its prizes. Do they have to pay for the prizes? They were also told that twice a week they were going to have other food come in with that donation money so that they would have a choice of foods. That hasn’t happened. They were also told that their bingo was going to be twice a week like they had it and were generating money for field trips or bus tours. Now they are having to generate their own monies. They way they are doing that is by selling raffle tickets and are coming up with their own prizes.
They were also told that on Tuesdays their money would be supplied out of that $1,100 for crafts and art. I don’t know if you guys generate money for the Senior Center and you just keep it. She would like a better understanding.”
(Mayor Osorio responded that he knew there was a new process that was going to be in place but if she could give her information to the City Manager so that staff can follow up with her. Ms. Lopez asked who that is.
Mayor Osorio let her know that Recreation Manager Sumeet will follow up with her.)
4. Arthur Rodriguez: “They have a nutritionist guy for the senior citizens, and they are supposed to have a meeting with him tomorrow at 11:00am. My phone number is 661-868-0973. I come in regard to the foods.
I comes to hear the problems, I am the second nutritionist that has come over. If anyone has any questions, I will be there at 11:00am at the Senior Citizens.”

DEPARTMENTAL REPORTS
Chief Davis provided a departmental report on National Night Out.
COUNCIL STATEMENTS AND REPORTS
Council Member Alindajao:“I did want to mention the Junior police camp in which 40 children attended the camp ages nine through 14. They learned about the important duties that police officers carry out and execute every day, like investigations, physical training, and different aspects of the police department. It's a great program for the youth. It's a great way for the police department to build those bonds and relationships with the community starting at such a young level, young age. That is, the program was a two week program. Each child was given a certificate at the end of that program, so congratulations to them. Those are pretty fun. I did want to mention also, I don't think we've had another meeting since our crime prevention committee meeting, but we had a great first meeting. Talked about a lot of important community initiatives that the committee is considering. We got to hear from Juan Avila from Garden Pathways talk about the work they do in terms of crime prevention with other cities such as the City of Bakersfield and some pretty exciting stuff. I think it was a first for Delano. I think this is our first venture and step towards partnering with law enforcement to address the issues of crime in our city. So I'm super excited to be a part of it and super excited to see what the future holds for that committee and the recommendations we might make to the council at least at the end of this year. So I think we've already mentioned the National Night Out. I'm not sure if you can still register for the event because the event is this Saturday. It's been pretty full. It'll be worth at least sharing link with everyone where you can register, but I can't see. Okay, let me mention, it's called the Delano Congressional Gold Medal Ceremony for Filipino World War II Veterans. Some of the folks at home that are listening to the meeting, essentially it was the Filipino people's contribution to World War II, was to fight, help fight alongside US troops in the INE islands. When Japan attacked the United States, made a promise to the Filipino fighters of pay and benefits. For the next 40 to 50 years, Filipino World War II veterans fought for those benefits and at some point they were reinstated. It's a really neat story and a really neat event. If you go there, there may still be room to attend the event and hopefully you can get in.” Mayor Pro Tem Vasquez: “I was going to ask what will the formality be if I can, I don't know if it's great, but to be a part of a public relations committee involving community people. I've been getting a lot of people coming to me in regards to we have events going on in the community that the city sponsors and they don't know about it until last minute or it's already passed. I know we've asked this to be put on the agenda before, but if we can get the efforts of community people to help with this, aside from hiring someone, I don't know how I can get that going. I'll get that to happen. The other thing is, could we do something also with seniors, because that keeps on coming up a lot too, and how we can work together with the seniors. I want to say since beginning of the year, we've had issues come up with seniors so that we can make those efforts also”
Council Member Morris: “I'm excited about tomorrow night, national night out, and then I want to thank the chief for putting all that together. And I think that's such an important event for us to attend and to have our families attend because it is an opportunity for our youth and for our families to put our trust in them and know that they're there to protect us and we can rely on them when we need them. And so I hope that everyone can attend National Night Out and take advantage of that opportunity with our families out there.” Council Member Solorio-Ruiz: “I do want to start off by saying that I've heard of the meetings from the Crime Prevention Committees and I heard that they are going well, so I do appreciate that and the work that everyone's putting in. I would like to see them live-streamed. So this committee, one of the things we talked about when we originated and we made it was it's not for one specific person, it's for the community. If we truly want the community involved, I think it's necessary for us to at least offer some live stream where folks can listen in. Even if they're not going to provide their inputs or they can participate via Zoom, then that would be great. I also would like to see some promotion happening. I know that the committee had only first a few couple meetings, so I'm not trying to say do this now, but just an idea to put it out there. I would like to see more promotion, whether it's on the department or whether it's on, maybe the council members who are the head of that committee can possibly coordinate that. I'd appreciate outreach for that committee if we truly want community input. The second thing is I do want to thank all the community partners and leaders that helped with yesterday's back-to-school resource distribution that we hosted here in Delano. I do want to shout out a couple of the donors who provided resources, United Way of Kern County, Adventist Health, MGS Beauty Salon, Nutri Guys, Mayes, and Emannuel Furniture. I think that it just goes to show the power of community and what we really can do if we put our resources together. I think we distributed over 500 resource bags to the kids. I will see you all tomorrow there at the National Night Out. I think it's an important event to bring out the community and to make sure that we're getting exposure to our police officers and truly building that community heart. The other thing is I do want to put out an announcement this Wednesday. The United Farm Workers Foundation is having a March to Sacramento. They will launch, it's going to be for 20 days, 335 miles from Kern County to the state capitol. I just want to give them good luck and it's truly remarkable what they're doing.
They might also need water volunteers, so if anyone is interested, you can contact myself or I believe the mayors also in coordination with them as well, so feel free to reach out in regards to that. The other thing is I wanted to see if on a future agenda item, we could have a discussion and possibly a decision to secure the piece of land next to the police department to label it and categorize it as a food pantry so we can have that established there and to make sure that we secure that spot specifically for a food pantry for the community. I overheard comments that we receive here in the community daily from our seniors and I just had an idea and maybe we can talk it out. Possibly having a senior committee, a senior citizens committee where we can coordinate to see some of the issues and maybe some of our senior citizens can possibly sit on them and we can go from there. Perhaps establishing a committee would be good.”
Mayor Osorio: “Thanks to Ms. Reyna and to Chief Davis for some meetings over the past couple of weeks as a follow-up to some residential concerns. Also, I do want to follow up and finally have a discussion on an outreach committee. Thank you Vice Mayor Vasquez, for putting that up on our radar. Just want to echo the points about there being a march, coordinated by UFW and UFW Foundation this Wednesday at 7:00 AM at the 40 acres for anyone who would like to join this past weekend. There were a couple of back to school drives and I attended one of them, but thank you to everyone who's trying to do what they can to give back to the kids. Happy back to school week for the elementary and high school districts in the next two weeks.”

ITEMS FROM THE PUBLIC
1. Joan Smith, 1302 Rounds St.: “I'm not sure if it's an agenda item because I didn't pick up the agenda, but I'm here to ask for your support for the walk for Shay on Thanksgiving morning. I know Thanksgiving is a busy day and a lot of us are with families and a lot of us are helping with the dinner out at Tony's firehouse. I understand that the city has incurred costs that come when you support a parade. I am aware that a few years ago you made some decisions about parades and nonprofits and those kinds of things. The one thing I am going to say is that I know that Elsa was given an invoice and it was not itemized and she's the manager at Valley Strong Credit Union and she's the mom. When the invoice isn't itemized, it's hard to know how much is for putting up the barricades, the police officers to be protecting the streets. I would just have the staff be encouraged to give that kind of an invoice. Since she talked about the animal shelter, I have to give a shout out and I'll just be honest, I have a dog that likes to jump. He probably should be out in the country, so when he ended up at the animal shelter, they picked him up with another dog and I ended up bringing both dogs home. I mean I got my dog back and I ended up with a black lab and it's way too big for me but I was highly impressed with the animal shelter when I had to deal with them. I think my jumper dog is going to take part in the next snip. I've lived here since 1978 when I started teaching school here. I just would encourage you to give some support to the Pinoliar family. I didn't do my research, but I know that we talked, we prayed tonight for safety for our community and I know our community has been very focused on pedestrian safety for kids going to school with the lights and the redoing of our streets and I'm sure that was on the part of the city. I think promoting this walk is promoting pedestrian safety and promoting kids getting to school safely. Thank you.”
Agenda Item No. 5
2. Annette Salim-Wesir, 410 Main St.: “I just want to say on behalf of representation for Delano Harvest Holidays Association, I would like to say a big thank you to the city council and to the city of Delano for being able to be a co-sponsor with us in the parade. We feel like it was a success. It was a very good opening for Delano to be able to bring Delano together as one. Unfortunately we have had some incidents that have happened that kind of shattered the kumbaya happy feeling that we had. But I have faith in you guys that you guys will try to help this city to be able to have the programs that we need to be able to have the protection that we need so that you guys and us citizens can be able to take back Delano and let it be our community, our city, that we can have our kids be able to go safely to school safely to the program safely to the activities that they have. We need to come together as a city. All of us parents and all of us need to educate and have programs to educate the parents so that we can be able to help those speaking as a parent, I was fortunate to have a job where I was able to take time off and say, Hey, I need this day off to take my child to whatever activity he need to be able to go to. But now that I work for a different company and it's a little bit different when you have harvesting season, you say, Hey, I'll be back, especially work in the fields or something like that. These parents might not be able to get the time off, even the ones that work out at the prisons and stuff like that. So we need to have programs, transportation. I know it's hard with the budgets that we have, but we have to try to find a solution to be able to help our communities so we can have these programs and help that these parents need to be able to get their kids because once these kids get older, they have the choices and sometimes they don't make the right choices, but if they get the unconditional love from their parents and from you guys, I know you guys have a lot of love and you guys for the community of Delano that we can try to overcome all of this and thank you for that. I also have that this Sunday they're going to be doing a Larry I. Day at 40 acres October 23rd and it's going to be from 3:00 to 7:00 PM and they're inviting the whole community to come out. We have about Cesar Chavez and we know that Larry I was one of the leaders for the Filipino farm workers. So I think on behalf we'd like 30 seconds to come to show representation of Delano to show the unity that we have between the Filipinos and the Mexican farm workers up fought for what we have now.”
3. Claribel Gutierrez, 1414 6th Ave.: “I want to thank all you guys for participating in this reaching out to the community as a whole for the activities that have been happening for the past weeks. That’s why we decided to do it in front of the city hall because I know that when the city hall is in one accord, the community is going to be very, if we don't show then people don't know where to go even though they go to different churches. On behalf, I wanted to thank you guys for participating in the Harvest Holiday Association in all the events and for sponsoring. I know it is been amazing coming back into the community and having this event even prior when I came to California, I am grateful that the city of Delano is going to open their doors to continue to build the bridge to everything that we have done in the past. I don’t know if Mr. Alindajao mentioned we are going to have the veterans parade. We welcome you guys. I know that you guys sponsor, but a little reminder that it's going to be November 5th and so we are looking forward to continue to partner with all you guys and just to be grateful. Then we are going to have a pumpkin patch.
So as the past president of the Kiwanis Internationals of Delano, we are having our pumpkin patch from October 17th, which is started today to October 28th. I know that most of you guys are busy, but if you have a little bit of free time in between 8:30 and 2:00, we would love for you guys to come and help us with a class or reading a book. Then they got a lot of things that you guys could help us in bridging the gaps. If you guys don't have anything to do, don't hesitate to volunteer from October 18th, tomorrow to the 28th.”
4. Pastor David Vivas: “I know that all of us have been disturbed about the recent violence that has occurred in our community in the last week and this should not be taking place. When the shooting occurred last Monday, I started getting so many phone calls and text messages immediately and I had not heard anything. I was occupied in a meeting and so I didn't know who to contact at the moment, but that occurred near Hyatt and County Line Road, right where my son's cross street from where Adam's shooting took place in January 2020. That brought back so much mixed emotions at that point for myself, my heart started racing. I hadn't felt like that in quite some time, but everything was fresh for me and I started reliving the moment. I've got to say, and I want to encourage the city council you are the face of Delano and other elected officials do listen to these meetings, the Zoom meetings. Unfortunately, I want the city council to represent the people accurately. In times past the city council last year at this time, there was some contention going on regarding the SROs and there was a disturbing comment that was made last week and it bothered me. I know we have our differences, but when it comes to law enforcement, we should be supporting them 100%. When I hear a comment that I don't know if Delano City Council supports the police department, there's a little bit of validity as to why they make that statement. I want to believe that the city council does support the police department and that we would never, ever again to the best of our ability give anybody reason that lives outside of Delano to question the city council and ask if they even support our police or not. I really don't want to come up here and act like I'm scolding because I'm not. I'm just asking to make sure that you give a hundred percent without reservation, without debate. If the police department needs equipment, do whatever it takes to give them the equipment that's going to help them.
Right now a lot of our community does not feel safe. I have received so many phone calls and text messages over the weekend over the second shooting. Last night I had a gang member call me up. I had no idea who he was, but I went to his home, and talked to him for almost two hours, he wants to get out of the gang, but couldn't get out of the gang. Others feel the same way, but they can't speak up because they don't know who to trust. I'm glad that they took time to call me and opened up, but we have a real genuine need in our city and I just want to encourage the city council that we need to do everything we can to bring our resources together to help these young people and do whatever it takes to intercept and prevent these shootings intercepting. I believe that we have a good chief here who can bring his knowledge and his connections to be able to distract these individuals from committing such crimes. People in this city want to feel safe.”
5. Yolanda Chacon Serna: “I'm so happy that Annette Salem presented the Larry Itliong event this weekend.
I would also like to leave a flyer that if this information could get out to a bigger circuit because it's going to be very educational for the youth and there's going to be a theater group from Oakland that will be performing and there will also be a jazz ensemble. So, it's going to be a very beautiful event and I think that it's very beneficial for our family and youth to attend. I just wanted to say that and I believe that everybody here is a daughter or son of the creator and we are our in unity and in grieving for our community. My family is as well, just the fact that we back and support our law enforcement as well. I think as a fellow citizen in this community that I believe, yes, we should staff up our police department and yes, we need to protect our children because who will speak for them? We need to make sure our budget will give services for our families. An enrichment center, we do outreach and for our children this is cyclical. Sometimes it's generational and we as a village are failing our children and our families. We need to invest in programs so that we can have successful adults like those of us here in this room that were products of Delano. And I've been speaking to many of my fellow community members, and we remember all the different services that were offered then. We've always been a disenfranchised community. I would like to welcome families and parents, other parents to get involved and that we look at avenues to offer opportunities to our children such as getting rid of the pay to play because many low-income families cannot afford it when they have more than one or two or three children. We need to look at real solutions that will work. We need to get them when they're young so that they're not following that gang mentality or the only way to take a gang, a gun gang or drugs from a child is to offer them something better. And I think that is our challenge to stand up to. I think we're all here deeply invested and rooted in our community. I believe we can do that. So that is, I know that we're praying for the officers and for the families and more for the children that are gone because their lives were gone in vain and there's many hurting people today. And this is not just here in Delano, it's everywhere. So I just want to say that together as all children of the creator that we think about what can we do to be a positive solution in this situation that's affecting our community.”
6. Ida Ramirez: “I've been a catechism teacher for over 30 years, so I've seen many children and this is an ongoing problem, this red and blue and gangs and things. I would like to find out what you all think or what the city is doing. I know the police chief has spoken on it, but as a community, what are we doing to implement a safeguard as a teacher this last week, the kids, and I'm talking about I teach from sixth grade to high school, their focus is staying alive. Why is this happening? Do we need to put more officers out there or do we need, can we get some volunteers? What can we do? Because I remember in our time, myself and two other volunteers used to, when we knew school was out, we'd go out to Caesar Chavez Park and watch. As soon as we saw a group, we knew there was going to be a fight. As soon as the bandana started coming out, red, blue, we knew a lot of times the gang members would come to us and tell us there's going to be a fight. It's just like being in jail. They know when there's going to be a fight. I saw it from my own eyes, I worked there. We need to pay attention to these children. These are our future. I'm talking about elementary to high school. Please, please pay attention, do something. And I'm also questioning what has the police department done or is there any answers?”
7. Abraham Jimenez, 1535 Randolph St.: “I want to discuss very simply the Girard and County Line stop sign. I was told by the chief that he cannot implement an officer there because it's very dangerous for his life. Well, he's not going to stand out there alone. He can put the car out there or put a blockade but something has to be done. It's very bad traffic there between 2:00 and 5:00 is so bad that it backs up to Randolph Street and that way and every direction. Traffic has been really bad and I live right off of Cecil and on Randolph. Popeye's chicken is going to open up very quickly and there's a lot of traffic going to be going from the high school and from the other direction. A lot of it has been gas meters that have been installed and then it's just a mess and I've almost fallen several times, but I know that they're there, but somebody that's not aware at night can fall. I know you have the power, and you have the executive privilege of being able to do something with it. Can you please do something about Cecil Avenue? Thank you and I wish all of you that are running good luck in the new election. If you think you deserve it, you win. If you don't, you won't win.”

COUNCIL STATEMENTS AND REPORTS
Council Member Alindajao: No comments.
Mayor Pro Tem Vasquez: No comments.
Council Member Morris: “I want to thank everyone that supported Harvest Holidays this last week. It was great for all of us to come out and to hopefully until some people started something going in our community that we so missed that camaraderie, doing things together. And I miss that. So, thank you all of you for being out there and coming out to support us. Thank you to the chief for your information and for being transparent with our community and for us to know that our PD is doing something. A lot of times we don't hear from them, so we think they're not doing anything, but technically they're really working hard for us right now. And we certainly need that. We continue to pray for our city and for our families that were affected by the loss of their loved ones and their family.
And hopefully we can all work together to help curb some of this gang violence or how we can help in some way to make this awareness in our community as to if you see something, say something. And I think we need to start that campaign and just get that out there, the people so they're not afraid to speak up.” Council Member Solorio-Ruiz: “I want to start off by thanking the Harvest Holiday Association and their committee members for and Councilwoman Morris for a fantastic parade that we had. It was very, I echo what you said. I think it was very touching, seeing the community come together, especially because of the last couple of years that we've had as a community and really as a nation. So thank you for that. I also want to extend gratitude to our staff, specifically Noemi, thank you so much for all you did to help with the coordination for the career and resource fair that we just had recently. I think whether we got five people to come in looking for a job, whether we got 20-30, I think it was still beneficial to truly get back to where we were when it comes to our workforce in our city and in our county. I hope that we can continue to collaborate on that and maybe conduct even more in the future, maybe possibly even outdoors now, the weather is getting a little better. In regard to future agenda items, I did want to see if we can get the vacancy on the planning commission. I also wanted to see if we can have a discussion on executing an outreach plan in terms of if, and I know we've had some conversations before internally in terms of if we go with a full-time staff member or if we contract with the firm based off the budgeting amount that we put to the side. I want to coordinate with city staff to host a pet adoption event for our animal shelter. I know that they're struggling when it comes to the animals that they have, maybe doing a outside event where we waive the adoption fees or et cetera.
To communicate to staff in regards to that. I would also like to invite the community to an event that I am co-hosting with our superintendent Rosalina Rivera, United Way of Kern and other partners to host a Healthy Minds and healthy bodies event. We will be distributing food books, COVID, 19 tests and dental hygiene kits. And that will be on Tuesday, October 25th at the Harvest Elementary School from 3:30 PM to 5:30 PM We'll go ahead and post the flyer on the City of Delano Facebook page. And just to kind of close off, because I do believe it's appropriate and it's necessary to speak out on what has been happening in our city. I have been speaking to family members, community members recently, and they have expressed fear in our community because of recent events. And to those families, parents and youth, I will say that we do see you and we do hear you, and I think I speak for all of us when it comes to that. We need to have a collaborative effort with our law enforcement and community, our faith-based institutions, our city leaders, regardless of our differences for the betterment of our city. I truly believe that and I know we can do that and I hope that we do that. So please, as Councilwoman Morris stated, please keep our city in your prayers, as I will as well. Thank you.”
Mayor Osorio: “On my end, I just want to report on a few events that I attended with fellow council members such as the Street Fair on Main Street, the Harvest Holidays Parade, and of course this weekend, the Career Resource Fair. It was good seeing city staff members out there this past Saturday. And of course, again, thanks to city staff as they've been responsive to the immediate needs that we've seen over the last few weeks as it relates to public safety.
Councilman Morris asked me if I can get a reminder to folks that we have the Boo and Boots trunk or treat on October 27th, which is a Thursday from 5:00 to 8:00. If you'd like to register, you can do so by October 20th.”

ITEMS FROM THE PUBLIC
1. David Vivas – “I just wanted to express my appreciation being a member of the Delano Hometown Heroes Committee, we had a very good outcome in the parade, the Veterans Parade this past Saturday, and I believe just about all of you were in attendance or were able to watch it online, and I received so much positive feedback from the community. Something like this really uplifted the spirits of the members of this community, but especially even more so our veterans. All of the committee members wore a certain T-shirt that was able to identify us as committee members, and I was having total strangers as I was walking through a few times on Main Street, stop me thanking me for the parade. Many of the veterans don't expect recognition from people, but they were so appreciative that they were honored and they were recognized and celebrated in this manner because that's what a parade is. A parade is a celebration, and so I'm sure that if we had every single veteran that was there or every single veteran that viewed this online, if we were to get their comments and their reaction to this parade, no doubt we would be here for the rest of the week listening to the positive outcome and how it impacted them and it touched them. And so I really believe that something like this has brought a lot of healing to them because we never know what these veterans, we don't know what they went through. I know my own son went to Afghanistan, I believe in 2009 and 10, and I saw how he came home. He was shaking when he'd come home. He said, dad, there's things that I saw out there that I cannot tell you because I just don't want to talk about it. And a lot of these veterans come back suffering with PTSD. We talk about sacrifice. These men and women sacrifice their careers, their family, they're very unselfish, and so some of them come back with missing limbs, unable to hear anymore. These men and women, they have truly sacrificed. I've never been in the service, but I know that these individuals deserve to be celebrated. I want to thank the city council, city of Delano for helping to sponsor that event.
Agenda Item No. 6
I'm just speaking for myself as an individual member of this committee and of course fellow committee members.”
2. Anthony Cortez, 282 Shell Beach Court – “I would just want to thank the Delano Hometown Heroes Committee for putting this veterans parade together. I participated in the parade. I am a United States Marine Corps veteran, and to be part of that was hard to explain, but as I was riding down and through in the parade, I can tell who a veteran was out there. A lot of them were wearing their Army or Navy or Marine Corps hats and I would salute them. I happened to salute one older gentleman and he started to cry and I'm reminded of a story that Delano trustee Frank Herrera told me. I was talking to him out there, he happens to be my godfather as well. He told me of an event he went to years ago where they were honoring veterans. I believe it was Medal award of Veterans. At the end of the event, he walked up to three veterans.
There was a World War I, World War II and a Vietnam vet, and he reached his hand out to thank them. He went to the World War I bed and shook his hand and said, thank you. Went to the World War II bed, said thank you, and he went to the Vietnam bed and the Vietnam vet started crying and he asked him, did I say something wrong? Did I offend you? He goes, no, we did not get a thank you. When we came home, our Vietnam vets got a bum wrapped. They were drafted, some of them took that call, didn't want to go, and they came back because government made bad choices back then. Government still is making bad choices.
We as a small community, as city council members have the opportunity to make things right, and I pray we have our election tomorrow, so whatever happens, I pray that we learn from our past and move forward and just forget about all this other stuff. Just concentrate on the citizens and residents of Delano and our neighbors and let's move forward. That's all I'm asking.”
3. Annette Salem Weezer, 410 Main St. – “I too would like to take the time to say thank you to you for the city council for co-sponsoring or sponsoring our parade for being able to see the vision, to be able to believe in us, to be able to share and to honor the veterans and the first responders that we have. It was nice to see it. We were the ones doing the registration and Michelle, myself and Clarabelle, and to see these veterans and to be able to tell them thank you and to see them in the parade, it brought such a humbleness not only to us but to them to and to be able to see the community of Delano, to be able to come together for something like this was very touching and especially at the ending of the parade where we had the horse, which represented those that didn't come back. I just want to say thank you for allowing us to be able to do the parade and for sponsoring us with the money that you guys did.”
4. Thomas Soto – “I also have the pleasure of serving on the Hometown Hero's Veterans Day Parade committee. I just wanted to say a big thank you to not only the city council members, but the city of Delano for coming forward and responding. The outpour of support and the outcome of all those who came out to participate that day was just amazing for all of our veterans and their families because people not only forget that their families are the ones that also due to their loved ones being lost, suffer great loss. But on that note, I just want to briefly say that we look forward to more events like this and helping, to me, this is just providing a cracking of the surface to help provide services for veterans to this community. I know it's been brought forward to this council that mental health services for veterans are needed in the community.
Yes, I agree 100% and if there's any way we can provide that to help make that noted to veterans, we will so do so. On that note, I want to just say that I did see in veterans that day, like gentlemen explained a lot of Vietnam veterans and other veterans of other world wars, all they wanted was a welcome home, which they felt they never received. And so tonight on record, on behalf of the committee, I'd like to once again say to those brothers and sisters who never got that welcome home, welcome home from your brothers and sisters here in Delano and the Hometown Herald's Parade Committee. So thank you guys once again for all your support.”
5. Claribel Gutierrez, 1414 6th Ave. – “I second all the committee members has shared. We are so grateful for the opportunity the community of Delano has allow us to do the veteran parade loan overdue. We thank you to the city for sponsoring like some of the members say, but just to be able to reach out and see those that pay the ultimate sacrifice so we could be free and enjoy the freedoms that we enjoy today. It was the best thing that we could ever have done. I am so grateful that God has given us some of us division to be able to move forward to honor those past, present, and future for the liberties that we appreciate today. So I also put myself on the spot in behalf of the Hometown's Parade Committee. I thank you and especially the veterans, the families in the city of Delano as a whole.”

COUNCIL STATEMENTS AND REPORTS
Council Member Alindajao: “I wanted to see if we can, or I'd like to have on the next agenda, Maybe some discussion and vote for an upgraded sound system speaker system for the parade route. I think all the parades would benefit from it since the parade route goes through Main Street and around Jefferson. The Jefferson attendees don't have the benefit of hearing the announcer announce names or make special announcements or even hear some of the music that's being played over the speaker system on Main Street. I'd like to have that and maybe, I don’t know if it's an RFPs necessary for something like that, but I'd like to bring that if possible on the next meeting in November.
I'll leave it to the experts, but I doubt we have enough time to have it for the Christmas parade, but certainly we can talk about it. I also want to remind the public about the Shaylin 5K walk and run for public safety awareness. That's going to happen on Thanksgiving Day at 8:00 AM at the corner of Summer and Browning Road, if you want more information, you can always reach out to me and I can point you in the right direction. It's for a good cause. This is her 10th year anniversary of a tragic accident that occurred at that very corner. The proceeds will go to raising awareness, public safety awareness issues. Speaking of Veterans Day Parade, I think this Friday will be the Porterville and the Bakersfield Veterans Day Parade. If you have time, and don't got much to do, I encourage you to take your families out to those parades in the city of Porterville and the city of Bakersfield.” Mayor Pro Tem Vasquez: Absent.
Council Member Morris: “We had a really eventful week this week on last Wednesday. We dedicated the Larry Morris Park and what an honor that was to dedicate that park in Larry's name. I want to thank staff for all your hard work. I know Roman worked on that being like forever seems like, but it's been a long time. Thank you staff for the setup and thank you for all your contribution to that event that day. We were also proud of Larry. As you know, the developer out there wanted to name that park in Larry's name. It was, he said that because of what Larry contributed to the community and how much he loved this community that he wanted to dedicate that to in his name.
I totally agree, he is such a service guide to this community. He loved this town. He would always tell me, we used to go to LA, he used to say they couldn't pay me a million dollars to live here. He comes from San Diego, but he loved Delano. Every time he had a chance, he would volunteer his time anywhere to raise funds or monies for kids to go somewhere or to do something. He helped the band for years, barbecuing for them and dedicated so much of his time and we're so proud of him and so deserving of that honor. On another hand too, we dedicated gymnasium and Hubert Rubenal's name, who is another great person in our community that we lost and what an honor that was to be there to celebrate that in his name also. Also the other thing I wanted to mention is I know the vice mayor had allowed me to go to a meeting that she wasn't able to attend. I really didn't know what the meeting was going to really be all about, but it was with the former mayor of Los Angeles, Antonio Osa. He was there along with some of his right hand people that are working on this particular project here in the state of California. I just kind of wanted to report you because I know this is coming. He wanted to gather leaders in the valley to tell them what was coming down the road. He said that there was going to be about a hundred billion dollars coming to the state of California for infrastructure. I guess what we're going to be looking at is probably broadband energy, and traffic safety. So based on COVID and transportation, he says he wanted to make sure that every city had broadband as this money rolled in. So everything will move faster for us to be prepared and ready. The problem is, is that we don't have enough contractors to do the work. So he says that we should be ready to offer jobs to many, many people, local people that put them back to work and we need to hire locally is what he indicated. I think it was good to hear good news like that, that we'll be getting some kind of money for infrastructure and our community to make some of those things happen in our community. So hopefully we'll be looking for that money and when it gets here, because it looks like there's going to be a lot of job openings for a lot of people. So we're looking forward to that.” Council Member Solorio-Ruiz: “I haven't really attended anything recently, but I do have just two, just not for feature items. I don't think they require it, but just so to let the council aware, I had a discussion with the city manager about possibly having, because of down Main Street during the night, it seems really dark down main. I asked her if we could look into possibly putting more lights up, whether it's even the white Christmas lights around the trees just to kind of make it with more lights, it equals to more safety, et cetera. We had that conversation and then also the city managers assisting me with coordinating with our animal shelter to have an adoption day for fur babies. We're going to have an event soon, so stay tuned on that as well.” Mayor Osorio: “Just a quick report on events I've attended with fellow council members mid through October. I attended the State of the City and Community Awards banquet with Council Member Morris and Vice Mayor Vazquez, and which was hosted by the Chamber of Commerce. I also attended the Larry Itliong Day celebration at the 40 acres. I wanted to thank Parks and Rec and the Delano Police Department for hosting the Trucker Treat as well. Thank you, Chief for facilitating that. Alongside Council member Morris I attended the dedication of Larry Morris Park and also with Council member Morris, we attended the grand opening of the daily discounts store. I think many people will find that place very interesting if you want to check it out. Of course, with fellow council members, I attended the Veterans Day Parade.”

COUNCIL STATEMENTS AND REPORTS
Council Member Nunez: “I'd like to thank staff for all you do, all your hard work, city manager for hanging in there and staying tough and pushing us in the right direction. I didn't get to talk about too much about this Thursday, but my family and friends who worked really hard with me get elected. I'd like to thank those who voted either for or against me. It didn't matter. You voiced your opinion and that's what we want. We want to hear you. Only thing else I have is save the dates. People are asking us that they'd like to see the city council involved in more community events. Not just stuff that we do, but stuff that they do and they want us to show up to February 18th for they want to see us there, all of us. February 18th. The other one is Little League. Little League has opening ceremonies, March 11th. They want us all there. They talk about us and we all talk about our children and community events and with our kids and we care about our kids. March 11th, they've invited us all to come out. Other than that, Merry Christmas and Happy New Year to everyone. Have a safe holidays and see you next year.” Council Member Vasquez: “I'd like to thank the staff that's been working overtime in late hours for the events that they've been doing. It's greatly appreciated. The community has said how much they've enjoyed the different events.
A lot of people was doing the transit. I took a lot of my family out there and they really appreciated that. Also those that have donated for the senior raffles, thank you and everyone have a happy holiday.” Council Member Morris: “I just want to thank everyone for volunteering this holiday season from Thanksgiving on until now because there has been so much going on in our community. Thank God. Okay, we've got stuff going on in our community because it's been good for everyone. I think everyone's really kind of ready to get out there, but I know that I see most of you everywhere, wherever we go and volunteering, whether it be Shop With a Cop, the Thanksgiving luncheon, the parade, the toy giveaway, the family fun nights, the food giveaways, the music festivals.
There's been so much and so thank you all of you for being there for volunteering. if you weren't in charge of something, thank you for being there to support what's going on in our community. We need to come together and support our community so that we can have more successful things in our city where we can say, yeah, we're active, we're doing something for our residents to create ways so that we can come together and get to know each other better. I just wanted to wish everyone a Merry Christmas and may we always remember what the reason for the season is.”
Mayor Pro Tem Solorio-Ruiz: “Anytime that we have a new business come into Delano. Let me tell you, we had a lot of businesses come in this past year and it's phenomenal to see the community really building up. As a matter of fact, a community resident from, city of Tehachapi was just visiting this past weekend for an event that we had. She was just boasting about really all the development she's seen in Delano and she joked about her wanting to possibly move here because she sees that Delano is really developing into the vision of economic development for betterment lives for our children and for our families. So that's always awesome. I also hosted a teddy bear and toy giveaway this past Saturday. I want to share a special thanks to the donors such as Maria Martinez, the Wonderful Company, Athletix Sports Gym, Adventist Health, our very own DPOA, YK America, STRR. I do want to also thank our volunteers, Veronica Soto, Claribel Gutierrez, Annette Salem, Paola Rodriguez, and as well as Mayor Alindajao was present to assist as well. A chunk of our successes, really the majority of our successes is because of our city staff. We could not function. All we do is really just read the reports, gather our input, but really the individuals who work so hard, not just for the ideas that we have, but for city business is our city staff. So this past year they have and the years before that, they've really been hustling to provide us the necessary tools to make the proper decisions. So I do want to give a round of applause to our city staff real quick and also our city manager for the success that they've had this past year. other than that, I just want to wish everyone a happy holiday and a Merry Christmas as well. As we enter this new year, because this is possibly the last time that we will see each other until the next year, let's reflect on this past year and all the accomplishments we've made and the accomplishments that we're going to make next year. I have so much hope for what we're going to accomplish. So other than that, I will see you all next year.”
Mayor Alindajao: “Cookies and chocolate, it was a lot of fun. It was a lot of people. People were waiting in line. It was super cold. Crumble Cookie is going to be a great addition to the city of Delano. Their presentation, their product, the whole thing from top to bottom. They're a great business and I look forward to them being part of the landscape of Delano. I did attend Shop with a Cop. I think I was the cash register person. I think I was the first person in the history of Shop with a cop to stay under budget. I told them I'm a city council member. I have to be fiscally responsible. So no, I'm kidding. So we wanted to go get over the budget or expand the budget and we had a great time. So many people over there and it was great. It was great to see the PD out there, see all their police patrol units lined up out there taking a picture. It was just a really, cool moment. Attended the Teddy Bear as the Vice Mayor mentioned the Teddy Bear giveaway in front of City Hall. Another freezing cold event at an ungodly hour. But no, it was fine. We had a lot of fun, lots of toys, lots of Santa was there. We had a seven-foot Santa. We had a really good time. It was a lot of fun. I want to thank the Vice Mayor for putting that together. It was a wonderful event. Christmas is coming up and I have to tell you this, wherever you live and no matter what city you're in, be aware of your personal safety. We're out late. Lots of traffic, lots of people, a lot of people coming into the city. Be aware of your personal safety as you go out there and shop and buy gifts and whatnot. Thank you, Councilman Nunez, for bringing up the Little League on March 11th. I think it's a great program. I hope I've been hearing rumors that it's really starting to grow and expand and it's great to hear because it was really sort of nonexistent there for a few years. So I'm glad to see that program moving forward. I also concur with a lot of my colleagues' opinions about our city staff. We do have a world-class city staff here, being led by our city manager Maribel Reyna. A lot of things, believe it or not, happen around here without my help. it's because we have a worldclass staff that gets the job done. I've told people before; that my number one job is just to stay out of the way and be the best cheerleader I can be with pompoms and everything and just let them do their work. I mean, look at the city.
I've said this repeatedly, Delano is not only living its best life, but there's so much in the horizon for Delano. The last thing they want is for me to mess anything up. But I'm going to be there to help, to encourage, to give them the tools they need to be successful. let tell you, I don't think enough people know the kind of staff we have at the city.
Look around you. They can take credit for all if not most of the progress that's happening in the city. So thank you, Maribel, to your staff. They're here tonight and those that are not here tonight.”

ITEMS FROM THE PUBLIC
1. Claribel Gutierrez – “I want to thank Councilman Nunez and the chief of police for allowing us to do the car seat event, it was a graceful set event. We had 71 babies passing through the line. We were able to give free car seats and so that’s what we want to see. We want to make sure that all people are inclusive. Their kids are going to be safer and hopefully it’s not the last time that we collaborate an event. We wish that that the rest of the council can participate as well. On behalf of Assemblywomen Dr. Jasmeet Baines thank you again for helping our families and our children.
2. Mary Ballardo, 906 Balboa Ave. – “They put a dump on High St, the old Gibson. They have a dump and I live right across the street from it and I wanted to know why they built it there or who let them do that. Theres a lot of mice that are coming to my house. I just want to know whose property that is and who decided to do that. The people coming into Delano see all the trash there and also I own my house and the property value is going to go down because who wants to live next to the dump, and I just don’t understand why the city let them do that.
Since I moved there, that property has been empty and then it caught on fire a couple of times because the homeless were living there. It was not locked up but now they put a lock but now it’s a dump site. It was an abandoned house, then they used it for a bit and now they dumped iron and somebody is moving the stuff around and I had a mouse come and it tried to get into my garage and it doesn’t look nice when people are driving into Delano.”

REGULAR AGENDA
26) Potential Ballot Measures on the November 2024 Election to Establish the Office of an Elected Mayor
Staff report by City Attorney Hensley.
Suzanne Villaruz shares different ways city council meetings are ran in different cities. She also believes there should be a lot of input from the community on this matter.
City Attorney Hensley makes a few clarifications.
Councilmember Vasquez is concerned on how there will be an outreach to receive community input. She wants to know if there will be a plan to include the community because this decision for the Mayor will affect them. She asks if a presentation can be done with the different possible options. She also wants to know if its possible to polling.
Councilmember Solorio Ruiz shares that he is familiar with charter cities and he understands it is a hassle. He also shares that he is interested in a presentation to get more community input.
Councilmember Nunez shares that he has received input from the community and many are in favor of having the mayorship be two years. He shares that there is no advantage of going to charter. Also there shows concern of the mayor that gets elected not being experienced, it would hurt the city if we had a mayor who didn’t know what they were doing. Nunez shares he is in favor of putting the mayorship on a ballot and is in favor of a two year term.
Vice Mayor Morris shares that she believes the mayorship should be strictly ceremonial. She would like for every council member to have the opportunity to serve as the Mayor. She shares how she knows the council is uncomfortable when they have to select who is going to be the next Mayor. She wants to know if the Mayor will have extra responsibility or if they will have more “power” as opposed to the other council members. She would like for different methods to be discussed.
Mayor Alindajao shares the Mayor is in a position to impact the community differently when making decisions. He states how the mayorship has been up for discussion for some time now. He believes the community wants to choose who gets to be the Mayor.

Consideration and possible action to direct staff to undertake further analysis of the proposed measure, including an analysis of the potential effects of the measure pursuant to Elections Code section 9212.
Mayor Alindajao has a conflict of interest with item 27 so he steps out and Vice Mayor Morris takes over the meeting at 6:34. A 5-minute recess is taken.
Meeting resumed at 6:43pm.
City Attorney Hensley provides a staff report.
Mayor Pro Tem Morris opened public comment.
Veronica Soto who is the property manager at the Brandywine Apartments. She shares that she thinks this will have adverse effects on rental properties. If this ordinance passes, it will be hard to make necessary repairs and upgrades to the property due to the cap on rent increases. She encourages building more affordable properties rather than penalizing those who are trying to provide good living conditions for renters.
Art from Central Valley Empowerment Alliance talks about the impact on the City of Delano. There have been many studies that this won’t have an impact on building affordable housing. It greatly helps tenants keep a roof over their head. Delano is one of the top cities that has seen a high increase in rent.
Suzanne Villaruz shares that capping rent prevents the property owners and managers from making improvements on the buildings/units. Rent control does not benefit everyone and it won’t be fair for property owners and managers.
Mayor Pro Tem Morris closed public comment.

COUNCIL STATEMENTS AND REPORTS
Veronica Vasquez – “I want to see if this evening we can end this meeting in memory of Stephanie Fierros. She just passed away this past week and she was one of the ladies in our community that used to sing a lot, at our events. she's very well-known and loved, so if we can do that, I appreciate it. Another thing is Claribel, next time you guys do that event, if you can do it on a Saturday, I actually used to train that event and do that event and was certified and I was surprised that it was done on a Friday. I usually do it on a Saturday. I did it throughout the state, so it is a successful event. So that kind of threw me off guard. If not, I would've went. Just remember Relay for Life is going to be April 13th, and we’re still looking for teams. I know it's not going to be overnight yet, but it's going to hopefully if we get enough teams, it can just go back to the overnight part. For now, lastly, at least it was from 12 to 9. The third Thursday at 6:00 American Legion will be the HOW dinner for Ray and Darlene Salinas if you can go and make reservations. Thank you.”
Salvador Solorio-Ruiz – “I just want to give a quick shout out to our city staff who helped to coordinate the Dolly Parton Imagination Library launch event on behalf of the Kern Literacy Council. Basically what it does is that program, if you enlist or enroll your child, they receive a free book every month to their home, which is fantastic.
The more books, the better our kids could read. I want to say before they did that event, they had about 15 kids registered, and right now they have a total of 166 kids registered. that's huge. they're hoping to do more events to enroll more youth into that program. We also attended the, when I say we, I mean myself and some council colleagues and the mayor attended the state of the county. Also myself and Councilwoman Morris attended the Kern Hispanic Chamber of Commerce installation gala. That was this past weekend. So it was good. Delano was in that.
Also just want to give a huge thanks to city staff. I know that right now there's the threats of flooding and et cetera, and I haven't asked too many questions about that, but I am confident and I know that our staff is on it and they're diligent on that. I did want to ask to be placed on an agenda possibly in April or May, but myself and the city manager as well as the city attorney, I'll ask further questions on my own time about establishing a youth commission here in Delano. I know that was an idea I had about last year or two years ago, and so I want to kind of revisit it, see the pros and cons of that.”
Councilmember Nunez – “I want to thank Dr. Bains, Community Connections, the Kern County Health Department, CHPN, and the Delano Police Department. The car seat thing was very successful. Listening to the ladies out there from the county and from Community Connections. It was probably the most successful one they've had in probably over 10 years. The amount of certified technicians out there and the people needing car seats went very well. It worked out pretty good. February 13th, is the senior dinner dance. We have moved it this year over to the Guadalupe Church in the hall to help staff continue doing their staff work. It's open to all seniors. If you're interested in going, go down to the senior center on Jefferson and speak with staff there so they can put you on the list. I think Wednesday's the last day to get you on the list. I think we're over a hundred people so far right now and it's completely free. No cost to our seniors.”
Mayor Pro-Tem Morris – “Thank you Chief and happy birthday to you. I just wanted to do another shout out to Maribel, and I didn't mention this earlier, but I remember coming onto the council and when we came on, we were in dire straits there because our budget was very bad and it really didn't look good. Maribel came in and I think we had administrators. There was like 15 of them, and we had every position. Maribel was able to cut her staff down to about five people. I feel sorry, and thank you all of you guys who were part of that, because I knew you had to take on triple jobs all at one time and that was a lot of work. You brought the City back to where we should be, and we've been on a balanced budget since, and we’re so proud of our community. We've seen a lot of growth in our community, and it's just the hard work of all of you and the staff and all of you that have worked so hard and so great to work with my colleagues also. And you guys promote our community and are out there doing great things.
Thank you all of you for your hard work and your dedication to our community, and thank you, Maribel, for the job that you do.”

STAFF REPORT
Honorable Mayor and Members of the City Council
Maribel Reyna, City Manager
By: Jerry Nicholson, Interim Chief of Police
February 20, 2024
Agenda Item: 9
SUBJECT: Authorization for the purchase of fifteen fully equipped new patrol units.
Recommendation:
Staff is recommending that the City Council approve as presented, a. Authorization for the purchase of fifteen ( 15) new 2023 Dodge Charger Pursuit police vehicles from Donalson CDJR. in the amount of $644,786.25 b. Authorize the purchase and installation (upfitting) of all the police equipment to Cook's Communication for fifteen (15) fully marked vehicles in the amount of $298,591.35
c. Authorize the purchase of fifteen (15) new Panasonic Toughbook laptops, fifteen (15) new Havis Docking Stations, and related router equipment from Diamond IT in the amount of $117,221.91
d. Authorize the purchase of fifteen ( 15) new police radios, and related radio equipment, from Motorola Solutions, Inc. in the amount of $145,701.49 Discussion:
The Patrol Division has nine (9) marked vehicles that have exceeded one hundred thousand miles and will need to be replaced very soon. This does not account for several additional vehicles that are nearing one hundred thousand miles. These high-milage vehicles require an increased frequency of repairs and are becoming more unreliable as time passes. Since our last delivery of marked police vehicles, we have decommissioned seven (7) marked police vehicles and expect to decommission one additional soon.
Due to automotive industry delays the current wait time for delivery of a new patrol vehicles is approximately 6-24 months from order to delivery and equipping with emergency equipment.
Most dealerships do not have an existing inventory of vehicles and are still attempting to overcome a backlog of orders brought on by the COVID-19 pandemic. Upfitters are also experiencing backlogs due to large amounts of vehicles being delivered as dealerships fill pending orders as quickly as possible. Upfitters do not have the staff to quickly fill this backlog
orders because it represents the current technology supplied by Motorola that is compatible with our previous equipment and which will be compatible with planned future upgrades.
These four quotes will purchase and outfit these fifteen (15) police vehicles. -Purchase of fifteen (15) vehicles:
-Upfit fifteen (15) Patrol Vehicles:
-Outfit fifteen ( 15) Patrol Vehicles w/Radios:
-Outfit fifteen vehicle w/Computers:
TOTAL
Budget Impact:
($644,786.25)
($298,591.28)
($145,701.49)
($117,221.91)
($1,206,300.93)
This purchase will be funded by budgeted Measure U funds. This item allocates $1,148,528 for the purchase of twenty (20) new police vehicles. However, due to inflation and the increased cost of the police radios staff is requesting Council approve an additional $57,772.93 bringing the total to $1,206,300.93 for fifteen (15) vehicles.

STAFF REPORT
February 20, 2024
Agenda Item: 10
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Viviana Alapisco/Transportation Manager
SUBJECT: Public Hearing to receive comments related to unmet transit needs that may exist and can be reasonably met
Recommendation
Each year DART is required to hold Public Hearings for the purpose of receiving testimony concerning any unmet transit needs that may exist within its service area that is reasonable to meet. Staff will review, evaluate, and make recommendations to City Council on February 20, 2024 regarding any needs identified during the public hearing period. Hearing notices were posted on the buses, at the Transit Center, Transit Bus Stops, City Hall, and posted in the local newspaper on Thursday, January 11, 2024.
Discussion
As a requirement to receive State Transportation Development Act (TDA) Funds, the receiving agency must annually hold a public hearing review of its transit program to determine if the needs of individuals or groups are being met. The funding sources for TDA are from two sources, the Local Transportation Fund (LTF) and the State Transit Assistance (STA).
The TDA creates in each county LTF for the transportation purposes specified in the Act (Mills-Alquist Deddeh Act, known as the Transportation Development Act, PUC Section 99200). LTF funds may be allocated for salaries, equipment, and operations. Revenues to the LTF are derived from the ¼ cent of the 8.50 cent retail sales tax collected statewide.
The ¼ cent is returned by the State Board of Equalization to each county according to the amount of tax collected in that county. Payments from the LTF are made by the county auditor but only in accordance with written allocation instructions issued by the county’s transportation planning agency Kern COG.
The State Transit Assistance (STA) fund provides a second source of TDA funding for transportation planning and mass transportation purposes as specified by the Legislature.
Funds for this program are derived from statewide sales tax on gasoline and diesel fuel.
The money is appropriated to the State Controller by the Legislature, for allocation by formula to each Transportation Planning Agency (TPA) (Kern COG) and other agencies within the State. The formula allocates 50 percent of the funds according to population and the remaining 50 percent is allocated according to operator revenues from the previous fiscal year. STA funds may not be allocated to fund administration or streets and roads projects only for capital purchases. Operators receiving STA funds must meet qualifying criteria based on the subsidy per revenue vehicle hour received in the previous year taking into consideration the change in the Consumer Price Index within the operator’s region.
In order to qualify for funding under the TDA (from either the LTF or STA fund) a transit claimant must maintain a ratio of fare revenues for fixed routes to operation cost at least equal to the ration it had during 1978/79 or 20 percent (urbanized area), whichever is greater.
To assist the Council in determining an unmet transit need that can reasonably be met, please refer to Exhibit “A”, a set of questions and answers to explain how transit needs are analyzed.
Budget Impact
None.
Attachment(s)
Exhibit A
Public Hearing Notice
EXHIBIT “A”
1. What are the unmet transit needs finding process?
It is an annual review of transit needs of individuals or groups. It is also a review of new services needed to meet those needs.
2. How is public transportation currently funded?
Fares bring in only 10-20% of the operating percent expenses. Money for operations is primarily derived from a ¼ of one-percent sales tax.
3. Who distributes this money?
Kern COG in its capacity as the Regional Transportation Planning Agency (RTPA).
4. What is the basis for distribution?
Distribution is based on population of cities/unincorporated communities.
5. Does every transit need get funded?
Not necessarily. The stated need must meet adopted definition of an “unmet transit need”.
6. How is an “unmet transit need” defined?
An unmet transit need exists if an individual of any age or physical condition is unable to transport himself or herself due to deficiencies in the existing transportation system.
Excluded are: 1) those request for minor operational improvements, 2) those improvements funded and scheduled for implementation in the following fiscal year.
7. Why aren’t all unmet transit needs funded?
An unmet transit needs to pass the “reasonable to meet” definition.
8. How is “reasonable to meet” defined?
1) operational feasibility: the requested improvement must be safe to operate, there must be adequate roadways for transit vehicles, 2) duplication of service: the proposed service shall not duplicate other transit services, 3) timing: the proposed service shall be in response to an existing, rather than a future need, and 4) service must meet the legally required farebox ratio (Public Utility Service Sections 99268.2 and 99268.5) with fares close to fares of similar service.
9. Isn’t the “reasonable to meet” definition too narrow? Not. New services are extremely difficult to fund because:
a. in many situations, there is no transportation sales tax money to spare. b. ridership on new service could be so low that it can be difficult to recover through fares even the mandated 10% of the expenses.
10. Who would the public contact to express an unmet transit need? By calling the Transportation Manager at (661) 721-3333, submitting their unmet transit needs request to Delano City Clerk, 1015 11th Avenue, P.O. Box 3010, Delano, CA 93216, or [email protected], or attend the publicly held City Council meeting on “Unmet Transit Needs”.
