Morris – “No, I think it's pretty reasonable for me. I'm good with the fee.” Solorio-Ruiz – “Yeah, no, I agree as well. I think that first off, thank you Danielle, for yourself and your team for figuring this out. I think that it allows us to avoid the whole back and forth of developers or applicants or whoever applies to continue to apply after they get denied. It's a waste of city's time and our time. I think as well, I think that it should allow us as well to make sure that the planning commissioners that we appoint and to put a little bit more pressure on them that they must also make the best decision in terms of the city, but also hand in hand with staff because now that there's going to be the a thousand dollar fee, it's going to make it more difficult at times potentially for the applicants to apply. Again. I think that if the applicants are trying to get a business into town or what you name it, I think it's not a big ask for a thousand so we can take it on again. So I'm in favor of it.” Nunez – “The only question I have is why isn't the city trying to recover the full amount?” Interim Community Development Director Monsibais – “Based off of the analysis that we did with other cities and counties? We thought the thousand dollars was in line and it was kind of in the middle of other jurisdictions and because that was the first starting off point, we just figured a thousand dollars would be the good starting off point and see how if it continued to work or if it didn't or were we continuously losing money if they continued to appeal and then we could come back to you guys to let you know that yes, this is what we thought was working, but it wasn't. We just figured that this was a good ballpark to start off with and especially the fact that we're in line with the other jurisdictions.”
Alindajao – “And can you tell us, Danielle, what the actual costs or give us a good guesstimate of what the actual cost would be to process an entire appeal?”
Interim Community Development Director Monsibais – “Yes. Well, for the three appeals that we have currently had in the last two years and two of the appeals were for the same request, it was $3,555 that the city paid.”
Alindajao - “Okay. As far as I'm concerned, I'll invite a motion for a fee that's higher than the thousand dollars the city's recommending, but I think scaling the fee I don't think is a good idea.
That was the board version because we're incurring those costs now in real time and we don't have 5, 6, 7 years even if we got to a thousand dollars, sounds like we're way under what the actual cost is anyway. So there's no reason to slow play the fees and the cost of the city. I hate to say this, but the city's not a charity and I think putting these kinds of restrictions also avoids council member shopping, which sometimes what folks do on appeals, they just keep bringing them towards, I guess at different times hoping that maybe a different version of the council may approve the project. So there's a lot of good policy reasons for this change in the law, but I'll certainly invite a motion for a fee that's more than a thousand dollars. Is that something that is going to cause any issues? Are you going to have any problems with the fee that's more than a thousand? Mark?”
City Attorney Hensley – “The agenda tonight set up to a thousand. As you recall last time it was a little ambiguous and so that's why we brought it back and staff has outlined the fee can't exceed the amount of that it actually costs to do the appeal and staff has outlined about a thousand dollars. Now, I suspect that doesn't take into account all of the costs such as potentially the time that the attorney sits here during the appeal, city manager, clerk, et cetera. So there's probably more that could be added to that. But if you want to look at that, then we would need to go back and really include that because the fee should be justified by costs that are stated in the record tonight. In the record, Ms. Monsibais said $3055 for three of 'em. So that's been substantiate, substantiated. What we could do is if you continue to get a number of appeals and the city looks like it's losing money, we could bring this back and then add the additional costs and time into it if you want to do it that way.”
Alindajao - “And at some point, does the fee get to a point where that might open the door to any sort of litigation or exclusion or that kind of”
City Attorney Hensley – “Well, so long as it doesn't exceed the actual cost of the appeal, then well, anybody can always file a lawsuit, but so long as it doesn't exceed the actual cost of what it costs the city to process the appeal, then it should be fine.” Alindajao –“Then I think at this point, I guess the agenda caps us at a thousand dollars and this council can always revisit the issue if it feels that it's warranted. So did you want to say something?”
City Manager Reyna – “Yes, and I think the purpose too for staff was just again, to kind of gauge the other cities as to the industry standard of the fee. So as Danielle mentioned, we're kind of right in line with that. I don't think it's so much of a recouping our full costs. It's just kind of trying to charge a fee that again, would serve as a deterrent for any meritless appeals.” Motion was made by: Morris to approved item 7;

REGULAR AGENDA
8) Potential Adjustment to City Council Member Compensation Pursuant to California State Bill 329. Placed on agenda pursuant to Mayor’s request.
Mayor Alindajao opened public hearing.
Staff Report by City Attorney Hensley.
Mayor Alindajao opened public comment.

Solorio-Ruiz – “I have two questions and I know this just recently passed Mark, but have we seen what other communities have done? I know there was some talks in Bakersfield, I believe, of them trying to do it, but I don't think it was accomplished.”
City Attorney Hensley – “I do not have that information about what the other, I know there are cities around the state that have taken action, but I don't have a list of who those, what cities those are.”
Solorio- Ruiz – “Okay. And then if we decide not to raise our stipend, is that something in our jurisdiction to do as well?”
City Attorney Hensley – “You don't have to take any action at all if you don't want to.” Solorio-Ruiz – “Well, I guess those are all the questions, but I guess just more so my opinions on it, I think I look at this in two different ways and on one side I think that it is important for not just only elected officials, but people period, to have a good decent, and I won't say living wage because I don't think even the $1,600 is a living wage, but a more respectable amount because it allows you to retain the best talent. It allows you to recruit the best talent to attract folks, whether they graduate from college or not. Because oftentimes we see and we've seen in these roles of elected officials is that sometimes these roles are maintained by folks who are retired. And nothing wrong with folks who are retired. I would love to be retired one day and they deserve it. But it's important to have a diverse opinion on the council and I think that that's what, if we raise it, that's what it could cause is what I think. But on the other side, which is I think the reason that a lot of us get into this type of business, which is it's a business of public service and it's a business that we don't get in to get money out of this. I was thinking about this item and I thought we're in the business to put money into people's pockets, not our own. And so I think that that's why I am looking at this in two angles. I see the benefits of it, and not only the benefits but the importance of it, which is a reason that the state legislature did decide to do it. But I also see it in that angle as well, which is the angle to make sure that we keep this role a role that is based on integrity, but also that is not used for that reason. So those are my points and opinions that just come off the top of my head.”
Nunez – “As you all know, when I ran for city council in 2022, I didn't do it for the money and I still don't do it for the money. After being on the council for over a year, it is costing me money now to be on the city council than it is helping people. I do feel that councils should be reimbursed, at least for what they put into it. And right now, if you ask my wife, I'm about $600 in the hole every month based on what I'm doing.
So I do feel that the increase should be done, what the dollar amount is. I don't have a set dollar amount, but I do feel that it should increase”
Morris – “Well, I kind of feel that way too. I think we haven't had a wage increase on the council since what, 1984? Is that correct? Is that the last ours? We can tell more or less.” Alindajao – “Yeah. That was the cap in 1984 and the salary today is what the cap was.” Morris – “It's been a while, so I had no doubt that it probably should raise a divide. I don't agree on the full amount on here, but I think it should be raised some because we look at it, even if we raised it $1,600 and we're looking at a budget for council pay $96,000 a lot of money. So for me, I think we should increase it maybe by $400 or something like that, which would give the council pay maybe a thousand. But that would be my opinion. I think we, and I am not saying that as far as the amount of service, I think the council gives and a lot of people don't really know. A lot of times we have to attend meetings out of town, whether it be for league or whether it be for whatever reason that we need for training or whatever else we need to attend. And then again, the council gets paid benefits also and that's not included in the compensation that we get. So I agree that we should raise at some, but not an astronomical amount as what is indicated that we can get.
That's my personal opinion.
Alindajao – “My position on SB 329 council members are people too. We invest a lot of time. Looks like 1984 was the last time that the city council raised its salary for council members. At that time, there was approximately 18,000 people in the community. Today there's over 50,000 people, so that means a lot more work for the folks that get elected to office. And I don't want you to feel sorry for council members. We do this because we enjoy it and we love it and we want to serve the public, but at the same time, to a full-time job for some of us, we get phone calls, text messages, emails, issues, complaints on a weekly if not daily basis. We attend meetings and trainings. We hold special meetings here at City Hall. So a lot goes into it besides just sitting up here and running a meeting or being participating in a meeting and $1,600. I think the state was, I think, super conservative in setting some of those limits because $1,600, if you're trying to attract new talent other than retirees and you're trying to diversify the talent of the pool talent, I mean $1600 hardly I would think does that. $1,600 is not a very large amount. The city's current two year budget's about $210 million. I think you can more than afford the increase, correct me if I'm wrong, about 210 million approximately. I think that the city can more than afford any increase to the council wages. We haven't done it since 1984. I understand the spirit of SB 329 and it really is like council member solo reset is to try to help supplement the income of some folks that may want to run but maybe decide not to run just because of finances for some candidates. But nevertheless, I think what goes the work that goes into serving the community now at this stage in the city's life and growing by the way and growing, I think $1,600 is still not enough, in my opinion, to justify some of the costs and time and effort that elected officials have to do. I know the city of Bakersfield, they did address this issue to council member Solorio-Ruiz’s point. They decided to put that on the ballot to the voters in November, which also comes at a cost, I don't know, that might be 10 to $20,000 that's put on the ballot perhaps. But I think my support is for the $1,600 minimum.
We haven't increased the salaries and I'm up here advocating for salaries. This may not even apply to me or council member Solorio-Ruiz. We may not even be on this council come January 2025. So, I think this is something that future councils or any council members that sits here, I think can be proud in the sense that a man is worthy of his work and if he's going to risk life and limb to try to get a seat up here and to serve his community, then $1,600 and not too much to ask.

TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Noemi A. Zamudio, Human Resources Director
SUBJECT: Adopt a Resolution approving a monthly Stipend for Part Time Public Safety & Communications Dispatchers
Recommendation
Adopt the Resolution as presented.
Discussion
A Public Safety and Communications Dispatcher serve as frontline responders, equipped with crucial knowledge about emergencies ahead of police officers. They handle emergency and non-emergency calls for service from the public. Acting as a vital link between officers and backup, they play a pivotal role in connecting the community with law enforcement, fire, and or medical response. Dispatchers must maintain communication with all police units in the field and provide resources as needed during emergency and non-emergency matters. Dispatchers must be able to quickly adapt to various situations, at times handle multiple emergencies at one time, all while always ensuring the safety of our officers. They have seconds to make decisions that make the difference between life and death.
A dispatcher will train for six months to one year before being able to work on their own without close supervision. In addition to the stressful work environment, dispatchers also work shift work, weekends, night, and holidays, making the hiring, training, and retention of qualified dispatchers very difficult. The toll on dispatchers is significant, as they grapple with the emotional weight of critical incidents and time away from family. The demanding nature of this role is reflected in the high turnover rate experienced by the Delano Police Department dispatchers.
Currently we have two budgeted part-time positions; there is one part-time vacancy in the Communication Center. When vacancies exist, the burden is felt not only by the remaining dispatchers who must pick up extra shifts, but also by our officers who must step in and assist picking up some shifts as well.
In an effort to increase retention of our dispatchers, staff is recommending a monthly stipend of $500 to all Part Time Public Safety and Communication Dispatcher I, existing and new hires.
Budget Impact
Budget impact will be $12,000 annually to the general fund for the two budgeted parttime positions.

By: Noemi A. Zamudio, Human Resources Director
SUBJECT: Adopt resolution Revising the Police Officer Hiring Bonus Program, extending it through fiscal year 2024-25, and Repealing Resolution 2023- 17 Recommendation
Staff recommends City Council adopt the proposed resolution revising the Police Officer Hiring Bonus Program and extending it through fiscal year 2024-25.
Discussion
On September 20, 2021, City Council approved a hiring bonus of $7,000 for new Police Officers. The hiring bonus serves to entice new applicants.
The hiring bonus currently in place for new Police Officer is set to expire on June 30, 2023. We have about ten vacancies and staff wishes to stay competitive with surrounding agencies, therefore, staff is recommending to extend the hiring bonus through fiscal year 2024-25.
Staff is recommending to revise the payment amounts. Instead of paying half at time of hire and half after completion of probation, staff is recommending to pay $1,000 with the first pay check and $6,000 after the completion of their probationary period.
The revision and extension was provided to DPOA and no opposition was received.
Budget Impact
$91,000 annually, incorporated into the Budget for Fiscal Year 2024-25.

Currently we have five full time vacancies in the Communication Center. When vacancies exist, the burden is felt not only by the remaining dispatchers who must pick up extra shifts, but also by our officers who must step in and assist, picking up some shifts as well.
In an effort to increase retention of our dispatchers, staff is recommending a monthly stipend of $1,000 to all Full Time Public Safety and Communication Dispatcher Is, IIs, and the Public Safety Communications Supervisor, both existing and new hires.
The stipend has been discussed with the Miscellaneous Unit and no opposition was received.
Budget Impact
Budget impact will be $132,000 annually to the general fund for the budgeted positions of full time Public Safety and Communication Dispatcher Is (9), IIs (1), and the (1) Public Safety Communications Supervisor

SUBJECT: A Resolution Finding that a Local Emergency Has Existed Within the City, Authorizing Contracting Without the Need for Bidding Pursuant to Public Contracts Code § 22050. Awarding the Project to JM Pipeline Construction, Inc. for $350,000.00, and Associated Actions.
RECOMMENDATIONS
It is recommended that the City Council adopt the proposed resolution to:
1. Find a local emergency has existed within the City;
2. Authorize contracting without the need for public bidding, pursuant to Public Contract Code § 22050;
3. Appropriate $350,000 and award such funds to JM Pipeline Construction, Inc. for the remediation work; and
4. Authorize the City Manager or designee to execute any documents needed to perform effectuate the necessary, emergency repairs.
DISCUSSION/BACKGROUND
Pursuant to Public Contracts Code § 20168, the City Council may, upon a four-fifths vote, declare that public interest and necessity demand the immediate expenditure of public money to safeguard life, health, or property because of an emergency.
In accordance with Public Contracts Code §§ 20168 and 22050, the City Council may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts. On March 7, 2024, an unforeseen collapse occurred on a City sewer line located approximately at the alley between Lexington and Kensington Streets, south of Cecil Avenue, which also impacted an adjacent water line.
In compliance with applicable law, and to protect public, health, safety and welfare, the City took immediate emergency action to cause the sewer and adjacent water line to be repaired beginning on March 8, 2024.
The utility line collapse created a sudden, unexpected occurrence that poses a clear and imminent danger to City property, its citizens, and employees. This threat required immediate action to prevent or mitigate the loss or impairment of essential public services.
The proposed resolution would direct the City Council directs the City Manager, or designee, to take all steps necessary to protect public health, safety and welfare including, without limitation, awarding contracts in accordance with Public Contracts Code § 22050. Pursuant to Public Contracts Code § 22050(c), the City Council must review this emergency action at its next regularly scheduled meeting and at every regularly scheduled meeting thereafter until the work described above is completed. The Council must determine by a four-fifths vote that there is a need to continue the work at each meeting or terminate the action at the earliest possible date that conditions warrant.
FISCAL IMPACT
There are sufficient funds in Sewer Fund Account 72-880W-570 (Sewerline Replacement) to cover the emergency repair expenditure not to exceed $350,000 on a time and materials basis.

Recommendation
Staff recommends that the City Council approve the Public Improvements for Tract 7379, Phase II, as constructed, and authorize the Public Works Department to begin maintenance and operation of the public facilities on said tract.
Discussion
The City’s Engineering & Public Works Department has inspected the improvements for Tract 7379, Phase II, as included in the Subdivision Agreement, and found them to be substantially completed to City Standards.

RECOMMENDATION:
Award of Well 39 Repairs to Bakersfield Well & Pump Co. in the amount of $140,730.00.
DISCUSSION:
Well 39, located at 20th Ave. and Albany St., was shut down needing a new pump, the well was pulled and videoed and several holes in the casing were found. Staff found Bakersfield Well & Pump as the only contractor able to make the repairs within a reasonable time in order to place the well back into production before the summer season. The drinking water produced by Well 39 is treated by an Arsenic removal plant, so it is crucial to the supply needed in this area of town. As mentioned, Bakersfield Well & Pump has proven to be very reliable in quality of work and is available to perform the work on time.
BUDGET/FISCAL:
The current budget has sufficient funds under account 08-980L-108 (Various Well Rehabs, ARP funds) to pay for this project ($140,730.00), it is requested that a 10% contingency be included ($14,073.00), bringing the total possible cost to $154,803.00. Authorization is also requested for the City Manager, or her designee, to execute any documents needed to carry out this project.

SUBJECT: Approval of the Shelter Services Agreement with the Regents of the University of California, Davis Campus School of Veterinary Medicine, on behalf of its Koret Shelter Medicine Program, in connection with the California for All Animals statewide animal shelter assistance program and authorization for the City Manager, or her designee, to sign the agreement.
Recommendation
Approve the Shelter Services Agreement with the Regents of the University of California, Davis Campus School of Veterinary Medicine, in connection with the California for All Animals statewide animal shelter assistance program.
Discussion
This assistance from UC Davis is enabling the City to partner with the SNIP Bus over a one-year period to provide spay/neuter services at no-cost to the residents of Delano. This will undoubtedly reduce unwanted litters and reduce health issues in owned pets.
The SNIP Bus will have monthly two-day events in different parts of the City to provide spay/neuter services at no cost to the residents. The City has worked with SNIP Bus on several occasions and treated hundreds of dogs from the public and from the shelter.
The first event will be scheduled in April 2024, and two or three times per month thereafter for the next year.
Budget Impact
UC Davis will issue a check for $195,160.00 upon execution of this agreement, which will cover the SNIP Mobile Bus for $192,000.00 and $3,160.00 for dog tags and collars. It is requested that the budget be amended with the expenses listed.

By: Roman Dowling, PE, Public Works Director/City Engineer SUBJECT: Rejecting all bids for the 2023 Randolph Street and High Street Pavement Resurfacing and Rehabilitation Project STPL-5227(071) and directing the City Engineer to modify as needed and re-advertise.
Recommendation:
Reject all Bids and authorize the City Engineer to revise as needed and re-advertise the 2023 Randolph Street and High Street Pavement Resurfacing and Rehabilitation Project STPL-5227(071) Re-bid.
Discussion:
Eight bids were opened and read out loud to the public on February 15, 2024. The lowest bid is significantly lower than all other bids and the Engineer’s Estimate. Staff found a discrepancy between the contract line-item description and the Special Provisions Part II, Technical Specifications for Cold Plane.
Staff recommends that the project be revised to provide consistency on the Contract LineItem description, Technical Specifications and a detailed cross section plan to be able to meet the needs of the construction contract, then re-advertise for bids.
Fiscal Impact:
No impact. Grant funding is not in jeopardy.

Agenda Item: 15
SUBJECT: Authorization for the purchase of 6 unmarked detective vehicles Recommendation:
Staff is recommending that the City Council approve as presented, a. Authorization for the purchase of six (6) 2024 Dodge Durango Pursuit SUV's from Elk Grove Auto in the amount of $290,931.06.
Discussion:
The Detective Division currently operates a fleet containing vehicles that have accumulated nearly two-hundred-thousand-miles and are now due for replacement. Several vehicles in our fleet are nearing the one-hundred-thousand-mile mark and are in need ofreplacement. The department currently invests a significant amount of time and resources in replacing parts for these vehicles, often incurring costs that reach into the thousands of dollars. In addition, the department has increased the number of investigators within the Detective Division, which requires the purchase of additional vehicles. In response to the City of Delano's Request for Proposals (RFP) for Unmarked Police Vehicles, three reputable dealerships submitted their proposals.
Elk Grove Auto proposed a fleet of six (6) 2024 Dodge Durango Pursuit SUVs at a total cost of $290,931.06. Future Automotive Group Future KIA of Clovis presented an alternative with six (6) mismatched vehicles, including KIA Sportage, Sorento, and Telluride models, at a total cost of $247,544.20. Lastly, Future Chevrolet proposed six (6) Chevrolet Tahoe 4-wheel drive vehicles, quoting a total cost of $379,752.30.
After careful consideration, our recommendation is to proceed with the purchase of the six (6) Dodge Durango Pursuit SUVs from Elk Grove Auto. These vehicles offer ample storage capacity, specifically designed to accommodate the necessary police equipment for investigators. In contrast, the KIA vehicles lack the specifications required for police use, and the 4-wheel drive feature in the Chevrolet Tahoe is deemed unnecessary for the City of Delano.
Therefore, investing in the Dodge Durango Pursuit SUVs aligns best with the operational needs of the Detective Division.
Budget Impact:
This purchase will be funded by budgeted Measure U funds (0l-89OU-200) in the amount of $180,000.00. However, due to inflation and the increased cost of vehicles, staff is requesting Council approve an additional $110,931.06 bringing the total to $290,931.06 for six (6) vehicles.

Authorization To Purchase Two Drones from Skydio 1nc. and Authorize The City Manager to Execute Any Required Documents.
Recommendation:
Staff is recommending that the City Council approve as presented, a. Authorization To Purchase Two Drones f
rom Skydio Inc. For $47,078.14 And
Authorize The City Manager to Execute Any Required Documents.
Discussion:
The Delano Police Department's mission is to enhance the quality of life through community partnership with the goal ofreducing crime, minimizing fear, preserving peace, and improving traffic safety. In line with this mission, the introduction of advanced technologies such as drones are increasingly important.
The acquisition of two (2) Skydio XI 0 drones will enhance our aerial surveillance capabilities, aid in search and rescue operations, facilitate traffic incident investigations, aid in crime scene analysis, assist with communication and surveillance during crisis negotiation incidents, and aid with combating organized retail theft through assisting with suspect apprehension and retail parking lot surveillance. These drones are equipped with advanced features such as night vision, loudspeaker communication, and thermal imaging, allowing for round the clock operational capability. The Skydio Xl0 drones will significantly improve our officers' situational awareness in various operational scenarios. During the first 12 -month period Skydio, Inc. will also be responsible for maintenance suppo1t for the drones, ensuring their effective and efficient use in law-enforcement activities.
During the evaluation process, the DJ1 Matrice 350 RTK was considered. However, the decision to select the Skydio X 10 was driven by a combination of financial and technological advantages.
Notably, we can purchase two Skydio XI 0 drones for the price of one DJ1 Matrice 350 RTK, providing us with greater operational flexibility and redundancy, which are essential in lawenforcement operations.
The Skydio XI O's advanced imaging technology was a significant factor in our decision. It features a three-camera system that includes a radiometric thermal camera, and a telephoto camera, supplemented by an additional camera. This set up ensures detailed visual and thermal imaging. The Skydio XIO drones technology also allows for autonomous flight in zero light environments, increasing its suitability for our department's needs.

SUBJECT: An Ordinance Amending Delano Municipal Code Chapter 1.12 to Adopt a City Logo and Specify Restrictions on the Use of the City Seal and City Logo.
RECOMMENDATIONS
1. Introduce and waive first reading of an Ordinance Amending Delano Municipal Code (“DMC”) Chapter 1.12 to adopt a City logo and specify restrictions on the use of the City seal and City logo.
2. Direct staff to schedule a second reading of the Ordinance at the next City Council regular meeting or as soon thereafter it may be considered.
3. Alternatively, discuss and take other action related to this item.
DISCUSSION/BACKGROUND
Currently DMC Section 1.12 contains a description of the City’s seal but does not specify permitted or prohibited uses. State law pursuant to Government Code section 40811 provides that city clerks are the custodians for city seals which provides some authority to the Clerk regarding controlling the use of the seal.
The City Council has directed the City Staff and City Attorney to propose a policy on the use of the City Seal and City Logo. The Mayor and Council Member Nunez met with the City Manager and City Attorney and asked that the City Attorney review other City codes for purposes of finding language that would provide more clarification and restrictions on the use of the City’s Seal.
The City Attorney’s Office reviewed Kern County cities’ codes and found some of the cites (Wasco, Tehachapi, Ridgecrest, Shafter, Arvin, and McFarland) had nothing in their municipal codes dealing with their city seals. However, Bakersfield, California City and Taft did have municipal code sections that addressed the use of their city seals. Additionally, some other Southern California city codes were reviewed but nothing was located that was significantly different from the three Kern County cities’ codes identified above.
Based upon prior direction, the best example of a code that achieved what the Council may be looking for is California City’s Code as it has tight restrictions on the use of Delano's seal. California City Municipal Code Chapter 7.01 (https://library.municode.com/ca/california%20city/codes/code_of_ordinances?nodeId=C OOR_TIT1GEPR_CH7CISE). California City provides that the city clerk has custody of the seal (which is consistent with the Government Code) but that the council must approve all uses of the seal. It provides for a process for the clerk to seek approval from the council of the use of the seal as well as prohibitions on the use of the seal.
Taft’s code is not as restrictive as California City’s code. Taft Municipal Code Chapter 1-8-1 (https://codelibrary.amlegal.com/codes/taftca/latest/taft_ca/0-0-0-304). It also has the city clerk has the custodian of the seal but allows for its use by the council, officers and Departments for official City business only, unless the use is otherwise approved by a Council resolution or ordinance. The potential ambiguity in this code is how "official City business" is defined.
Finally, Bakersfield has a code section which is somewhat comprehensive, but is not as clear as the above reference codes. Bakersfield Municipal Code 1.08.010 (https://bakersfield.municipal.codes/Code/1.08). It has one section regarding "unauthorized" use of the seal and another section re "unlawful" use of the seal. These distinctions are not entirely clear but read as a whole, it does seem to prohibit any use of the seal without the Council's permission.
Based upon the above, it is recommended that California City’s Code language be used but adding to it the right for Council Members to use the code for strictly ceremonial purposes (congratulating people on anniversaries and significant birthdays, congratulating a local sports team, etc.). The following sections would be added to the DMC pursuant to the attached draft ordinance:
“1.12.020 (Custody and Use):
The City Clerk shall have the custody of the City of Delano City seal. The use of the City seal shall be for purposes directly connected with official business of the City. The City seal shall not be used by any person or group without first obtaining the prior consent of the City Clerk as provided in this Section.
1.12.030 (Authorization for Use):
The City Clerk is empowered to authorize individuals or groups to use the City seal, provided the use has been approved in advance by the City Council. This includes authorizing use of the City seal in conjunction offered for sale by the City, for the purpose of promoting the City. Prior to authorizing such use, the City Clerk shall obtain a plan describing the items that would bear the City seal. The plan shall include the criteria used in determining the proposed items and analysis of the marketability of
each item. Only those items bearing the City seal that have been authorized by the City Council pursuant to this Section may be offered for sale.
1.12.040 (City Council Use):
Currently seated Council Members may use the City seal for non-commercial and nonpolitical ceremonial purposes such as congratulating individuals on significant anniversaries, birthdays, local sports teams and similar type events.
1.12.050 (Penalties):
Every person who, without the prior approval of the City Council, uses or allows to be used the City seal or any copy or reproduction of the City seal, without authority granted by the City Council, whether for commercial, personal, or any manner whatsoever not consistent with this Chapter 1.12 or state law, is guilty of a misdemeanor.”
In addition, the proposed Ordinance would adopt the image below as the City logo and apply the use restrictions above for the City seal to the City logo:
