ITEMS FROM THE PUBLIC

1. Abraham Jimenez – [inaudible for first few minutes] “Also Stephanie had waved a knife and there were witnesses. There are still three witnesses, Ms. Reyna that you have not interviewed. I have them and they have they're witnesses that they had the knife when Stephanie pulled the knife on a few of the citizens there to wave to show her authority. Well, this is America. We don't have to wave knives. I go to the seniors to enjoy myself and also for everything else to share good moments with people. And I leave and I am very peaceful. But this day got out of hand because one lady named Chris Lanka is very rich and she's my friend and she has a habit of taking too much food. Well, I told her she couldn't do that. They've told her she couldn't do that, but they overlooked this. Ms. Reyna, you did not look into that and if you did, I don't know.

And also Stephanie was overlooked. She doesn't wash her hands. She goes to the bathroom and they caught her. She goes to the bathroom, she stays in her stall, she comes out and she doesn't wash her hands. And then she handles her coffee. She makes her coffee and we have to handle, drink our coffee with somebody that doesn’t -”
Stopped due to the limit of 3 minutes per speaker.

2. Anthony Cortez, 282 Shell Beach Ct. – “First of all, I just want to say that this last Saturday went and attended the grand opening for the pickleball courts and it was a nice event. It was cool. Got to see the mayor show his stuff and I going to challenge him. I put that challenge out right now and any of you that want that challenge, you know what? Let's do this. It looks like fun. I didn't get a chance to get out there Agenda Item No. 3
and play, but man, it looks like great exercise, limber and just have a good time. I did notice or hear a couple of complaints out there though it started at 7:30 and they started playing. The sun was in their eyes.

So if you go by those courts right now, you'll see, I guess they're called black shades that are around just on three sides of those fences. So the sun's coming up on the east side, but there's no shade there. So I think that if you would maybe, I don't know if parks and recreations are in charge of that or the city is, but if they can look into that and maybe put those shades there, I think that will eliminate that. Another thing too, if you get off 99 freeway, if you're going south and you get off to go to the marketplace area, there's the street right there called Marketplace Drive, the stop sign stoplight if you make a right, going to In and Out and Home Depot's right there, it looks like there used to be a stop sign. There's a pole that's knocked down. In that intersection, that corner right there, you get close to accidents there because there's nothing at that stop. If you could look into that, maybe put yields or something like that right there. I know that by law big places like that and I think Councilman Nunez and the Chief over here, if you run a stop sign in a big place that has stop signs wherever that it's against the law and people do run those stop signs too. So anyways, it is kind of a bottleneck there. Sometimes you don't know who's coming and who's going to turn. I'd just like for the city to look into that. That's all I have. Thank you.”

3. David Vivas – “I'd like to just first of all extend my appreciation to the City of Delano and also to Chief Jerry Nicholson for the use of the community center on Jefferson Street for the community vigil, which was held again Thursday, July 25th. This particular remembrance vigil was long overdue. It's been a few years since we've had the last one and I know that the families that had attended really appreciated the vigil that was put forth. Our Chief MCed the event and it was a very nice put together vigil. One thing I just want to encourage the council in the future is to continue to be supportive of our police department when it comes to flock cameras or anything else that would be useful to the department. My heart grieves several years ago, back in 2018, the City Police Department had a grant to purchase flock cameras. At the time the previous Mayor who was no longer here, he was very much adamantly opposed to it and put out a false notion that putting up cameras in the city would make people feel unsafe. That is the total opposite of the case. It's very sad that some people who don't know bought into that narrative. Had those cameras been up there, I'm sure that it could have been either a preventative or maybe some of these crimes that did occur could have been solved already because of those cameras. But unfortunately, we had some really horrible information, which now we have victims of crime. We've got families that have been devastated all because a former Mayor said that those cameras would make this city unsafe. We have a very poor view today from certain politicians who want to release criminals and actually have no consequences for criminals. We had a debate here with that by that same Mayor putting forth a bill that would free up many criminals and put them on the streets because we have people today who just don't believe in punishing bad behavior. It's just the total opposite of what should be done. I want to thank the current Chief and others who have pushed for these cameras and thank you to the city council who have approved and see the value of such equipment, which helps our detectives and the police department. I know because of those cameras you could talk to the Chief, they will tell you that they have been very instrumental in capturing many suspects. So again, thank you to this current city council for approving those cameras and I genuinely appreciate anything that has to do with public safety. God bless you.”

COUNCIL STATEMENTS AND REPORTS
Council member Solorio-Ruiz – “Yes. I just want to give an appreciation. I know Sumeet isn't here, but give an appreciation to her and her staff for helping host the Back to School Open House event, we provided many backpacks of course, thanks to Kern County Child Support Services as well as the different barbershops and hair salons that gave their time and commitment to help our little ones as they go back to school. I also want to thank the Central Valley Latino Mayors and elected officials. That is an organization that every year reaches out if we want to receive donations for backpacks. I reached out of course, and after the event distributed to families who were in need of one and then also the pastor is here, so I just want to give thanks to him as well and the Chief for hosting the Remembrance Vigil Delano victims of crime. I think it was a beautiful event and I think that we always need to reiterate our support to the families who have been impacted by gun violence and how we can move the needle forward on finding out who committed those acts, but also supporting our families. I did not go to the pickleball tournament with the mayor, but I did see that it was a hit and I'm glad to see it was a success. Of course, I believe the mayor lost. So just on the record, you won one, and then, let me see. Just wanted to send a reminder, to support our local businesses as Delano is growing and expanding. It's important to support our local businesses where we can, whether it's a sharing on social media or actually purchasing a meal or something. I think that's important. For the next meeting, I will be talking to staff to present a proclamation to the Valley Fever Institute of Kern County for Valley Fever Awareness Month. I have the language on that. They provided me the language and I'll forward it over so we can do that. I think that's a great thing to do. Other than that, everyone have a safe day and God bless you all.

Thank you.”
Council member Vasquez – “Suzanne brought it up earlier, but people are very excited that Filipino weekend is going to be coming back. That's the big thing right now and I'm excited for our community. October 18th, 19th and 20th.”
Councilmember Nunez – “The only thing is it’s my grandson's birthday tomorrow, so I have to say happy birthday Roman.”
Mayor Pro-Tem Morris – “Yeah, just excited about all the growth in our community and our city. We even got a Baskin Robbins now, but we're on the map now. It is exciting when you see something come into Delano and raises the quality of life for the people that live here, that live in our town. Then when you see charter homes come up, , it's amazing. I was out at the pickleball court. It was a challenge and that was fun. It was good to see so many people out there supporting that. It's always great when we have a facility that our residents can use here in our community that'd have to go someplace else or some other town to participate in those kinds of events. I hope to see other little pickleball tournaments and stuff out there. We had a large crowd from the pickleball people who play, I guess are dedicated pickleballers in Bakersfield. They were all here to help us do the ribbon cutting there. The mayor was out there challenging people and he even had his gift cards ready to pay out. He lost. Yes. So thank you everyone for all that you guys do for this community and your passion for our city. I hope that we continue our growth and that all of us will keep that passion and let's keep Delano going. As we get more things in our community we can say, Hey, we can shop at Target or now, or we can shop at other stores that have come in. I'm excited about our growth. Thank you.”
Mayor Alindajao – “I often say that Delano's living its best life right now. It is. I want to thank my colleagues on the city council for their cooperation and work on being open for business, our staff and everybody who takes part in ensuring that we create the right environment for our community to grow. It is super exciting to watch the ground opening of Target, the pickleball courts. I also want to say thank you to the Chief and tell the police department and Pastor David Vivas and World Harvest Church for putting on the victim's Vigil. It's important that we keep the memory alive of our loved ones, that we've lost a violent crime, and also keep attention on the cases that are still being worked on to try to solve the cases. I appreciate you doing that, pastor. I know you led the way in doing all that for years now, so we appreciate that. And Chief, thank you for your participation in that as well. Yep. I was at the pickleball grand opening. I mean, I want to thank a lot of people for that project. I want to thank Sumeet, our Parks and Rec director. I want to thank Art Medina, Roman for your work on the construction and managing that project. I know we were talking about pickleball courts from, I think last summer of last year, and it's sometimes slow to get things done, but we finally got 'em done and we had a great turnout at the grand opening. We had some folks from Bakersfield that joined us. Maddie, I want to thank Maddie Jane. She's a pickleball pro. I call her and teacher and she's going to be conducting some what we call fast track pickleball lessons. So we're going to have those fast track lessons a few times during the year, and she's also going to be putting on some tournaments. So I'm kind of excited for that. I've been playing ever since our courts opened. I started playing at the coast because that's the only pickleball court that I knew of at least a back in the day. I started playing at a friend's house, and then we got our city pickleball courts open about a month ago. So I've been out there probably three or four times a week.

The lights are on until 11 and it's packed. People are always out there playing most days of the week. So it's really exciting to watch the community have an opportunity to get out there and be healthy, be active, and folks of all ages and young, older, middle, middle age, whatever your station in life is. I see folks out there, so you never tried it. It's a lot of fun. I always like to describe it as the mix between tennis and ping pong, but it's a lot of fun. It's really addicting. I had the mayor's challenge. I played five games. Most pickleball games are played till 11. After the first game, I was about wiped out, so I lowered it to nine. Then after that game, I lowered it to seven because it was just a lot of games. Most pickleball games are played in doubles, but I happened to do the Mayers challenge in singles, so you can imagine how long that took. I was exhausted. But anyway, I beat one person and I barely beat him, but we gave away some fun prizes to the winners and everybody had a great time. We got a lot of great compliments on how the pickleball courts came out. So thank you all for coming out. Whoever was out there in support that the vice mayor was there, it's a lot of fun.”

STAFF REPORT
August 19, 2024
Agenda Item: 6
TO: Honorable Mayor and Council Members
FROM: Maribel Reyna, City Manager
By: Rosa Lara Rios, Finance Director/Treasurer
SUBJECT: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELANO

ACCEPTING THE GANN APPROPRIATIONS LIMIT REPORT FOR
THE FISCAL YEAR 2024-2025
Recommendation
Staff recommends the City Council accept and adopt the Gann Appropriations limit report for the fiscal year 2024-2025.

Discussion
On November 6, 1979, California voters approved the Gann Spending limitation initiative (proposition 4) establishing Article XIIIB of the State of Constitution.

Subsequently, on June 5, 1990, California voters approved the Traffic Congestion Relief and Spending Limitation Act (proposition 111), which made various amendments to Article XIIIB of the State Constitution. Article XIIIB sets limits on the amount of tax revenues that the State and most local governments can appropriate within a given fiscal year. If the local government receives excess funds in any one year, it may “carry those excess funds into the subsequent year” for use. Any excess funds remaining after the second year must be returned to taxpayers by reducing tax rate or fees.

The appropriations limit for fiscal year 2024-2025 is $44,971,508 which far exceeds the proceeds of taxes in the amount of $19,880,458. This new limit has been calculated by adjusting the fiscal year 2023/2024 appropriations limit for the changes in the California per capital personal income and Los Angeles County population. Since the annual appropriations limit is greater than the appropriations that are subject to the limit, the City follows the provisions of Article XIIIB of the California Constitution.

RESOLUTION NO. 2024-

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DELANO

DETERMINING THE CALCULATION AND ACCEPTING THE GANN
APPROPRIATIONS LIMIT REPORT FOR THE FISCAL YEAR 2024-2025 WHEREAS, Article XIIIB of the California State Constitution, more commonly referred to as the Gann Initiative or Gann Limit, was adopted by California voters in 1980 and placed limits on the amount of proceeds of taxes that state and local governmental agencies can receive and appropriate (authorize to spend) each year; and WHEREAS, under Article XIIIB of the Constitution of the State of California, the City of Delano (City) may not appropriate any proceeds of taxes in excess of its appropriations limit (Limit); and
WHEREAS, pursuant to Government Code Section 37200, the calculation of the Limit and the total appropriations subject to the limit were set forth in the biennial budget of the City for Fiscal Year 2024 & 2025, which was adopted by City Council on September 13, 2023; and
WHEREAS, pursuant to Government Code sections 7901 and 7910, the final calculation of the Limit has been determined, and the adjustment factors on which the calculation is based are a 3.62% percent change in California per capita income and a 0.96% percent change in the population growth for the City of Delano; and WHEREAS, the documentation used in the determination of the Limit has been made available to the general public for fifteen (15) days prior to the date of adoption of this resolution; and
WHEREAS, according to the final calculation, the City’s net appropriations subject to limitation are approximately $44,971,508.

For the Fiscal Year 2024-2025 the City’s estimated tax proceeds to be received, as well as tax proceeds appropriated by the City Council, will be under the legal limit.

NOW, THEREFORE, the Council of the City of Delano does RESOLVE as follows:

SECTION 1 The Council of the City of Delano hereby finds that, for Fiscal Year 2025, the final calculation of the Appropriations limit of the City of Delano has been determined in accordance with the adjustment factors referred to above, the documentation used in the determination of the calculation has been made available to the general public for the period of fifteen days as required by law, and the City’s appropriations subject to limitation are under the Limit by approximately $19,880,458.

SECTION 2 The City Council accepts the Gann Appropriations limit report for fiscal year 2024-2025, a copy of which attached hereto as Exhibit A.

CITY OF DELANO

STAFF REPORT
August 19, 2024
Agenda Item: 7
TO: Honorable Mayor and Council Members
FROM: Maribel Reyna, City Manager
By: Rosa Lara Rios, Finance Director/Treasurer
SUBJECT: Authorization to award contract to NeoGov for the purchase and implementation of NeoGov Software for related HR and Payroll functions.

Recommendations

1. Approve to award a contract and implementation of NeoGov Software for human resources (HR) and related equipment for payroll functions, replacing the current Corbin Willits System.

Discussion
The City has been utilizing the Corbin Willits system (MOMS) for HR and payroll management for over 18 years. While it has served us adequately, the system's limitations have become increasingly apparent as our HR and payroll processes have grown in complexity. These limitations have led to inefficiencies and challenges in maintaining accuracy and compliance.

To address these issues, we currently use NeoGov for recruitment purposes, which has proven to be a reliable and efficient platform. NeoGov is a comprehensive, modern software solution designed specifically for government entities. As a sole-source vendor, NeoGov offers a range of features that effectively bridge the gaps in our current HR and payroll processes. Key benefits of transitioning to NeoGov for these functions include enhanced user experience, improved efficiency through automation of manual tasks, better compliance and reporting, and employee self-service capabilities. This strategic investment will modernize our administrative processes, improve efficiency, and ensure compliance, ultimately benefiting both our employees and HR staff and enhancing service delivery to our community.

In our ongoing efforts to further modernize City operations, we have also conducted a thorough review and evaluation of biometric timeclock solutions. Previously, the City used biometric timeclocks via ADP, but a transition to a new platform resulted in significant operational issues, leading to decreased efficiency and increased administrative challenges. The City reverted to traditional timekeeping methods, which have proven less effective.

NeoGov has been identified as the most suitable provider for biometric timeclocks due to their comprehensive product offerings, competitive pricing, and strong reputation in the industry. The biometric timeclocks, specifically the TouchTime3 solution, offer advanced features such as accurate time tracking, a user-friendly interface, integration capabilities, and data security. This solution addresses our current needs and mitigates the issues previously experienced with ADP, ensuring a more reliable and user-friendly system.

Budget Impact:

The total cost for implementing NeoGov for HR and payroll functions, including configuration, data migration, and training, is estimated at $136,992.71. Additionally, the cost for the purchase and implementation of biometric timeclocks from NeoGov is $63,016. Funding for these projects is available in the current budget under 84-8417-140.

After the initial year, costs will be distributed among the respective Finance, HR, and other departments utilizing the clocks, and will be approved in the upcoming biennial budget.

CITY OF DELANO

STAFF REPORT
August 19, 2024
Agenda Item: 9
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
Roman Dowling, PE, City Engineer/Public Works Director
Prepared by City Attorney’s Office
SUBJECT: Second Reading and Adoption of an Ordinance Adding Chapter 12.40 (Covenant of Easement) to the Municipal Code.

RECOMMENDATIONS
Staff recommend the City Council take the following actions:

1. Waive the second reading, including by title, and adopt an Ordinance adding Chapter 12.40 (Covenant of Easement) to the Delano Municipal Code.

2. Alternatively, take other related action as desired.

DISCUSSION/BACKGROUND
Ordinance Introduction and First Reading
On August 5, 2024, the City Council conducted a first reading of an Ordinance amending the Delano Municipal Code to add Chapter 12.40 (Covenant of Easement) to the Municipal Code.

Government Code sections 65870-65875 authorize a process by which a city may require a property owner holding property in common ownership to execute and record a covenant of easement for parking, ingress, egress, emergency access, light and air access, landscaping, or openspace purposes when such an easement is required by an approval, permit, or other designation granted by the city. This is an extremely valuable tool that allows the city to ensure that important conditions of approval relating to one of the aforementioned subjects are properly memorialized and implemented in a manner that is legally enforceable for all interested parties. The mechanism authorized by Government Code sections 65870-65875 authorizes the recordation of a “covenant of easement” that serves the same purpose as a traditional easement (even though the properties are under common ownership at the time the “easement” is created) and further ensures that the “covenant of easement” created thereby cannot be released in the future without the express permission of the city. In order to avail itself of this useful tool, the city must first adopt an ordinance expressly allowing for the imposition of such covenants.

Procedures for Adoption
If approved for second reading, the Ordinance will become effective 30 days following adoption.

FISCAL IMPACT
None.

1 SECTION 1: ORDINANCE NO. ______

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
DELANO ADDING CHAPTER 12.40 (COVENANT OF EASEMENT)

TO THE DELANO MUNICIPAL CODE
The City Council of the City of Delano does hereby ordain as follows:

SECTION 2: The City Council finds and declares as follows:

A. Government Code sections 65870-65875 authorize a process by which a city may require a property owner holding property in common ownership to execute and record a covenant of easement for parking, ingress, egress, emergency access, light and air access, landscaping, or open-space purposes when such an easement is required by an approval, permit, or other designation granted by the city.

B. The City of Delano wishes to amend the Delano Municipal Code to allow for the use of such covenants.

SECTION 3: Environmental Review. The City Council finds and determines that this ordinance is not subject to the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq. (“CEQA”)) for the following reasons: (1) it will not result in a direct or reasonably foreseeable indirect physical change in the environment (14 Cal. Code Regs. § 15060(c)(2)), (2) there is no possibility that the ordinance may have a significant effect on the environment (14 Cal. Code Regs. § 15061(b)(3), and (3) the ordinance does not constitute a “project” as defined in the CEQA Guidelines (14 Cal.

Code Regs. § 15378).

SECTION 4: Chapter 12.40 is hereby added to the Delano Municipal Code to read as follows:
“Chapter 12.40 – COVENANT OF EASEMENT

12.40.010 – Purpose.

It is the purpose of this chapter to implement the provisions of Article 2.7 (commencing with Section 65870) of Chapter 4 of Division 1, Title 7 of the California Government Code, regarding the creation of easements through the execution and recording of covenants.

12.40.020 – Creation—Types of Easements.

In addition to any other method for the creation of an easement, as easement may be created by a recorded covenant of easement made by an owner of real property to the city. An easement created pursuant to this chapter may be for parking, 2 ingress, egress, emergency access, light and air access, landscaping, or open-space purposes.

12.40.030 – Effect.

At the time of recording of the covenant of easement, all the real property benefited or burdened by the covenant shall be in common ownership. The covenant shall be effective when recorded and shall act as an easement pursuant to Chapter 3 (commencing with Section 801) of Title 2 of Part 2 of Division 2 of the Civil Code, except that it shall not merge into any other interest in the real property.

Section 1104 of the Civil Code shall be applicable to conveyance of the affected real property.

12.40.040 – Enforcement.

A covenant executed pursuant to this chapter shall be enforceable by the successors in interest to the real property benefited by the covenant.

12.40.050 – Recording—Contents.

A covenant of easement recorded pursuant to this chapter shall describe the real property to be subject to the easement and the real property to be benefited thereby.

The covenant of easement shall also identify the approval, permit, or designation granted which relied upon or required the covenant. The covenant of easement shall be recorded in the County Recorder’s Office and shall contain a legal description of the real property and be executed by the owner of the real property.

From and after the time of its recordation, the covenant shall impart notice thereof to all persons to the extent afforded by the recording laws of this state. Upon recordation, the burdens of the covenant shall be binding upon, and the benefits of the covenant shall inure to, all successors in interest to the real property.

12.40.060 – Release of Covenant.

Upon written request from any person, whether or not that person has title to the real property, the City Council shall hold a public hearing regarding the release of a covenant of easement recorded pursuant to this chapter. The covenant of easement may be released upon a determination by the City Council that the restriction of the property is no longer necessary to achieve the land use goals of the city. Said determination shall be made based upon a preponderance of the evidence presented at the public hearing. If the City Council so determines, a release shall be recorded by the city in the official records of the County within 30 days following the public hearing.

12.40.070 – Fees.

The city may impose fees to recover the city’s reasonable cost of processing a 3 request for a release. The amount of the fees shall be specified in a resolution adopted by the City Council.

12.40.080 – Standing to Enforce or Challenge.

Nothing in this article shall create in any person other than the city and the owner of the real property burdened or benefited by the covenant standing to enforce or to challenge the covenant or any amendment thereto or release therefrom.” SECTION 5: Interpretation. This Ordinance must be broadly construed to achieve the purposes stated in this Ordinance. It is the City Council’s intent that the provisions of this Ordinance be interpreted or implemented by the city and others in a manner that facilitates the purposes set forth in this Ordinance.

SECTION 6: Severability. If any part of this Ordinance or its application is deemed invalid by a court of competent jurisdiction, the City Council intends that such invalidity will not affect the effectiveness of the remaining provisions or applications and, to this end, the provisions of this Ordinance are severable.

SECTION 7: Certification. The City Clerk is directed to certify the passage and adoption of this Ordinance, cause it to be entered into the City of Delano’s book of original Ordinances, and, within 15 days after the passage and adoption of this Ordinance, cause it to be published or posted in accordance with California law.

CITY OF DELANO

STAFF REPORT
August 19, 2024
Agenda Item: 11
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Noemi A. Zamudio, Human Resources Director
SUBJECT: Approve adding one full time Permit Technician to the Planning Department and authorize the Finance Director to appropriate funds Recommendation
Staff recommends City Council approve adding one full time Permit Technician to the to the City’s budget.

Discussion
The CDD has seen an increase in new development throughout the City, in particular down Woollomes Avenue. The CDD has processed approximately 1,600 housing units and expect more to come in the near future.

Further, the department has seen an increase in Accessory Dwelling Units (ADU) due to new State laws. Also, the streamline of solar panel permits have increased due to the State’s green initiative program and will continue to increase with more State incentives.

The department currently only has one clerical staff to assist counter traffic, answer phone calls, accept, process and assign permits applications, schedule inspections, accept permit fees, among other clerical duties.

The new Permit Technician will help alleviate the increased workload the department has experienced for the past couple of years and will help reduce the processing time for building permits.

The addition was discussed with DCEA and no opposition was received.

Budget Impact
Annual budget impact is approximately between $87,268 and $101,069 to the general fund.
