STAFF REPORT

Agenda Item: 15
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
SUBJECT: Potential Ballot Measures on a Special Election in 2025, Primary Election 2026 or General Election in 2026 to Establish the Office of Elected Mayor

RECOMMENDATION
Direct staff to place the ballot measures on a Special Election in 2025, Primary Election 2026 or a General Election in 2026.

DISCUSSION
At its meeting on July 3, 2024, the City Council passed a motion with a 4-1 vote directing staff to prepare the necessary documents to place on the ballot for the November 5, 2024, election the question of whether an Office of Elected Mayor should be established and whether the term for such Mayor should be two or four years.

The deadline of August 12, 2024, to submit a local measure to the Kern County Elections Division was missed. Staff is seeking direction as to whether the Council wants to place this matter before the voters at a 2025 Special Election, 2026 Primary Election or during the 2026 General Election. If a majority of voters approve of having an elected Mayor at a Special Election in 2025, or at the Primary Election in 2026, then the first time that the office of Mayor will appear on the ballot will be in the next regularly scheduled general election in November 2026. Whereas, taking the measure in a 2026 General Election the measure will be placed on the ballot for the first time during the 2028 General Election.

Option 1: Special Election 2025 approximate cost of $25,000* Option 2: Primary Election 2026 approximate cost of $18,000* Option 3: General Election 2026 approximate cost of $18,000* *This is an estimate, and costs could be higher or lower, depending on multiple variables that will not be determined until after an election is concluded.

FISCAL IMPACT
Staff anticipates that the County Registrar's Office will impose a per ballot measure fee.

The approximate fees with a ballot measure during a General Election in 2026 and Primary Election in 2026 is $18,000. Approximate fees for a Special Election in 2025 are $25,000.
