CITY OF DELANO
STAFF REPORT
October 21, 2024
Agenda Item: 3
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Jerry Nicholson, Chief of Police
SUBJECT: Authorize the Chief of Police To Modify the Delano Police Department Take Home Vehicle Program Policy and Increase The Range From 8 miles to 50 miles From The Delano City Limits.
Recommendation:
Staff is recommending that the City Council approve as presented, a. Authorize the Chief of Police To Modify the Delano Police Department Take Home Vehicle Program Policy and Increase The Range From 8 miles to 50 miles From The Delano City Limits.
Discussion:
The Take-Home Car Program is a policy that allows police officers to drive their patrol vehicles to and from their residence during off-duty hours. This program has been implemented in various cities with positive outcomes, and this report aims to highlight the benefits of adopting such a program for the Delano Police Department.
Purpose of the Program
The primary goal of the Take-Home Car Program is to enhance community policing efforts, increase officer visibility, improve response times, and extend the life cycle of police vehicles. Additionally, the program can serve as a valuable incentive for officer retention and recruitment, contributing to overall public safety.
Benefits of the Take-Home Car Program
1. Increased Officer Visibility
When police officers have access to take-home vehicles, their presence in the community extends beyond their work shifts. This visibility acts as a crime deterrent and enhances the perception of safety in neighborhoods, especially those that may be underserved during traditional shifts.
Residents seeing marked police vehicles in their neighborhoods can contribute to a stronger sense of security, creating a community bond with law enforcement.
2. Faster Response Times
Officers who have take-home vehicles can respond more quickly to emergencies. This is particularly beneficial for off-duty officers who live within the city or nearby. In the case of major incidents or natural disasters, these officers can report directly from their homes, reducing the time it takes to mobilize the required personnel. Quicker response times during critical incidents can save lives and mitigate damages.
3. Improved Vehicle Maintenance and Longevity
A take-home car program encourages officers to take personal responsibility for their vehicles, leading to better maintenance. Vehicles used by a single officer typically experience less wear and tear than those that are shared across multiple shifts. Reduced wear and tear can extend the lifespan of vehicles, resulting in lower overall maintenance costs and reducing the need for frequent vehicle replacements.
4. Retention and Recruitment
Offering a take-home car is an attractive benefit that can be used as a recruitment tool. It enhances the department’s ability to attract and retain experienced officers, especially in a competitive law enforcement environment. In addition, providing a take-home vehicle can improve job satisfaction and morale by minimizing personal vehicle expenses, such as fuel and maintenance, for commuting.
The following police department have take home car programs and their ranges are listed below. It should be noted that all of their policies calculate their range from city limits.
Arvin Police Department – 30 miles
Taft Police Department – 35 miles
Shafter Police Department -24 miles
McFarland Police Department -35 miles
Conclusion
The Police Officer Take-Home Car Program has been shown to provide tangible benefits to law enforcement agencies and the communities they serve. Increased officer visibility, faster response times, and enhanced recruitment and retention are key advantages. Additionally, the program encourages a stronger community bond through proactive policing and enhanced neighborhood safety.
We recommend that the City Council consider approving the revised Take-Home Car Program and authorize the necessary budget allocation for its implementation. Further analysis of fleet management costs and operational details should be conducted to ensure the program’s long-term sustainability.
BudgetImpact:
While the Take-Home Car Program offers numerous benefits, there are some cost factors that the City Council should consider:
Initial Vehicle Purchase: Expanding the fleet to provide take-home vehicles for a larger number of officers will require an upfront investment. The Delano Police Department recently purchased 37 vehicles, both marked and unmarked. When the Delano Police Department becomes fully staffed, there may be a need for the purchase of more additional vehicles.
Fuel and Maintenance: Although vehicles may experience less wear and tear, overall fuel consumption and maintenance costs could increase due to extended use.
Insurance: The City’s Liability may increase due to the extended mileage traveled.
The budget impact for this policy modification is estimated to be $75,000 annually.

SUBJECT: RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH PITNEY BOWES FOR A 60-MONTH
LEASE FOR POSTAGE//FOLDING EQUIPMENT THROUGH
GOVERNMENT CONTRACT PRICING.
RECOMMENDATION
Staff recommends the City council authorize the City Manager, or designee to enter into an agreement with Pitney Bowes for a 60-month lease for postage and folding equipment.
DISCUSSION
The prior lease with the city’s current postage and folding insert equipment expired and the equipment is malfunctioning; a representative of Pitney Bowes advised staff that it would be in the best interest of the city to lease new postage equipment for postage metering. The Pitney Bowes representative is recommending the Relay 4500 Series as it has similar functions to the current machines; additionally it provides the ability for staff to utilize FedEX or UPS business accounts and print the necessary labels by reviewing discounted costs and selecting the appropriate shipment for the package being mailed.
THE BUDGET IMPACT
The 60-month lease combined will be $820.18 per month for new postage and folding insert equipment and meter rental will commence upon execution and will be charged across all departments who utilize it. Respective funds have been appropriated in the budget.

SUBJECT:
Honorable Mayor and Council Members
Maribel Reyna, City Manager
By: Brad Evanson, Interim Community Development Director Combined Development Permit No. CDP 2024-001, an application for a proposed prezoning of approximately 355 acres to prezoning district consistent with a land use designation as shown on the City of Delano General Plan map adopted in 2005 as a prerequisite of City Annexation. The sites are located west and south of the current City limits and include nine (9) parcels of land including the rights-of-way along the frontage of said parcels, which are subject to prezoning and eventual annexation. The applicant is the City of Delano, 1015 11th Avenue Delano CA 93215. (Assessor Parcel Numbers: 520-170-02, 03, 04, 05, 06, 07, 14 and 047-170-03 and 04)
California Environmental Quality Act (CEQA) This project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) §15183, Projects Consistent with Community Plan, General Plan or Zoning as the project is consistent with the general plan designation, policies and zoning designation.
RECOMMENDATION
Staff recommends the City Council take the following actions:
1. Conduct the Public Hearing
2. Introduction and First Reading of an ordinance prezoning approximately 355-acres to Agriculture (A) District as prerequisite to annexation of the site to the City of Delano; and
3. Adopt City Council Resolution for Application of annexation to the Kern Local Agency Formation Commission. (Government Code § 56000 et seq)
This item was continued from the October 7, 2024, City Council meeting. 2 Background
The applicant is requesting to prezone nine (9) parcels and right-of-way along the frontage of the parcels as a prerequisite to annexation of the sites. The prezoning district will include approximately 355 acres zoned Exclusive Agriculture (A) District.
The project site is currently located outside the west and south boundary of the Delano City limits.
Current zoning consists of Kern County's Zoning designations, “A” Exclusive Agriculture District.
The applicant proposes to prezone the project parcels to Agricultural (A) District in advance of an application for annexation into the City. The property must be prezoned before such an application can be filed with the Local Agency Formation Commission (LAFCO). When the annexation is, the City's zoning districts will replace the County's zoning, as the effective land use regulation governing the properties LAFCO is the lead agency for annexations of properties into the City. As a component of the annexation process, per LAFCO's determination, other properties may be removed from annexation where there are protests during the LAFCO process. The proposed prezoning districts are consistent with the underlying general plan land use designations for the project sites. The proposed annexation is consistent with LAFCO policy regarding contiguous boundaries.
Staff notes there are no future development plans for the proposed annexation area and will remain as is. In addition, most of the parcels within the annexation area is within a Williamson Act contract and will remain under contract once annexed.
Project Location
The project site is located on the west and south side of the current City limits and includes nine (9) parcels of land (Assessor Parcel Numbers: 520-170-02, 03, 04, 05, 06, 07, 14 and 047-170-03 and 04). In addition, the project will also include the right-of-way along the frontage of said parcels.
3 Public Hearing Notice
A Notice of Public Hearing was mailed to all property owners within a 300-foot radius of the subject property 25 days prior to the public hearing. In addition, a Public Hearing Notice was published 25 days prior to the public hearing.
California Environmental Quality Act (CEQA)
This project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) §15183, Projects Consistent with Community Plan, General Plan or Zoning as the project is consistent with the general plan designation, policies and zoning designation. 4 Planning Commission
During the discussion, the Planning Commissioners raised a couple of questions; current and future use of the proposed annexation, will the frontage roads be within the City limits, and did anyone comment on the project. Staff informed the Commission that the proposed annexation will remain as agriculture for the foreseeable future as the City has no plans for development, the frontage roads of the annexation will be maintained by the City as well as no one commented on the project.
Once the questions had been addresses it was a mutual consensus that the Commissioners recommend approval of the annexation to the City Council.
After the City Council approves the annexation, the prezoning will be considered as part of the required Resolution of Application to forward the annexation application to LAFCO for their consideration. At the LAFCO hearing, the annexation application will be considered based on their policies and procedures for incorporating the area into the City of Delano.
Findings Required for the Prezoning
1. Finding: The proposed Prezoning is consistent with the goals, objectives, policies, and programs of the General Plan and is necessary and desirable to implement the provisions of the General Plan
2. Finding: The proposed Prezoning will not adversely affect the public health, safety, and welfare or result in an illogical land use pattern.
3. Finding: The proposed Prezoning plan are consistent with the purpose and intent of the remainder of this Title not under consideration.
4. Finding: The proposed Prezoning is Exempt from the California Environmental Quality Act CEQA Guidelines §15183, Projects Consistent with a Community Plan, General Plan or Zoning
Budget/Fiscal Impact:
Approval of this request will not have a negative fiscal impact on the City.

FROM:
SUBJECT:
Honorable Mayor and Council Members
Maribel Reyna, City Manager
By: Brad Evanson, Inteirm Community Development Director Introduction and first reading of an ordinance of the City of Delano amending Section 20.14.35 (Signs with changeable copy) of the Delano Municipal Code. The proposed Zoning Text Amendment would allow (i) electronic and mechanical signs that have changeable copy and is located within the Downtown Commercial (DC) District along High Street between 9

administrative approval from the Community Development Director through the Sign Program process. California Environmental Quality Act (CEQA) Determination
California Environmental Quality Act (CEQA) Determination The proposed Zoning Text Amendment is exempt from review under the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that the proposed amendments may have a significant effect on the environment. In addition, the proposed Zone Text Amendment is statutorily exempt from CEQA pursuant to Title 14, Section 15273(a) of the California Code of Regulations.
Recommendation
Staff recommends the City Council take the following actions:
1. Conduct the Public Hearing
2. Introduction and First Reading of an ordinance for a Zoning Text Amendment to Section
20.14.35 of the Delano Municipal Code
This item was continued from the October 7, 2024, City Council meeting.
Background
The applicant requested revisions to Section 20.14.35 (Signs with changeable copy) to be able to have a changeable copy sign on his commercial property. The applicant believes that due to the location of his property and the proximity to General Commercial District which is located across 2 the street from his property and allows for changeable copy signs with approval of a Conditional Use Permit, his property should be allowed to utilize said signs.
As Staff was reviewing the request, Staff determined that the parcels along High Street between 9 th and 13th are in close proximity to parcels that are zoned General Commercial District and are in an area that is known for mixed-use development and could benefit from having a changeable copy sign. Therefore, Staff is recommending the following revisions to Section 20.14.35 (Signs with changeable copy) of the Delano Municipal Code. The following revisions would allow:
(i) Electronic and mechanical signs that have changeable copy and is located within the Downtown Commercial (DC) District along High Street between 9th and 13th; and (ii) Would be subject to administrative approval from the Community Development Director through the Sign Program process.
The following additions to Section 20.14.35 are shown in underline below:
D. Notwithstanding the provisions of Subsection 20.14.20.9.a above, electronic and mechanical signs that have changeable copy may be allowed within the Downtown Commercial (DC) District along High Street between 9th and 13th are permitted as follows:
The following operational and locational criteria shall be submitted with a Sign Program Application to address traffic safety, and aesthetics and conditioned in the application.
1. Sign shall be a one (1) double face sign per street frontage for a total of 32 square-feet with a height of four-(4-) feet;
2. Sign shall have a setback of five-(5-) feet from the property line and shall not be located within five-(5-) feet of a public right-of-way and must not create traffic hazard at corner or driveways;
3. Copy shall pertain only to the name and/or address of the building and illumination shall be reverse backlit, channel lit or indirectly illuminated;
4. The sign shall be no brighter than measured light source on the property;
5. The length of time between the copy changes shall not be less than five (5) seconds and method of transition between copy changes shall be instantly and without animation and do not display movement;
6. The sign shall not be located 100-feet of any residential property; Provisions from the Subsection 20.14.35.b and c shall still remain.
Planning Commission Hearing
On September 11, 2024, Planning Commissioners came to a mutual consensus regarding the proposed amendment and agreed with Staff’s recommendation. The Commissioners believed that the opportunity for downtown businesses to be able to utilize changeable signs would be a great opportunity and possibly rejuvenate the downtown area. Therefore, by a vote of five (5) to zero the Planning Commission recommended approval of the proposed Text Amendment. 3 California Environmental Quality Act (CEQA) Determination The proposed Zoning Text Amendment is exempt from review under the California Environmental Quality Act (CEQA) because it can be seen with certainty that there is no possibility that the proposed amendments may have a significant effect on the environment. In addition, the proposed Zone Text Amendment is statutorily exempt from CEQA pursuant to Title 14, Section 15273(a) of the California Code of Regulations.
Fiscal Impact
There is no direct fiscal impact to the general fund for this revision. However, if approved, the City would potentially be processing additional Site Plan Reviews (ministerial permit) with the Community Development Department. The fee for a Site Plan Review has been established and will remain the same.
