ITEMS FROM THE PUBLIC

1. Jannett Tapia – “I'd like to say congratulations to the Wonderful College Prep Academy and thank you for demonstrating what it means and what it shows when passion meets purpose. And on behalf of the Senator, I also have some certain certificates for the executive team as well.”

2. Claribel Gutierrez – “Thank you. Yeah. Thank you, Major, for allowing us these two minutes to recognize the wonderful college prayer in our District 35th for the amazing job that they have done. I tell them all the time, if you build it, they will come. And on behalf of the Assemblywoman, Dr. Jasmeet Bains, we also have a resolution to honor you for everything that you have done, everything that you continue to do. And it shows in the way you carry yourself and treat others from the little ones to the oldest, because the faculty and the students that like, they're wonderful.

I thank you for allowing us to be part of your journey and you know that this is going to be in the archives forever, ever. So, when people go to Sacramento and say what happened in Wonderful in 2026, they're going to see the amazing work that you have done, you're going to continue to do in our District 35th. Congratulations to you on behalf of the Senator Melissa Arthur and Assembly Women, Dr. Jasmeet Bains. Thank you.”

3. Steven Kemp – “Sorry about that. So hi, I'm Steven Kemp with Congressman David Valladeo's office. I serve as one of his representatives. And similar to my colleagues, I just would like to thank the Wonderful College Prep Academy for their outstanding achievements this year. Thank you so much for enhancing the quality of education for our students in California's 22nd Congressional District and ensuring that they succeed in the workforce and higher education.

And so I have a congressional record statement here. Just recognizing you guys for getting the Charter School of the Year Award. This statement is from Congressman Valadao. It was entered into the official proceedings of Congress, particularly the 119th Congress. And so just wanted to provide this to you. Thank you so much. And then also I have some certificates of recognition as well for the other three achievements. Thank you so much. Thank you so much.”

4. Pastor David Vivas – “Good evening, council members. I am Pastor David Vivas right here in Delano. Just wanted to let everyone know that this week, April the 19th through the 25th is known as National Crime Victims’ Rights Week. This subject is very extremely sensitive to my heart, and so I know that it touches the lives of so many people in our community. Many people in our city alone have lost their lives due to a heartless individual who has murdered one of our loved ones.

And I'm happy that when the Chief has given reports about the crime stats here in Delano, we know that there has not been a gang-related shooting since July of 2023, and I just hope that that continues on. But we want to make sure that we remember these victims of crime. And the fact that we haven't had a gang-related shooting is very encouraging. But what I want to start seeing is I want to start seeing arrests, and that could only be possible if witnesses and people who have knowledge of whoever committed these crimes would step forward and give this information to the detectives, because they could only go by so much information. And they don't have omniscience where they know everything, but they need assistance too from the general public.

But I have a list of about 54 names of those cases which are cold, have gone cold. And a lot of people in our community have become very discouraged because they'd like to see justice for their loved ones, as do I. But we're going to continue to speak out for those who cannot speak for themselves. And I'm not going to read ... I almost was going to read all the names that I have just from Delaney alone, but again, for a lack of time, I'm not going to do so, but I will submit to the record, send an email to everyone, that way everyone can have a list of those names. And then finally, this coming Thursday, April the 23rd at 6:00 PM in Bakersfield, our district attorney, Cynthia Zimmer, is going to host the Crimes Victims Rights Event, which is a feature that she does every year to remember those who have lost their lives as a result of somebody having violent behavior, taking their lives. And so there's going to be a gathering and a march in front of her office this coming Thursday, again, at 6:00 PM, 1215 Truxton Avenue. And I want to thank you again to all our council members, and especially our police department who's doing everything they can to keep our community safe. So, we stand behind the blue here in the city of Delano, and so we want to continue to give them 100% support. Thank you.”

5. Roberto Ibarra – “Hello, my name is Roberto Ibarra, Delano citizen. I have two things to say on those spray parks that we have on Cesar Chavez and I believe one on the far side, I don't recall exactly the address, but it's on that side of town by Dover, somewhere in Dover Street to school, what, by Valle Vista, Valle Vista, something like that. In that area, it is. They just sitting idle like a trophy. Are you guys planning on doing anything on that? I mean, my suggestion is to make that as a basketball court in which our youth can do exercise, play basketball, whichever they can do their ... Let go their energy because instead of having them run around the town, just try to do things that are not good for them, their health. So, I wondered if you can consider that. And the other thing that came to my mind, because I've been telling you about these stores that sell vapes and all that marijuana paraphernalia, that stuff. And I was going to say, my question is that at one time in the city, in the State of California, the act was passed that we were supposed to have a clean air act in which nobody was supposed to be closed to anybody who smoke and they were going to be secluding in their own space. And now vaping is everywhere. Whoever is clean, for some reason, I myself find myself edgy, nervous, and I don't know why. I said, "Why am I feeling like this? " I even told my son, one of my sons, I tell them, "What is this? " It's because of vape.

People smoke all over the town, all over the town. Not in a secluded place, not in the secrecy, it secluded all the homes. No, they're going everywhere. So, whoever wants to be clean on their body, lungs and stuff like that, they automatically take that into their And they become nervous, edgy, and something that I just don't even know myself why I am like this. I even asked my son.

It's vape. So thank you very much.”

17) Discussion and direction regarding City properties, monuments and streets named or depicted after Cesar E. Chavez
Staff report provided by City Manager Reyna.

Mayor Solorio-Ruiz opened public comment.

Marivel Servin – “Good evening. My name is Marivel. I'm a resident of Delano, and I'm in support of removing Cesar Chavez's name and image from city property. It's not a debate about whether there's validity in the claims of the victims, but rather a debate about what we are to do as a city. Considering the city recognizes sexual assault awareness and prevention month and sexual assault cases are up by 54% in our community. This is a perfect example of how the city can go beyond proclamations and interaction to defend victims against known abusers. Our community is ready to make a change. Our state and schools have already began to remove his name and image from murals and even our schools.

What's the city waiting for?”
Roberto Ibarra – “My name is Robert Ibarra. I'm a Delano resident. I saw Cesar Chavez from a distance here to Ms. Maribel. And it was in 1976 and we were brought here with my dad from Mexico to here in 1971. It was when the grapes movement, union movement was a full swing. We had people being shot at, harassed, bullied, and beat up because he was working hard. And I admire the man to my heart. When he died, it hurt my feelings now. And he helped the agriculture people like never before. So, this nonsense that I hear that is happening, there's a frivolous people usually involved, not mine. Forgive the expression. Lawyers who want to use women so they can get money. I see it all the time nationalwise [sic], Hollywood and all the areas of society. And just to forgive me if I have the woman in target, but that's not my intention to ... But they being used and I don't believe this stuff that is happening. I regret that they want to pull his name out of many public places. To me, the men is an icon, same as Martin Luther King and many others that have even died, assassinated by government, you name it. And because they don't like to be the move, they don't want the establishment to be moved or ransack or whatever you want to call it. To me, Cesar Chavez was a very peaceful man and he took everything to his heart. And I saw him from the distance from here to there. And he was very, very good man to me. Thank you very much.”
Fernando Bravo – “Good evening, Mayor. City Council. Name is Fernando Bravo, 1417 Belmont Street.

And I'm just here. Just want to say that I agree with our City Manager about Cesar Chavez Park being going back to Ellington Park because when I was a kid, I grew up there playing baseball, going to the swimming pools there. And while that's over my years, over 50 years. So as far as my concern, I would like to see the city rename it back to Ellington.”
Mayor Solorio-Ruiz closed public comment.

Council Member Osorio – “Yeah, thanks. Well, first, I really want to thank city staff for preparing this report and the recommended actions this evening. I want to thank my colleagues for participating in this discussion. And I know that tonight's discussion is rather difficult. I hear folks today and folks over the last few weeks that this is a painful conversation, especially for those who live through the farmworker movement. I understand and respect how personal this is, and I want to commend their perspectives. At the same time, we have to address the severe claims of abuse that have come to light. Even the Delano Joint Union High School District already held a special meeting and made a difficult choice to rename one of its campuses. And I believe we should take similar steps in terms of the murals, the street, and the park. As already presented, there have been four recommendations made. After reviewing them, I'm in support of all four with a slight amendment to one if we'd like to launch a public process to renaming it.

Again, taking actions on these makes the most practical sense for the street, as the City Manager mentioned, shortening it to Chavez Lane might be the most responsible step. Hopefully, alleviates drastic changes for folks who live on that street. For the murals, painting over the Ellington Community Center allows us to pursue a new grant for the neighborhood, for the wall. For the main street breezeway, I'm also in support of staff reaching out to Mr. Guzman and asking if he can modify his artwork if he intends to change it. But going back to number one, again, I would be in support of rescinding the council action that named Ellington Park Cesar Chavez Park, but hopefully also allow for a few months to talk to people and get a recommendation that they'll be happy with. As I know for the school, they were a bit more limited based on the financial aspect, but if there is another name that folks or residents would like, I'd also be in support of that. And so I would have a motion to make after I'll let my colleagues make some comments. Thanks.”
Council Member Alindajao – “Thank you, Mayor. Appreciate it. Yeah, this is a very difficult decision to make. When I heard the news a couple of weeks ago or now, probably months, it's difficult because it's a person that the community has held in high regard and high esteem. And to hear allegations at this point is difficult to accept and even more difficult to what to do with that information. But I will say this, that having a school named after you or a park or a building or any of that sort is a privilege and not a right.

It is a privilege. And this is not a legal proceeding. We will never know with any legal certainty whether Mr. Chavez is guilty of any of those accusations. At this point, they're just accusations. Nevertheless, I think for our purposes and for the city purposes, I think the standard of proof isn't beyond a reasonable doubt, but really our standard is beyond reproach. If we're going to hold out some of these leaders, some of these icons, the work that they did over the past few years, if we're going to hold them as models to our kids, models to our community, I think the standard is above reproach. And if you read the New York Times article, it was more than just accusations. They provided information, emails, letters. It was quite extensive if anybody took the time to read the article. And my understanding is that victims and information continue to come forward or come out regarding the accusations against Mr. Chavez. It's unfortunate, but for our purposes, I think the leaders that we hold out to be examples to our kids in our community have to be above reproach. And when you have these many people and this much evidence to show, to impugn that reputation of this person, no matter who it is, whether it's Cesar Chavez or anyone else, I think the community needs to pay attention and it maybe perhaps needs to make a different choice in terms of who we hold out as examples in our community. So with that said, I am in support of changing the name of the park specifically from Cesar Chavez to Ellington Park. And then I'm in agreement and support of the recommendations given by our staff in terms of the changes to the murals and the changes to the city street. Thank you, Mayor.”
Council Member Morris – “Yeah, this is a difficult for me too, because I grew up during that era when the strike was on that was back in the '60s and I was in high school then. I was never a Cesar Chavez supporter as my mother with a single parent, and she had to support six children and had no option then to work to support six of us. But I do recognize this. I do recognize the sacrifices that he made to change the conditions of the farm workers and now canceled all of our history over the last 50 years that has actually happened in this community. I'm not saying the allegations, but we don't know of the unproven sexual misconduct. How do we know that the allegations are true? I mean, he's not here to defend himself anymore, but if it did happen, I don't know. I know none of us were there to support that case or know for sure. But I do know that there was many sacrifices made in behalf, and I recognize that even though I wasn't his supporter, I recognize what he did. He did make a difference in the lives of those agricultural workers. If it not been for him and Philip De La Cruz and Larry Itliong, those things would not have changed. And so, I just hate to see ... And aside from that, his life was cut short due to the side effects of a devastating hunger strike during which he drank only water for 36 days to bring the attention of the working conditions affecting agricultural workers. And I hope that we can see the good in the people who have sacrificed so much of their lives with a disadvantage and the underserved members of our community instead of canceling their whole history and out and erasing their sacrifices from our history here in town. I will say, I do like the recommendations that the city has made. Ellington School, I went to Ellington School. That's how old I am. And I remember going there till second grade at Ellington School.

Then it was changed to Ellington Park, and then it was changed to Cesar Chavez Park. So, I'm kind of glad it's going back to Ellington Park. It sounds good. Sounds good to me. I do recommend ... I like the Chavez Lane. I do like us erasing maybe the mural, but I do would like us to keep the breezeway as it is right now because after all, that is part of our history. I mean, he did sacrifice. He's worth that. He's worth that to be able to at least ... And there's no names on it either. So, it doesn't say Philip De La Cruz or whatever, or Cesar Chavez and Larry Itlion, but I would like us to keep at least that part of his part of his history to show the sacrifices that he made because he did make a difference. So, it's hard to say, can we just erase that from our history in our town? I don't think that's right. It's not fair to do that. So, I agree with the recommendations here, except keep the breezeway as it is, and that would be my proposal.

Mayor Pro Tem Nunez – “I agree with staff's recommendations, and I am in favor of the changes provided by staff. Although Cesar Chavez did a lot of great things for a lot of people, including my family, I don't agree with some of the allegations that came up, and that's for I will vote to change based on city staff's recommendation.”
Mayor Solorio-Ruiz – “As for my comments, the movement was not about one man, in my opinion. It was about farm workers. I don't think it was about one person in particular. I think doing this will also stand with other communities who are conducting similar practices of changing names. I'm in full support of the name change. I actually had a curiosity to potentially name it, maybe ‘Campesino Park’ or ‘La Raza Park’ or something along those lines. But I think that with staff's recommendation, going back to Ellington, we'll just make it a smoother process. I'm for it as well. But I do want to just emphasize, I think what everyone here, I think cares about, which is that we cannot remove history, in particular, our farm workers and what they achieved. And I think that it's up to us to make sure that we continue to uplift our farmworkers. When we forget history, history becomes prologue, and it's important for us to keep uplifting those who have paved the way in the UFW movement and in the farm worker movement. And so with that, I also support the recommendations by staff. The way we can do this is we can go one by one based on some comments that I heard from council members in disagreement, or we can go based one motion altogether and go from there. But I will put that back to the council, what they wish to do.” City Clerk Chavez – “So just to be clear, it's items one through three in with respect to the staff report, correct?”
Mayor Solorio-Ruiz – “So voting on items one, two, three for approval.” City Clerk Chavez – “So just for the record, in regards to Council Member Morris' motion, this is going to be for the park renaming back to Ellington, correct?” Council Member Morris – “Yeah.”
City Clerk Chavez – “The removal of ‘Cesar’ of ‘Cesar Chavez Lane,’ so it will then therefore be ‘Chavez Lane’ and the mural behind Ellington Building.” Council Member Osorio – “So just for clarification, that doesn't exclude us from making a motion on the other item. I'll second that.”

Council Member Alindajao – “I can make a few comments before, Council Member Osorio. The only reason why I don't think I would support the committee to change the name to a different name, it's just that's going to take us into a protracted process of having to rename the park. So, I think my support would be just to change it back to Ellington Park. Just wanted to communicate, put that out on the table for discussion.”
Council Member Osorio – “Yeah, no, thank you. I was going to just reiterate that ideally it would've been to have more public input, but I also acknowledge, engage the temperature in the room that there is support for changing it back to Ellington. So my motion would be to adopt all four recommendations made by city staff.”

Mayor Solorio-Ruiz – “And just for the record as well, there's three separate items?” Human Resources Director Zamudio – “Correct. One for each unit, which the first one is the miscellaneous unit.”
Mayor Solorio-Ruiz – “Yes, which is item number 18.”
Human Resources Director Zamudio – “Correct.”
City Manager Reyna – “If counsel chooses, you can take the three items together.” Mayor Solorio-Ruiz – “We can take them all together. I'm in favor of taking them all together. Yes. Okay.

So we will be discussing items 18 through 20. We will open it up to the public. Anyone in the public have a comment on this item. Being that there are none, I will take it back to council.” Council Member Osorio – “I'm fine with either, but I feel Farm Workers' Appreciation Day is more active, so I would lean towards that one slightly.”
Mayor Pro Tem Nunez – “I just have a question for, when this item was put onto the bargaining units, this was actually a bargain item because of the specific date for that person. Is that going to change the bargaining item when it came up? Because when it was put on, it was put on as ‘Cesar Chavez Day’ because we are Delano and we celebrate Cesar Chavez. Now we're not going to be celebrating Cesar Chavez statewide, but this stays as a regular bargaining item or is it changing the item itself or why they're getting the holiday?”
Human Resources Director Zamudio – “So all units agreed to switch it to the last Monday. So the side letter keeps everything else the same. The only thing that changes is the name of the holiday and the date of the holiday, but everything else will remain the same and all units were in agreeance to doing that.” Council Member Osorio – “I'll make a motion to rename Cesar Chavez Day to ‘Farmworkers’ Appreciation Day’ for agenda items 18 through 20.”

COUNCIL STATEMENTS AND REPORTS
Council Member Bryan Osorio – “I think for myself, just want to flag that I attended the KernCog meeting last week and they shared that. I think I had previously shared that they had anticipated starting construction on Garces in spring, but that's now been delayed to July or August of this year. Yeah, I think that's the biggest update. Thanks.”
Council Member Alindajao – None.

Council Member Morris – “No, it was good to go to the ... Is it Prop 39 or 36? We went to… Yeah, retail theft. Right. Well, that was very informative. Thank you to Mario and Joe for presenting that information or bringing that up in light of all the things that are happening in the crazy world today. But thank you for ... I know Target was there and Walmart was there, and I'm sure it was probably pretty good information for them or what they needed to do in case that happened at their place. I do want to report that there is a National Day of Prayer, May the 7th. It's going to be a De Vino at five o'clock and it's a meeting where we pray for our nation, our city, the schools, our safety persons, the police department and all the others that take place. So, it's a great event and they are serving Filipino food, so very good. So do come out and support them. Yeah. And it's going to be, like I said, at De Vino on the 7th.”
Mayor Pro-Tem Nunez – “One item. My wife, we just celebrated our 38th wedding anniversary, so I got to recognize her. That's all I have.”
Mayor Solorio-Ruiz - “Congratulations. Congratulations to you both. I have none as well. The only thing I want to say is the next meeting, which is on May 4th, I will potentially either not be here or I will be running late. The Vice Mayor will take up the mantle, that meeting.
