ITEMS FROM THE PUBLIC

1. Roberto Ibarra – “So in New York, the subway, a wallet was placed on the subway, and if I see a wallet, I take it. It's there. The person happened to take it home and then it was followed by police, snatched. And I believe they stopped because they were sued because there was no need to fabricate delinquents. So why is it was just allowed? I'm asking. The poor fellow, I mean, he was a farm worker. He's a farm worker. What happened? He ended up paying maybe for his impound vehicle and God forbid, maybe fee, court and all that stuff when it could be avoided. Now we fabricated delinquents. That's one thing. The other thing is that now that the overtime pay for the farm workers, I feel like they're being punished. Whatever the amount of days that it takes for, let's say, to work on the field, if it takes five days, now they want to have it done in three days or two days, the maximum. 2. Gloria Herrera – “Gloria Herrera, and I'm here today to submit some signatures and opposition to centralized mailbox installation on Asti Street and then between 8th and 9th Avenue. It's affecting me now because I have to go every other day to pick up my mail at the post office. And this is happening over an incident that happened on Asti Street. I don't see why I should be penalized over someone that decided to confront the mailman. To me, he or that house should be punished where they are not get their mail services, but not the whole street. It's been, I think it's going a month or three weeks where we not receiving our mail at home. I find out about not receiving my mail for two weeks and days, and I had a health problem in my family. I was really busy that day, but anyway, I knew that I needed to go pick up my mail. I mean, that I hadn't received mail, so I was wondering. So, I went to ask at the post office, and that's what they tell me, that they were not longer going to deliver mail to that area between 8:00 and 9:00 because of that. So, I decided to go pick up some signatures from those neighbors, and I have them right here in opposition of that. And there's a letter explaining why we all opposed to have…” Mayor Pro Tem Nunez – “Ms. Herrera, have you reached out to the Delano Postmaster?” Gloria Herrera – “I went and asked them, but what they told me is that they were already in process of asking the city for a location where to put the community mailbox. So that told me that maybe it's already decided that they're going to put a community mailbox, but that area or that section of Delano is been probably a hundred years old where all the mailboxes are at home because it's an old neighborhood. I understand the new neighborhoods, all new developments, they do have those community mailboxes. But that area, it's been there forever. So, they only want to do eighth and ninth because it's already stopped because I'm across the street from eight, but they're not delivering my mail. Yeah. So, I decided to come and let you know that we are opposing all the signatures of these people. They're opposing to have their mail change.”

3. Wendy Salcedo – “Hello, everybody. My name is Wendy Salcedo. I've been a resident for Delano over 40 years, and this lady, I'm actually going to also oppose that this mailbox is going to be ...

They want to implement this mailbox outside of our street. I just moved into Asti Street. It'll be a year in July, and the mail not being delivered into my home has been affected because my medication comes through the mail. And so, my medication has been delayed. We weren't given any notification from the post office that our mail was going to be not delivered anymore. I believe April 3rd was the last day we received mail in our mailboxes, and therefore my medication was delayed until we were notified by one of our neighbors. So, it has been affecting us. I don't agree that whatever mistake happened with the neighbor, it's affecting now the rest of us. So far, our street has been very calm. A lot of families live there, older people live there, and now I feel that it's affecting now the ambiance and now my health because I'm getting my medication delivered late. So, I just wanted you guys to hear our concern and what's currently going on around Asti and 8th Street. Thank you.”

4. Gallo Santido – “Hello, good afternoon. My name is Gallo Salcedo, and I also live in Asti Street.

Wendy is my wife, and the thing that also feels ... How they just went about things, they didn't notify us, they didn't give us no notifications. They just went and stood the ground and does our opinion not matter or do we just do things like that now? I just forgot about the public opinion.

And another issue that I wanted to bring up is that it's also affecting our street. And I think it might have something to do with our mail not being delivered. It's that they have, I would call it a rehab house at 818 Asti Street, and the police are always being called to that address and they're always a lot of shouting, a lot of screaming, a lot of smoking. So, it's becoming a more and more disturbance for our street. And I know I was talking to one of my neighbors, his name is Rosario.

He's also present here that he lives right next to that house and he always gets all that smoke and all that smell of marijuana going into his house. And it's just a big disturbance. And then some patients might be mentally ill and in the middle of the night, they'll be shouting, going out on the street, and they'll be taking off their clothes. They'll be doing all kinds of incidents. And again, we feel that our safety is a risk because there've been other incidents with them where they might attack us or we feel unsafe. So, we really want to be able to see how we can manage and get rid of that house if they can move it somewhere else because it's very unsafe for our neighborhood, for our street in particular.”

5. Pastor David Vivas – “Good evening, Council Members, Pastor David Vivas here in Delano.

First and foremost, I'd like to say I want to thank our Delano Chief of Police, Chief Jerry Nicholson for representing Delano at the Victims of Crime Vigil that was put on by our current ground district attorney, Cynthia Zimmer, on Thursday, April the 23rd, 2026. And I appreciate his representation and being there. I'm not sure if there was anybody else from Delano who was there. And if you were, I did not see you because there was several hundred people that were there who are seeking justice for their loved ones such as myself and finding those who have perpetrated these crimes against them. And so, we're seeking justice. So, I want to thank Chief Nicholson. He did a good job, City Manager representing the community of Delano. We're very proud of him, and it was good to see many other law enforcement officials present. Also, I'd like to invite our city council and city leadership and those who may be listening on the Zoom at this evening's meeting at the time that this meeting is going forth. This coming Thursday, May the 7th at 5:30 PM is going to be our city's annual observance of the National Day of Prayer. The National Day of Prayer has been codified into law under the United States Code Title 36, Section 119, in which the president shall issue each year a proclamation designating as a first Thursday in May as a National Day of Prayer on which the people of the United States may turn to God in prayer and meditation and churches, in groups, and as individuals. And this observance has been going on since ... We're going all the way back to 1789 when President George Washington made a proclamation where he spoke about a proclamation of Thanksgiving, not the Thanksgiving that we observe in November, but a thanksgiving of prayer in which we seek God's guidance for its new leaders in this nation. And then later on in 1952, President Harry Truman also put into law the National Day of Prayer in which they would designate a day in the year, not necessarily a Sunday, but a day in the year in which people of America, those who wish, those who desire. This is not something that is imposed or forced upon, but those who desire, they encourage to pray for its leaders and the direction in which this nation ought to go. And then in 1988, President Ronald Reagan designated the first Thursday in May to be observed as the National Day of Prayer. So, I invite our council members and leaders. An email went forth to you in your email boxes inviting you. And so, I hope you are able to make it. Hopefully you can make this into your schedule. We have a great dinner, so you'll not leave there hungry. Thank you so very much.”

REGULAR AGENDA
14) Approval of new appropriation in the amount of $35,000.00 for the “250th 4th of July Fireworks Show”; request direction for the coordination of the firework show; and authorize the City Manager to sign any documents needed to complete this project Staff report provided by Interim Community Development Director Dowling.

Mayor Pro Tem Nunez opened public comment.

Steve Kinsey – “Okay. So as you know, over the last year since COVID, the cost of the show has increased and it became very difficult for the club, one club organization to try to go out and raise all those funds. And we would come to the city and we would ask for help in that regard into paying for the show. And last year the show was $32,500, whereas the city then only contributed a thousand dollars toward that show because of the way that the changes were in the donation process. So that left the club with $31,500 plus the expenses of the ... When we did the family fun day, that added another couple thousand dollars to the fees that Kiwanis had to come up with to put on the events for the community. So, we were coming to you as something that City Manager and I have talked with for the last couple of years or so about a better way to do this. And as you know, this is the one big event that the city gets a great participation in from its citizens. 30 to 35,000 people plus all the communities around us come to watch that show. And with that, it brings money to the city, all the restaurants and the stores and other things.

And if you break down the cost of this, the cost of the show is about 70 cents a person if you estimate about 50,000 residents divided by that 35,000 number. I was able to get that reduced in looking at the proposal this year from Zambelli Fireworks, they also had added a tariff fee onto it, and I was able to get that waived and knocked off. Now, providing three proposals may be difficult. There was only two companies that we'd ever dealt with, PyroSpectacular and also Zambelli, and I'll have to search and find the third. The difficult thing is always finding the pyrotechnics to fire the show and the ability for them to be here on the night we put the show together. July 4th is when we try to stay away from because it's the most used from the bigger communities, and so it takes up most of their manpower or their staff for that.

So, we've always tried to stay to a different date. So, this year we're proposed for Friday, July the 3rd and using the airport because it's such a great secured location for the show, and it gives greater opportunity for people to view the show. So, some suggested a drone show. The only problem with the drone show, it's going to cost close to anywhere from 20 to $25,000 depending on the amount of the show, but it's not able to be viewed as well as the fireworks show is by everyone in the community. And 4th of July, this is the 250th celebration. It's something we need to really, I think, support and to come back with traditional fireworks is what people expect. And the word I'm looking at on Facebook and different comments around the community is majority of people say go with the fireworks. So I'm looking for help from the city to help support us and Kiwanis will do our part to make sure it's a successful show. And we're still going to put together the Family Fun Day with the Chamber and Memorial Park to bring out the community to be a part of that also.”
Mayor Pro Tem Nunez closed public comment.

Council Member Osorio – “Yeah, I would say I appreciate Mr. Kinsey taking the time to meet with me and giving me the context for this item before today. I think that just to start off, I'd be in support of this item as presented for this year, but as I also shared, I would have reservations about continuing to make this amount of allocations, especially if it's been growing. I appreciate city staff providing a table here documenting the payments from 2010 till now, which has totaled $91,100. And so, I remember in 2022 when we doubled the amount that we had given the prior year, that was a big amount to invest, and now we're looking at 20,000 past that allocation. And so again, I do recognize that a lot of cities are planning for the 250th anniversary. I know the Kiwanis Club have done a great job of facilitating this event over the years. And so again, ultimately, I'm in support of this, but do have reservations about making this a continuous allocation.”
Council Member Morris – “I am fully in support of this particular item because I truly believe we ... How should I say this? This is our 250th birthday of our country. And although I know that Kiwanis in the past has really struggled to get people to contribute to a week, and they got some. And I don't see why the city ... Why we can't go out either, even if we support this program, we can still reach out to the prison or we can still reach out to other co-sponsors to help us offset the cost with this fire workshop. And I'm sure that they would be willing to help contribute to that fund. But ultimately, the community thinks that the city puts on this event anyway, and I don't think that nobody says, "Oh, Kiwanis is putting on the fireworks." It's usually the city was putting on the fireworks and that's what they're thinking. And gosh, it's enjoyed by everyone in this community and surrounding communities. So why wouldn't we celebrate it? We have to support this proposal that's been presented here to celebrate that big enough. And I know Kiwanis and the Chamber, they do a terrific job with the Family Fun Day, and it really does feel good when you get out there during Family Fun Day. And you see all those people out there enjoying themselves and having a good time and actually really celebrating our country's birthday. So, I'm in full support of the project.

And like I said, I think if we still go out and ask for funds from other entities that are big contributors in this town that help us out. And I know they get hit all the time because I know that the same people are probably always investing money, but that's what makes them great community partners. So I'm in full support of that.”
Council Member Alindajao – “I think this ... Thanks. The 4th of July fireworks show has been, it's become a tradition of Delano, really. I don't know. How long has it been going on, Steve? Okay. So yeah, it's been at least 40, 40-ish, 50-… 50 years… So it's been a great community event and to do without that event, I think it'd be a loss for the city and the community. I do have though some concerns like Councilman Osorio brought up. Specifically, we have in our ordinance a pathway to an RFP for the fireworks show and a booth and whatnot. Why wasn't that process followed? And we're bringing this ask to the city. Any reason why that happened or that occurred? I'd like to hear from Mr. Dowling if he's still on or ...” Interim Community Development Director Dowling – “Yes, sir. It kind of crept up on me, honestly. And then the proposal came in and then we saw, like you mentioned, Mr. Alindajao, there is an RFP. I checked with staff over the years, a true RFP was not followed. A proposal was always received from the Kiwanis Club, so that's really it. No other reasoning than that. Then we basically ended up following what has been done historically, but you are correct. If you follow the code, the city should have issued a true RFP several months back.”
Council Member Alindajao – “And I don't have an issue with... I think Kiwanis has done a great job, Steve. Thank you for carrying the torch on that. It's been a great event every year. And I assumed that we didn't follow the RFP process because of the, maybe it was a special year, like the 250th anniversary of the country, and I figured that was the reason why. But I think in the future, I mean, let's look at ... Rosa, what's our biannual budget? It's a total amount approximately with all the enterprise funds, over a hundred million?”
Finance Director Rios – “Yes.”
Council Member Alindajao – “Okay. So, $35,000 isn't a huge ask in terms of it being a great community event and following the tradition for our community. So moving forward, sure, I think we ought to follow the RFP. That's what our law says and states. We ought to do that, but I think at some point, I think the city should take it upon themselves to make sure that this event does move forward and happen. So I'm in support of that item today. Thanks.”
Mayor Pro Tem Nunez – “I also, with the rest of the council, do agree that we should support this a hundred percent this year moving forward. Also agree with the council regarding in the future, which may require us to amend the ordinance if we're no longer going to go to the RFP, and that's something we can work on in the future. I believe it's going to be too late for this time around, but if we can start working on that in the future, and I will have a proposal at the end of the evening for something for the future if we do want to do something like that. But again, we've been fortunate enough that Kiwanis has been the one taking the grunt of it, and I understand that it's a stressful situation, and I understand there's years that you're crossing your fingers and asking people to help fund it, and so I'm 100% in agreement with it. And with that being said, we have a motion on the floor of what we would like to do with this for tonight. A motion to approve based on the staff recommendations, we have recommendations one, two, three, and four, which one of the one, two, three, and four or combination of. I'll read the first one here. It says, "Number one from staff is approved general funds not to exceed the amount of $35,000 for fully fund only this year's 4th of July show. Second recommendation is also considered the request of the Kiwanis Club to coordinate this year's fireworks show. At no cost the city and remove themselves from the fireworks booth lottery. In addition, Kiwanis agrees that any donation or funds that may have already been collected or received or will receive through the July 3rd, 2026 for the purpose of the firework show will be donated to the city to offset the cost of the show. Number three is alternatively discuss the city's conducting the coordination of the 4th of July fireworks show or other necessary action related to this item. And number four is authorized a city manager to approve the lowest response bid procured by the Kiwanis Club and to sign the documents necessary to complete this project as directed by council. But your proposal would be a combination of any of the four.” Council Member Osorio – “I think I'd be in support of motioning for one and two. Those work together.” Mayor Pro Tem Nunez – “One, two. Can we also add three? That authorizes the city manager to deal with this afterwards so we don't have to bring it back.” Council Member Osorio – “Yeah. Okay.”
Mayor Pro Tem Nunez – “Sorry, one, two, and four. My correction.” Motion for to approve recommendations one, two and four was made by: Osorio; 2nd by: Morris

COUNCIL STATEMENTS AND REPORTS
Council Member Bryan Osorio – “Yeah, thank you. So, end of April, I attended a meeting co-hosted by the Department of Toxic Substance Control and the Agency for Toxic Substances and Disease Registry.

And essentially, it was to discuss, I believe, the first health evaluation that we've had of the indoor air exposures in buildings near the Delano PCE plume site, which has been receiving state funding to address through soil vapor extractions systems. And I hope that at a future meeting we can invite them to present. It looks promising in terms of what they're finding, and I just hope my colleagues get the same information I was able to listen to at this meeting. And the other just quick update, recently I learned about a dear friend and former school board member, Jean Flores, who passed away and just wanted to share my condolences to her family and to her friends who may have known her, and that's it for me.” Council Member Alindajao – “Vice Chiron. Not much, just to say that I attended the Cinco de Mayo Parade. It was well attended. We had a good time, and that's it. Thanks.” Council Member Morris – “No, I don't have anything other than I would like to, again, like Pastor Vivas said, invite everyone to the Community Day of Prayer on the 7th, which is going to be on Thursday, and they're having a terrific day. They're serving Filipino food, and the tickets in advance are $20, and if you buy them at the door, they're $25. So be sure and get your tickets before you go. Okay? I have tickets.

So, if anybody wants any, and that's all I have. Thank you.” “Officer Geivit, of services also too. Our police department really represented that particular ceremony so well. I am so proud of our PD and how they honored him and well to be commended with the job that they did.”
Mayor Pro-Tem Nunez – “Yes, I agree with Councilwoman Morris, Officer Geivit's funeral and his arrangements and everything, and all the men and women from the Delano Police Department, they went all out above and beyond. And today I was even in the store and people were very, very grateful that we recognized one of our own employees, not only employee, but an officer and gave them a good sending.

So they were very, very happy with the city and everybody involved. And again, Chief, if you can thank staff, we say this, thank staff, thanks staff, but very, very proud and please thank the staff because that was an outstanding job that they did this past weekend. Also, Ms. Reyna, if we can get that webpage that Brandon spoke about to file our complaints regarding the bridges or any other issues through Caltrans, we can add it to our water bill and potentially even on our website for the city, maybe even put it out on the Civic Ready. And then my last item is moving forward. I know we had talked about the RFP for the 4th of July. If we want to change what we're currently doing, I don't know what the future's going to hold for our 4th of July and for fireworks show the huge one that gets put on every year with the help of the Kiwanis. So, in sometime in October, put something together and bring back after speaking to people, see what the appetite will be. Are we looking at the city being a full-time sponsor or are we looking at staying with what we are with our RFP or a combination of similar to what we have, but something in October, so that gives us plenty of time to build something and that's all I have.” Mayor Solorio-Ruiz - Absent

CITY OF DELANO

STAFF REPORT
May 18, 2026
Agenda Item: 10
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Pedro Nunez, PE, Public Works Director
SUBJECT: A Resolution Finding that a Local Emergency Has Existed Within the City located on the 900 block of Lexington Street, Authorizing Contracting Without the Need for Bidding Pursuant to Public Contracts Code § 22050 and Awarding the Project to JM Pipeline Construction Inc. for $350,000.00, and Associated Actions.

RECOMMENDATIONS
It is recommended that the City Council adopt the proposed resolution to:

1. Find a local emergency has existed within the City;

2. Authorize contracting without the need for public bidding, pursuant to Public Contract Code § 22050;

3. Appropriate $350,000.00 from the Sewer Fund and award such funds to JM Pipeline Construction, Inc. for the remediation work; and

4. Authorize the City Manager or her designee to execute any documents needed to perform effectuate the necessary, emergency repairs.

DISCUSSION/BACKGROUND
Pursuant to Public Contracts Code § 20168, the City Council may, upon a four-fifths vote, declare that public interest and necessity demand the immediate expenditure of public money to safeguard life, health, or property because of an emergency.

In accordance with Public Contracts Code §§ 20168 and 22050, the City Council may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes, without giving notice for bids to let contracts. On April 15, 2026, an unforeseen failure occurred on City Sewer Main located on the 900 block of Lexington Street.

In compliance with applicable law, and to protect public, health, safety and welfare, the City took immediate emergency action to cause the Sewer Main to be repaired beginning on May 4, 2026.

The water main failure resulted in an unforeseen and imminent hazard to City property, its residents, and personnel. This threat necessitated prompt intervention to avert or mitigate the loss or impairment of vital public services.

The proposed resolution directs the City Manager, or designee, to take all steps necessary to protect public health, safety and welfare including, without limitation, awarding contracts in accordance with Public Contracts Code § 22050. Pursuant to Public Contracts Code § 22050(c), the City Council must review this emergency action at its next regularly scheduled meeting and at every regularly scheduled meeting thereafter until the work described above is completed. The Council must determine by a four-fifths vote that there is a need to continue the work at each meeting or terminate the action at the earliest possible date that conditions warrant.

CITY’S PURCHASING ORDINANCE AND EMERGENCY REPAIR EXCEPTION The City’s Purchasing Ordinance typically requires staff to engage in a formal bidding process for maintenance / repair work in excess of $35,000 (Delano Municipal Code section 3.08.030.D). The Code has an exception to the bidding process, though, for emergency repairs, which include “a breakdown in machinery or an essential service which requires the immediate procurement of supplies or equipment or services to protect the public health, welfare and safety.” (DMC Section 3.08.040.A.3) The City Manager has determined that an emergency purchase is required and is requesting the City Council waive the formal bidding requirements and authorize staff to award the contract.

FISCAL IMPACT
A new appropriation from the Sewer Fund is requested to cover the emergency repair expenditure, not to exceed $350,000.00 on a time and materials basis, with authorization for the Finance Director to amend the current budget and add a new project account in the subject fund labeled “2026 Emergency Sewer and Water Main Replacement at the 900 block of Lexington St.”

Agenda Item: 11
TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Pedro Nunez, PE, Public Works Director
SUBJECT: A Resolution Finding that a Local Emergency Has Existed Within the City on 23rd Avenue and Princeton Street, Authorizing Contracting Without the Need for Bidding Pursuant to Public Contracts Code § 22050 and Awarding the Project to JM Pipeline Construction Inc. for $350,000.00, and Associated Actions.

RECOMMENDATIONS
It is recommended that the City Council adopt the proposed resolution to:

1. Find a local emergency has existed within the City;

2. Authorize contracting without the need for public bidding, pursuant to Public Contract Code § 22050;

On April 27, 2026, an unforeseen failure was found on City Storm-Sewer Main located on 23rd Avenue and Princton Street.

In compliance with applicable law, and to protect public, health, safety and welfare, the City took immediate emergency action to cause the Storm-Sewer Main to be repaired beginning on April 27, 2026.

The storm-sewer main’s failure resulted in an unforeseen and imminent hazard to City property, its residents, and personnel.

A new appropriation from the Sewer Fund is requested to cover the emergency repair expenditure, not to exceed $350,000.00 on a time and materials basis, with authorization for the Finance Director to amend the current budget and add a new project account in the subject fund labeled “2026 Emergency Storm-Sewer Main Replacement on 23rd Avenue”.

WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide; and

2 changes are described in the attached Frequently Asked Questions document, which was prepared by the City Attorney’s office.

In addition, because of the new public participation requirements, SB 707 requires local agencies to adopt a policy that addresses how the agency will respond when there are disruptions in the telephonic or internet service that prevent members of the public from attending the meeting remotely. (Gov. Code § 54953.4) To remain compliant with state law and ensure transparency, accessibility, and the continuity of government during technology disruptions, the City of Delano must adopt a formal Disruption Policy by July 1, 2026.

Discussion
Proposed Telephonic or Internet Disruption Policy
This proposed Disruption Policy outlines procedures and expectations for managing technological disruptions during public meetings, specifically telephonic or internet services that enable two-way, remote, public participation during Delano City Council meetings and pertains to all open and public meetings of the City Council at which remote participation is offered or required under the Brown Act.

Key elements of this policy include:
• Clear definitions: defines “disruption” and “remote access services” in accordance with the Brown Act.
• Procedures for addressing disruptions: outlines steps for the presiding officer or City Clerk to follow in the event of service disruptions, including troubleshooting teleconferencing software and platforms, restoration of service, or procedures in the event service cannot be restored.
• Procedures for recess: establishes guidelines for calling a recess if the disruption cannot be resolved immediately, as well as reconvening the open session once service is restored.
• Public access assurance: ensures the public’s right to participate in remote open meetings remains protected, even in the event of technological disruptions.

Staff has reviewed guidance from the League of California Cities, the California Municipal Clerk’s Association, and similar policies adopted by other agencies to ensure that the City of Delano’s process is compliant with Senate Bill 707 while continuing to preserve the public’s right to participate in the democratic process.

This recommended policy will:
• Establish procedures for handling technological disruptions. • Clarify the roles and responsibilities of the presiding officer or City Clerk. • Ensure that disruptions do not hinder public participation or access to open public meetings.
• Provide transparency in the City’s response to disruptions during remote participation. 3 • By adopting this policy, the City of Delano will comply with State Law and show a commitment to transparent, accessible public meetings. Failure to adopt this policy could result in noncompliance and potential challenges regarding accessibility.

Proposed Administrative Policy regarding Conduct of Meetings In addition to the Disruption Policy, because of SB 707’s new requirements of two-way telephonic service or a two-way audiovisual platform for City Council meetings, the City Attorney has also prepared the attached Administrative Policy about the conduct of meetings. The City Attorney and City Clerk are recommending the City Council also adopt this policy. It addresses the following issues:
• The time allotted to public comments for both non-agendized and agendized items are three minutes per person, and a total of 15 minutes for each topic. • To address SB 707, remote and in-person speakers will be called on to speak on a rotated basis to provide everyone with an equal opportunity to speak, recognizing that depending on the number of speakers, not everyone will be allowed to speak. People will be chosen on a “first come, first served” basis.
• Provides for a process for warning and then expelling speakers from the meeting if they cause disruption at a meeting.

Fiscal Impact
Approval of the resolution and policies will not have a negative fiscal impact on the City.

Adopted pursuant to City Council Resolution No. _____

1. BACKGROUND:

Senate Bill 707 (SB 707) (2025) amended the Brown Act to require eligible legislative bodies to adopt, on or before July 1, 2026, a policy that addresses how the agency will respond when there are disruptions in telephonic or internet service that prevents members of the public from attending or observing a meeting remotely. This policy is adopted to comply with that requirement and to ensure continuity of public participation during technical disruptions.

2. PURPOSE:

This policy sets forth clear procedures and expectations for addressing technological disruptions in telephonic or internet services that provide two-way remote public access to Delano City Council meetings, as required by the Brown Act (Gov. Code § 54953.4). This policy affirms the City’s commitment to maintaining transparency, accessibility, and continuity of government during technology disruptions.

4. The meeting shall remain in recess for at least one hour or until the service is restored, whichever occurs first. The recess may be extended if restoration efforts are ongoing.

6.2. IF SERVICE HAS BEEN RESTORED:

If the remote access service is restored before or at the time the meeting reconvenes, the meeting will continue as normal.

6.3. IF SERVICE IS NOT/CANNOT BE RESTORED:

If service has not been restored after one hour, the City Council may reconvene and:

1. Adjourn the meeting: or

Exhibit “B”

CITY OF DELANO

ADMINISTRATIVE POLICIES AND PROCEDURES MANUAL
RULES FOR ALL PUBLIC MEETINGS Section:

1. PURPOSE
The purpose of this policy is to ensure that public meetings are conducted in a manner that provides for City business to be conducted in an efficient and civil manner so members of the public have an equal opportunity to address the presiding body on matters that are within the subject matter jurisdiction of the City Council or Commission to the extent time permits.

2. GENERAL

2.1 The Public Comments portion of the City Council or Commission meeting agendas are subject to the Brown Act, at which the public is allowed to speak on any item of interest, whether or not on the agenda so long as it is within the subject matter jurisdiction of the City Council or Commission.

2.2 The Subject Matter Jurisdiction of the City Council or Commission (aka City Business) includes matters over which the City has been granted authority pursuant to state law, subject to state and federal legal and constitutional limitations.

2.3 The Consent Calendar portion of the City Council and all Commission meeting agendas is the portion of the agenda subject to the Brown Act, at which all items are approved in one motion without discussion unless the item is pulled for discussion by a Council Member or Commissioner.

2.4 Unless the Council specifically takes action to authorize a particular committee, commission or board to conduct remote meetings and/or allow individuals to participate in meetings remotely, such is not permitted.

2.5 Disrupting a Council or Commission Meeting is when a member or members of the public: interrupt(s) Council discussions/deliberations or people who are speaking during public communications; speaks out or makes noise which is loud enough to disrupt a meeting except when it is the person’s turn to address the Council or Commission from the podium or remotely during the public communications portion of a meeting; speaks about subjects that are not within the City’s subject matter jurisdiction during public communications; or, fails to abide by this policy including those policies referenced in Section 6.1 below and which causes a meeting to be disrupted.

ADMINISTRATIVE POLICIES AND PROCEDURES
GUIDELINES FOR ALL PUBLIC MEETINGS Section:

3. RESPONSIBILITY

3.1 It is the responsibility of the City Clerk and all Commission Secretaries to place the Public Comments portion on the meeting agenda in the appropriate location; and

3.2 It is the role of the City Attorney to provide the Mayor and City Council with guidance on the subject matter jurisdiction of the Council or Commission.

4. POLICY

4.1 The following policies apply to the Public Comments Portion of the agenda.

4.1.1 During the Public Comments portion of the agenda, the public may address the City Council or Commission regarding any items on the agenda or matters that are within the Subject Matter Jurisdiction of the Council or Commission, whether or not the item appears on the agenda.

4.1.2 Speakers are prohibited from addressing the City Council or Commission on matters that are not City Business or within the Subject Matter Jurisdiction of the legislative body and must comply with this policy including those policies referenced in Section 6.1 below regarding Council and Commission meetings. Failure to adhere to the prohibition against public comments on non-City Business may result in the speaker losing their opportunity to provide public comments at that meeting or being removed from the meeting.

4.1.3 The Public Comments portion is generally placed at or near the beginning of the agenda, however, the actual comments may be heard at a different time during the meeting but will be heard before the Council or Commission take action on the item. The time allotted to public comments for both non-agendized and agendized items are three minutes per person, and a total of 15 minutes for each topic. Because public comments on one topic will generally be limited to 15 minutes per topic, not all members of the public may have the opportunity to speak at a given meeting.

4.1.4 Use of the City’s electronic or audio and/or visual equipment by a speaker during the Public Comments Portion of the agenda is prohibited; however, a speaker is not prohibited from presenting printed materials to the City Clerk during the Public Comments portion of the agenda.

4.1.5 Exception: Non-Traditional Teleconferenced Legislative Body Meetings. If the City Council is holding a non-traditionally teleconferenced meeting (e.g., under just cause or proclaimed

GUIDELINES FOR ALL PUBLIC MEETINGS Section:

state/local emergency), the timed general comment period of 15 minutes per topic will not apply, only the individual time limits per speaker will be enforced.

4.2 The following policies apply to all portions of the agenda (Public Comments, Consent, Discussion, Public Hearing, etc.)

4.2.1 A public speaker card may be completed and submitted to the City Clerk or Commission Secretary. Individuals may not submit multiple Speaker Cards on behalf of additional speakers and may only submit a Speaker Card for themselves. Public speakers are not required to give their name or address. If a speaker does not wish to give a name, they will be provided with some identifying information by the City Clerk's Office so that they can be called upon during the meeting such as “Speaker X.” Speakers will be called based upon the order their speaker cards are received except that the City Clerk’s Office shall rotate between speakers physically attending meeting and those attending remotely.

4.2.2 The time allotted per person for public comments may vary depending on the total number of speaker cards or remote speaker requests received as described above in sections 4.1.3 and 4.1.4. Additionally, the Mayor/Chair may modify the time limit per person on any particular item listed on the agenda in accordance with the above regulations. A majority of the Council or Commission may override the Mayor/Chair's decision on this issue. A person may not give their speaking time to another person to increase another speaker's time.

4.2.3 Written comments must be submitted for inclusion in the public record no later than 12:00 p.m. on the day of the meeting to give the City Clerk/Commission Secretary adequate time to print them out for Council/Commission consideration. Comments submitted in writing are not read aloud at the meeting. Written comments will also be placed with the official meeting record on the City's website but are not a part of the meeting minutes. Written comments received after the adjournment of the meeting will not be considered a record for that meeting.

4.3 Notwithstanding the above, the following policies apply to Public Hearing items:

4.3.1 Public Hearing item time limits will be the same Public Comments per item and per speaker unless the Council sets different time limits on a particular public hearing item.

4.3.2 Testimony on Public Hearing items must be provided during those hearings so it cannot be provided during the Public Comment

Portion of the agenda.

4.4 The public may participate in a meeting from a remote or mobile device; by using a dedicated URL link posted on each agenda or by calling in on the designated phone number. Those wishing to make a public comment may join the queue for public comment may do so by dialing *9 after joining the meeting which will “raise their hand” in the remote application, or by using the “raise hand” feature within the application after joining the meeting. Each person wishing to speak will be provided some identifying information by the City Clerk’s Office so that they can be called upon during the meeting. All public participants will be muted until called upon for public comments.

6. DISRUPTING PUBLIC MEETINGS AND BEING REMOVED FROM PUBLIC

MEETINGS

6.1 Persons that engage in activities that result in disrupting a Council or Commission meeting shall be issued a warning, if possible, by the public official presiding over the meeting (for example, Mayor or other Council Member if Mayor is absent; Chair, etc.) to cease the conduct or risk being removed from the meeting.

6.2 Persons who continue to engage in activities that result in disrupting a Council or Commission meeting after having been warned to cease such conduct or when a warning is not deemed to be required (examples: a person appears to be a physical threat to others or a person attending remotely who launches into a rant of graphic sexual references or racial epithets), then the person(s) will be asked by the presiding official to leave the meeting on their own accord. If the person or persons refuse to leave on their own accord, the official conducting the meeting shall ask the City Police Officer attending the meeting to escort the person or persons from the meeting room. If no Police Officer is present, the presiding officer shall recess the meeting and contact the Police Department for assistance.

6.3 Should it be necessary to remove all of the public from the meeting, bona fide members of the press shall be allowed to remain and attend the meeting unless such person(s) were engaging in conduct disrupting the meeting.

6.4 Members of the public who have been required to physically leave the Council or Commission meeting because of their conduct may continue to attend the meeting remotely by following the instructions on the posted agenda for the meeting.

6.5 For persons attending a meeting remotely, if such persons engage in conduct disrupting the meeting, the presiding officer shall order that the employee controlling the virtual portion of the meeting mute the person so

that they cannot be heard. A person attending remotely shall not be disconnected from the meeting if they can be muted such that they can no longer engage in conduct that disrupts a meeting.
1 SOME FREQUENTLY ASKED QUESTIONS ABOUT
SB 707’S NEW PUBLIC PARTICIPATION REQUIREMENTS

1. What is Senate Bill 707?
Senate Bill 707 (Durazo) is a bill that was signed into law in 2025. The bill amends the Brown Act in several ways to increase public participation in City meetings. For example, the bill now requires that certain City meetings “shall include an opportunity for members of the public to attend via a two-way telephonic service or a two-way audiovisual platform.” The new law defines “two-way audiovisual platform” as “an online platform that provides participants with the ability to participate in a meeting via both an interactive video conference and a two-way telephonic service.” On the other hand, a “two-way telephonic service” is defined as “a telephone service that does not require internet access and allows participants to dial a telephone number to listen and verbally participate.”

2. Do the new public participation rules apply to all City appointed and elected bodies?
No, the new rules only apply to meetings held by the City Council (the law uses the term “eligible legislative body”). The City may, but is not required to, implement the new procedures for meetings of appointed bodies.

3. Do the new public participation rules apply to all City Council meetings? The new rules apply to almost all City Council meetings held in the Council Chamber.

There are some exceptions, including emergency meetings or meetings that are held outside of the Council Chamber.

4. Does the City need to provide BOTH a two-way audiovisual platform AND a twoway telephonic service? No, the City can choose one or the other. However, if the City chooses a two-way audiovisual platform, the City must publicly post and provide a call-in option. The City must also activate any automatic captioning functioning during the meeting, if such a function is included on the platform.

5. Do the new public participation requirements apply to only the public comment portion of the City Council meeting or the entire meeting? The law does not say expressly but implies that members of the public shall be provided an opportunity to attend the meeting via either the two-way telephonic service or two-way 2 audiovisual platform. The law does not limit the requirement to only providing public comment. The use of the word “attend” suggests that the entire meeting should be broadcast either by two-way telephonic service or two-way audiovisual platform.

6. Does the law specify who should get priority in providing public comments, either an in-person speaker or a speaker attending virtual? The law only specifies that virtual attending public speakers should be provided the “same time allotment as a person attending a meeting in person.” When it comes to ordering the public comment portion, we recommend a policy that treats in-person speakers and virtual speakers as equally as possible. Alternating between an in-person speaker and a virtual speaker may be the best option.

7. Does the new law change anything else about the conduct of City Council meetings?
Yes. The new law provides additional rules about interpretation of the meeting into another language. While the new law does not require the City Council to provide live interpretation services during the meeting, it requires the City Council to “reasonably assist members of the public who wish to translate a public meeting into any language … so long as the interpretation is not disrupting the meeting.” The City of Delano provides live interpretation services during Council meetings, so the City is going beyond what the state law requires.

In addition, the new law clarifies that any person may record a City Council meeting unless the City Council finds that the recording constitutes a persistent disruption.

8. What happens if a person virtually attending disrupts the City Council meeting? Please see the Administrative Policy prepared by the City Attorney’s office.

9. Are the new public participation requirements permanent? No. As of now, the requirements would automatically expire on December 31, 2030.

2 violations. No remedial action was undertaken or commenced by the property owners in response to the March 18, 2025, administrative citation and, on April 16, 2025, a second administrative citation was issued.

No efforts to abate the violations were undertaken in response to the second administrative citation and, on April 24, 2025, the City Manager issued an Emergency Abatement Order directing the City and/or its contractors to erect a temporary fence around the perimeter of the Subject Property and to post appropriate “No Trespassing” signs warning of the danger.

On May 19, 2025, the City Council held a duly noticed public hearing and adopted Resolution No. 2025-37 declaring the Property a public nuisance and ordering abatement of said nuisance by demolishing the structure and cleaning/clearing the Property of other nuisance conditions. In July 2025, the Owner caused the structure to be demolished and removed as directed by the City Council. However, there were some nuisance conditions that remained on the Property that the owner had not yet addressed.

On September 25, 2025, a “Notice of Hearing on Abatement of Nuisance” was sent by certified mail to all owners of record. The Notice informed the recipients that the City Council would hold a hearing on October 6, 2025, to consider whether the Subject Property should be condemned as a public nuisance and the nuisance abated by razing or removing the vegetation, fencing and concrete remaining. The Notice further informed the recipients that, in the event the nuisance was not promptly abated by the owner, the cost of proceedings, all previous code enforcement efforts concerning the condition of the property, and the cleaning, clearing, rehabilitation, repair, or demolition by the City, would constitute a special assessment and a nuisance abatement lien on the property upon which the City may foreclose in order to reimburse the City for these costs. A similar notice was posted at the Subject Property.

During the October 6, 2025 City Council meeting, at the owner’s request, the nuisance abatement hearing was continued to allow the Parties to pursue a Compliance Agreement as an alternative means of resolving the matter. The owner signed the Compliance Agreement, however, upon the completion of the agreed timeframe in the compliance agreement, no remedial action was undertaken or commenced by the property owners. Subsequently, on November 17, 2025, the City Council held a duly noticed public hearing and adopted Resolution No. 2025-85 declaring the Property a public nuisance and ordering abatement of said nuisance by demolishing the fencing, removing all vegetation and concrete, and cleaning/clearing the Property of other nuisance conditions.

The City incurred significant costs in carrying out the Emergency Abatement Order and Nuisance Abatement including, without limitation, personnel costs, contractor costs, and legal expenses. Together, these costs totaled $51,105.08. An itemized invoice of the City’s costs of abatement is attached hereto.

Pursuant to Section 7.32.130 of the Delano Municipal Code, the property owner remains 3 responsible for reimbursing the City for all costs associated with carrying out the Emergency Abatement Order and Nuisance Abatement, as detailed on the attached invoice.

On March 17, 2026, the City mailed the invoice to the owner of record by certified mail and further provided notice of a hearing that if the invoice was not paid in full by April 16, 2026, the City Council would hold a hearing at its May 18, 2026 regular meeting to receive and consider the itemized report of all abatement costs incurred by the City and, further, to consider whether to authorize the recording of a nuisance abatement lien against the Subject Property and/or to make the costs of abatement a special assessment against the Subject Property.

On April 29, 2026, the owner’s attorney contacted the City Attorney’s office to request the invoice because he stated that his client had not received anything. In response, the invoice and Notice of this hearing was forwarded immediately to the owner’s attorney and the owner via email on April 29, 2026. The owner acknowledged receipt of the notice of hearing and invoice on April 29, 2026 by email and also expressed frustration in the email that she had not received it before. The United States Postal Service website showed that the owner had not picked up the notice of hearing letter and invoice that had been sent by certified mail on March 17, 2026. The owner’s attorney and the owner was informed via email that as long as the owner paid the invoice by May 12, 2026, this City Council hearing would be taken off calendar, and that even if the City Council approves the lien on May 19 after it holds the hearing, per the applicable ordinance, she would receive another notice and invoice that will give her another 30 days notice to pay the invoice before the lien is recorded.

As of this date of the drafting of this staff report, no response or payment has been received from either the owner’s attorney or the owner since the extension was granted.

ENVIRONMENTAL DETERMINATION
The resolution is not subject to the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq. (“CEQA”)) because there is no possibility that the resolution may have a significant effect on the environment (14 Cal. Code Regs. § 15061(b)(3)).

FISCAL IMPACT
The costs will constitute a nuisance abatement lien upon the property until paid. The City will have the option of foreclosing on any such lien in order to reimburse the City for its costs. If there is insufficient equity in the Subject Property to cover the City costs, there will ultimately be a negative fiscal impact.

The City Council of the City of Delano resolves as follows:

SECTION 1. Findings.

A. State Housing Law and the Delano Municipal Code (“DMC”) authorize the city to declare and abate public nuisances occurring on private property. (Health & Safety Code § 17980 et seq., DMC Chapter 7.32.)
B. The property located at 320 10th Avenue (the “Subject Property”) was improved with a single-family residential dwelling. On or about May 29, 2024, a fire occurred at the Subject Property, resulting in extensive damage to the dwelling.

C. The Subject Property was red tagged on May 29, 2024. On August 8, 2024, a Notice of Violation was mailed to the owners of record, informing them that the property had been deemed a public nuisance that must be abated and further detailing various violations of the Municipal Code. No efforts were undertaken in the ensuing months to abate the nuisance or otherwise correct the violations, and, on March 18, 2025, an administrative citation was issued imposing fines for the persistent Municipal Code violations. No remedial action was undertaken or commenced by the property owners in response to the March 18, 2025, administrative citation and, on April 16, 2025, a second administrative citation was issued.

G. During the October 6, 2025 City Council meeting, at the owner’s request, the nuisance abatement hearing was continued to allow the Parties to pursue a Compliance Agreement as an alternative means of resolving the matter. The owner signed a Compliance Agreement, however, upon the completion of the agreed timeframe in the compliance agreement, no remedial action was undertaken or commenced by the property owners. I. No payment was received as of May 18, 2026.

J. The City Council held a hearing at its May 18, 2026, regular meeting at which time it received and considered all oral and written evidence and testimony presented.

SECTION 2. Environmental Determination. This resolution is not subject to the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq.) because there is no possibility that the resolution may have a significant effect on the environment (14 Cal. Code Regs. § 15061(b)(3)).

Re: Invoice for Costs for Abatement of Public Nuisance at 320 10th Avenue Notice of Hearing Regarding Abatement Costs
Notice of Lien and/or Special Assessment
To Each of the Above Addressees:

On or about May 29, 2024, a fire occurred on the property located at 320 10th Avenue in Delano (the “Subject Property”) and caused extensive damage to the singlefamily residential structure thereon.

No efforts to abate the violations were undertaken in response to the second administrative citation and, on April 24, 2025, the City Manager issued an Emergency Abatement Order directing the City and/or its contractors to erect a temporary fence CITY HALL 1015 ELEVENTH AVENUE, DELANO, CA 93215
around the perimeter of the Subject Property and to post appropriate “No Trespassing” signs warning of the danger.

During the October 6, 2025 City Council meeting, at your request, the nuisance abatement hearing was continued to allow the Parties to pursue a Compliance Agreement as an alternative means of resolving the matter. However, upon the completion of the agreed timeframe in the compliance agreement, no remedial action was undertaken or commenced by the property owners.

Pursuant to Section 7.32.040 of the Delano Municipal Code, the property owner remains responsible for reimbursing the City for all costs associated with carrying out the Emergency Abatement Order and Nuisance Abatement, as detailed on the attached invoice. Full payment of the invoice must be received by the City no later than April 16, 2026 (the “Due Date”).

If the invoice is not paid in full by the Due Date, PLEASE TAKE NOTICE that May18, 2026, the City Council of the City of Delano will hold a hearing in the Council Chambers of the Delano City Hall located at 1015 11th Avenue, Delano, California, at which time it will receive and consider an itemized report of all abatement costs incurred by the City. The City Council may make such modifications to the report as are deemed CITY HALL 1015 ELEVENTH AVENUE, DELANO, CA 93215
necessary and the report will be finalized and deemed conclusive. Upon confirmation of the abatement costs, the City Council will authorize the recording of a nuisance abatement lien against the Subject Property or may elect to make the costs of abatement a special assessment against the Subject Property. A nuisance abatement lien may be foreclosed by an action brought by the City at the time of its choosing. Should the City elect to make the costs of abatement a special assessment, the Subject Property may be sold after three years by the tax collector for unpaid delinquent assessments. The assessment may be collected at the same time and in the same manner as ordinary municipal taxes are collected and shall be subject to the same penalties and the same procedure and sale in case of delinquency as provided for ordinary municipal taxes.

The property owner and/or any other persons who may have a legal interest in the Subject Property may attend the hearing and be heard prior to the Council taking action.

Alternatively, the property owner may provide written objections in advance of the hearing, provided those objections are received by the City Clerk at 1015 11th Avenue, Delano, California 93215, no later than 3:00 p.m. on the date of the hearing.

Agenda Item: 15
______________________________________________________________________________ TO: Honorable Mayor and Members of the City Council
FROM: Maribel Reyna, City Manager
By: Roman Dowling, PE, Interim Community Development Director SUBJECT: Resolution of Initiation of Annexation and Pre-Zoning Ordinance related to Pre-Zoning Application No. 25-0002. A request to (i) pre-zone an approximately 122.49-acre property (Assessor Parcel Numbers: 521-120-14 and 521-120-15) from the Kern County Exclusive Agriculture (A) zoning district to the City of Delano Industrial (I) zoning district.
______________________________________________________________________________

RECOMMENDATION
Staff recommends the City Council take the following actions:

1. Direct the Community Development Director to have the Applicant retain a qualified California Environmental Quality Act (CEQA) consultant to work in consultation with the Community Development Department and the City Attorney’s Office to prepare appropriate environmental documentation, at the Applicant’s expense, in compliance with CEQA.

2. Upon completion of the revised CEQA documentation, schedule the matter for a public hearing before the Planning Commission in accordance with Delano Municipal Code section 20.2.40, and forward the Planning Commission’s recommendations to the City Council for consideration at a duly-noticed public hearing.

Project Description
The applicant is requesting to prezone the Subject Property as shown below as a prerequisite to annexation of the site. The prezoning district will include 122.49 acres of Industrial district.

Reference only, not to scale.

Public Hearing Notice
A Notice of Public Hearing was mailed to all property owners within a 300-foot radius of the subject property and required agencies 13 days prior to the public hearing originally set for February 17, 2026. In addition, a Public Hearing Notice was published in the paper 12 days prior to the February 17, 2026 public hearing. On February 17, 2026, the City Council continued the matter to March 16, 2026. On March 16, 2026, the City Council continued the matter to April 20, 2026. On April 20, 2026, the City Council continued the matter to May 18, 2026.

Planning Commission Review
The Planning Commission conducted a public hearing on January 14, 2026, and after discussion voted five to zero recommending approval of the prezoning request by adopting Planning Commission Resolution 2026-01.

Discussion
The project site, consisting of two parcels, is currently located outside the boundary of the Delano City limits and within the unincorporated territory of Kern County. The county’s zoning for the site is Exclusive Agricultural (A). The applicant proposes to prezone the site into the City’s Industrial (I) district in advance of an application for annexation into the City. The property must be prezoned before such an application for annexation can be filed with the Local Agency Formation Commission (LAFCo). If the annexation is subsequently approved by LAFCo, the City’s zoning district would replace Kern County’s zoning designation.

At its January 14, 2026 meeting, on staff’s recommendation, the Planning Commission found the project to be exempt from review under CEQA pursuant to Section 15183 of the CEQA Guidelines. 3 In the weeks after the Planning Commission’s action, the City received three letters commenting on the adequacy of the Planning Commission’s CEQA finding. Two letters were submitted by a law firm on behalf of Supporters Alliance for Environmental Responsibility (“SAFER”) and the other was submitted by the Center on Race, Poverty & the Environment. Each of these letters alleges that there is lack of evidentiary support for the CEQA finding and that additional environmental review and analysis is necessary. The City Attorney’s Office has reviewed the correspondence and has advised staff to retain a qualified CEQA consultant to assist with the peer review of a revised CEQA analysis to be submitted by the applicant. Upon completion of the revised CEQA document, the matter would be set for hearing before the Planning Commission in accordance with Section 20.2.40 of the Delano Municipal Code and the Planning Commission’s recommendation would be forwarded to the City Council for its consideration at a future public hearing.

SECTION 3: PREZONING FINDINGS. Pursuant to Section 20.2.40.5 of the Delano Municipal Code, the Planning Commission hereby finds as follows:

1. Finding: The proposed prezoning is consistent with the goals, objectives, policies, and programs of the General Plan and is necessary and desirable to implement the provisions of the General Plan.

Evidence: The proposed prezoning of the project site has a map code designation of Industrial within the City of Delano General Plan. The power plant and proposed use of industrial warehousing is consistent with the goals, objectives, policies and programs of the map code designation of Industrial within the City of Delano’s General Plan.

2. Finding: The proposed prezoning will not adversely affect the public health, safety, and welfare or result in an illogical land use pattern.

Evidence: The proposed prezoning will not adversely affect the public health, safety, and welfare or result in an illogical land use pattern as the project site will not only blend in with the surrounding uses but share the same map code designation and zoning with the parcels directly north, south, and east of the project site. In addition, the project site will serve the vicinity with an Industrial use.

3. Finding: The proposed prezoning is consistent with the purpose and intent of the remainder of this Title not under consideration.

Evidence: The proposed prezoning is consistent with the purpose and intent of both the map code designation Industrial and the Industrial district.

4. Finding: The potential environmental impacts of the proposed prezoning are insignificant, have been mitigated, or there are overriding considerations that outweigh the potential impacts.

Evidence: The project is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15183 of the CEQA Guidelines (14 Cal. Code Regs. § 15183) which provides that projects that are consistent with the development density established by existing zoning, community plan, or general plan policies for which an EIR was certified shall not require additional environmental review, except as might be necessary to examine whether there are project specific significant effects which are peculiar to the project or its site. The subject property is in the City of Delano’s sphere of influence and has been assigned the Industrial (I) land use designation in the City of Delano
