The amended chapter and table would allow for cannabis entertainment facilities in the downtown commercial zoning district.

The downtown commercial zoning district is located within the boundaries of 1st Street (North), Mesquite Ave. (East), Buena Vista Ave. (South), and Cactus Dr. (West). The majority of the Commercial Downtown Parcels are located off of Pierson Avenue between Cactus (West) and Mesquite (East).

Exhibit 1 shows the boundaries.

FISCAL IMPACT:

Any Marijuana Entertainment Facilities selling cannabis would be required to pay cannabis taxes per the City's Municipal Code.

ENVIRONMENTAL ANALYSIS:

On May 26, 2020, the City Council approved the General Plan Update and in doing so adopted the Environmental Impact Report (EIR). Pursuant to Section 15162(a) of the CEQA regulations, once an EIR has been adopted for a project, no subsequent environmental review needs to be completed unless there are substantial changes in the project that warrant additional review. No significant changes are proposed as a part of the proposed project.

WHEREAS, the City Council finds that the adoption of this ordinance is categorically exempt from environmental review under the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that the adoption of this Ordinance in question may have a significant effect on the environment; and WHEREAS, this Ordinance protects the public health, safety and welfare; and WHEREAS, the Planning Commission held a duly noticed hearing on this Ordinance and recommended that the City Council adopt same; and Item Number: 19.

AGENDA ITEM REPORT
To: City Council
Date: June 21, 2022
Department: Public Works
Prepared by: Jilleen Ferris, City Engineer
Subject: Adoption of Resolution For An Americans With Disabilities Act (ADA) Grievance Procedure
RECOMMENDATION:
1) Adopt a Resolution of the City Council adopting an Americans With Disabilities Act (ADA) Grievance Procedure; and
2) Designate the City Engineer, or his/her designee, as the ADA Coordinator.

BACKGROUND:

In 1990, the Federal Government adopted the Americans with Disabilities Act (ADA) which sets forth certain obligations and responsibilities to ensure non-discrimination against individuals with disabilities.

Title II of the Americans with Disabilities Act (ADA) requires that public entities adopt and publish grievance procedures to assure the prompt and equitable resolution of complaints (28 CFR 35.107).

In addition, the City has an obligation to investigate and resolve under California Government Code Section 4452. The following policy is intended to standardize the procedures for receiving and addressing complaints.

DISCUSSION:

The City has developed a procedure to meet the requirements of the Americans with Disabilities Act of 1990 and Section 504 of the Rehabilitation Act of 1973. It may be used by anyone who wishes to file a complaint or grievance alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the City. Grievance procedures set out a system for resolving complaints of disability discrimination in a prompt and fair manner. The Grievance / Complaint Procedure includes the following:
• Submit an ADA Grievance/Complaint Form in writing to the City of Desert Hot Springs ADA Coordinator.
• Complaint should be submitted no later than 60 calendar days after the violation. • The ADA Coordinator shall meet with the complainant within 15 calendar days after receiving the complaint.
• A written response will be provided within 15 calendar days of the meeting, which will include the position of the City and offer options for resolution of the complaint. • The complainant may appeal the decision within 15 calendar days after receipt of the response to the City Manager or their designee.

Item Number: 20.

Page 769 of 778 ends

SR-22-149
• The City Manager or designee will then meet with the complainant within 15 calendar days after receipt of the appeal, and provide a written response within 15 calendar days of the meeting.
• All received written complaints shall be retained by the City for at least 3 years.

If a public entity has 50 or more employees, it is required to designate at least one responsible employee to coordinate ADA compliance. Such an employee is known as the “ADA Coordinator.” The ADA Coordinator is responsible for coordinating the efforts of the government entity to comply with Title II and investigating any complaints that the entity has violated Title II. The name, office address, and telephone number of the ADA Coordinator must be provided to interested persons.

FISCAL IMPACT:

There is no fiscal impact as a result of this action.
